[UNDER SECTION 3(1) OF THE KERALA FOREST (VESTING & MANAGEMENT OF ECOLOGICAL FRAGILE LAND) ACT, 2003] No. EFL-1-885/2010.

4th November 2015.

An extent of 0.809 Ha of land comprised in Re-survey No. 175, of Kavilampara-I Village, Vatakara Taluk was notified as Ecologically Fragile Land under Section 3 (1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance No. 8/2000 Vide Notification No. C4-21437/00 dated 4-10-2000 and published in Kerala Gazette No. 43 dated 31-10-2000 as Sl. No. 68.

Following the procedure stipulated under Section 10A of EFL Act, 2003 the Govt. as per letter No. 6653/E2/2013/ F & WLD dated 9-9-2013 have agreed to denotify 0.809 Ha from the notification. Hence it is hereby notified that the land detailed in the schedule below is excluded from Ecologically Fragile Land.

(4)-29243/13-ാം നമ്പരായി 4-11-2014-ലെ 43-ാം നമ്പർ കേരള ഗസറ്റ് വാല്യം 3-ൽ പരസ്യപ്പെടുത്തിയിട്ടുളള പൊതു ദർഘാസ്/ലേല വ്യവസ്ഥകൾക്കും വനം വകുപ്പിൽ നിലവിലുളള ഇതര ലേല വ്യവസ്ഥകൾക്കും വിധേയമായി തിരുവനന്തപുരം ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ ഇ-ലേലത്തിലൂടെ വിൽക്കുന്നതാണ്. പട്ടികയിൽ പറയുന്ന ഉൽപ്പന്നങ്ങൾക്ക് പുറമേ, ഇ-ലേലത്തിന് മുൻപ് വരെ ശേഖരിച്ച് അട്ടിവയ്ക്കുന്ന ഉൽപ്പന്നങ്ങളും ടി ഇ-ലേലത്തിൽ ഉൾപ്പെടുത്തി വിൽക്കുന്നതായിരിക്കും. ടി ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ഇ-ലേലത്തിനു മുൻപ് തേക്ക് കഴകൾക്കും/തേക്ക് ബില്ലറ്റുകൾക്കും/പാഴ്മര വിറകുകൾക്കും ` 20,000, എന്ന വിധത്തിൽ ഇ-പേയ്മെന്റ ്/ഇ-ട്രഷറി/ഡിമാന്റ ് ഡ്രാഫ്റ്റ്/എം.എസ്.റ്റി.സി. ലിമിറ്റഡ് വഴി നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ഇ-ലേലക്കാരൻ, ഇ-ലേലത്തുകയുടെ 35% തുക ഇ-ലേല ദിവസം തന്നെ 'ഇ' പേയ്മെന്റായി കെട്ടിവയ്ക്കേ≠താണ്. വിജയിയായ ഇ-ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ വാറ്റ്, വനവികസന നികുതി, ആദായനികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠തു≠്.

ടി ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേലത്തിനു മുൻപായി ഉൽപ്പന്നങ്ങളുടെ ഗുണനിലവാരവും അളവും നേരിൽ ക≠് ബോധ്യപ്പെട്ടുകൊളേള≠താണ്. ഇ-ലേലത്തിന് ശേഷമുളള പരാതികൾ പരിഗണിക്കുന്നതല്ല. ഈ വി⁄ാപന തീയതിക്ക് മുമ്പായി ദർഘാസ്/ലേലം സംബന്ധമായി സർക്കാർ ഉത്തരവുകൾ എന്തെങ്കിലും ഉ≠ായാൽ ആയതും ടി ലേലത്തിന് ബാധകമായിരിക്കും. വിൽപ്പനയ്ക്ക് വച്ചിട്ടുളള ഉൽപ്പന്നങ്ങൾ ഏതെങ്കിലും സർക്കാർ വകുപ്പുകൾക്ക് ആവശ്യമായിവരുന്നപക്ഷം ആയത് കഴിച്ചുളള ഉൽപ്പന്നങ്ങൾ മാത്രമേ വിൽക്കുകയുളളു. തോട്ടത്തിലെ ജോലികൾ നടന്നുകൊ≠ിരിക്കുന്നതിനാൽ ലേലത്തിന് മുൻപ് വരെ ഡമ്പിംഗ് ഡിപ്പോയിൽ ഇറക്കി ലോട്ടു ചെയ്യുന്ന ഉൽപ്പന്നങ്ങൾ കൂടി ടി ഇ-ലേലത്തിൽ ഉൾപ്പെടുത്തി വിൽക്കുന്നതായിരിക്കും. പട്ടികയിൽ കാണിച്ചിട്ടുളള തീയതിയിൽ നടക്കുന്ന ഇ-ലേലത്തിൽ വിറ്റു പോകാത്ത ഉൽപ്പന്നങ്ങളും പുതുതായി വരുന്ന ഉൽപ്പന്നങ്ങളും അടുത്ത പുനർ ഇ-ലേലത്തിലൂടെ വിൽപ്പന നടത്തുന്നതാണ്.

