Conditions

1. Bidders shall remit the e-tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of India or through NEFT for other Banks. Bidders opting for NEFT facility of online payment are advised to exercise this option at least 48 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e-procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction is not a payment confirmation. Kerala Forest Department/NIC/SBI shall not be responsible for any kind of delay in payment status confirmation.

2. Bidders are requested to submit scanned copy of the following documents—Registration certificate duly attested by the Superintending Engineer/Executive Engineer, PWD Kerala, GST Registration Certificate, PAN, Bank details, EMD exemption certificate (if any), preliminary agreement executed in Kerala Stamp Paper worth ` 200, duly filled up proforma for availing e-payment by Online. Technical bid and financial bid shall be submitted in their respective designated online covers. Subsequently the hard copy of attested copy of Registration Certificate, EMD exemption certificate (if any), preliminary agreement in original, proof of prequalification etc. would be submitted offline in a sealed cover superscribing the name of work and tender number to the office of the Divisional Forest Officer, Punalur through Speed Post/Registered Post as prescribed in the time schedule, failing which such tenders will be rejected.

3. The bidding authority deserves the right to modify/cancel any/all bids without assigning any reason. The Forest Department will not be responsible for any error like missing of scheduled data while downloading by the bidder and non receipt of documents.

4. Any further clarifications on this e-tender can be obtained from NIC/the e-tender Helpdesk number available in the www.etenders.kerala.gov.in website and from this office during the office hours. The details regarding e-payment (Bidder's Bank account number where he/she is having core banking facility and email ID) should be submitted along with the tender. Tenders without these details will not be accepted.

5. The Forest Department will not be responsible for any inconveniences or loss to the Bidder while uploading/ downloading the bid.

6. The tender/bids shall be opened online at the office of the Divisional Forest Office, Achencovil in the presence of 'bidders/their representatives who wish to attend at the above address. If the tender opening date happens to be on a holiday or non working day due to any other valid reason, the tender opening process will be done on the next working day at same time and place.

1. ഇ-ദർഘാസിനുശേഷം നടക്കുന്ന ലേലത്തിൽ പങ്കെടുക്കാൻ ആഗ്രഹിക്കുന്ന ഇത്തരം ജോലികൾ ചെയ്ത് പരിചയ സമ്പന്നരായ ജി.എസ്.റ്റി. രജിസ്ട്രേഷനുള്ള വ്യ‡ികൾ ഏതെങ്കിലും ദേശസാൽകൃത ബാങ്കിൽ നിന്നും എടുത്ത ` 25,000 (ഇരുപത്തയ്യായിരം)-ന്റെ ഡിമാന്റ ് ഡ്രാഫ്റ്റ് ലേലത്തിന് മുമ്പ് നിരതദ്രവ്യമായി ലേലപേപ്പറുകൾക്കൊപ്പം സമർപ്പിക്കേ≠താണ്.

ദർഘാസുകാർ പങ്കെടുക്കുന്നതിന് ഇ.എം.ഡി. ബാധകമല്ല.

2. വിജയിയാകുന്ന ഇ-ദർഘാസുകാരൻ/ലേലക്കാരൻ മൊത്തം ദർഘാസ്/ലേലത്തുകയുടെ 35% തുക, ` 1,00,000-ൽ കൂടുതലാണെങ്കിൽ ലേല ദിവസം കുറഞ്ഞത് ` 1,00,000 കെട്ടിവെയ്ക്കേ≠തും ബാക്കി തുക 7 പ്രവൃത്തി ദിവസത്തിനകം ഈ ഓഫീസിൽ നിന്നും നൽകുന്ന മേലൊപ്പ് വച്ച ചെലാൻ മുഖാന്തിരം കോട്ടയം ജില്ലാട്രഷറിയിൽ ഒടുക്കി രസീത് ഹാജരാക്കേ≠തുമാണ്. ടി തുക ഒടുക്കുന്നതിൽ വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി പ്രവൃത്തി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ലേലം ചെയ്യുന്നതും നിയമപ്രകാരമുള്ള നടപടി സ്വീകരിക്കുന്നതുമായിരിക്കും.

3. വിജയിക്കുന്ന ഇ-ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ ചരക്ക് സേവന നികുതി, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠താണ്.

4. ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ലേലം തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും നടത്തുന്നതായിരിക്കും.

5. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിനായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്തുത സ്ഥലത്ത് നിൽക്കുന്ന താഴെ പട്ടികയിൽ പറഞ്ഞിട്ടുള്ള മരങ്ങൾ നീക്കം ചെയ്യുന്നതിനുള്ള അവകാശത്തിന്് വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.

6. ഇ-ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുൻപായി ഉൽപ്പന്നങ്ങളുടെ നിൽപ്ക≠് ബോദ്ധ്യപ്പെടേ≠തും, ലേലത്തിനു ശേഷം അവ സംബന്ധിച്ച പരാതികൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതുമല്ല.

7. ലേലക്കാരൻ നേരിട്ട് ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

8. ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസർ സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റും നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.

9. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ഓഫീസർമാരുമായോ ഓഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസിനോടൊപ്പവും ലേല ദിവസം ലേലക്കാരൻ ലേലപേപ്പറുകൾക്കൊപ്പം ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ദർഘാസുകാരന്/ലേലക്കാരന് ടി ജോലിയുമായി ബന്ധപ്പെട്ട ഓഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ഇ-ദർഘാസ്/ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി പ്രവൃത്തി പുനർ ഇ-ദർഘാസ്/ലേലം ചെയ്യുന്നതായിരിക്കും.

10. ഇ-ദർഘാസ്/ലേല തീയതി മുതൽ 7 ദിവസങ്ങൾക്ക് ശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20%-ൽ കുറയാതെയുള്ള പോസ്റ്റ് ഓഫറുകൾ മാത്രമേ പരിഗണിക്കുകയുള്ളു. കൂടാതെ താഴെപ്പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമായിരിക്കും.

(എ) പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന ആൾ യഥാർ∞ ഇ-ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.

(ബി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റ് നികുതികളും ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുള്ളിൽ ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഒടുക്കി, ചെലാൻ രസീത്/ ബാങ്ക് രസീത് ഈ ഓഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പുമരങ്ങളുടെ ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം മാത്രം നി›ിത മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർ ലേലം നടത്തുന്നതാണ്. പുനർ ലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ലേലം സ്ഥിരപ്പെടുത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽ നിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുള്ള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ഇ-ദർഘാസ് നൽകുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുകയ്ക്ക് ആ വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

11. പുനർ ഇ-ദർഘാസ്/ലേലത്തിൽ ലഭിക്കുന്ന തുക ആദ്യ ഇ-ദർഘാസ്/ലേലത്തിൽ ലഭിച്ച തുകയേക്കാൾ കുറവായാൽ ടി നഷ്ടവും മറ്റു ചെലവുകളും ഉൾപ്പെടെ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ നി›യിക്കുന്ന തുകയും, നഷ്ടം വരുത്തിയ ഇ-ദർഘാസ്/ലേലക്കാരിൽ നിന്നും റവന്യൂ ഉൾപ്പടെയുള്ളവ നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.

12. ഇ-ദർഘാസ്/ലേലം കൊള്ളുന്നയാൾക്ക്, ഈ ഇ-ദർഘാസ്/ലേല പരസ്യത്തിന്റെ ആദ്യ ഖfiികയിൽ പറഞ്ഞിട്ടുള്ള സ്ഥലത്ത് നിൽക്കുന്നതും മാർക്ക് ചെയ്ത് നിർത്തിയിരിക്കുന്നതുമായ ഇനത്തിൽപ്പെട്ട മരങ്ങൾക്കും ഈ ഇനത്തിൽപ്പെട്ട വണ്ണം കുറഞ്ഞ തിനാൽ മാർക്ക് ചെയ്യാത്ത മരങ്ങൾക്കും മാത്രം അവകാശമുള്ളതാകുന്നു.

13. ഇ-ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ലേലം കഴിഞ്ഞാലുടൻ ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ഒപ്പ് വയ്ക്കേ≠താണ്.

14. ഇ-ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും, മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡെവലപ്പ്മെന്റ ് ടാക്സും, നിലവിലുള്ള നിരക്കിൽ ചരക്ക്സേവന നികുതി, ഇൻകം ടാക്സ് എന്നിവയും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും വച്ച് ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠തുമാണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുക ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുക ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും, 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ം പോലെ കോട്ടയം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് അനുവദിക്കാവുന്നതാണ്.

