2016 മാർച്ച് 11. 22-12-2009-ലെ കേരള ഗസറ്റ് നമ്പർ 50, വാല്യം 54, പേജ് നമ്പർ 669 മുതൽ 675 വരെ പ്രസിദ്ധീകരിച്ച് ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (പ്രൊട്ടക്ഷൻ) തിരുവനന്തപുരം അവർകളുടെ 2-12-2009-ലെ പ്രൊ-5-6835/2009-ലെ ലേലനിബന്ധനകൾക്ക് വിധേയമായി താൽപ്പര്യമുള്ള കരാറുകാരിൽ നിന്നും താഴെ പട്ടികയിൽ വിവരിക്കുന്ന തൃശ്ശൂർ വനം ഡിവിഷനിലെ പരിധിയിൽ വരുന്ന മച്ചാട് റെയ്ഞ്ചിലെ 2007 ചേപ്പിലക്കോട് പൾപ്പ് വുഡ് തോട്ടത്തിൽ നിന്നും പലകത്തടം മാഞ്ചിയം തോട്ടത്തിൽ നിന്നും വടക്കാഞ്ചേരി റെയ്ഞ്ചിലെ 2002 ചെമ്പിക്കുന്ന് പൾപ്പ് വുഡ് തോട്ടത്തിൽ നിന്നും എച്ച്.എൻ.എൽ. കമ്പനി മരങ്ങൾ മുറിച്ചുമാറ്റിയതിനു ശേഷം അവശേഷിക്കുന്ന താഴെ പറയുന്ന ലിസ്റ്റിൽ ഉൾപ്പെട്ട പലജാതി മരങ്ങളും വണ്ണം കുറവുമൂലം ലിസ്റ്റിലുൾപ്പെടുത്താത്ത സോഫ്റ്റ് വുഡ് ഇനത്തിൽപ്പെട്ട മരങ്ങളും ഉദ്യോഗസ്ഥരുടെ നിർദ്ദേശമനുസരിച്ച് മുറിച്ചുകൊ≠ുപോകുന്നതിന് ഇ-ടെ≠ർ മുഖേന ദർഘാസ് ക്ഷണിക്കുന്നു. എന്നാൽ തേക്ക്, ഈട്ടി, ഇരുൾ, ചന്ദനം മുതലായ മറ്റു ഘനമരങ്ങൾ മുറിക്കുവാൻ പാടുള്ളതല്ല. ദർഘാസുകാർ വനം വകുപ്പിൽ നിലവിലുള്ളതും സർക്കാർ ഭാവിയിൽ പ്രാബല്യത്തിൽ കൊ≠ുവരുന്നതുമായ എല്ലാ നിബന്ധനകളും ഇതരവ്യവസ്ഥകളും പാലിക്കാൻ ബാദ്ധ്യസ്ഥരാണ്. ദർഘാസ് പ്രമാണങ്ങളും ദർഘാസ് ഷെഡ്യൂളുകളും www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ ലഭ്യമാണ്. ദർഘാസിനോടൊപ്പം സമർപ്പിക്കുന്നതിനുള്ള നിരതദ്രവ്യം, ദർഘാസ് പ്രമാണവില എന്നിവ SBT-യുടെ Internet Online Banking വഴിയോ, മറ്റ് ബാങ്കുകളുടെ കാര്യത്തിൽ NEFT വഴിയോ ഓൺലൈൻ ടെ≠റിനൊപ്പം സമർപ്പിക്കേ≠താണ്. ദർഘാസുകൾ സമർപ്പിക്കുവാൻ www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റ് ഉപയോഗിക്കേ≠താകുന്നു.

