മൂന്നാർ വന്യജീവി ഡിവിഷനുകീഴിൽ പ്രവർത്തിക്കുന്ന ആനമുടി വനവികസന ഏജൻസിയുടെ ഉടമസ്ഥത യിലുള്ളതും അഞ്ചാം മൈലിൽ നിന്ന് രാജമല ടൂറിസം സോണിലേക്ക് സന്ദർശകരെ കൊ≠ുപോകുന്നതിന് ഉപയോ ഗിച്ചിരുന്നതുമായ ടാറ്റാ മിനി ബസ്സ്—ഒരെണ്ണം (2005 മോഡൽ, രജിസ്റ്റർ നമ്പർ KL 06 D 1921, കേരള വന നിയമം 1961-ലെ എ വകുപ്പ് പ്രകാരം പിടിച്ചെടുത്ത സുസുകി മോട്ടോർ സൈക്കിൾ എന്നിവ ബഹു: കേരള ഹൈക്കോടതി യുടെ 2008 ഡിസംബർ 2-ാം തീയതിയിലെ എം.എ.സി.എ. 1458/08 നമ്പർ വിധിയുടെയും ബഹു. കേരള ചീഫ് സെക്രട്ടറിയുടെ 2009 ജനുവരി മാസം 5-ാം തീയതിയിലെ 89584/ജി3/08 ഹോം നമ്പർ സർക്കുലറിന്റെയും അടിസ്ഥാന ത്തിൽ അവ സൂക്ഷിച്ചിരിക്കുന്ന സ്ഥലത്ത് തത്സമയ അവസ്ഥ യിലും സ്ഥിതിയിലും 23-3-2016-ാം തീയതി ദർഘാസ്/ലേലം മുഖേന വിൽക്കുന്നതായിരിക്കും. ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ താൽപ്പര്യമുള്ളവരിൽ നിന്നും മുദ്രവച്ച ദർഘാസുകൾ സ്വീകരിക്കുന്നതാണ്. അന്നേ ദിവസം പകൽ 3.30 മണിക്ക് വൈൽഡ്ലൈഫ് വാർഡനോ അല്ലെങ്കിൽ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ മൂന്നാർ വൈൽഡ് ലൈഫ് ഡിവിഷൻ ആഫീസിൽവച്ച് ലേലം ചെയ്യുന്നതും ലേലത്തിനുശേഷം ദർഘാസ് തുറന്ന് പരിശോധി ക്കുന്നതുമായിരിക്കും. ദർഘാസിലോ/ലേലത്തിലോ ഏറ്റവും കൂടുതൽ തുക വാഗ്ദാനം ചെയ്യുന്നയാളുടെ പേരിൽ ദർഘാസ്/ലേലം താൽക്കാലികമായി ഉറപ്പിക്കുന്നതായിരിക്കും.
ലേലം കൊ≠യാൾ ലേലം കൊ≠ തുകയുടെ 50% അപ്പോൾ തന്നെ ഈ ഓഫീസിൽ ഒടുക്കേ≠താണ്.

ഏതെങ്കിലും കാരണവശാൽ ടി ദിവസം ദർഘാസ്/ ലേലം നടത്തുവാൻ കഴിയാതെ വന്നാൽ 30-3-2016-ാം തീയതി ടി സമയത്ത് ദർഘാസ്/ലേലം നടത്തുന്നതായിരിക്കും.
ദർഘാസ് ഫോറം ഉച്ചയ്ക്ക് ഒരു മണി വരെ മൂന്നാർ വൈൽഡ് ലൈഫ് വാർഡന്റെ ആഫീസിൽ നിന്നും നൽകുന്നതും 3 മണി വരെ സ്വീകരിക്കുന്നതുമായിരിക്കും.