ഈ കാലാവധിയ്ക്കുള്ളിലും തുക ഒടുക്കാതെ വന്നാൽ കോട്ടയം ഹൈറേഞ്ച് സർക്കിൾ, ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 24% പലിശ നിരക്കിൽ 15 ദിവസത്തേയ്ക്കും വീ≠ും 48% പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

15. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 15% പലിശ നിരക്കിൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, ഹൈറേഞ്ച് സർക്കിൾ കോട്ടയത്തിന്റെ യു‡ം പോലെ 30 ദിവസത്തേക്കും, വീ≠ും 30 ദിവസത്തേക്ക് 48% പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെയും കാലാവധി നീട്ടികൊടുക്കാവുന്നതാണ്. എന്നാൽ നീട്ടികൊടുക്കുന്ന കാലാവധികളെല്ലാം തന്നെ കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും ബാക്കി മൂന്നിൽ ര≠ു തുകയിൽ ആദ്യ ഗഡു തുക അടച്ചാൽ മാത്രമേ കൂപ്പിൽ പ്രവേശിപ്പിക്കുകയുള്ളൂ. .

16. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 30 ദിവസമാണ്. സാധാരണ ഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടികൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കോട്ടയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ, ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, ഹൈറേഞ്ച് സർക്കിൾ, കോട്ടയം എന്നിവർ യഥാക്രമം ഓരോ മാസം വീതം താഴെ ചേർത്തിരിക്കുന്ന രീതിയിൽ പിഴ ഈടാക്കി ഓരോ പ്രാവശ്യവും കാലാവധി ദീർഘിപ്പിച്ചുകൊടുക്കുന്നതാണ്.

(എ) എന്യൂമറേറ്റ് ചെയ്തതും മുറിയ്ക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.

(ബി) മുറിച്ചിട്ട് നീക്കം ചെയ്യാത്ത-രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യു. മീറ്ററിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം.

(സി) നീക്കം ചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.

ഒന്നാമത്തെ മാസം ടി നിരക്കിലും 2-ാം മാസം ഇതിന്റെ ഇരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടി നൽകുന്ന തീയതിയ്ക്കുള്ളിലും നീക്കം ചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റ ിലേക്ക് മുതൽ കൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ാകുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ഉടമ്പടി പ്രകാരമുള്ള നി›ിത സമയപരിധിക്കുള്ളിലും മേൽ വിവരിച്ച രീതിയിലുള്ള ദീർഘിപ്പിച്ച് നൽകുന്ന കാലാവധിക്കുള്ളിലും ചെയ്തു തീർക്കാത്ത ജോലികൾ ഡിപ്പാർട്ട്മെന്റ ് ചെയ്യിപ്പിക്കുന്നതും ആയതിന് ഉ≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

17. ടി പ്രദേശത്ത് ശേഖരിച്ച് വയ്ക്കുന്ന തടികളും വിറകും നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

18. കോട്ടയം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടേയോ അയ്യപ്പൻകോവിൽ റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസറുടേയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ ടി പ്രദേശത്ത് പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

19. ഇ-ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

20. യാതൊരു കാരണവശാലും πാന്റേഷനിലെയോ റിസർവ്വിലെയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടുള്ളതല്ല. അങ്ങനെ ഉ≠ാകുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.

21. കൂപ്പിനു പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്ത് തടികളും മറ്റും സുക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിയ്ക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠് പോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് M³--ന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.

22. കൂപ്പിന് 0.50 കി. മീറ്റർ ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയാകുന്നതാണ്.

അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ ഉടമ്പടിക്കാരൻ വിവരം വനം വകുപ്പ് ഉദ്യോഗസ്ഥരെ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടുന്നതാണ്.

It is hereby notified for the information of the public that the right of collection and removal of marked and enumerated standing trees, left after the final felling of Teak trees in the 1951 Urumbikkara Teak Plantation under Erumely Range of this Division as specified in the schedule appended below will be sold in e-Tender/Auction by the Divisional Forest Officer, Kottayam or any other officer authorised by him in the Divisional Forest Office, Kottayam (situated at Kottayam) subject to the terms and conditions of the sale of Timber in Government Timber Depots published in Government Gazette No. 49, Vol. II dated 10-12-2013 vide Notification No. Pro. (5) 26274/12 dated 22-11-2013 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and as per General Conditions of the sale of tree growth prevailing in the Department. After these two tenders outright sale will be conducted by the Divisional Forest Officer, Kottayam. The Divisional Forest Officer, Kottayam for and on behalf of the Governor of Kerala invites separate online e-tenders from registered eligible contractors/bidders having a valid and active registration with Kerala Forest Department in pursuance of G. O. (Ms.) No. 26/2017/F&WLD dated 20-5-2017 for the execution of works noted in the schedule attached below. The tenderer is bound to comply with the terms and conditions in force, besides the conditions that will be framed by the Government in future in connection with this tender. Tender documents and tender schedules may be downloaded free of cost from the e-GP website www.etenders.kerala.gov.in. All bid/tender documents are to be submitted online only and in the designation online cover (s)/envelope(s) on the www.etenders.kerala.gov.in websites. Bids shall be accepted only through online mode www.etenders.kerala.gov.in website and tenders submitted manually/through post will not be entertained. Late online bids will not be accepted.

Probable Amount of Contract—` 44,90,350.

EMD—` 50,000.

Bidders shall remit the tender document fee and the Earnest Money Deposit using online payment option of e-procurement system only and submitted through the internet online banking of State Bank of India or through NEFT for other banks. Bidders opting for NEFT facility of online payment are advised to exercise this option at least 72 hours before the closing date of bid to ensure that payment towards tender document fees and EMD are credited and a confirmation is reflected in the e-procurement system. The online NEFT remittance form provided by e-procurement system for making a NEFT transaction is not a payment confirmation. Kerala Forest Department/NIC/SBI shall not be responsible for any kind of delay in payment status confirmation.

Conditions

1. Intending Bidders experienced in this field and having GST registration should deposit an Earnest Money Deposit of ` 25,000 (Twenty Five Thousand only), as Demand Draft drawn in favour of the Divisional Forest Officer, Kottayam from any Nationalised Bank for participating in the auction. EMD is not applicable for e-tenders.

2. The successful e-Tenders/Bidders have to remit 35% of the sale value on the date of tender/auction itself.

If this 35% value exceeds ` 1,00,000 (One Lakh only) ` 1,00,000 will be remitted on the auction date itself and balance value have to be remitted in the District Treasury, Kottayam (at Kottayam) within 7 working days through countersigned chalan issued from this office and the receipted chalan should be submitted to this office forthwith. If he fails to remit this amount, the EMD will be forfeited to Government and the area will be re-auctioned at his risk and loss and legal actions will be intiated.

3. The successful e-Tenderers/Bidders have to pay GST (as per Rule) FDT, Income Tax etc. at the rate prevailing from time to time.

4. If the notified date of auction happens to be a holiday, the auction will be conducted on the very next working day at the same place and time.

5. The tender/auction will be on lump-sum basis for the right of collection and removal of entire marked softwood species growth, except all hardwood species (including Teak, Anjili, Rosewood etc.), from the above area mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.

6. Intending e-tenderers/bidders may inspect the trees themselves of the quality and quantity of the produce before participating in the tender/auction. Complaints if any, regarding the quality and quantity etc. received after the tender/auction will not be entertained.

7. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid Power of Attorney is produced prior to commencement of tender/auction.

8. Intending e-tenderers/bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature along with Earnest Money Deposit.

9. The successful e-tenderers/bidders should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent Divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

10. No petition or post offer received after seven days of the date of conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is one lakh and above and more than 20% where the original bid amount is less than one lakh will ordinary be considered.

The post offers will comply with the following terms.

(a) Post offerer should remit double the amount paid by the successful tenderer/bidder on the Tender/ Auction date.

(b) The remittance should be made by the Chalan or Bank Deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.

The post offer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms, if the post offerer satisfies the conditions, a re-auction will be conducted after giving the usual publicity as per rules. In the re-auction the price fetched, does not come upto what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest bidder/ tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

11. If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting tenderers/bidders through legal means including Revenue Recovery Act in force.

12. The participating tenderers/bidders have rights only for the collection and removal of enumerated standing softwood trees and the softwood trees of lower girth not enumerated and has no right for removing trees like Teak, Rosewood, Sandal, Irul etc., if any.

13. The successful tenderers/bidders should execute a bounden agreement on a Stamp Paper worth ` 200 after completion of tender/auction.

14. The confirmation of the tender/auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful tenderers/bidders shall remit 1/3 rd of the balance sale value and 5% Forest Development Tax, GST (as per Rule) and Income Tax at the rate in force and security deposit of 10% for the total sale value. The successful tenderers/bidders should execute an agreement on a Stamp Paper worth ` 200. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period, further extension for 15 days by the Chief Conservator of Forests, High Range Circle, Kottayam and 15 days by the Addl. Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.

15. The balance 2/3rd sale value should be remitted in two equal instalments by the successful tenderers/bidders.

The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful tenderers/bidders fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by the Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests concerned and further extension for 30 days by the Addl. Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.

