In exercise of the powers conferred by Section 3(1)(zb) of Food Safety and Standards Act, 2006 (Central Act 34 of 2006) and in supersession of the notified order read above, "the geographical area" of the Assembly Constituency existing in the State of Kerala is notified as local area for the purpose of the Act as given in the schedule.
The order read as above stands cancelled.

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.)
Section 3(1)(zb) of Food Safety and Standards Act 2006 define local area as any area whether urban or rural notified by the Commissioner of Food Safety to be a local area for the purpose of the Act. The Commissioner of Food Safety has notified the Panchayath, Municipality, and Corporation Wards as local area as required by the Act in the Kerala Gazette Part IV dated 4-2-2014. Due to re-arrangements of Wards under Local bodies many Wards were added or excluded from the existing Panchayaths, Municipalities and Corporations. This requires re-arrangements of the existing circles.
As per Government Order G. O. (Ms.) No. 29/2016/H&FWD dated 2-2-2016, Government has already formed Food Safety Circle Offices Constituency wise. The area of a circle is the geographical area of the existing Assembly Constituency of the State and Food Safety Officers are to be posted in such Circles. The names of the Circles are as listed in the schedule.
These re-arrangements are intended to achieve the above objectives.

NOTIFICATION
The "local area" of each Food Safety Circle of the State was notified vide read as above.
In exercise of the powers conferred by Section 3(1)(zb) of Food Safety and Standards Act 2006 (Central Act 34 of 2006) the districts given in the schedule is notified as the jurisdiction of the Analytical Labs for the purpose of the Act. This notification comes into effect from 1st day of June 2016.

Section 3(1)(zb) of Food Safety and Standards 2006 define local area as any area whether urban or rural notified by the Commissioner of Food Safety to be a local area for the purpose of the Act. The Commissioner of Food Safety has notified the local area as required by the Act in the Kerala Gazette Part IV dated 4-2-2014. Local areas of Food Safety Circle Offices has also been re-arranged due to formation new Food Safety Circle Offices. Consequently jurisdiction under three Analytical Labs (Food Testing Labs) under this State has also become uneven and also leading to variation in number of samples analyzed and thereby work load of each Lab. To ensure uniform statutory work allocation in all Analytical Labs, the areas under each Analytical Labs is fixed.
The area of an Analytical Lab is as listed in the Schedule.
The above areas will be applicable to samples lifted by notified Food Safety Officers/Health Inspectors under Thiruvananthapuram and Palakkad Railway Division under Southern Railway also. It is intended to carry out functions as notified according to Regulation 2.2.2(1) of Food Safety and Standards Regulations 2011(Laboratory and Sample Analysis).
This notification is intended to achieve the above objectives.