എല്ലാ ടെ≠ർ പ്രമാണങ്ങളും www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ കാണിച്ചിരിക്കുന്ന ഓൺലൈൻ കവറുകളിൽ ഓൺലൈനായി മാത്രം സമർപ്പിക്കേ≠താണ്. ദർഘാസുകൾ www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിലൂടെ ഓൺലൈനായി മാത്രമേ സ്വീകരിക്കുകയുള്ളൂ. നേരിട്ടോ തപാൽമാർഗ്ഗമോ ലഭിക്കുന്ന ദർഘാസുകൾ ഒരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല. നിശ്ചിത സമയപരിധിക്കുശേഷം ലഭിക്കുന്ന ടെ≠റുകൾ സ്വീകരിക്കുന്നതല്ല.

ഓൺലൈൻ ടെ≠റിനോടൊപ്പം ` 150-ന്റെ കേരള സർക്കാരിന്റെ മുദ്രപ്പത്രത്തിൽ തയ്യാറാക്കി ഒപ്പിട്ട പ്രിലിമിനറി എഗ്രിമെന്റ ്, സ്കാൻ ചെയ്ത കോപ്പി ഓൺലൈനായി സമർപ്പിക്കാത്തതും അവയുടെ ഒറിജിനൽ തുറക്കുന്നതിന് മുൻപ് സമർപ്പിക്കാത്തതുമായ ദർഘാസുകൾ നിരസിക്കപ്പെടുന്നതാണ്. ഈ ടെ≠റുമായി ബന്ധപ്പെട്ട മറ്റു വിവരങ്ങൾ എൻ. എെ. സി.-യിൽ നിന്നോ www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ പറഞ്ഞിരിക്കുന്ന Help desk-ൽ നിന്നോ ഈ ഓഫീസിൽ നിന്നോ ഓഫീസ് സമയത്ത് അറിയാവുന്നതാണ്. ഇ-പേമെന്റിന് ആവശ്യമായ വിവരങ്ങൾ (കരാറുകാരൻ ഇടപാടു നടത്തുന്ന കോർ ബാങ്കിംഗ് സൗകര്യമുള്ള ബാങ്ക് അക്കൗ≠ിന്റെ വിശദവിവരങ്ങളും ഇ-മെയിൽ അഡ്രസും) ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. ഈ വിവരങ്ങൾ ഉൾപ്പെടുത്താത്ത ദർഘാസുകൾ നിരസിക്കപ്പെടുന്നതാണ്. ടെക്നിക്കൽ ബിഡും ഫിനാൻഷ്യൽ ബിഡും അതിനായി പറഞ്ഞിരിക്കുന്ന അതാത് കവറുകളിൽ മാത്രം സമർപ്പിക്കേ≠താണ്. കരാറുകാർ വിവരങ്ങൾ അപ്ലോഡ് ചെയ്യുന്നതിലും മറ്റും ഉ≠ാകുന്ന അസൗകര്യങ്ങൾക്കും നഷ്ടത്തിനും വനം വകുപ്പ് ഉത്തരവാദി ആയിരിക്കുന്നതല്ല.

ഇ-ലേലത്തിൽ പങ്കെടുക്കുന്നവർ ലേലത്തിനുമുമ്പുതന്നെ മരങ്ങളുടെ നൽപ്പ്, നിൽപ്പ് എന്നിവ പരിശോധിച്ച് ബോധ്യ പ്പെടേ≠തും ലേലവ്യവസ്ഥകൾ വായിച്ചുനോക്കി ബോധ്യപ്പെടേ≠തുമാണ്. ലേലത്തിനുശേഷം ഇതു സംബന്ധിച്ച പരാതികളൊന്നും സ്വീകരിക്കുന്നതല്ല.