16. The period of contract will be 60 days from the date of intimation of confirmation. No extension of the period of contract shall normally be granted on any ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month each respectively on realization of penalty or penalties for completion of each work for each month mentioned below.

(a) For enumerated trees and balance unfelled per hectare or fraction thereof ` 750 per hectare.

(b) Unremoved registered logs and unregistered logs ` 100 per m³ or fraction thereof.

(c) Unremoved firewood ` 50 per Tonne or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first month shall be realized as per above rates, double the rate for the second month shall be realized. If the tenderer/bidder fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderer as per the agreement will be forfeited to government and the tenderer/bidder shall not have any right on the produce confiscated to government.

In the above circumstances, the balance work to be executed by the tenderer shall be completed departmentally and all the loss sustained to government in this regard shall be realized from the tenderer/bidder.

17. The licence for the removal of timber and firewood collected in the coupe should be issued only on the basis of the prevailing norms.

18. The contractor or his agent shall enter into the coupe only after getting the written permission from the Divisional Forest Officer, Kottayam or Range Forest Officer, Erumely.

19. The contractor shall at all time during the currency of the contract, keep the boundaries cleared to a width of 2 meters and keep the cairns intact.

20. The contractor will be liable for any damage or loss caused to other trees in the nearby plantations, if any or reserve.

21. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe, if requested by the contractor at his risk. But if the collected timber/firewood are not within the agreement period due to unforeseen situation or climate, a ground rent @ ` 250 per hectare will be recovered from the contractor.

22. The contractor will be liable for all the illegal activities occurred within 0.5 km perimeter of the above mentioned chainage. Any such activities noticed should be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

23. The security deposit will be refunded only after the successful completion of the contract after producing the Clearance Certificates of Sales Tax, Income Tax, Agricultural Income Tax etc. If there is any liabilities outstanding in this respect to the government, that will be adjusted from the security deposit of the contractor.

24. All common conditions regarding sale coupes are also applicable to this tender/auction. Further details can be had from the office of the undersigned or from the office of the Range Forest Officer, Erumely on all working days.

Conditions

1. All the conditions in the G. O. (Ms.) No. 26/2017/F&WLD dated 20-5-2017 will be applicable to this tender also.

2. Tender form (Appendix 9) and other details (Not transferable) can be obtained from Divisional Forest Office, Mankulam on payment of cash or by Demand Draft (DD) drawn in favour of Divisional Forest Officer, Mankulam payable on any Scheduled/Nationalized Bank. 3. The tender form shall be used only by the person in whose name it is issued and for the work specified in the Schedule attached to the tender form.

4. Before submitting the tender, the tenderer is expected to study and scrutinize all the conditions in the agreement to be executed, the draft of which can be had for perusal at the Divisional Forest Office, Mankulam on any working day during office hours. They are also requested to study the detailed tender conditions attached to the tender document. Any plea of ignorance of the agreement conditions or any complaint regarding the said conditions received after the time of tender will not be entertained.

5. Before submitting the tender the tenderer shall visit the area of work to study all the field conditions and nature of work and quote his rate accordingly. No enhancement in rate due to any reasons will be entertained thereafter.

6. The tenderer shall quote a firm percentage of the basic rate per Kilometer for trek path as in the Schedule both in figures as well as in words in the appropriate column in the tender form. In the case of tenderer quoting different total amount in words and figures, least of the same will be considered valid and shall be binding on him/her.

7. The tenderer shall submit the filled up tender form together with all the pages intact in a sealed cover addressed to "The Divisional Forest Officer, Mankulam Division" and superscribed Tender for (Name of work- as specified in the first part of tender notice) so as to reach the office as specified in the first part of tender notice.

8. Tender received after the specified date and time or received without the requisite enclosures or tenders not written up in proper order or form will not be honoured.

9. Each tender shall be accompanied by a demand draft of a Nationalized/Scheduled Bank for the amount specified against each work as per the notification in favour of the Divisional Forest Officer, Mankulam Division, as Earnest Money Deposit for the work.

10. All the corrections in the tender form shall be initialed by the tenderer himself.

11. Part I of the tenders received in due time will be opened by the Divisional Forest Officer or his deputy at the time specified in the first part of tender notice in the presence of such of the tenderers present on that occasion.

12. Part-II tenders (price bid) of the tenderers whose Part-I tenders have been accepted only will be opened on the day to be declared subsequently. The time and place of opening of the Part-II tenders will be announced immediately on the acceptance of the Part-I tender.

13. The lowest tender will ordinarily be accepted, but the authority competent to accept the tender reserves the power of accepting or rejecting any tender without assigning any reason thereof.

14. No tenderer will be permitted to withdraw his offer within three months from the date of opening of the financial bid.

15. All the taxes prevailing at the time is applicable to this tender.

16. The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a Confirmation Order issued through registered letter bearing the address mentioned in the tender. The successful tenderer, within seven days of receipt of confirmation of his tender, shall have to execute an agreement in the prescribed form (Appendix 11) on a proper non-judicial stamp paper (worth ` 100) to be supplied by him at his cost. If the contractor fails to execute the agreement during the period, the tender will be cancelled, and the Earnest Money Deposit submitted by the tenderer shall stand forfeited to the Kerala Forest Department. The work will be carried out at the risk and cost of the tenderer or through any other method (including through the next higher tenderer). The loss, if any, to the Government consequent to the default, if not paid by the defaulter within a reasonable time specified by the Divisional Forest Officer, shall be treated as arrears on public revenue to be recovered from the defaulter under the provisions of the Kerala Revenue Recovery Act 1968 and in such other manner as the Government may deem fit. The defaulter however will not be entitled for gain, if any.

17. The successful tenderer while signing the agreement shall furnish a security deposit for an amount equal to 10 per cent. of the total Probable Amount of Contract. The security deposit will be released only after the successful completion of the contract work and after producing the Non Liability Certificate from the concerned officers.

18. The successful tenderer shall give an undertaking at the time of execution of agreement that he shall not sell, mortgage or otherwise alienate the properties covered by the solvency certificate during the currency of the contract.

19. The post-offers and representations sent, after receipt of the tender in respect of the work shall not be considered on any grounds.

20. The Earnest Money Deposit of the unsuccessful tenderers will be returned as soon as possible after the tenders are finalized.

21. The quantities of work shown in the Schedule are approximate and it may vary on actual execution of work.

22. The area shown in the tender schedule is approximate. The actual extent of the contract area may vary as per the final survey report, which will be binding on the successful tenderer.

23. Payment in two installments will be made to the contractor on specific request and on submission of bill in the prescribed format at the following stages provided, the condition specified are achieved. Payment will be made through crossed cheques or e- payment only.

24. It shall be open to the Divisional Forest Officer to cancel/reduce the quantity of work to be executed in the attached schedule based on site conditions and the Divisional Forest Officer's decision will be binding on the successful tenderer. If any additional item/s of work which are not included in the schedule are required to be carried out inevitably for reasons to be recorded, in the contract area during the course of contract period, the successful tenderer is bound to execute that work for which payment worked out as per forest schedule rate for such item will be made at the agreed rate in the contract. The cost of the work will be worked out as per the prevailing forest schedule of rate.

25. Kerala Forest Department reserves the right to execute the work through any other mode of execution other than through contract system if the tender offered by the contractors is not feasible according to the Department.

26. The undersigned reserves the right to cancel the tender without assigning any reason.

കോതമംഗലം ഡിവിഷനിൽപ്പെട്ട തൊടുപുഴ റെയിഞ്ചിലെ വേളൂർ ഫോറസ്റ്റ് സ്റ്റേഷൻ പരിധിയിലെ 1947 കുഴിമറ്റം തേക്ക് തോട്ടത്തിൽ നിൽക്കുന്നതും അടച്ചുമുറി നടത്തി ഡിപ്പോയിലേക്ക് ഘനമരങ്ങൾ നീക്കംചെയ്തതിനുശേഷം അവശേഷിക്കുന്ന താഴെ പട്ടികയിൽ ചേർത്തിട്ടുള്ളതുമായ വിവിധ ഇനങ്ങളിൽപ്പെട്ട പാഴ്മരങ്ങൾ മുറിച്ച് ശേഖരിച്ച് നീക്കംചെയ്ത് കൊ≠ുപോകുന്ന തിനുള്ള അവകാശം 10-12-2013-ലെ കേരള ഗസറ്റ് നമ്പർ 49, വാല്യം II-ൽ അഡീഷണൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (പ്രൊ.) അവർകളുടെ 22-11-2013-ലെ പ്രൊ (5)-26274/12-ാം നമ്പരായി പ്രസിദ്ധീകരിച്ചിട്ടുള്ള ഡിപ്പോ ലേലവ്യവസ്ഥകൾക്കും താഴെ ചേർത്തിട്ടുള്ള ലേല വ്യവസ്ഥകൾക്കും നിബന്ധനകൾക്കും വിധേയമായി കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന മറ്റ് ഉദ്യോഗസ്ഥനോ കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസിൽ വച്ച് പരസ്യമായി ദർഘാസ്/ലേലത്തിൽ (Tender/auction) വിൽക്കുന്നതാണ്.