1. താൽപര്യമുള്ളവർക്ക് മുകളിൽ പറയുന്ന സ്ഥലത്ത് സൂക്ഷിച്ചിരിക്കുന്ന വാഹനത്തിന്റെ ഗുണനിലവാരം അസിസ്റ്റന്റ ് വൈൽഡ്ലൈഫ് വാർഡന്റെ സാന്നിദ്ധ്യ ത്തിൽ പരിശോധിച്ച് ബോദ്ധ്യപ്പെടാവുന്നതാണ്. ലേലത്തിനുശേഷം ഉന്നയിക്കുന്ന യാതൊരുവിധ പരാതികളും പരിഗണിക്കുന്നതല്ല.
2. ദർഘാസുകൾ ആവശ്യമുള്ളവർ അവരെ തിരിച്ചറിയു ന്നതിന് തിരഞ്ഞെടുപ്പ് കമ്മീഷനോ/ബന്ധപ്പെട്ട വില്ലേജാഫീസറോ നൽകിയിട്ടുള്ള തിരിച്ചറിയൽ കാർഡ്/സർട്ടിഫിക്കറ്റ് സഹിതം അപേക്ഷിക്കേ ≠താണ്.
3. ദർഘാസിനോടൊപ്പം നി›ിത നിരതദ്രവ്യം ഈ ആഫീസിൽ അടയ്ക്കേ≠താണ്.
4. ദർഘാസ്/ലേലത്തിൽ പരിഗണിക്കപ്പെടാത്തവരുടെ നിരതദ്രവ്യം അപ്പോൾ തന്നെ തിരികെ നൽകുന്നതാണ്.
5. കൂടുതൽ തുകയ്ക്കുള്ള ദർഘാസുകൾ അംഗീകാര ത്തിനായി മേലധികാരത്തിലേക്ക് അയയ്ക്കുന്നതും മറ്റ് ദർഘാസുകാർ നൽകിയ നിരതദ്രവ്യം അപ്പോൾ തന്നെ തിരികെ നൽകുന്നതുമാണ്.
6. ദർഘാസ് സംഖ്യ നിരതദ്രവ്യത്തിനേക്കാൾ കൂടുതലാ ണെങ്കിൽ ദർഘാസ് സംഖ്യയുടെ 50% അല്ലെങ്കിൽ ` 10,000 ഏതാണോ കൂടുതൽ (നിരതദ്രവ്യം ഉൾപ്പെടെ) അത് അപ്പോൾ തന്നെ ഒടുക്കേ≠താണ്.
7. ദർഘാസുകൾ ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥന്റെ അംഗീകാരത്തിന് വിധേയമായിരിക്കും. ദർഘാസുകൾ സ്വീകരിക്കുന്നതിനോ നിരസിക്കുന്നതിനോ ഉള്ള പൂർണ്ണ അധികാരം ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനിൽ നിക്ഷിപ്തമായിരിക്കും.
8. ദർഘാസുകൾ അംഗീകരിച്ചതായി അറിയിപ്പുകിട്ടി 15 ദിവസത്തിനകം ബാക്കി സംഖ്യയും നിയമ പ്രകാരമുള്ള നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്യേ≠താണ്.
9. 15 ദിവസത്തിനുള്ളിൽ ബാക്കി സംഖ്യയും നികുതിയും അടച്ച് വാഹനം നീക്കം ചെയ്തില്ലെങ്കിൽ ദർഘാസുകാരൻ ആവശ്യപ്പെടുന്നപക്ഷം മറ്റൊരു 15 ദിവസം കൂടി ബാക്കി സംഖ്യയ്ക്ക് 12% പലിശയും ദിവസം ` 20 നിരക്കിൽ ഇരുപ്പുവാടകയും വസൂലാക്കി അനുവദിക്കുന്നതായിരിക്കും. ഇതിനു ശേഷം കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. ഇപ്രകാരം വീഴ്ച വരുത്തിയ ദർഘാസുകാരന്റെ നഷ്ടോത്തര വാദിത്വത്തിൽ പുനർലേലത്തിലോ ടെ≠ർ അടിസ്ഥാ നത്തിലോ ടി വാഹനം വിൽക്കുന്നതും ദർഘാസു കാരൻ അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്ന തുമായിരിക്കും.

