No. P-540/2019. 9th October 2019.
Whereas the M/s. United India Insurance Company Limited has deposited with this Court a sum of ` 11,69,069 (Rupees Eleven lakhs sixty nine thousand and sixty nine only) as compensation to be distributed to the dependents of the deceased Sri Rishad who met with a fatal accident while employed under M/s. RDS Projects Ltd. and where as the Assistant Labour Officer, Chirayinkeezhu reported that,
1. Sri Abdul Rasheed, Konathu Rishad Manzil, Puthukurichi P. O., Kadinamkulam––Father 2. Smt.Assoora Beevi, Konathu Rishad Manzil, Puthukurichi P. O., Kadinamkulam––Mother 3. Smt. Ancy Latheef, Theruvil, Kuzhivilakam, Perumathurai P. O., Perumathurai––Wife
4. Kumari Aisha Rishad, Theruvil, Kuzhivilakam, 15 days of the publication of this notice in the Kerala Government Gazette prefer their claim in writing before me and prove the same. If no such claims are received within the prescribed time the entire amount of compensation will be disbursed to the persons mentioned above. Claims preferred thereafter will not be considered.

Whereas, the Oriental Insurance Company Limited has deposited with this Court an amount of ` 8,82,386 (Rupees Eight Lakh Eighty two Thousand Three Hundred and Eighty six only) towards compensation payable to the dependents of the deceased Vipinesh who met with fatal accident in the course of work while he was working as a driver in a Autoriksha bearing Registration No. KL-58P-7685 on 12-11-2017. The Assistant Labour Officer, Thalassery 1st Circle has reported that (1) Bhaskaran (Father), (2) Ramani Puthussery (Mother) Ushas, 6/204, Andalur, Dharmadam, Palayad-670 661 are his only dependents as defined under Section 2(1) (d) of the Employees' Compensation Act, 1923 any other claiming to If no such claims are received within the prescribed time the entire amount of compensation will be disbursed to the person mentioned above and Claims preferred thereafter will not to be considered.
12-11-2017-ാം തീയതി, KL-58P-7685 നമ്പർ ഓട്ടോറിക്ഷയിൽ ഡ്രൈവറായി ജോലി ചെയ്യവെ ഉ≠ായ അപകടത്തിൽ മരണപ്പെട്ട വിപിനേഷ് എന്ന തൊഴിലാളിയുടെ ആശ്രിതർക്ക് തൊഴിലാളി നഷ്ടപരിഹാരം നൽകുന്നതിനായി ` 8,82,386 (എട്ട് ലക്ഷത്തി എൺപത്തിര≠ായിരത്തി മുന്നൂറ്റി എൺപത്തിയാറ് രൂപ മാത്രം) ഈ കോടതിയിൽ കെട്ടിവെച്ചിട്ടു≠്. തൊഴിലാളി നഷ്ട പരിഹാര ആക്ടിലെ 2(1) ഡി വകുപ്പ് അനുസരിച്ച് നിർവചിച്ച പ്രകാരം ടിയാന്റെ ആശ്രിതരായി (1) ഭാസ്ക്കരൻ (പിതാവ്), (2) രമണി പുതുശ്ശേരി (മാതാവ്) ഉഷസ്സ് 6/204, അ≠ല്ലൂർ, ധർമ്മടം, പാലയാട് പി. ഒ., കണ്ണൂർ എന്നിവർ മാത്രമേ ഉള്ളൂ വെന്ന് തലശ്ശേരി ഒന്നാം സർക്കിൾ അസിസ്റ്റന്റ ് ലേബർ ഓഫീസർ റിപ്പോർട്ട് ചെയ്തിരിക്കുന്നു. അപ്രകാരമുള്ള ആശ്രിത രാണെന്ന് അവകാശപ്പെടുന്ന മറ്റ് ആരെങ്കിലും ഉ≠െങ്കിൽ അവർക്കുള്ള അവകാശം, ഈ നോട്ടീസ് കേരള ഗവൺമെന്റ ് ഗസറ്റിൽ പരസ്യപ്പെടുത്തി 15 ദിവസത്തിനകം എന്റെ മുമ്പാകെ എഴുതി സമർപ്പിക്കേ≠തും, ആയത് തെളിയിക്കേ≠തുമാണ്.
നിർദ്ദിഷ്ട സമയത്തിനകം യാതൊരു അവകാശവാദവും ലഭിച്ചില്ലെങ്കിൽ നഷ്ടപരിഹാര തുക മുഴുവനും മേൽപ്പറഞ്ഞ വ്യ‡ികൾക്ക് വിതരണം ചെയ്യുന്നതാണ്. അതിനുശേഷം സമർപ്പിക്കുന്ന അവകാശ വാദങ്ങൾ പരിഗണിക്കുന്നതല്ല.