വ്യവസ്ഥകൾ/നിബന്ധനകൾ

1. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യ‡ികൾ ഏതെങ്കിലും ദേശസാൽകൃത ബാങ്കിൽ നിന്നും എടുത്ത ` 1,00,000-ന്റെ ഡിമാന്റ ് ഡ്രാഫ്റ്റ് ദർഘാസ്/ലേലത്തിന് മുൻപ് നിരതദ്രവ്യമായി ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്.

2. വിജയിയാകുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ മൊത്തം ദർഘാസ്/ലേലത്തുകയുടെ 35% തുക ` 1,00,000-ൽ കൂടുതലാണെങ്കിൽ ലേല ദിവസം കുറഞ്ഞത് ` 1,00,000 കെട്ടിവയ്ക്കേ≠തും ബാക്കി തുക 7 പ്രവൃത്തി ദിവസത്തിനകം ഈ ഓഫീസിൽ നിന്നും നൽകുന്ന മേലൊപ്പ് വച്ച ചെലാൻ മുഖാന്തിരം കോതമംഗലം സബ്ട്രഷറിയിൽ ഒടുക്കി രസീത് ഹാജരാക്കേ≠താണ്. ടി തുക ഒടുക്കുന്നതിൽ വീഴ്ച വരുത്തിയാൽ ടിയാൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യം സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതും ടി പ്രവൃത്തി ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ലേലം ചെയ്യുന്നതുമായിരിക്കും.

3. വിജയിയാകുന്ന ദർഘാസുകാരൻ/ലേലക്കാരൻ നിയമപ്രകാരവും കാലാകാലങ്ങളിൽ നിലവിലുള്ളതുമായ ചരക്ക് സേവന നികുതി, വനവികസന നികുതി, വരുമാന നികുതി, മറ്റ് ബന്ധപ്പെട്ട നികുതികൾ എന്നിവ യഥാസമയം അടയ്ക്കേ≠താണ്.

4. ദർഘാസ്/ലേല ദിവസം പൊതു അവധിയായി വന്നാലോ മറ്റേതെങ്കിലും കാരണത്താലോ ദർഘാസ്/ലേലം നടത്താൻ കഴിയാതെ വന്നാൽ ടി ദർഘാസ്/ലേലം തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം പ്രസ്തുത സ്ഥലത്തും സമയത്തും നടത്തുന്നതായിരിക്കും.

5. ടെ≠ർ/ലേലം ഒരു നി›ിത തുകയുടെ അടിസ്ഥാനത്തിലാണ് നി›യിച്ചിരിക്കുന്നത്. ഇതിനായി സർവ്വെ ചെയ്ത് തിരിച്ചിട്ടുള്ള പ്രസ്തുത സ്ഥലത്ത് നിൽക്കുന്ന താഴെ പട്ടികയിൽ പറഞ്ഞിട്ടുള്ള മരങ്ങൾ നീക്കം ചെയ്യുന്നതിനുള്ള അവകാശത്തിന് വേ≠ിയാണ് ഇത് തീരുമാനിച്ചിരിക്കുന്നത്.

6. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ ലേലത്തിന് മുമ്പായി ഉൽപ്പന്നങ്ങളുടെ നൽപ്പ് നിൽപ്പ്് ക≠് ബോധ്യപ്പെടേ≠തും ലേലത്തിനുശേഷം അവ സംബന്ധിച്ച പരാതികൾ യാതൊരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

7. ദർഘാസുകാരൻ/ലേലക്കാരൻ നേരിട്ട് ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കേ≠താണ്. നിയമപരമായ പവർ ഓഫ് അറ്റോർണി ഇല്ലാത്ത പകരക്കാരെ ലേലത്തിൽ പങ്കെടുപ്പിക്കുന്നതല്ല.

8. കോതമംഗലം ഡിവിഷനിലേയും മറ്റ് സമീപ ഡിവിഷനുകളിലേയും സπൈ കോൺട്രാക്റ്റർമാരെ ടി ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ അനുവദിക്കുന്നതല്ല.

9. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ വിലാസവും കൈയൊപ്പും ബന്ധപ്പെട്ട വില്ലേജാഫീസർ സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റും നിരതദ്രവ്യത്തോടൊപ്പം ഹാജരാക്കേ≠താണ്.

10. വിജയിക്കുന്ന ദർഘാസുകാരന്/ലേലക്കാരന് പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ഓഫീസർമാരുമായോ, ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു ധാരണാപത്രം ദർഘാസ്/ലേല ദിവസം ദർഘാസുകാരൻ/ലേലക്കാരൻ ഈ ഓഫീസിൽ സമർപ്പിക്കേ≠താണ്. ദർഘാസുകാരന്/ലേലക്കാരന് ടി ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുള്ള ബന്ധമു≠െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുള്ള ദർഘാസ്/ലേലം റദ്ദ് ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി പ്രവൃത്തി പുനർ ദർഘാസ്/ ലേലം ചെയ്യുന്നതായിരിക്കും.

11. ദർഘാസ്/ലേല തീയതി മുതൽ 7 ദിവസങ്ങൾക്കുശേഷം ലഭിക്കുന്ന പോസ്റ്റ് ഓഫറുകളോ മറ്റേതെങ്കിലും തരത്തിലുള്ള പരാതികളോ പരിഗണിക്കുന്നതല്ല. ഒരു ലക്ഷം രൂപയിൽ കൂടുതൽ ലേലത്തുക വരുന്ന കേസുകളിൽ ലേലത്തുകയുടെ 10%-ൽ കുറയാത്ത പോസ്റ്റ് ഓഫറുകളും ഒരു ലക്ഷത്തിൽ താഴെ ലേലത്തുക വരുന്ന കേസുകളിൽപ്പെട്ട ലേലങ്ങൾക്ക് 20%-ൽ കുറയാതെയുള്ള പോസ്റ്റ് ഓഫറുകളും മാത്രമേ പരിഗണിക്കുകയുള്ളു. കൂടാതെ താഴെപ്പറയുന്ന നിബന്ധനകളും പോസ്റ്റ് ഓഫറുകൾക്ക് ബാധകമായിരിക്കും.

(എ) പോസ്റ്റ് ഓഫർ സമർപ്പിക്കുന്ന ആൾ യഥാർ∞ ദർഘാസ്/ലേലക്കാരൻ ഒടുക്കിയ തുകയുടെ ഇരട്ടി തുക അടയ്ക്കേ≠താണ്.

(ബി) ബന്ധപ്പെട്ട പോസ്റ്റ് ഓഫർ തുകയും മറ്റ് നികുതികളും ഈ ആഫീസിൽ നിന്നും രജിസ്റ്റേർഡ് തപാൽ മുഖേന അറിയിച്ച് ഏഴു ദിവസത്തിനുള്ളിൽ ചെലാൻ മുഖാന്തിരമോ ബാങ്ക് രസീത് വഴിയോ ഒടുക്കി ചെലാൻ രസീത്/ ബാങ്ക് രസീത് ഈ ആഫീസിൽ ഹാജരാക്കേ≠താണ്. പോസ്റ്റ് ഓഫർ നൽകുന്ന ദർഘാസുകാരൻ കൂപ്പിന്റെയും അതിലെ നിൽപ്പുമരങ്ങളുടെയം ഗുണനിലവാരവും മറ്റ് ദർഘാസ് വ്യവസ്ഥകളും ബോദ്ധ്യപ്പെട്ടശേഷം നി›ിത മുദ്രപ്പത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്.

പോസ്റ്റ് ഓഫറുകാരൻ ടി വ്യവസ്ഥകൾ ബോദ്ധ്യപ്പെട്ട് ഉടമ്പടിയിൽ ഏർപ്പെടുന്നപക്ഷം ഇതിൻമേൽ ആവശ്യമായ പരസ്യം നൽകി ഒരു പുനർ ലേലം നടത്തുന്നതാണ്. പുനർ ലേലത്തിൽ ലഭിക്കുന്ന തുക പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കുറവാണെങ്കിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയ്ക്ക് ടിയാന്റെ പേരിൽ ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തുന്നതായിരിക്കും. പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത ലേലത്തുക അടയ്ക്കുന്നതിൽനിന്നും പിൻമാറുന്നപക്ഷം ടിയാൻ അടച്ചിട്ടുള്ള സെക്യൂരിറ്റി തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുന്നതാണ്. പുനർലേലത്തിൽ പോസ്റ്റ് ഓഫറുകാരൻ വാഗ്ദാനം ചെയ്ത തുകയേക്കാൾ കൂടുതൽ തുകയ്ക്ക് ലേലം/ദർഘാസ് നടക്കുകയാണെങ്കിൽ ഉയർന്ന ലേലത്തുകയ്ക്ക് ആ വ്യ‡ിയുടെ പേരിൽ ലേലം ഉറപ്പിക്കുന്നതും പോസ്റ്റ് ഓഫറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരികെ നൽകുന്നതുമാണ്.