വിജയി ആകുന്ന ദർഘാസുകാരൻ ദർഘാസ് തുകയുടെ 35% (മുപ്പത്തിയഞ്ച് ശതമാനം) തുക ലേലദിവസം അടയ്ക്കേ≠തും അന്നുതന്നെ ` 150 വിലയുള്ള മുദ്രപത്രത്തിൽ പ്രിലിമിനറി എഗ്രിമെന്റ ിൽ ഒപ്പുവയ്ക്കേ≠തുമാണ്. ലേലം സ്ഥിരീകരിച്ച് ഉത്തരവായി 5 ദിവസത്തിനകം വേ≠തായ സെക്യൂരിറ്റി തുക അടച്ച് അന്തിമ കരാർ ഒപ്പു വയ്ക്കേ≠തും അന്നുതന്നെ ബാക്കിവരുന്ന മുഴുവൻ ലേല സംഖ്യയും നികുതികളും ഉൾപ്പെടെ സർക്കാരിലേക്ക് അടയ്ക്കേ≠തുമാണ്. അതിനുശേഷം മാത്രമേ ലേലക്കാരന് മരങ്ങൾ മുറിക്കുന്നതിന് ലൈസൻസ് നൽകുകയുള്ളു.

ദർഘാസിനായി പരസ്യപ്പെടുത്തിയ തീയതി ഏതെങ്കിലും കാരണത്താൽ അവധിയാവുകയാണെങ്കിൽ തൊട്ടടുത്ത പ്രവൃത്തിദിവസം അതേ സ്ഥലത്തും, സമയത്തും ദർഘാസ് നടത്തുന്നതായിരിക്കും. ദർഘാസിനെ സംബന്ധിച്ച വിവരങ്ങൾ ചുവടെ പട്ടികയിൽ വിവരിക്കുന്നു:

1. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പ് നിൽപ്പ് ക≠് ബോധ്യപ്പെടേ≠തും അവ സംബന്ധിച്ച യാതൊരു പരാതികളും ലേലത്തിന് ശേഷം പരിഗണിക്കുന്നതുമല്ല.

2. കൂടുതൽ തുകയ്ക്ക് ദർഘാസ്/ലേലം കൊളളുന്ന ആൾ മൊത്തം ലേലത്തുകയുടെ 35% തുക ലേലം കഴിഞ്ഞാലുടൻ ഒടുക്കേ≠താണ്. ടി 35 ശതമാനം തുക ` 1,00,000-ൽ കൂടുതലാണെങ്കിൽ ` 1,00,000 ലേല ദിവസം തന്നെ ഒടുക്കേ≠തും ബാക്കി തുക 7 പ്രവൃത്തി ദിവസത്തിനകം ഈ ഓഫീസിൽ നിന്നും നൽകുന്ന മേലൊപ്പിട്ട ചെലാൻ മുഖാന്തിരം പുനലൂർ സബ് ട്രഷറിയിൽ ഒടുക്കി രസീത് ഹാജരാക്കേ≠തുമാണ്. ടി തുക ഒടുക്കുന്നതിന് വീഴ്ചവരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുളള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും സർക്കാരിലേക്ക് ഈടാക്കേ≠ ബാക്കി തുക വിവിധ ചെലവുകളും ഉൾപ്പെടെ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ നി›യിക്കുന്ന തുക നഷ്ടം വരുത്തിയ ദർഘാസ്/ലേലക്കാരനിൽ നിന്നും റവന്യുറിക്കവറി ഉൾപ്പെടെയുള്ള നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.

3. ദർഘാസ്/ലേലംകൊളളുന്ന ആൾക്ക് പ്രസ്തുത കൂപ്പിൽ എന്യൂമറേറ്റ് ചെയ്തു നിർത്തിയിരിക്കുന്ന മരങ്ങൾക്കും അതേ സോഫ്റ്റ് വുഡ് ഇനങ്ങളുടെ വണ്ണം ക ു റ ഞ്ഞ തും ലിസ്റ്റിൽ ഉൾപ്പെടുത്താത്തതുമായ സോഫ്റ്റ് വുഡ് മരങ്ങൾക്കും മാത്രം അവകാശമുള്ളതും തേക്ക്, ഈട്ടി, ചന്ദനം, ഇരുൾ തുടങ്ങിയ ഘനമരങ്ങൾക്ക് അവകാശമില്ലാത്തതുമാകുന്നു.

4. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ നിലവിലുള്ള നിരക്കിൽ മൂല്യവർദ്ധിത നികുതി, വനവികസന നികുതി, വരുമാന നികുതി എന്നിവയും ഒടുക്കേ≠താണ്.

5. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊളളുന്ന ആൾ ` 150 വിലയുള്ള മുദ്രപ്പത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടികൂടി ലേലം കഴിഞ്ഞാലുടൻ ഒപ്പ് വയ്ക്കേ≠താണ്.

6. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 7 ദിവസത്തിനകം ബാക്കി തുകയും മൊത്തം തുകയുടെ 5 ശതമാനം ഫോറസ്റ്റ് ഡവലപ്പ്മെന്റ ് ടാക്സും, നിലവിലുളള നിരക്കിൽ വില്പന നികുതി, ഇൻകം ടാക്സ് എന്നിവകളും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10 ശതമാനം സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 150 വിലയുള്ള മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 7 ദിവസത്തിനുളളിൽ ടി തുകകൾ ഒടുക്കേ≠താണ്.

7. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 21 ദിവസമാണ്. സാധാരണഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടിക്കൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും തൃശ്ശൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ, മുറിക്കാൻ ബാക്കിയുള്ള ഭാഗത്തിന് ഹെക്ടറിന് ` 1,000 വീതം പിഴ ഈടാക്കി ഏഴ് ദിവസം കാലാവധി നീട്ടിക്കൊടുക്കുന്നതാണ്.

ഇപ്രകാരം നീട്ടിനൽകുന്ന തീയതിക്കുള്ളിലും നീക്കംചെയ്യാതെകിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ചെയ്തുതീർക്കുവാനുള്ള ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിക്കുന്നതും ആയതിൽവച്ചു≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

8. തൃശ്ശൂർ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ മച്ചാട്/വടക്കാഞ്ചേരി റെയിഞ്ചാഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ കൂപ്പിൽ പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

9. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാസമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

10. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും, തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്താൻപാടില്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.

11. കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് തിരിച്ചുനൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽനിന്നും ഈടാക്കുന്നതാണ്.

12. സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതു നിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.

Separate online tenders are invited from contractors in pursuance of Kerala Gazette No. 50 dated 22-12-2009 Vol. 54 Page No. 669 to 675, auction conditions vide Pro (5) 6835/2009 dated 2-12-2009 of CCF (Protection) for outright sale of trees standing in the plantations mentioned in the schedule below including softwood trees not included in the list due to lower girth. However trees like Teak, Rosewood, Sandal, Irul and other hardwood trees should not be felled. The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender. Tender documents and schedules are available in the website : www.etenders.kerala.gov.in. The Earnest Money Deposit and tender cost for the tender should be submitted through the Internet online banking of SBT or through NEFT for other Banks. For submission of tenders visit the website. www.etenders.kerala.gov.in.

All bid/tender documents are to be submitted online only and in the designated online cover(s)/envelope(s) on the www.etenders.kerala.gov.in website and tenders submitted manually/through post will not be entertained. Late tenders will not be accepted.

Online tenders/bids are to be accompanied with a preliminary agreement executed in Kerala Stamp Paper worth ` 150. Tenders/bids received online without the scanned copies of relevant documents, preliminary agreement will not be considered and shall be summarily rejected. Any further clarification on this tender can be obtained from NIC/the e-tender Helpdesk number available in the www.etenders.kerala.gov.in website and from the Office of the Divisional Forest Officer, Chalakkudy during the office hours. The details regarding e-payment (Bidder's Bank Account No. where he/she is having core banking facility and email ID) should be submitted along with the tender. Tenders without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective designated online covers.

The Forest Department will not be responsible for any inconvenience or loss to the Bidder while uploading/ downloading the bid.