It is hereby notified that Teak Poles, Teak billets and jungle wood fire wood collected from final felling areas of 1950 & 1951 Teak plantation at Punnamonvayal in Chittar North section of Kulathupuzha Range Thiruvananthapuram Division will be sold through e-Auction shown in the schedule, by the Divisional Forest Officer, Thiruvananthapuram or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 43, Vol. III dated 4-11-2014 vide Notification No. Pro.(4) 29243/13 dated 17-10-2014 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction and that could be lotted immediately before the e-auction will also be placed in the e-auction. Those who wish to participate have to remit an amount of ` 20,000 for Teak poles and Teak billets and firewood/jungle wood as EMD as e-payment before the e-auction through MSTC limited. Successful bidders will have to remit 35% of the bid amount on the e-auction itself through e-payment. Successful bidders will have to remit the balance value, VAT, Forest Development Tax, Income Tax and such other taxes that are prevailing at the time of e-auction within the stipulated time limit.

e-Auction documents and connected records are available in the website: www.mstcecommerce.com. The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online banking of SBT or through NEFT for other banks. For submission of e-auction visit the website: www.mstcecommerce.com. All bids/e-auction documents are to be submitted online only and in the designated online cover (s)/envelope (s) on the www.mstcecommerce.com Website and e-auction documents submitted manually/through post will not be entertained.

Online e-Auction/bids are to be accompanied with relevant documents. E-Auction/bids received online without the scanned copies of relevant documents will not be considered and shall be summarily rejected. Any further clarification on this e-Auction can be obtained from NIC/the e-Auction helpdesk number available in the www.mstcecommerce.com. Website and from the office of the Divisional Forest Officer, Thiruvananthapuram during the office hours. The details regarding e-Payment (Bidder's Bank Account No. where he/she is having core banking facility and email id) should be submitted along with the e-Auction documents. E-Auction documents without these details will not be accepted.

Technical bid and financial bid shall be submitted in their respective designated online covers.

The Forest Department will not be responsible for any inconvenience or loss to the Bidder while uploading/downloading the bid.

The bidders who wish to participate in the e-auction should produce a certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer, or any other approved identity documents along with the EMD through online. Those who do not produce any approved Identity Card or Certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the materials put up for the e-auction, the quantity remaining after their selection only will be re-auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the e-auction. Any further notification to the sale conditions that may be issued by the Government after the issuance of this notification will also be applicable to this e-auction. The unsold materials in the e-auction will be re-auctioned.

The bidding authority deserves the right to modify/ cancel, any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.

മുദ്രവച്ച ദർഘാസുകൾ 4-12-2015, 3 മണിവരെ സ്വീകരിക്കു ന്നതും ദർഘാസുകൾ അന്നേ ദിവസം തന്നെ 3.30 മണിക്ക് വൈൽഡ്ലൈഫ് വാർഡനോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ സ്ഥലത്ത് ഹാജരുള്ള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതുമാണ്. ദർഘാസ് ഫോറങ്ങൾ 4-12-2015 പകൽ ഒരുമണിവരെ വൈൽഡ് ലൈഫ് വാർഡന്റെ ഓഫീസിൽനിന്നും പ്രവൃത്തി ദിവസങ്ങളിൽ ലഭിക്കുന്നതാണ്.

അംഗീകൃത കരാറുകാർക്ക് അവരുടെ രജിസ്ട്രേഷൻ കാർഡ് കാണിച്ചാൽ മാത്രമേ ദർഘാസ് ഫോറങ്ങൾ ലഭിക്കുകയുള്ളൂ.