12. പുനർ ദർഘാസ്/ലേലത്തിൽ ലഭിക്കുന്ന തുക ആദ്യ ദർഘാസ്/ലേലത്തിൽ ലഭിച്ച തുകയേക്കാൾ കുറവായാൽ ടി നഷ്ടവും മറ്റു ചെലവുകളും ഉൾപ്പെടെ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ നി›യിക്കുന്ന തുകയും നഷ്ടം വരുത്തിയ ദർഘാസ്/ലേലക്കാരിൽ നിന്നും റവന്യൂ റിക്കവറി ഉൾപ്പെടെയുള്ള നിലവിലുള്ള നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.

13. ദർഘാസ്/ലേലം കൊള്ളുന്നയാൾക്ക് ഈ ദർഘാസ്/ലേലപ്പരസ്യത്തിന്റെ ആദ്യ ഖfiികയിൽ പറഞ്ഞിട്ടുള്ള സ്ഥലത്ത് നിൽക്കുന്നതും മാർക്ക് ചെയ്തു നിർത്തിയിരിക്കുന്നതുമായ ഇനത്തിൽപ്പെട്ട മരങ്ങൾക്കും ഈ ഇനത്തിൽപ്പെട്ട വണ്ണം കുറഞ്ഞതിനാൽ മാർക്ക് ചെയ്യാത്ത മരങ്ങൾക്കും മാത്രം അവകാശമുള്ളതാകുന്നു.

14. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുത്ത് കൂടുതൽ തുകയ്ക്ക് ലേലം കൊള്ളുന്ന ആൾ ലേലം കഴിഞ്ഞാലുടൻ ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഒരു ബൗ≠ൻ ഉടമ്പടി കൂടി ഒപ്പുവയ്ക്കേ≠താണ്.

15. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 15 ദിവസത്തിനകം ബാക്കി തുകയുടെ മൂന്നിൽ ഒന്നും മൊത്തം തുകയുടെ 5% ഫോറസ്റ്റ് ഡെവലപ്മെന്റ ് ടാക്സും നിലവിലുള്ള നിരക്കിൽ ചരക്ക് സേവന നികുതി, ഇൻകം ടാക്സ് എന്നിവയും ഒടുക്കി മൊത്തം ലേലത്തുകയുടെ 10% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റുംവച്ച് ` 200-ന്റെ മുദ്രപത്രത്തിൽ ഉടമ്പടി വയ്ക്കേ≠താണ്. 15 ദിവസത്തിനുള്ളിൽ ടി തുക ഒടുക്കാതിരുന്നാൽ 12% പലിശയോടുകൂടി തുക ഒടുക്കുന്നതിന് 15 ദിവസത്തെ സമയവും 24% പലിശയോടുകൂടി വീ≠ും 15 ദിവസത്തെ സമയവും യു‡ം പോലെ കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അനുവദിക്കാവുന്നതാണ്.

ഈ കാലാവധിക്കുള്ളിലും തുക ഒടുക്കാതെ വന്നാൽ കോട്ടയം ഹൈറേഞ്ച് സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെ 24% പലിശ നിരക്കിൽ 15 ദിവസത്തേയും വീ≠ും 48% പലിശ നിരക്കിൽ അഡീഷണൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ സമയം അനുവദിക്കാവുന്നതാണ്. എന്നാൽ മുകളിൽ പറഞ്ഞ കാലാവധികളെല്ലാം കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും.

16. ബാക്കി മൂന്നിൽ ര≠് ലേലത്തുക ര≠് തുല്യ ഗഡുക്കളായി ഒടുക്കേ≠താണ്. ആദ്യ ഗഡു കരാർ തീയതി മുതൽ 15 ദിവസത്തിനകവും ര≠ാം ഗഡു കരാർ തീയതി മുതൽ ഒരു മാസത്തിനകമോ കരാർ കാലാവധിക്കകമോ ഏതാണോ ആദ്യം വരിക ആ കാലാവധിക്കുള്ളിലും ഒടുക്കേ≠താണ്. ടി കാലാവധിക്കുള്ളിൽ പണം ഒടുക്കുവാൻ കഴിയാതെ വന്നാൽ 12% പലിശ നിരക്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർക്ക് 15 ദിവസത്തേയും 24% പലിശ നിരക്കിൽ കോട്ടയം ഹൈറേഞ്ച് സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ംപോലെ 30 ദിവസത്തേക്കും വീ≠ും 30 ദിവസത്തേക്ക് 48% പലിശ നിരക്കിൽ അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ യു‡ം പോലെയും കാലാവധി നീട്ടികൊടുക്കാവുന്നതാണ്. എന്നാൽ നീട്ടികൊടുക്കുന്ന കാലാവധികളെല്ലാംതന്നെ കരാർ കാലാവധിക്കുള്ളിലായിരിക്കും. ബാക്കി മൂന്നിൽ ര≠് തുകയിൽ ആദ്യ ഗഡു തുക അടച്ചാൽ മാത്രമേ കൂപ്പിൽ പ്രവേശിപ്പിക്കുകയുള്ളൂ.

17. ഉടമ്പടി കാലാവധി ലേലം സ്ഥിരപ്പെടുത്തി അറിയിക്കുന്ന തീയതി മുതൽ 60 ദിവസമാണ്. സാധാരണ ഗതിയിൽ കൂപ്പിന്റെ കാലാവധി നീട്ടികൊടുക്കുന്നതല്ല. എന്നാൽ പ്രത്യേക സാഹചര്യത്തിലും മതിയായ കാരണങ്ങളുടെ അടിസ്ഥാനത്തിലും കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, കോട്ടയം ഹൈറേഞ്ച് സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ എന്നിവർ യഥാക്രമം ഓരോ മാസം വീതം താഴെ ചേർത്തിരിക്കുന്ന രീതിയിൽ പിഴ ഈടാക്കിക്കൊ≠് ഓരോ പ്രാവശ്യവും കാലാവധി ദീർഘിപ്പിച്ചുകൊടുക്കുന്നതാണ്.

(എ) എന്യൂമറേറ്റ് ചെയ്തതും മുറിയ്ക്കാനുള്ളതുമായ മരങ്ങൾക്ക് ഓരോ ഹെക്ടറിനും അതിന്റെ ഭാഗത്തിനും ` 750 വീതം.

(ബി) മുറിച്ചിട്ട് നീക്കംചെയ്യാത്ത രജിസ്റ്റർ ചെയ്തതും അല്ലാത്തതുമായ തടികൾക്ക് ഓരോ ക്യു. മീറ്ററിനും അതിന്റെ ഭാഗത്തിനും ` 100 വീതം.

(സി) നീക്കംചെയ്യാത്ത വിറകിന് ഓരോ ടണ്ണിനും അതിന്റെ ഭാഗത്തിനും ` 50 വീതം.

ഒന്നാമത്തെ മാസം ടി നിരക്കിലും 2-ാം മാസം ഇതിന്റെ ഇരട്ടിയും എന്ന ക്രമത്തിൽ പിഴ ഈടാക്കുന്നതാണ്. ഇപ്രകാരം നീട്ടിനൽകുന്ന തീയതിക്കുള്ളിലും നീക്കംചെയ്യാതെ കിടക്കുന്ന തടിയും വിറകും ക≠ുകെട്ടി ഗവൺമെന്റിലേക്ക് മുതൽകൂട്ടുന്നതും കരാറുകാരന് ആയവയിൽ യാതൊരു അവകാശവും ഉ≠ായിരിക്കുന്നതുമല്ല. ഉടമ്പടിക്കാരൻ ഉടമ്പടി പ്രകാരമുള്ള നി›ിത സമയപരിധിക്കുള്ളിലും മേൽവിവരിച്ച രീതിയിലുള്ള ദീർഘിപ്പിച്ച് നൽകുന്ന കാലാവധിക്കുള്ളിലും ചെയ്തുതീർക്കാത്ത ജോലികൾ ഡിപ്പാർട്ടുമെന്റ ് ചെയ്യിക്കുന്നതും ആയതിന് ഉ≠ാകുന്ന മുഴുവൻ ചെലവും ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമായിരിക്കും.

18. ടി പ്രദേശത്ത് ശേഖരിച്ച് വയ്ക്കുന്ന തടികളും വിറകും നിലവിലുള്ള നിയമങ്ങൾക്ക് വിധേയമായിട്ടായിരിക്കും നീക്കം ചെയ്യാനുള്ള ലൈസൻസ് നൽകുന്നത്.

