Explanatory Note
(This does not form part of the notification, but is intended to indicate the general purpose).
An approximate extent of 1.6670 Ha vested in Government as EFL under section 3(1) of the Kerala forest (V/M of EFL) ordinance 16/2001 was notified as such vide notification No. C6-21437/2000 dated 22-6-2001 and published in Kerala Gazette No. 27, volume 46, dated 3-7-2001. The actual extent on survey is only 1.5180 Ha. following the procedures stipulated under section 10 A of EFL Act, the Government as per letter No. 14743/E2/12/F&WLD dated 7-2-2013 & letter No. 3376/E2/14/F&WLD dated 6-8-2015 have agreed to denotify 1.5176 Ha. from the ecologically fragile land. Above denotification is published with the intension to achieve the above objective.

An approximate extent of 1.5215 Ha of comprised in Survey No. 141/3pt, 4, 5 Mundur Village, Palakkad Taluk, Palakkad District vested in the Government was notified as such as Ecologically Fragile Land under section 3(1) of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance (Ordinance 8 of 2000) vide notification No. C4-21437/00 dated 20-10-2000 published in Kerala Gazette No. 1, vol. 46, dated 2-1-2001 as Sl. No. 86. On scrutiny of the above said notification under Section 19 (3) b of EFL Act and Rule 20 of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Rule 2007, the Custodian as per order No. EFL6-520/06 dated 23-10-2014 found that the above land does not qualify the definition of Ecologically Fragile Land as defined under Section 2 b (1) of the EFL Act 2003 and ordered to remove the same from the notification. Hence it is hereby notified that the land detailed in the schedule below is excluded from Ecologically Fragile Land.

Subsequently the hard copy attested copy of Registration Certificate, EMD exeption certificate (if any) preliminary agreement in original, signed copy of conditions would be submitted offline in a sealed cover subscribing the name of work and tender number to the office of the Divisional Forest Officer, Thenmala Division through speed post/registered post as prescribed in the time schedule, failing which such tenders will be rejected. The bidding authority deserves the right to modify/cancelled any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data, while downloading by the bidder and non-receipt of documents.
Any further classifications on this tender can be obtained from NIC/KITM the e-tender Helpdesk number available in the www.etenders.kerala.gov.in website and from the office of the Divisional Forest Officer, Thenmala (0475-2344521) during the office hours. It is hereby notified that Teak timber–IV, and Teak billets collected from final felling of 1952 Adukuzhy Teak Plantation in Vadasserikkara Range of Ranni Division and which were not sold in the auction on 15-7-2015 and 22-7-2015, will be sold through e-Auction as shown in the schedule, by the Divisional Forest Officer, Ranni or any officer authorized by him, subject to the conditions published in Kerala Gazette No. 50 Vol. III dated 23-12-2014 vide Notification No. Pro. (4) 26243/13 dated 3-12-2014 of the Additional Principal Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department.
Besides the quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction and that could be lotted immediately before the e-auction will also be placed in the e-auction. Those who wish to participate have to remit an amount ` 50,000 for Teak timber and for ` 20,000 for Teak billets as EMD as e-payment before the e-auction through MSTC limited. Successful bidders will have to remit 35% of the bid amount on the day of e-auction itself through e-payment. Succesfull bidders will have to remit the balance value, VAT, Forest Developemnt Tax, Income Tax and such other taxes that are prevailing at the time of e-auction within the stipulated time.

