Sub:— Excise Establishment—CA 7849/2009 filed by Sri K. R. Babu—Re-fixation of seniority of Sri T. Raju, Circle Inspector of Excise in the cadre of Excise Inspector & Circle Inspector of Excise—Orders issued—reg.

Read:—(1) Judgment dated 21-9-2017 of the Hon'ble Supreme Court in CA Nos. 7849/2009 & 7913/2009.

(3) Representation of Sri T. Raju, Asst. Excise Commissioner dated 7-12-2017.

(4) Order No. XD2-23502/2010 dated 23-5-2011.

(5) Order No. XD3-4525/2002 dated 5-10-2002.

As per Government Order read as 2nd paper above Government have re-fixed the seniotiry of Sri T. Raju in the cadre Excise Inspector with effect from 1-4-1999, and promoted to the post of Asst. Excise Commissioner on the basis of Gaz. No. 48/2019/DTP (Commissionerate of Excise). 41 3rd DEC. 2019] COMMISSIONERATE OF EXCISE 32 the Judgment of the Hon'ble Supreme Court vide order read as lst paper above.

Now Sri T. Raju, Asst. Excise Commissioner, KSBC Ware House, Kottarakara has submitted a representation read as 3rd above for re-fixing his seniority in the cadre of Circle Inspector of Excise in accordance with the refixation of Seniority in the cadre of Excise Inspector.

After examining the matter in detail, the seniority of Sri T. Raju in the cadre of Excise Inspector is re-fixed in between S/Sri C. K. Kunjabdullah and K. P. Hamsa as Sl. No. 289A with date of assignment as 1-4-1999, in the seniority list of Excise Inspector for the period from 2-2-1993 to 30-6-2001. As such his seniority in the cadre of Circle Inspector of Excise is re-fixed in between S/Sri Suresh Kumar, K. N. and Govind Naik as S1. No. 45 A with date of assignment as 1-11-2006 in the seniority list of Circle Inspector for the period from 1-6-2004 to 31-12-2008. The final seniority list of Excise Inspector and Excise Circle Inspector published vide orders 4th and 5th above stands modified to this extent.
