വിഷയം:—ഭൂമിയുടെ ന്യായവില നിർണ്ണയം—ന്യായവില രജിസ്റ്ററിൽ ഉൾപ്പെടുത്താതെപോയ ഭൂമിയ്ക്ക് വില നി›യിക്കുന്നത്—
സംബന്ധിച്ച്.
സൂചന:—(1) കേരള സ്റ്റാമ്പ് ആക്ട്, 1959 സെക്ഷൻ 28എ (fixation of fair value of land) ചട്ടം 3(7), ചട്ടം (4). (2) ശ്രീ. വി. ജെ. എബ്രഹാം, വരിക്കോലിൽ, മണിയാർ വടശ്ശേരിക്കര വില്ലേജ് സമർപ്പിച്ച അപേക്ഷ.
(3) റാന്നി തഹശീൽദാരുടെ 20-7-2017-ലെ എച്ച് 1/7567/19-ാം നമ്പർ റിപ്പോർട്ട്.
(4) ജില്ലാ കളക്ടർ, പത്തനംതിട്ടയുടെ 28-9-2019-ലെ സി11-220994/19 നമ്പർ കത്ത്.

2010 മാർച്ച് മാസം 6-ാം തീയതിയിലെ അസാധാരണ ഗസറ്റ് വി⁄ാപന പ്രകാരം നിലവിൽവന്ന ന്യായവില രജിസ്റ്ററിൽ ഉൾപ്പെടുത്താതെപോയ താഴെപ്പറയുന്ന സർവ്വെ നമ്പരിൽപ്പെട്ട വസ്തുക്കൾക്ക് സൂചന റിപ്പോർട്ടിന്റെ അടിസ്ഥാനത്തിൽ കേരള സ്റ്റാമ്പ് ആക്ട് സെക്ഷൻ 28എ പ്രകാരം ന്യായവില നിർണ്ണയിച്ച് ഇതിനാൽ ഉത്തരവാകുന്നു.

വിഷയം:—കേരള മുദ്രപ്പത്ര നിയമം 1959—സെക്ഷൻ 28എ ഭൂമിയുടെ ന്യായവില നിർണ്ണയിച്ചുകൊ≠ുള്ള ഉത്തരവ് പുറപ്പെടുവിക്കുന്നത്—സംബന്ധിച്ച്.

കാസർഗോഡ് താലൂക്കിൽ ബേള വില്ലേജിൽ 472/1 ബി-ൽപ്പെട്ട ഭൂമിക്ക് ന്യായവില രജിസ്റ്റർ പ്രകാരം ന്യായവില നിർണ്ണയിച്ചിട്ടില്ലായെന്ന് കാണിച്ച് സൂചന (2) പ്രകാരം ശ്രീമതി തസ്രിയ സമർപ്പിച്ച അപേക്ഷയിൽ സൂചന (3) പ്രകാരം കാസർഗോഡ് തഹസിൽദാരുടെ സൂചന (4) പ്രകാരം ഈ ഓഫീസിലെ 'ബി' വിഭാഗം ജൂനിയർ സൂപ്ര≠ും റിപ്പോർട്ട് സമർപ്പിച്ചിട്ടുള്ളതാണ്.
4ബദിയടുക്ക സബ് രജിസ്ട്രാർ ഓഫീസിലെ 2280/12-ാം നം. ആധാരപ്രകാരം ഫൗസിയ d/o ഇബഹിം ഹിദായത്ത് നഗർ എന്നിവർ പേർക്ക് സിദ്ധിച്ച ബേള വില്ലേജ്, 472/1 ബി-ൽപ്പെട്ട 20.23 ആർ ഭൂമി കല്ലക്കട്ട്-കൊല്ലംകാന റോഡിൽ നിന്നും ബംബാ നഗറിൽ ഉദ്ദേശം 500 മീറ്റർ വടക്ക് മാറിയും ടി. എസ്., റോഡ് തെക്ക് മാറിയും സ്ഥിതി ചെയ്യുന്നു. വില്ലേജ് അടങ്കൽ പ്രകാരം ടി വസ്തു "പുഞ്ച" എന്ന വിഭാഗത്തിൽപ്പെടുന്നതും സ്വകാര്യറോഡ് സൗകര്യമുള്ള താമസസ്ഥലമായും കാണപ്പെടുന്നു. ഫെയർവാല്യു രജിസ്റ്ററിൽ ടി സർവ്വേ നമ്പറിൽപ്പെട്ട വസ്തുവിന്റെ ഫെയർവാല്യൂ രേഖപ്പെടുത്താത്തതിനാൽ തൊട്ടടുത്ത സർവ്വേ നമ്പറിൽപ്പെട്ട അപേക്ഷ വസ്തുവിന് സമവും സമസ്ഥിതവുമായ സർവ്വേ നമ്പർ 471/2-ൽപ്പെട്ട "Residential Plot with Private Road Access"-ന്റെ ന്യായവിലയായ ` 4,000 നിരക്കിൽ ഫെയർവാല്യു നി›യിക്കാവുന്നതാണെന്ന് റിപ്പോർട്ട് സമർപ്പിച്ചിട്ടു≠്.
മേൽ സാഹചര്യത്തിൽ ബേള വില്ലേജിൽ റീ സർവ്വെ നമ്പർ 472/1 ബി-ൽപ്പെട്ട ഭൂമി "Residential Plot with Private Road Access" എന്ന വിഭാഗത്തിൽ ഉൾപ്പെടുത്തി ആർ ഒന്നിന് ` 4,000 (നാലായിരം രൂപ മാത്രം) നിരക്കിൽ ന്യായവില നി›യിച്ചുകൊ≠് ഇതിനാൽ ഉത്തരവാകുന്നു.
സർക്കാർ ഉത്തരവുകളായ (1) (പി) നമ്പർ 188/2014/റ്റി. ഡി. തീയതി 14-11-2014 (2) (പി) നം. 43/2018/റ്റി. ഡി. തീയതി 31-8-2018-(3) (പി) നം. 73/19/റ്റി.ഡി. തീയതി 30-4-2019 എന്നിവ പ്രകാരമുള്ള വർദ്ധനവുകൂടി നിലവിലെ ന്യായവിലയ്ക്കു പുറമെ കണക്കാക്കുന്നതാണ്.