ദർഘാസ് ഫോറത്തിന്റെ വില യാതൊരു കാരണവശാലും മടക്കി കൊടുക്കുന്നതല്ല. ദർഘാസ് ഫോറങ്ങൾ കൈമാറുവാനും പാടുള്ളതല്ല. നി›ിത സമയത്തിനുശേഷവും നിരതദ്രവ്യം ഇല്ലാതെയും ലഭിക്കുന്ന ദർഘാസുകൾ നിരസി ക്കുന്നതാണ്. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനുള്ള അവസാന തീയതി ഒരു പൊതു അവധി ആയാൽ അടുത്ത പ്രവൃത്തി ദിവസം അതേ സമയം വരെ സ്വീകരിക്കുന്നതും അന്നേ ദിവസം തന്നെ തുറക്കുന്നതുമാണ്. ഏതെങ്കിലും കാരണവശാൽ ദർഘാസ് 4-12-2015-ന് നടക്കാതെ വന്നാൽ ടി ദർഘാസുകൾ 7-12-2015 അല്ലെങ്കിൽ 9-12-2015 എന്നീ തീയതികളിൽ നി›ിത സ്ഥലത്തും സമയത്തും നടത്തുന്നതാണ്.

Separate sealed tenders are invited for the following works indicated in the schedule given below from Registered PWD Contractors so as to reach the Office of the Wildlife Warden, Silent Valley Division, Mannarkkad, before 3 p.m. on 4-12-2015. The tenders received will be opened by the Wildlife Warden or any other officer authorized by him at 3.30 p.m. on the same day in the office of the Wildlife Warden, Silent Valley Division, Mannarkkad. Tender form can be purchased from the office of the Wildlife Warden, Mannarkkad on any of the working days till 1 p.m. on 4-12-2015. The registered contractors will be supplied with the tender forms only on production of their registration cards. The cost of the tender form is non-refundable under any circumstances. Tenders received after the due date time and not accompanied by proper Earnest Money Deposit will not normally be entertained. The tenders not containing the prescribed preliminary agreement in Kerala Government Stamp Paper worth ` 150 will be rejected. If the tender date happens to be a public holiday, tender will be conducted and opened on the next working day at the same time and venue.

നിബന്ധനകൾ

1. ലേല ദിവസം പൊതു അവധിയായി പ്രഖ്യാപിക്കുന്ന പക്ഷം അടുത്ത പ്രവൃത്തി ദിവസം നി›യിച്ച സ്ഥലത്തും സമയത്തും വെച്ച് ലേലം നടത്തുന്നതായിരിക്കും.

2. താഴെ പറയുന്ന വ്യവസ്ഥകൾക്ക് പുറമെ സർക്കാർ തടി ഡിപ്പോകളിൽ അപ്പപ്പോൾ നിലവിലുള്ള മറ്റ് ലേല വ്യവസ്ഥകളും ഈ ലേലത്തിന് ബാധകമായിരിക്കും. ലേലത്തിൽ പങ്കുകൊള്ളാൻ ആഗ്രഹിക്കുന്നവർ വില്ലേജ് ഓഫീസിൽ നിന്നും ലഭിക്കുന്ന തിരിച്ചറിയൽ കാർഡ് ഹാജരാക്കേ≠തും ലേലത്തിനു മുമ്പ് നിരതദ്രവ്യമായി ` 5,000 കെട്ടിവെക്കേ≠തുമാണ്.

3. ഏറ്റവും കൂടുതൽ തുകയ്ക്ക് ലേലം വിളിക്കുന്ന ആളുടെ പേരിൽ താൽക്കാലികമായി ലേലം സ്ഥിരപ്പെടുത്തുന്നതാണ്. ലേല തുക ` 10,000-മോ അതിൽ കുറവോ ആണെങ്കിൽ മുഴുവൻ തുകയും ലേലം കൊള്ളുന്ന ആൾ ലേലദിലസം തന്നെ ഒടുക്കേ≠താണ്. ` 10,000-ത്തിൽ കൂടുതലാണ് ലേല തുകയെങ്കിൽ ലേലത്തുകയുടെ മൂന്നിലൊന്നോ ` 10,000-മോ ഏതാണ് കൂടുതലെങ്കിൽ, കൂടുതലുള്ള സംഖ്യ ലേലം കഴിഞ്ഞ ഉടനെ അടയ്ക്കേ≠താണ്. അല്ലാത്തപക്ഷം ലേലം റദ്ദാക്കപ്പെടുന്നതും കെട്ടിവെച്ച നിരതദ്രവ്യം സർക്കാരിലേക്ക് മുതൽ കൂട്ടുന്നതുമായിരിക്കും. ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം നടത്തുന്നതും അതിൽ സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം സംഭവിക്കുക യാണെങ്കിൽ ആയത് ടിയാനിൽ നിന്നും റവന്യു റിക്കവറി വഴിയോ മറ്റ് ഉചിതമായ മാർഗ്ഗങ്ങളിലൂടെയോ വസൂലാക്കുന്ന തായിരിക്കും എന്നും പുനർലേലത്തിൽ എന്തെങ്കിലും ലാഭമു≠ായാൽ അതിൽ ടി ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല.