The tenders will be opened by the undersigned or his deputee on the same day at 3 p. m. in the presence of those tenderers present at that time at the office of the undersigned. If the due date happens to be a holiday due to any reason the tender will be held on the next working day. If the tender cannot be carried out due to other reasons or any item not taken up by anybody the same will be again tendered on 12-10-2015 or if again not taken up then on 15-10-2015. ദർഘാസ് സമർപ്പിക്കുവാനുദ്ദേശിക്കുന്ന കരാറുകാർ ദർഘാസ് സഹിതം നി›ിത ഫോറത്തിലുള്ള ഒരു പ്രാഥമിക കരാർ ` 500-ന്റെ മുദ്രപത്രത്തിൽ തയ്യാറാക്കി ഒപ്പിട്ട് അടക്കം ചെയ്യേ≠തും അങ്ങനെ ചെയ്യുവാൻ വീഴ്ചവരുത്തുന്ന കരാറുകാരുടെ ദർഘാസുകൾ അവ തുറക്കുമ്പോൾതന്നെ അധികാരപ്പെട്ട ഉദ്യോഗസ്ഥൻ നിരസിക്കുന്നതുമാണ്. കേരള പൊതുമരാമത്ത് വകുപ്പിലും വനം വകുപ്പിലും ദർഘാസ് സംബന്ധിച്ച് നിലവിലുള്ള മറ്റ് എല്ലാ വ്യവസ്ഥകളും ഈ ദർഘാസ് പരസ്യത്തിനും ബാധകമാണ്.

Period of completion of works—3 months.
If the tender could not be conducted due to any technical or unexpected reasons or persons not purchased tender forms also, on the above date, tenders for the above works will be conducted on 8-10-2015 at the same time and if the tender could not be conducted at 8-10-2015, it will be conducted on 9-10-2015 at the same time.
Only the qualified contractors having sound financial and other technical backgrounds are expected to participate in the tender. The work shall be completed within the specified time limit. The contractors are directed to follow the rules specified in form 83.

Separate, sealed competitive tenders are invited from the registered PWD contractors for the following works in Kalpetta Range of South Wayanad Forest Division, Kalpetta during 2015-16.
Tender forms will be issued from the office of the Divisional Forest Officer, South Wayanad Division office up to 7-10-2015, 1 p.m. and will be received upto 2.30 p.m. on 7-10-2015. The received tenders will be opened at 3.30 p.m. on 7-10-2015 by the Divisional Forest Officer, South Wayanad Division, Kalpetta or by any other officer duly authorized by him in the presence of the tenderers or their authorized representatives who are Tender forms can be had from the office of the undersigned on direct remittance of cost of tender form or through money order along with the Registration cards. Value of the forms once realized will not be refunded at any cost. EMD for the work should be made through Demand Draft drawn from any nationalized bank in favour of the Divisional Forest Officer, South Wayanad Division, Kalpetta and payable at Kalpetta. Tenders without adequate EMD, incomplete, defective or belated tenders will be summarily rejected. The undersigned reserves the right to reject any tender without assigning any reason thereof. The Co-operative societies, rendering the tenders should produce consent letter to participate in the tender and valid relevant certificate issued by the Registrar of Co-operative Society. They are also directed to produce true copies of relevant orders exempting them from remittance of EMD/security along with the tenders if any. Otherwise they will have to remit EMD/security applicable.
Each and every tender should accompany preliminary agreement in stamp paper worth ` 500 (Rupees Five hundred only) duly signed by the tenderer. Tenders without this preliminary agreement in stamp paper will also be rejected even at the time of opening the tenders. All the relevant rules, regulations, conditions etc. prevailing in PWD and Forest Department in respect of tenders will be applicable to this tender notification also.