It is hereby notified that the condemned Departmental Jeep KL 01/P 3957 in this Division will be sold through e-auction shown in the schedule, by the Assistant Conservator of Forests, Forest Resources Survey Cell, Thrissur or any other officer authorized by him, subject to the conditions notified in the e-auction notification, and as per the order No. WA-875/2014 dated 11-12-2015 of Principal Chief Conservator of Forests, Working Plan and Research, Thiruvananthapuram.
e-Auction documents and connected records are available in the website : www.mstcecommerce.com. The Earnest Money Deposit of ` 1,400 for the vehicle should be submitted on e-payment/e-treasury/demand draft/MSTC through the Internet online banking of SBT or through NEFT for other banks. For submission of tenders visit the website: www.mstcecommerce.com. All bids/e-auction documents are to be submitted online only and in the designated online cover/envelope on the www.mstcecommerce.com website and e-auction documents submitted manually/through post will not be entertained. Late tenders will not be entertained.
Online e-auction/bids are to be accompanied with relevant documents, e-auction/bids received online without the scanned copies of relevant documents will not be considered and shall be summarily rejected. It is hereby notified that the condemned Departmental Mahindra Jeep in Pattikkad Range and seized vehicles in OR cases TATA 407 Mini Lorry in Wadakkanchery Range, Motor Cycle in Pattikkad Range of Thrissur Division will be sold through e-auction shown in the schedule, by the Divisional Forest Officer, Thrissur or any other officer authorized by him, subject to the conditions notified in the e-auction notification, and as per the order No. B1-755/14 dated 8-5-2015 of Additional Principal Chief Conservator of Forests, Regional North, Kozhikode of vehicle Mahindra Jeep and Mini Lorry in Wadakkanchery Range and Motor Cycle in Pattikkad Range which were seized in forest offences and kept under Government Custody.

The Earnest Money Deposit of ` 500 for each vehicle should be submitted on e-payment/e-treasury/demand draft/MSTC through the Internet online banking of SBT or through NEFT for other banks. (5)-26274/12-ാം നമ്പരായി പ്രസിദ്ധീകരിച്ചിട്ടുള്ള ഡിപ്പോ ലേലവ്യവസ്ഥകൾക്കും കൂടാതെ താഴെപ്പറയുന്ന ലേല വ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി ദർഘാസ്/ലേലത്തിൽ പരസ്യമായി വിൽക്കുന്നതാണ്. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ദർഘാസിന് മുൻപ് ` 50,000 ഓരോ തോട്ടത്തിനും നിരതദ്രവ്യം കെട്ടിവയ്ക്കേ≠താണ്. വിജയിക്കുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ, ദർഘാസ് തുകയുടെ/ലേലത്തുകയുടെ 1/3 ഭാഗം തുക ദർഘാസ്-കം ലേല ദിവസം തന്നെ കെട്ടിവയ്ക്കേ≠താണ്. വിജയിയായ ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ വാറ്റ്, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠തു≠്.
ദർഘാസ്-കം ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ് കം ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ് കം ലേലം അടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതായിരിക്കും. പുനർലേലം ആവശ്യമാണെങ്കിൽ 29-3-2016-നോ അല്ലെങ്കിൽ 5-4-2016-നോ ഇതേ സ്ഥലത്തും സമയത്തും വച്ച് നടത്തുന്നതാണ്.
1. ദർഘാസ്-കം ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിലേക്കായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്തുത തോട്ടങ്ങളിലെ നിൽപ്പ്, ഇലവ്, കമ്പിളി, മട്ടി, മുരിക്ക് തുടങ്ങിയ പട്ടികയിൽ പരാമർശിച്ചതും മാർക്ക് ചെയ്തതുമായ വിവിധ ഇനം മൃദുമരങ്ങളുടെ ശേഖരണവും നീക്കം ചെയ്യലും സംബന്ധിച്ച ജോലിക്കുവേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.
2. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നിൽപ്പ് നേരിൽ ക≠് ബോദ്ധ്യപ്പെടേ≠തും ഉൽപ്പന്നത്തിന്റെ ഗുണമേൻമ, അളവ് എന്നിവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിനുശേഷം പരിഗണിക്കുന്നതുമല്ല.
3. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

5. ദർഘാസ്-കം ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽനിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റോ സർക്കാർ നൽകിയ ഫോട്ടോ പതിച്ച എെഡന്റിറ്റി കാർഡോ നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.
6. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ് കം ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ് കം ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പുകൾ പുനർലേലം ചെയ്യുന്നതാണ്.
7. ദർഘാസ് കം ലേലത്തിന് 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരുലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20 ശതമാനത്തിൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളൂ. കൂടാതെ താഴെ പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമാണ്.
(1) ദർഘാസ് കം ലേലത്തിന് 7 ദിവസത്തിനുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.
(2) പോസ്റ്റ് ഓഫറുകാരൻ യഥാർ∞ ദർഘാസുകാരൻ/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.
(3) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റു നികുതികളും ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴുദിവസത്തിനുള്ളിൽ ഒടുക്കി ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പുകളുടെയും അതിലെ നിൽപ്പു മരങ്ങളുടെയും ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.
പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർലേലം നടത്തുന്നതാണ്. പുനർലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ് കം ലേലം സ്ഥിരപ്പെടുത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേല തുക അടയ്ക്കുന്നതിൽനിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുള്ള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലം നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുകയ്ക്ക് ആ വ്യ‡ികളുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.
8. ദർഘാസ് കം ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിലോ കണ്ണവം, കൊട്ടിയൂർ റെയിഞ്ചാഫീസുകളിലോ എല്ലാ പ്രവൃത്തി ദിവസങ്ങളിലും അന്വേഷിച്ചാൽ അറിയാവുന്നതാണ്.
9. ദർഘാസ് കം ലേലത്തിൽ പങ്ക് ചേരണമെന്നാഗ്രഹിക്കുന്നവർ ` 50,000, നിരതദ്രവ്യം ഓരോ തോട്ടത്തിനും/ബ്ലോക്കിനും കെട്ടിവയ്ക്കേ≠താണ്.
10. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ് കം ലേലംകൊള്ളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ 1/3 തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി തുക ഒടുക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി കൂപ്പ് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതുമായിരിക്കും.
11. ദർഘാസ് കം ലേലംകൊള്ളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ മാർക്ക് ചെയ്ത് എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന ഇലവ്, കമ്പിളി, മട്ടി, മുരിക്ക് എന്നീ മരങ്ങൾക്ക് മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി മുതലായ മറ്റ് മരങ്ങൾക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.
12. ദർഘാസ് കം ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.
13. ദർഘാസ് കം ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ Q ലേലത്തുകയും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡെവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ വാറ്റ്, ഇൻകം-ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുകകൾ ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുകകൾ ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറും മുകളിൽ പറഞ്ഞ കാലാവധിക്കുള്ളിൽ തുക അടയ്ക്കാതിരുന്നാൽ 15 ദിവസത്തെ സമയം ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂരിന് 24% പലിശയോടുകൂടി കാലാവധി ദീർഘിപ്പിച്ച് നൽകുന്നതാണ്. പലിശ കണക്കാക്കുമ്പോൾ 15 ദിവസമോ അതിൽ കുറവോ വരുന്നത് പകുതി മാസമായും 15 ദിവസത്തിൽ കൂടുതൽ വരുന്ന ദിവസം ഒരു മാസമായും കണക്കാക്കുന്നതാണ്.