19. കോതമംഗലം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസറുടെയോ തൊടുപുഴ റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസറുടെയോ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ അയാളുടെ ആളുകളോ ടി പ്രദേശത്ത് പ്രവേശിക്കുവാൻ പാടുള്ളു.

20. ദർഘാസുകാരൻ/ലേലക്കാരൻ കൂപ്പിന്റെ കാലാവധി തീരുന്നതുവരെ എല്ലാ സമയവും കൂപ്പിൽ ഉ≠ായിരിക്കണം. കൂപ്പിന്റെ ബൗ≠റികൾ ര≠് മീറ്റർ വീതിയിൽ തെളിയിക്കുകയും ജ≠കൾ യഥാവിധി സംരക്ഷിക്കേ≠തുമാണ്.

21. യാതൊരു കാരണവശാലും πാന്റേഷനിലേയോ റിസർവ്വിലേയോ മറ്റ് മരങ്ങൾക്കും തടികൾക്കും കേടുപാടുകളോ നാശനഷ്ടങ്ങളോ വരുത്തുവാൻ പാടുള്ളതല്ല. അങ്ങനെയു≠ാവുന്ന നഷ്ടത്തിന് കരാറുകാരൻ ഉത്തരവാദി ആകുന്നതാണ്.

22. കൂപ്പിന് പുറത്ത് ഫോറസ്റ്റ് സ്ഥലത്ത് തടികളും മറ്റും സൂക്ഷിക്കുന്നതിന് ആവശ്യമെങ്കിൽ ഉടമ്പടിക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ അനുവദിക്കുന്നതാണ്. എന്നാൽ അവിചാരിതമായ കാരണങ്ങളാലോ മോശമായ കാലാവസ്ഥമൂലമോ ഉടമ്പടി കാലാവധിക്കുള്ളിൽ ഇവ നീക്കം ചെയ്തുകൊ≠് പോകാൻ കഴിയാതെ വന്നാൽ തറവാടക ഇനത്തിൽ ഹെക്ടറിന് ` 250 നിരക്കിൽ ഉടമ്പടിക്കാരനിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.

23. കൂപ്പിന് 0.50 കി. മീറ്റർ ചുറ്റളവിൽ സംഭവിക്കുന്ന എല്ലാവിധ കുറ്റകൃത്യങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദി യാകുന്നതാണ്. അനധികൃത കുറ്റങ്ങൾ ശ്രദ്ധയിൽപ്പെട്ടാൽ ഉടമ്പടിക്കാരൻ വിവരം വനംവകുപ്പ് ഉദ്യോഗസ്ഥരെ അറിയിക്കേ≠താണ്. ഇതിൽ വീഴ്ച വരുത്തിയാൽ കരാർ റദ്ദാക്കപ്പെടുന്നതാണ്.

24. കാലാവധിക്കുശേഷം കരാറുകാരൻ സെയിൽസ് ടാക്സ്, ഇൻകം-ടാക്സ്, അഗ്രികൾച്ചറൽ ഇൻകം ടാക്സ് ഇവയുടെ ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് കരാറുകാരന്റെ സെക്യൂരിറ്റി തുക തിരിച്ചു നൽകുന്നതാണ്. എന്നാൽ ടി ഇനത്തിൽ ഗവൺമെന്റ ിലേക്ക് ബാദ്ധ്യതകൾ വല്ലതുമു≠െങ്കിൽ സെക്യൂരിറ്റി തുകയിൽ നിന്നും ഈടാക്കുന്നതാണ്.

25. സെയിൽ കൂപ്പുകളെ സംബന്ധിച്ച എല്ലാ പൊതുനിബന്ധനകളും ഈ ദർഘാസ്/ലേലത്തിനും ബാധകമായിരിക്കും.

It is hereby notified for the information of the public that the right of collection and removal of marked and enumerated standing trees (Softwood species only), left after the final felling of Teak trees in the 1947 Kuzhimattom Teak Plantation under Thodupuzha range of this division as specified in the schedule appended below will be sold in Tender/ Auction by the Divisional Forest Officer, Kothamangalam or any other officer authorized by him in the Divisional Forest Office, Kothamangalam (situated at Kothamangalam) subject to the terms and conditions of sale of Timber in Government Timber Depots published in Government Gazette No. 49 Vol. II dated 10-12-2013 vide Notification No. Pro. (5) 26274/12 dated 22-11-2013 of the Additional Principal Chief Conservator of Forests (P), Thiruvananthapuram and as per general conditions of the sale of tree growth prevailing in the Department. In case, the notified date happens to be a public holiday or hartal etc. the tender/auction will be conducted on the next working day at the notified place and time.

Conditions

1. Intending Tenderers/Bidders should deposit an Earnest Money Deposit of ` 1,00,000 as Demand Draft drawn in favour of The Divisional Forest Officer, Kothamangalam, from any Nationalized Bank for participating in the tender/auction.

2. The successful tenderers/bidders have to remit 35% of the sale value on the date of tender/auction itself. If this 35% value exceeds ` 1,00,000, ` 1,00,000 will be remitted on the auction date itself and balance value have to be remitted in the Sub-Treasury, Kothamangalam (at Kothamangalam) within 7 working days through countersigned chalan issued from this office and the receipted chalan should be submitted to this office forthwith. If he fails to remit this amount, the EMD will be forfeited to Government and the area will be re-auctioned at his risk and loss.

3. The successful Tenderers/Bidders have to pay GST (as per Rule) FDT, Income Tax etc. at the rate prevailing from time to time.

4. If the notified date of tender/auction happens to be a holiday, the tender/auction will be conducted on the very next working day at the same place and time.

5. The tender/auction will be on lump-sum basis for the right of collection and removal of entire marked softwood species growth, except all hardwood species (including teak, Anjili, Rosewood etc.), from the above area mentioned in the schedule hereto the area of which has been surveyed and demarcated on the ground.

6. Intending tenderers/ bidders may inspect the trees themselves of the quality and quantity of the produce before participating in the Tender/auction. Complaints if any, regarding the quality and quantity etc. received after the tender/auction will not be entertained.

7. Bidder should appear for the auction in person and nobody will be permitted to bid on behalf of another unless valid Power of Attorney is produced prior to commencement of tender/auction.

8. A supply contractor of Kothamangalam, Division or the adjacent Divisions will not be allowed to bid in the tender/auction.

9. Intending tenderers/bidders should produce a certificate from the concerned Village Officer showing their permanent address and duly attesting their signature alongwith Earnest Money Deposit.

10. The successful tenderers/ bidders should give an undertaking that he is not related to any officer having control of the work and that he is not supply contractor of this or any adjacent Divisions. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at his risk and loss.

11. No petition or post offer received after seven days of the date of conduct of the tender/auction sale and post offer which is not advantageous by more than 10% of the original offer where the bid amount is one lakh and above and more than 20% where the original bid amount is less than one lakh will ordinary be considered.

The post offers will comply with the following terms.

(a) Post offerer should remit double the amount paid by the successful tenderer/Bidder on the Tender/ Auction date.

(b) The remittance should be made by the chalan or Bank Deposit and the Bank receipt should be produced before the Divisional Forest Officer concerned within seven days from the date of receipt of registered notice to that effect.

The post offerer after satisfying the conditions specified above should execute an agreement before the Divisional Forest Officer concerned, pledging the security deposit for the due fulfilment of the above terms, if the post offerer satisfies the conditions, a re-auction will be conducted after giving the usual publicity as per rules. In the re-auction the price fetched, does not come upto what has been offered by the post offerer, it will be awarded to the post offerer at the amount offered by him. If he backs out, the security amount remitted by him will be forfeited to Government. If however, the bid amount is above what has been offered by the post offerer, the right will be awarded to the highest Bidder/Tenderer in the re-auction and the amount remitted by the post offerer will be released to him.

12. If the value fetched in the resale/re-tender is less than that obtained in the original tender/auction the difference between them together with all incidental expenditure to fixing up of the resale including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting Tenderers/ Bidders through legal means including Revenue Recovery Act in force.

13. The participating Tenderers/Bidders have rights only for the collection and removal of enumerated standing softwood trees and the softwood trees of lower girth not enumerated and has no right for removing trees like Teak, Rosewood, Sandal, Irul etc, if any.

14. The successful Tenderers/Bidders should execute a bounden agreement on a stamp paper worth ` 200 after completion of tender/auction.

15. The confirmation of the tender/auction sale will ordinarily be communicated to the party concerned as early as possible. Within 15 days from the date of intimation of the confirmation, the successful Tenderers/Bidders shall remit ¹/3 rd of the balance sale value and 5% Forest Development Tax, GST (as per Rule) and Income Tax at the rate in force and security deposit of 10% for the total sale value. The successful tenderers/Bidders should execute an agreement on a stamp paper worth ` 200. In case of failure to remit the amount within 15 days extension shall be granted by the Divisional Forest Officer for 15 days subject to the realization of 12% penal interest. Further extension for 15 days shall be granted by the Divisional Forest Officer subject to the realization of 24% penal interest. In case of failure to remit the amount within the extended period, further extension for 15 days by the Chief Conservator of Forests, High Range Circle, Kottayam and 15 days by the Addl. Principal Chief Conservator of Forests shall be granted subject to the realization of penal interest at 24% and 48% respectively. But all the extension periods mentioned above will be within the original contract period.