അനധികൃതമായി ചന്ദന മരകഷണങ്ങൾ കെ.എൽ. 58 എച്ച്-297 നമ്പർ ബജാജ് ഡിസ്ക്കവർ മോട്ടോർ സൈക്കിളിൽ കടത്തുവാൻ ശ്രമിച്ച കുറ്റത്തിന് 31-12-2012-ന് മാലൂർ പോലീസ് സ്റ്റേഷനിൽ ക്രൈം നമ്പർ 433/12 പ്രകാരം ഒരു കേസ് രജിസ്റ്റർ ചെയ്യുകയും പിന്നീട് കൊട്ടിയൂർ റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസർക്ക് ടി കേസ് കൈമാറുകയും കൊട്ടിയൂർ റെയിഞ്ചിൽ ഒ. ആർ. 01/2013-ാം നമ്പരായി 3-1-2013-ന് കേസ് രജിസ്റ്റർ ചെയ്യുകയും ചെയ്തിരുന്നു. ടി കേസിൽ കസ്റ്റഡിയിലെടുത്ത 11 ചന്ദന മരകഷണങ്ങളും കെ.എൽ. 58 എച്ച്-297 നമ്പരോടു കൂടിയ ബജാജ് ഡിസ്ക്കവർ മോട്ടോർ സൈക്കിളും ഒരു ഹാക്സോ ബ്ളെയിഡും ഒരു ബിഗ്ഷോപ്പറും കേരള വന നിയമം 1961 സെക്ഷൻ 47 എച്ച് പ്രകാരം കസ്റ്റഡിയിലെടുത്ത് സെക്ഷൻ 61 എ പ്രകാരം ഓതറൈസ്ഡ് ഓഫീസറായ എന്റെ മുൻപാകെ ഹാജരാക്കിയിട്ടുള്ളതും അടിയന്തിരമായി അന്വേഷണ റിപ്പോർട്ട് സമർപ്പിക്കുന്നതിന് നിർദ്ദേശം നൽകി പ്രസ്തുത തൊ≠ി മുതലുകൾ തിരികെ കൊട്ടിയൂർ റെയിഞ്ചാഫീസർക്ക് നൽകുകയും ചെയ്തിട്ടുള്ളതാണ്.
മേൽ കേസിൽ അന്വേഷണം നടത്തി അന്വേഷണ റിപ്പോർട്ട് റെയ്ഞ്ച് ഫോറസ്റ്റ് ഓഫീസർ, കൊട്ടിയൂർ എന്റെ മുൻപാകെ സമർപ്പിച്ചിട്ടു≠്.
31-12-2012-ന് മാലൂർ പോലീസ് സ്റ്റേഷൻ സബ് ഇൻസ്പെക്ടറും പാർട്ടിയും പട്രോളിംഗും വാഹന പരിശോധനയും നടത്തി വരവെ പടുപാറ അംഗൻവാടിക്ക് സമീപംവച്ച് ശിവപുരം ഭാഗത്തുനിന്നും തില്ലങ്കേരി ഭാഗത്തേക്ക് കെ.എൽ. 58 എച്ച്-297 നമ്പർ മോട്ടോർ സൈക്കിളിൽ വരികയായിരുന്ന ര≠് പേർ പോലീസ് പാർട്ടിയെ ക≠് ഓടിപ്പോവുകയും മോട്ടോർ സൈക്കിൾ പരിശോധിച്ചതിൽ ഒരു ബിഗ് ഷോപ്പറിൽ 3.5 കിലോഗ്രാം തൂക്കമുള്ള 11 പച്ചയായ ചന്ദന മരകഷണങ്ങളും ഒരു ഹാക്സോ ബ്ളെയിഡും ക≠െടുക്കുകയും ചെയ്തതായും മോട്ടോർ സൈക്കിൾ ഓടിച്ചിരുന്നത് ശിവപുരം പടുപാറ താമസിക്കുന്ന നിജേഷ് എന്നയാളാണെന്നും പുറകിലിരുന്നയാളെ ക≠ാൽ തിരിച്ചറിയുമെന്നും എഫ്.എെ.ആർ.-ൽ മാലൂർ പോലീസ് ഇൻസ്പെക്ടർ രേഖപ്പെടുത്തിയിട്ടുള്ളതായും അന്വേഷണ റിപ്പോർട്ടിൽ കാണുന്നു. കെ.എൽ. 58 എച്ച്-297 നമ്പർ ബജാജ് ഡിസ്ക്കവർ മോട്ടോർ സൈക്കിളിന്റെ രജിസ്ട്രേഷൻ സംബന്ധമായ വിവരങ്ങൾ പരിശോധിച്ചതിൽ ആയത് നിജേഷ്, പി. s/o പവിത്രൻ, ശിവപുരം പി. ഒ., മാലൂർ എന്നയാളുടെ പേരിലുള്ളതാണെന്ന് ബോധ്യപ്പെട്ട തായും അന്വേഷണ ഉദ്യോഗസ്ഥൻ സമർപ്പിച്ചിട്ടു≠്.