15th MARCH 2016] FOREST DEPARTMENT 28614. മുകളിലെ വ്യവസ്ഥപ്രകാരം നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും തുക ഒടുക്കി എഗ്രിമെന്റ ് വയ്ക്കുന്നതിന് വീഴ്ച വരുത്തിയാൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ അതുവരെ ഒടുക്കിയിട്ടുള്ള എല്ലാ തുകയും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ലേലം റദ്ദ് ചെയ്യുന്നതും ദർഘാസുകാരന്റെ/ലേലക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതുമാണ്. പുനർലേലം ചെയ്യുമ്പോൾ ലാഭം ഉ≠ാകുകയാണെങ്കിൽ ആയതിന് ലേലക്കാരന് യാതൊരുവിധ അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല. പുനർ ലേലത്തിലു≠ാകുന്ന എല്ലാ നഷ്ടങ്ങളും വീഴ്ചക്കാരനിൽനിന്നും ഈടാക്കുന്നതാണ്.
15. ദർഘാസുകാരൻ/ലേലക്കാരൻ ബാക്കി തുക മുതലായവ നീട്ടിക്കൊടുത്ത കാലാവധിക്കുള്ളിലും ഒടുക്കാതിരുന്നാൽ ഉടമ്പടി റദ്ദ് ചെയ്ത് ടിയാൻ അടച്ചിട്ടുള്ള മുഴുവൻ തുകകളും നീക്കം ചെയ്യാതെ കിടക്കുന്ന എല്ലാ ഉൽപ്പന്നങ്ങളും സർക്കാരിലേക്ക് ക≠ുകെട്ടി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർലേലം ചെയ്യുന്നതാണ്. പുനർലേലത്തിൽ ലാഭം ഉ≠ാക്കുകയാണെങ്കിൽ വീഴ്ചക്കാരന് യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതല്ല.
16. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 90 ദിവസമാണ്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, നോർത്തേൺ സർക്കിൾ, കണ്ണൂർ, അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (കോഴിക്കോട് നോർത്ത്) എന്നിവർ യഥാക്രമം തുടർന്നുള്ള 30 ദിവസം വീതവും താഴെപറയും പ്രകാരം പിഴ ഈടാക്കിക്കൊ≠് ഓരോ ജോലിക്കും കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.
(1) എന്യൂമറേറ്റ് ചെയ്തതും മുറിക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 1,125 വീതം.
(2) നീക്കം ചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക്/മുളകൾക്ക് ക്യു. മീറ്ററിനും/മെ. ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 150 വീതം.
(3) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 75 വീതം.
ഒന്നാമത്തെ 30 ദിവസത്തിന് ടി നിരക്കിലും 2-ാമത്തെ ദീർഘിപ്പിച്ച കാലാവധിയിൽ ഇതിന്റെ ഇരട്ടിയും 3-ാമത്തെ ദീർഘിപ്പിച്ച കാലയളവിൽ ഒന്നാമത്തെ 30 ദിവസത്തിന്റെ നിരക്കിന്റെ മൂന്നിരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ു കെട്ടി ഗവൺമെന്റ ിലേക്ക് മുതൽക്കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കാൻ ബാക്കിയുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽ വച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതുമായിരിക്കും.
17. കൂപ്പിൽ ശേഖരിച്ചുവയ്ക്കുന്ന മൃദുമരങ്ങൾ, വിറകുകൾ എന്നിവ നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.
18. കണ്ണൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ കണ്ണവം/കൊട്ടിയൂർ ഫോറസ്റ്റ് റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.
19. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.
20. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവിലെയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.
21. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠ുപോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിനോ അതിന്റെ ഭാഗത്തിനോ ` 375 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽനിന്നും ഈടാക്കുന്നതായിരിക്കും.
22. കൂപ്പിന് 0.4 കി. മീറ്റർ (2 ഫർലോങ്ങ്) ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ അനധികൃത കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ വിവരം ഫോറസ്റ്റ് ഉദ്യോഗസ്ഥരെ ഉടമ്പടിക്കാരൻ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ചവരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടാവുന്നതാണ്.
23. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ വാറ്റ്, അഗ്രിക്കൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്നമുറയ്ക്ക് തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽനിന്നും ഈടാക്കുന്നതാണ്.

It is hereby notified for the information of the public that the right of collection and removal of enumerated standing Elavu, Kambili, Matty, Murikku species of trees in the 1957 Soft wood Plantation, Peruva (9.9 Ha.), in Kannavam Range and 1965 Teak and Softwood Plantation, Nedumpoil (20 Ha.), in Kottiyoor Range of this Division as specified in the schedule appended below will be sold in-tender-cum-auction by the Divisional Forest Officer, Kannur or any other officers authorized by him on 22-3-2016 at 11.30 a.m. at the Divisional Forest Office, Kannur, subject to the terms and conditions of sale of timber in Government Timber Depots published in Government Gazette No. 49 dated 10-11-2013 in Page No. 815 to 824 of Forest Sheet as per Pro.(5)-26274/12 dated 22-11-2013 of the Chief Conservator of Forests (P), Thiruvananthapuram. In case the notified date happens to be public holiday, the tender-cum-auction will be conducted on the next working day at the notified place and time. If there is a requirement of re-auction, it will be conducted on 29-3-2016 and 5-4-2016 at the same place.
1. The auction will be on lumpsum basis for the right of collection and removal of entire Elavu, Kambili, Matty, Murikku species of trees growth from the above plantations mentioned in the schedule hereto, the area of which has been surveyed and demarked on the ground.
2. Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce before participating in the tender-cum-auction. Complaints if any, regarding quality and quantity etc. received after the tender-cum-auction will not be entertained.
3. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another person unless valid power of attorney is produced prior to the commencement of tender cum auction.
4. A supply contractor of Kannur Division or any adjacent divisions will not be allowed to bid in the tender- cum auction.
5. Intending tenderers/bidders should produce photo identity proof issued by Govt. authority or a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.
15th MARCH 2016] FOREST DEPARTMENT 2886. The successful tenderers/bidders should give an undertaking that he is not related with any officer having control over the work and that he is not a supply contractor of this or any adjacent Division. If this is proved otherwise, it shall result in cancellation of the contract and resale of the coupe at his risk and loss.
7. No post offer received after 7 days of the conduct of the tender cum auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is Rupees One Lakh and above and more than 20% where the original bid amount is less than One Lakh will ordinarily be considered. The post offerer will comply with following terms.
(a) Offer should be made within 7 days of tender cum auction failing to which the offer will not be considered.
(b) Offerer should remit double the amount paid by the successful tenderers/bidders on the tender-cum auction date.
(c) The remittance should be made by the Chalan or Bank deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within 7 days from the date of receipt of registered notice to that effect.
The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfillment of the above terms. If the post offerer satisfied the conditions, a re-auction of the right will be conducted after giving the usual publicity as per rules. In the re-auction, the price fetched if does not come up to what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidders/Tenderers in the re-auction and the amount remitted by the post offerer will be released to him.
8. Further particulars about the tender cum auction can be had either from the Office of the Divisional Forest Officer or from the Range Office, Kannavam/Kottiyoor.
9. Intending tenderers/bidders should deposit an Earnest Money Deposit of ` 50,000 for each Plantation/Block for participating in the tender/auction.
10. The successful tenderers/bidders have to remit 1/3 rd of sale value on the tender cum auction date, failure to which may result in the forfeiture of the E.M.D. to the Government and the resale of coupe at the risk and loss of the person concerned.
11. The successful tenderers/bidders have only the right for the collection and removal of marked Elavu, Kambili, Matty, Murikku trees as mentioned in the schedule appended and will have no right over Teak, Rosewood or such other unmarked trees.
12. The successful tenderers/bidders should execute a bounden agreement on a Stamp Paper worth ` 200 after the completion of tender-cum-auction.