16. The balance ²/3 rd sale value should be remitted in two equal instalments by the successful Tenderers/Bidders. The first instalment should be remitted within 15 days from the date of agreement and the second instalment within 30 days from the date of agreement or within the contract period whichever is earlier. If the successful Tenderers/Bidders fails to remit the above amount within the period mentioned above, extension for 15 days by realizing penal interest at 12% by the Divisional Forest Officer concerned, extension for 30 days by realizing penal interest at 24% by the Chief Conservator of Forests, concerned and further extension for 30 days by the Addl. Principal Chief Conservator of Forests concerned by realizing penal interest at 48% shall be granted respectively. But all the above extended periods will be within the original contract period.

17. The period of contract will be 60 days from the date of intimation of confirmation. No extension of the period of contract shall normaly be granted on any ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer and the Chief Conservator of Forests concerned may grant extension of time for one month each respectively on realization of penalty or penalties for completion of each work for each month mentioned below.

(a) For enumerated trees and balance unfelled per hectare or fraction thereof ` 750 per hectare.

(b) Unremoved registered logs and unregistered logs ` 100 per m³ or fraction thereof.

(c) Unremoved firewood ` 50 per Tonne or fraction thereof.

Penalty will be assessed and realized on timber, firewood as the case may be which are either uncollected or unremoved during the original contract period. The penalty for the first month shall be realized as per above rates, double the rate for the second month shall be realized. If the Tenderer/Bidder fail to remove the entire produce within the above extended period, the whole timber and firewood collected by the tenderer as per the agreement will be forfeited to Government and the Tenderer/Bidder shall not have any right on the produce confiscated to Government.

In the above circumstances, the balance work to be executed by the tenderer shall be completed departmentally and all the loss sustained to Government in this regard shall be realized from the tenderer/bidder.

18. The licence for the removal of timber and firewood collected in the coupe should be issued only on the basis of the prevailing norms.

19. The contractor or his agent shall enter into the coupe only after getting the written permission from the Divisional Forest Officer, Kothamangalam or Range Forest Officer, Thodupuzha.

20. The contractor shall at all time during the currency of the contract, keep the boundaries cleared to a width of 2 meters and keep the cairns intact.

21. The contractor will be liable for any damage or loss caused to other trees in the nearby plantations, if any or reserve.

22. The Divisional Forest Officer will give permission to keep the timber and other produce outside the coupe, if requested by the contractor at his risk. But if the collected timber/firewood are not within the agreement period due to unforeseen situation or climate, a ground rent @ ` 250 per hectare will be recovered from the contractor.

23. The contractor will be liable for all the illegal activities occurred within 0.5 k.m. perimeter of the above mentioned chainage. Any such activities noticed should be reported to the Forest Officials by the Contractor, otherwise the contract will be cancelled.

24. The security deposit will be refunded only after the successful completion of the contract after producing the clearance certificates of Sales Tax, Income Tax, Agricultural Income Tax etc. If there is any liabilities outstanding in this respect to the Government, that will be adjusted from the security deposit of the contractor.

25. All common conditions regarding sale coupes are also applicable to this tender/auction. Further details can be had from the office of the undersigned or from the office of the Range Forest Officer, Thodupuzha on all working days.

It is hereby notified that the seized vehicles in forest offences and kept under Government custody in Vellikulangara Range and Department Vehicle KL-8AE-2426 Mahindra Jeep in Palappilly Range in Chalakudy Division shown in the schedule will be sold through e-Auction through MSTC website subject to the conditions notified in the e-auction notification.

e-Auction documents and connected records are available in the website www.mstcecommerce.com. For submission of e-auction visit the website www.mstcecommerce.com. All bids/ e-auction shall be submitted online only.

Clarification on this e-auction can be obtained from NIC/ the e-auction Helpdesk number available in the www.mstcecommerce.com website and from the office of the Divisional Forest Officer, Chalakudy during the office hours.

The buyer registration number has to be mentioned while paying the EMD. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.

The successful bidder, 35% of the bid value after adjusting the EMD already remitted shall be paid within 7 working days of issuance of acceptance letter.

നെ∑ാറ വനം ഡിവിഷനിലെ കൊല്ലങ്കോട് റെയിഞ്ചിലെ കൊല്ലങ്കോട് സെക്ഷനിൽപ്പെട്ട ചപ്പക്കാട് ഭാഗത്ത് വിവിധ ഒ. എ. കേസുകളിൽപ്പെട്ടതും സർക്കാരിന് അനുകൂലമായി ഉത്തരവായിട്ടുള്ളതും, കൂടാതെ ടി ഭാഗത്ത് തന്നെയുള്ള അനധികൃത കയ്യേറ്റങ്ങൾ ഒഴിപ്പിച്ചെടുത്തതുമായ സ്ഥലങ്ങളിൽ സ്ഥിതിചെയ്യുന്ന ഫലവൃക്ഷങ്ങളിൽ നിന്നും താഴെ പട്ടികയിൽ കാണിച്ചിരിക്കുന്ന തുമായ കായ്ഫലങ്ങൾ ഉടമ്പടിവച്ച തീയതി മുതൽ 30-6-2020 വരെയുള്ള കാലയളവിൽ ശേഖരിച്ച് കൊ≠ുപോകുന്നതിനുള്ള അവകാശം 4-3-2020-ന് ഉച്ചയ്ക്ക് ശേഷം 2.30 മണിക്ക് നെ∑ാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ദർഘാസ്/ലേലം ചെയ്ത് വിൽക്കുന്നതാണ്. ലേലദിവസം പൊതു അവധിയോ ഹർത്താലോ പ്രഖ്യാപിക്കുന്നപക്ഷം പ്രസ്തുത ദർഘാസ്/ലേലം തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം നി›ിത സമയത്തും സ്ഥലത്തും വച്ച് നടത്തുന്നതാണ്. 4-3-2020-ന് ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളുന്നതിനോ ഏതെങ്കിലും സ്ഥലത്തെ ശേഖരണത്തിന് ആരും തന്നെ മുന്നോട്ട് വരാതിരിക്കുകയോ ടെ≠ർ/ലേലം റദ്ദ് ചെയ്യുകയോ ചെയ്യുന്നപക്ഷം പട്ടികയിൽ കാണിച്ച വിളകൾ 6-3-2020, 10-3-2020, 12-3-2020 തീയതികളിൽ നി›ിത സ്ഥലത്തും സമയത്തും ദർഘാസ്/ലേലപ്രകാരം വിൽപ്പന നടത്തുന്നതായിരിക്കും.

1. ദർഘാസ്/ലേല വിൽപ്പനയിൽ പങ്കെടുക്കുവാൻ ഉദ്ദേശിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജ് ഓഫീസിൽനിന്നുമുള്ള സർട്ടിഫിക്കറ്റ് അല്ലെങ്കിൽ ഇലക്ഷൻ എെഡന്റിറ്റി കാർഡ്/ഡ്രൈവിംഗ് ലൈസൻസ്/പാസ്പോർട്ട് ഇവയിൽ ഏതെങ്കിലും ഒന്നിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പും ഇൻകം ടാക്സ് പാൻ കാർഡും നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതിന് മുമ്പായി ഹാജരാക്കേ≠താണ്. കൂടാതെ ദർഘാസ്/ലേല നിബന്ധനകൾ പാലിക്കുന്നതിൽ വീഴ്ച വരുത്തിയാൽ തൻമൂലം സർക്കാരിന് ഉ≠ാകുന്ന കഷ്ടനഷ്ടങ്ങൾ ഈടാക്കാവുന്നതാണെന്ന് സമ്മതിച്ചുകൊ≠് ഒരു സമ്മതപത്രം ഒപ്പ് വയ്ക്കേ≠താണ്. മേൽ വിവരിച്ച സർട്ടിഫിക്കറ്റോ ഏതെങ്കിലും തിരിച്ചറിയൽ രേഖയോ ഹാജരാക്കാത്തവരെ ദർഘാസ്/ലേലത്തിൽ പങ്കുകൊള്ളുവാൻ അനുവദിക്കുന്നതല്ല.

2. ദർഘാസ്/ലേലത്തിൽ പങ്കെടുക്കുന്നവർ ദർഘാസ്/ലേലത്തിന് മുൻപായി വിൽപ്പനയ്ക്ക് വച്ചിരിക്കുന്ന വിഭവങ്ങളുടെ ഗുണനിലവാരവും മറ്റും നേരിൽ ക≠് ബോധ്യപ്പെടേ≠താണ്. ലേലത്തിനുശേഷം ഈ വകകാര്യത്തെക്കുറിച്ചുള്ള യാതൊരു പരാതിയും പരിഗണിക്കുന്നതല്ല.