കേരള വന നിയമം 1961 സെക്ഷൻ 47 സി പ്രകാരം ഒരു കിലോഗ്രാമിൽ കൂടുതൽ ചന്ദന തടികൾ കൈവശംവച്ച് കടത്തിക്കൊ≠ുപോകുവാൻ ശ്രമിച്ചതിലൂടെ സെക്ഷൻ 2 (e) പ്രകാരം ഒരു വനം കുറ്റകൃത്യം നടന്നതായും ആയത് കടത്തിക്കൊ≠ുപോകുന്നതിന് കെ.എൽ. 58 എച്ച്-297 നമ്പർ ബജാജ് ഡിസ്ക്കവർ ഉപയോഗിച്ചിട്ടു≠െന്ന് ബോധ്യപ്പെട്ട തായും അന്വേഷണ റിപ്പോർട്ടിൽ വ്യ‡മാക്കിയിട്ടു≠്. ആയതിനാൽ 11 കഷണം (3.33 കി.ഗ്രാം) ചന്ദന തടികളും [(1) 49 cm × 14 cm, (2) 39 cm × 15 cm, (3) 23 cm × 10 cm, (4) 37 cm × 17 cm, (5) 37 cm × 17 cm, (6) 35 cm × 15 cm, (7) 39 cm × 12 cm,(8) 39 cm × 12 cm, (9) 31 cm × 11 cm, (10) 46 cm × 10 cm, (11) 39 cm × 14 cm] ആയത് കടത്തി കൊ≠ുപോകുവാൻ ഉപയോഗിച്ച കെ.എൽ. 58 എച്ച്-297 നമ്പർ മോട്ടോർ സൈക്കിളും ഒരു ഹാക്സോ ബ്ളേഡും ഒരു ബിഗ്ഷോപ്പറും 1961-ലെ കേരള വന നിയമം സെക്ഷൻ 61 എ (2) പ്രകാരം സർക്കാരിലേക്ക് ക≠ുകെട്ടു ന്നതിനുമാണ് അന്വേഷണ റിപ്പോർട്ടിൽ ശുപാർശ ചെയ്തിരി ക്കുന്നത്.
അന്വേഷണ റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ ടി കേസിൽ ഉൾപ്പെട്ട മേൽ തൊ≠ി മുതലുകൾ സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതിന് താത്ക്കാലികമായി തീരുമാനിച്ചിരിക്കുന്നു. ആയതിനെതിരെ ആർക്കെങ്കിലും വല്ലതും ബോധിപ്പിക്കുവാനു ≠െങ്കിൽ ഈ നോട്ടീസ് പ്രസിദ്ധീകരിച്ച് 15 ദിവസത്തിനകം കണ്ണൂർ കണ്ണോത്തും ചാലിലുള്ള ഫോറസ്റ്റ് ഓഫീസ് കോംπക്സിൽ ഹാജരായി ബോധിപ്പിക്കാവുന്നതാണ്. അല്ലാ ത്തപക്ഷം ആർക്കും യാതൊന്നും ബോധിപ്പിക്കാനില്ല എന്ന നിഗമനത്തിൽ മേൽ തൊ≠ി മുതലുകൾ സർക്കാരിലേക്ക് ക≠ുകെട്ടി ഉത്തരവാകുന്നതായിരിക്കും.