4. ലേലത്തിൽ വിളിച്ചെടുത്ത സാധനങ്ങളുടെ ബാക്കി തുകയും (നിബന്ധന-3) വിൽപ്പന നികുതിയും വന വികസന നികുതിയും ആദായ നികുതിയും നിലവിലുള്ള നിരക്കുകളിൽ ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം ലേലക്കാരനെ അറിയി ക്കുന്ന ദിവസം മുതൽ 30 ദിവസത്തിനകം സർക്കാരിലേക്ക് അടച്ച് സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ നിയമാനുസരണം പിഴപ്പലിശയും തറവാടകയും ഈടാക്കി മതിയായ കാരണങ്ങളാൽ സാധനങ്ങൾ നീക്കംചെയ്യാൻ മുപ്പത് ദിവസം കൂടി അസിസ്റ്റന്റ ് വൈൽഡ് ലൈഫ് വാർഡൻ അനുവദിക്കുന്നതാണ്. ടി സമയപരിധിക്കുള്ളിലും പണമടച്ച് സാധനങ്ങൾ നീക്കം ചെയ്യാതിരുന്നാൽ, സാധനങ്ങൾ നഷ്ടപ്പെടുകയോ നശിച്ച് പോവുകയോ ഗുണം കുറയുകയോ ചെയ്താൽ ആയതിന് സർക്കാർ ഒരുവിധത്തിലും ഉത്തരവാദിയാകുന്നതല്ല. മേൽപറഞ്ഞ സമയപരിധി കഴിഞ്ഞ് നീക്കംചെയ്യാതെ കിടക്കുന്ന സാധനങ്ങൾ സർക്കാരിലേക്ക് മുതൽകൂട്ടുന്നതും ലേലംകൊ≠ ആൾക്ക് സാധനങ്ങളിൻമേൽ യാതൊരുവിധ അവകാശങ്ങളും ഇല്ലാത്തതുമാകുന്നു.

5. ലേല വസ്തുക്കൾ നീക്കംചെയ്യുന്നതിന് മുമ്പ് നിയമപ്രകാരമുള്ള വിൽപ്പന നികുതി, ആദായ നികുതി, വന വികസന നികുതി തുടങ്ങിയവ അടയ്ക്കേ≠താണ്.

6. കോടതിയിൽനിന്നും പ്രത്യേക അനുമതി നേടി ലേലംചെയ്യുന്ന തൊ≠ി വസ്തുക്കളുടെ മുഴുവൻ ലേലത്തുകയും ലേല ദിവസം തന്നെ ഒടുക്കേ≠താണ്.

7. ലേലത്തിൽ പങ്കെടുക്കുന്നവർ ലേലസമയത്തിന് മുൻപായി ലേലത്തിൽ വെച്ചിരിക്കുന്ന വകകളുടെ നിലവാരം, ഇനം, അളവ് മുതലായവ പരിശോധിച്ച് ഉറപ്പ് വരുത്തേ≠താണ്. ഈ വക കാര്യങ്ങൾ ബന്ധപ്പെട്ട റെയിഞ്ച് ഓഫീസറിൽനിന്നും ലഭ്യമാകുന്നതാണ്. ലേലം നടന്നശേഷം ലേലത്തിൽകൊ≠ വകകളുടെ അളവിലോ ഗുണത്തിലോ എന്തെങ്കിലും വ്യത്യാസമുള്ളതായി പരാതിപ്പെട്ടാൽ അത് യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

8. ലേലത്തേക്കുറിച്ചുള്ള വിവരങ്ങൾ അതാത് അസിസ്റ്റന്റ ് വൈൽഡ് ലൈഫ് വാർഡൻമാരിൽ നിന്നും ലഭിക്കുന്നതാണ്.

9. ഡിപ്പോ തടി ലേല നിബന്ധനകൾ എല്ലാം ഈ ലേലത്തിന് ബാധകമായിരിക്കും.