3. വിജയിയായ ദർഘാസ്/ലേലക്കാരൻ ലേലം കഴിഞ്ഞയുടൻ മൊത്ത വില ` 20,000-ൽ കുറവാണെങ്കിൽ മുഴുവൻ തുകയും അതിൽ കൂടുതലാണെങ്കിൽ മൊത്തം ലേലത്തുകയുടെ 35% വില, കുറഞ്ഞത് ` 20,000-ഉം കൂടിയത് ` 1,00,000-ഉം എന്ന കണക്കിൽ മൊത്തം പണമായോ ഡി.ഡി ആയോ ലേല ദിവസം തന്നെ അടയ്ക്കേ≠താണ്. ലേല സംഖ്യയുടെ 35% തുക 1 ലക്ഷം രൂപയിൽ കൂടുതലാണെങ്കിൽ ലേല ദിവസം അടച്ച ` 1,00,000 (ഒരു ലക്ഷം) കിഴിച്ച് ബാക്കി തുക ലേല ദിവസം കഴിഞ്ഞ് 7 പ്രവൃത്തി ദിവസത്തിനകം ട്രഷറിയിൽ അടച്ച് രസീതി ഹാജരാക്കേ≠താണ്. നി›ിതതുക ഒടുക്കാതിരുന്നാൽ ലേലം റദ്ദ് ചെയ്തതായി കണക്കാക്കി നിരതദ്രവ്യം ഉൾപ്പെടെയുള്ള തുക സർക്കാരിലേക്ക് മുതൽക്കൂട്ടുന്നതാണ്. അഡ്വാൻസ് തുക അവസാനം നീക്കംചെയ്യുന്ന വനവിഭവങ്ങളുടെ വിലയിലേക്ക് മാത്രമേ വകകൊള്ളിക്കുകയുള്ളൂ.

4. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തിയതായുള്ള അറിയിപ്പും ബാക്കി തുകയും അടച്ച് തീർക്കുവാനുള്ള ചലാൻ ഫോറവും അയച്ച തീയതി മുതൽ 40 ദിവസത്തിനകം ചലാൻ ഫോറത്തിൽ കാണിച്ചിട്ടുള്ള തുക സർക്കാരിന്റെ നിർദ്ദിഷ്ട ഖജനാവിൽ അടച്ച് ചലാൻ രശീത് റെയിഞ്ച് ഓഫീസർക്ക് എത്തിച്ച് കൊടുക്കേ≠താണ്. എല്ലാ വിഭവങ്ങളും മുഴുവൻ തുകയും അടച്ച് തീർത്ത് ലേലം സ്ഥിരപ്പെടുത്തിയ വിവരം അറിയിക്കുന്ന ദിവസം മുതൽ 40 ദിവസത്തിനകം നീക്കം ചെയ്യേ≠താണ്.

5. മേൽ സൂചിപ്പിച്ച നാൽപ്പത് ദിവസത്തിനകം (40 ദിവസം) തുക അടച്ച് ലേല വസ്തുക്കൾ നീക്കം ചെയ്യാത്തപക്ഷം പതിനെട്ട് ശതമാനം (18%) പലിശയോടുകൂടി ബാക്കി തുക അടയ്ക്കുന്നതിന് ഒരു മാസം (30 ദിവസം) വരെയും ഇരുപത്തിനാല് ശതമാനം (24%) പലിശയും പിഴപലിശയിൻമേൽ ര≠രശതമാനം (2.5%) സർചാർ÷ും ഈടാക്കികൊ≠് അടുത്ത ഒരു മാസം വരെയും (30 ദിവസം) 36% പിഴപ്പലിശയും പിഴപലിശയിൻമേൽ 5% സർചാർ÷ും ഈടാക്കിക്കൊ≠് വീ≠ും ഒരു മാസം കൂടിയും (30 ദിവസം) ഇങ്ങനെ ആകെ 3 മാസം വരെ (90 ദിവസം) റെയിഞ്ച് ഓഫീസർക്ക് കാലാവധി ദീർഘിപ്പിച്ച് അനുവദിക്കാവുന്നതാണ്. അപ്രകാരം ദീർഘിപ്പിച്ച സമയപരിധിക്കകവും പണമടക്കാതെ വന്നാൽ അടച്ച തുക സർക്കാരിലേക്ക് ക≠ുകെട്ടുകയും ലേലം കൊ≠ വകകൾ വീഴ്ചക്കാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർദർഘാസ്/ലേലം വഴി വിറ്റഴിക്കുന്നതാണ്.

6. ദർഘാസ്/ലേലം സ്ഥിരപ്പെടുത്തിയത് അറിയിക്കുന്ന തീയതി മുതൽ 130 ദിവസത്തിനകം (നൂറ്റിമുപ്പത് ദിവസം) എല്ലാ തുകയും അടച്ച് തീർക്കാത്ത പക്ഷം ദർഘാസ്/ലേലം റദ്ദാക്കുന്നതും ആയത് ദർഘാസ്/ലേലക്കാരന് 10 ദിവസത്തെ അവധി വച്ച് മുൻകൂട്ടി നോട്ടീസ് കൊടുത്തതിനുശേഷം അതെ റെയിഞ്ചിലെ ദർഘാസ്/ലേലത്തിൻ പ്രകാരം പുനർലേല വിൽപ്പന നടത്തുന്നതുമാണ്. ത∑ൂലം ഡിപ്പാർട്ടുമെന്റ ിന് ഉ≠ാകുന്ന എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും ആദ്യ ലേലക്കാരൻ/ദർഘാസുകാരൻ ഉത്തരവാദിയാകുന്നതുമാണ്.

7. ദർഘാസ്/ലേലം നടത്തുന്ന ഉദ്യോഗസ്ഥന്റെ താഴെപ്പറയുന്ന അധികാരങ്ങൾ ചോദ്യം ചെയ്യാൻ പാടുള്ളതല്ല.

(എ) ഏതെങ്കിലും വ്യ‡ിയുടെയോ സ്ഥാപനത്തിന്റേയോ നിരതദ്രവ്യം യാതൊരു കാരണവും പറയാതെ സ്വീകരിക്കുകയോ നിരാകരിക്കുകയോ ചെയ്യാവുന്നതാണ്.

(ബി) ദർഘാസ്/ലേലത്തിനായി പരസ്യപ്പെടുത്തിയ ഏതെങ്കിലും ലോട്ടുകൾ വിൽക്കാതിരിക്കുകയോ പരസ്യപ്പെടുത്തിയി ട്ടില്ലാത്ത ഏതെങ്കിലും ലോട്ട് വിൽക്കുകയോ ചെയ്യാവുന്നതാണ്.

(സി) ലേലത്തിന് പ്രതികൂലമായി ബാധിക്കുന്ന ഏതെങ്കിലും നടപടികളിൽ ഏർപ്പെട്ടെന്ന് ബോദ്ധ്യപ്പെടുന്നപക്ഷം ലേലക്കാരനെ ലേലത്തിൽനിന്നോ ലേല സ്ഥലത്തുനിന്നോ പുറത്താക്കാവുന്നതാണ്.

(ഡി) ലേലം വിളിക്കുന്നവർ പരോക്ഷമായി യോജിച്ച് സർക്കാരിനെ പ്രതികൂലമായി ബാധിക്കുന്ന നടപടികളിൽ ഏർപ്പെട്ട് പ്രതീക്ഷിച്ച വില ലഭിക്കുന്നില്ല എന്ന് ബോദ്ധ്യപ്പെട്ടാൽ ലേലം നിർത്തിവയ്ക്കാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കുന്നതാണ്.

8. പോസ്റ്റ് ഓഫർ ദർഘാസ്/ലേലം നടത്തി 7 ദിവസത്തിനകം സമർപ്പിക്കേ≠താണ്. ആയത് നിലവിലുള്ള നിബന്ധനകൾക്ക് വിധേയമായി മാത്രം പരിഗണിക്കുന്നതാണ്. ദർഘാസ്/ലേലം സംബന്ധിച്ച കൂടുതൽ വിവരങ്ങൾ ഈ ഓഫീസിൽ നിന്നോ കൊല്ലങ്കോട് ഫോറസ്റ്റ് റെയിഞ്ച് ഓഫീസിൽ നിന്നോ പ്രവർത്തി ദിവസങ്ങളിൽ അന്വേഷിച്ചറിയാവുന്നതാണ്.

9. ദർഘാസ്/ലേല പരസ്യത്തിലെ പൊതുവായ നിബന്ധനകൾ ഈ ലേലത്തിനും ബാധകമായിരിക്കുന്നതാണ്.