13. The confirmation of the tender cum auction sale will be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall remit the balance 2/3rd of the sale value and 5% Forest Development Tax, VAT and Income Tax at the rates in force and security deposit of 10% for the total sale value. The successful tenderers/bidders should execute an agreement on a stamp paper worth ` 200. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. In case of failure to remit the amount within the extended period further extension for 15 days by the Chief Conservator of Forests, Northern Circle, Kannur subject to the realization of 24% penal interest. But all the above extension period will be within the original contract period. Failure to remit any of the above instalment even during the extended period will entail cancellation of the contract and forfeiture of all money paid till then and all produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. In calculating interest, 15 days and below will be reckoned as ½ month and over 15 days as one month.
15th MARCH 2016] FOREST DEPARTMENT 28915. Failure to remit any of the above instalment even during the extended period will entail the cancellation of the contract and forfeiture of all the money paid till then and confiscation of all the produce remaining in the coupe. The right thus cancelled will be resold at the risk and loss of the contractor. The contractor will have no right over the profit derived out of the resale of the coupe.
16. The period of contract will be allowed 90 days from the date of agreement. No extension of period of contract shall be granted on ordinary ground. Under special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests, Northern Circle, Kannur and the Additional Principal Chief Conservator of Forests (Region North), Kozhikode concerned may grant extension of time for 30 days, further 30 days, further 30 days respectively on realization of penalty or penalties for completion of each work for each extension mentioned below:
(a) For enumerated trees and balance unfelled per hectare or fraction thereof— ` 1,125 per hectare. (b) Unremoved registered logs and unregistered logs and bamboo— ` 150/M3/MT or fraction thereof.
(c) Unremoved firewood—` 75/Tonne or fraction thereof.
Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first 30 days shall be realized at the above rates, double the rate for the second 30 days and three times of the original rate for the third 30 days shall be realized.
If the tenderers/bidders fails to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderers/bidders as per the agreement will be forfeited to Government and the tenderers/bidders will not have any right on the produce confiscated to Government. In the above circumstances the balance work to be executed by the tenderers/bidders shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderers/ bidders.
17. The contractor shall be allowed to remove the timber of Elavu, Kambili, Matty, Murikku species and firewood from the coupe subject to the law prevailing in the department from time to time.
18. The contractor or his persons shall be allowed to enter in the coupe only after getting the prior permission either from the Divisional Forest Officer, Kannur or from the Forest Range Officer, Kottiyoor/Kannavam.
19. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 Meters and keep the cairns intact.
20. He will be liable for the damages made to other trees in plantations or RF.
21. The successful tenderers/bidders may allow to stack the timber in the forest area outside the coupe at the risk of the tenderers/bidders upto the period of contract. An amount of ` 375 will be charged as ground rent for the timber unremoved for 1 Ha. or fractions thereof.
22. He will be liable for all illegal activities happened 400 Mtr. (2 Furlong) surrounding of the coupe. Such incidents, if noticed by contractor, should be informed the officer concerned, otherwise will lead to the cancellation of the contract.
23. The security deposit will be released to the contractor on production of clearance certificate. Any liability outstanding will be set off from the security deposit.
24. If the value fetched in the re-tender/re-auction is less than that obtained in the original tender cum auction, the difference between them together with all incidental expenditure to fix up of the resale including notification charges or any other dues or Government loss as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/bidders through all legal means including Revenue Recovery Act in force.
25. General condition of the sale of tree growth prevailing in the department from time to time shall be applicable to this tender cum auction also.
26. G. O. (Ms.) No. 22/2014/Forest dated 15-1-2014 shall be applicable to this tender cum auction also.
27. No unmarked tree shall be felled or damaged while felling a marked tree. Such instances if any will be treated as violation of agreement condition.
28. The tenderer/bidder should have PAN Card otherwise Income Tax at the higher rate in force will be levied.