Intending tenderers/bidders may inspect the trees and satisfy themselves of the quantity and quality of the produce and also satisfy the conditions of e-auction before participating in the e-auction. Complaints if any regarding quantity and quality etc. after the e-auction will not be entertained.

No. 13/2016/DTP (Forest). 63129th MARCH 2016] FOREST DEPARTMENT 316 The successful tenderers/bidders have to remit 35% of sale value on the tender/auction date and also execute a preliminary agreement in a stamp paper worth ` 150. The successful tenderers/bidders should execute within 5 days of confirmation orders a bounded agreement on a stamp paper worth ` 150. After the completion of e-auction and remit balance sale value, Forest Development Tax, VAT and income tax at rate in force and security deposit of 10% for the total sale value. Licence will be isssued to the successful bidder only after satisfying these conditions. If the notified date of tender happens to be a holiday, the tender will be conducted on the very next working day at same place and time.

Details of tender are furnished below in the schedule.

1. Intending Tenderers/bidders may inspect the trees and staisfy themselves of the quantity and quality of the produce before participating in the Tender/Auction. Complaints if any regarding quality and quantity etc. received after the Tender/Auction will not be entertained.

2. The successful Tenderers/Bidders have to remit 35% sale value on the Tender/Auction date. If this 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on auction date itself and balance value have to be remitted in the Sub Treasury, Punalur within 7 working days through the countersigned chalan issued from this office and the receipted chalan submitted to this office. If he fails to remit this amount, the EMD will be forfeited to Government and the amount due to Government by way of auction sale in original tender/auction together with all incidential expenditure including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/ Bidders through legal means including Revenue Recovery Act in force.

3. The participating Tenderers/Bidders have rights only for collection and removal of enumerated standing softwood trees and the Soft Wood trees of lower girth not enumerated and has no right for removing trees like Teak, Rose Wood, Sandal, Irul etc.

4. The successful Tenderers/Bidders have to pay VAT, FDT, Income Tax, etc. at the rate prevailing from time to time.

5. The successful Tenderers/Bidders should execute a bounded agreement on a stamp paper worth ` 150 after the completion of the Tender/Auction.

6. The confirmation of the Tender/Auction sale will ordinarily be communicated to the party concerned as early as possible. Within 7 days from the date of intimation of the confirmation the successful Tenderers/Bidders shall remit 1/3 of the balance sale value and 5% Forest Development Tax, VAT and Income Tax at the rate in force and security deposit of 10% for the total sale value. The successful Tenderers/Bidders should execute an agreement on a stamp paper worth ` 150.

7. The period of contract will be 21 days from the date of intimation of confirmation. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer, Thrissur may grant extension of time for 7 days on realization of penalty of ` 1,000 (One thousand only)/Ha. of unfelled area.

If the tenderers/bidders fail to remove the entire produce within the extended period, the whole timber and firewood collected by the tenders as per the agreement will be forfeited to Government and the Tenderers/Bidders shall not have any right on the produce confiscated to Government.

In the above circumstances the balance work to be executed by the Tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the Tenderers/Bidders.

8. The Contractor/his agent shall enter the coupe only after getting the written permission from the Divisional Forest Officer, Thrissur/Forest Range Officer, Machad/Wadakkanchery.

9. The contractor shall at all time during the currency of the contract, keep the coupe boundaries cleared to a width of 2 metres and keep the cairns intact.

10. The contractor will be liable for any damage or loss caused to other trees in the plantation or reserve.

11. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of VAT, Income Tax, etc. If there is any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.

12. All common conditions regarding sale coupe are also applicable to this E-Tender/E-Auction.

The quantities mentioned in the above table are approximate and on actual execution the quantities may vary.

Since the quantity is approximate there may be variation in the quanty of timber. The tenderer is bound to cut and remove the entire trees marked in the plantation as per the direction of the Departmental Staff. Undersigned reserves all rights for cancelling any work at any time without further intimation. All the prevailing conditions are applicable for this tender also.
