MSTC, Ltd. www.mstcecommerce.com എന്ന വെബ്സൈറ്റിലൂടെ പ്രസിദ്ധപ്പെടുത്തിയിട്ടുള്ള വ്യവസ്ഥകൾക്കും വിധേയമായി ഇ-ലേലത്തിലൂടെ വിൽപന നടത്തുന്നതാണ്. ചുവടെ ചേർക്കുന്ന പട്ടികയിൽ വിവരിക്കുന്ന ഉൽപ്പന്നങ്ങൾക്ക് പുറമേ ടി ഇ-ലേലത്തിന് മുൻപുവരെ ശേഖരിച്ച് അട്ടിവയ്ക്കുന്ന ഉൽപ്പന്നങ്ങളും ടി ഇ-ലേലത്തിൽ ഉൾപ്പെടുത്തി വിൽക്കുന്നതായിരിക്കും.

ഇ-ലേല പ്രമാണങ്ങളും ഇ-ലേല ഷെഡ്യൂളും www.mstcecommerce.com എന്ന വെബ്സൈറ്റിൽ ലഭ്യമാണ്. ഇ-ലേലത്തിൽ പങ്കെടുക്കുന്നതിനായി സമർപ്പിക്കുന്ന നിരതദ്രവ്യം SBI-യുടെ Internet Online Banking വിഴിയോ മറ്റ് ബാങ്കുകളുടെ കാര്യത്തിൽ NEFT വഴിയോ ഓൺലൈനായി സമർപ്പിക്കേ≠താണ്. ഇ-ലേലപ്രമാണങ്ങൾ www.mstcecommerce.com വെബ്സൈറ്റിലൂടെ ഓൺലൈനായി മാത്രമേ സ്വീകരിക്കുകയുള്ളു. നേരിട്ടോ തപാൽ മാർഗ്ഗമായോ ലഭിക്കുന്ന ഇ-ലേലപ്രമാണങ്ങൾ ഒരുകാരണവശാലും സ്വീകരിക്കുന്നതല്ല.

ടി ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ അവരുടെ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷ്യപ്പെടുത്തിയ സർട്ടിഫിക്കറ്റ് ബന്ധപ്പെട്ട വില്ലേജ് ആഫീസറിൽ നിന്നും വാങ്ങി ഇ-ലേലത്തിന് നിരതദ്രവ്യം കെട്ടിവയ്ക്കുന്നതോടൊപ്പം ഓൺലൈനായി ഹാജരാക്കേ≠താണ്.

നിയമാനുസൃത തിരിച്ചറിയൽ കാർഡോ സർട്ടിഫിക്കറ്റോ ഇല്ലാത്തവരുടെ ഇ-ലേല പ്രമാണങ്ങൾ യാതൊരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല.

ടി ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്നവർ ലേലത്തിനുമുമ്പായി ഉൽപ്പന്നങ്ങളുടെ ഗുണനിലവാരവും അളവും നേരിൽക≠് ബോധ്യപ്പെട്ടുകൊള്ളേ≠താണ്.

ഇ-ലേലത്തിന് ശേഷമുള്ള പരാതികൾ പരിഗണിക്കുന്നതല്ല.

ഈ വി⁄ാപന തീയതിക്ക് മുമ്പായി ദർഘാസ്/ലേലം സംബന്ധമായി സർക്കാർ ഉത്തരവുകൾ എന്തെങ്കിലും ഉ≠ായാൽ ആയതും ടി ഇ-ലേലത്തിന് ബാധകമായിരിക്കും.

വിൽപ്പനയ്ക്ക് വച്ചിട്ടുള്ള ഉൽപ്പന്നങ്ങൾ ഏതെങ്കിലും സർക്കാർ വകുപ്പുകൾക്ക് ആവശ്യമായി വരുന്നപക്ഷം ആയത് കഴിച്ചുള്ള ഉൽപ്പന്നങ്ങൾ മാത്രമേ വിൽക്കുകയുള്ളു. വിവിധ തോട്ടങ്ങളിലെ ജോലികൾ നടന്നുകൊ≠ിരിക്കുന്നതിനാൽ ലേലത്തിന് മുൻപുവരെ ഡമ്പിംഗ് ഡിപ്പോയിൽ ഇറക്കി ലോട്ട് ചെയ്യുന്ന ഉൽപ്പന്നങ്ങൾ കൂടി ടി ഇ-ലേലത്തിൽ ഉൾപ്പെടുത്തി വിൽക്കുന്നതായിരിക്കും.

It is hereby notified that the acacia timber, acacia firewood and miscellaneous jungle wood firewood collected through the felling of trees from the Elephant Rehabilitation Project area in ABP Range of Thiruvananthapuram Wildlife Division will be sold through e-auction as shown in the schedule by the Wildlife Warden, Thiruvananthapuram or any officer authorized by him subject to the terms and conditions published in Kerala Gazette No. 36 dated 16-9-2014, Gazette No. 43 dated 4-11-2014, Gazette No. 8 dated 24-2-2015, Gazette No. 34 dated 25-8-2015 and Gazette No. 40 dated 13-10-2015 and other conditions prevailing in the Forest Department.

Besides the approximate quantity shown in the schedule, the quantity if any delivered to dumping sites before the date of e-Auction will also be included in the sale. E-Auction documents and connected records are available in the website: www.mstcecommerce.com. The Earnest Money Deposit should be submitted on e-payment/e-treasury/demand draft/MSTC through the internet online banking of SBI or through NEFT for other Banks. For submission of e-auction visit the website:

www.mstcecommerce.com. All bids/e-auction documents are to be submitted online only and in the designated online cover(s)/envelop(s) on the www.mstcecommerce.com. Website and e-auction documents submitted manually/through post will not be entertained.

Online e-Auction/bids are to be accompanied with relevant documents. Any further clarification on this e-Auction can be obtained from NIC/the e-Auction Helpdesk number available in the website www.mstcecommerce.com and from the office of the Wildlife Warden, Thiruvananthapuram during the office hours. The details regarding e-Payment (Bidder's Bank Account No. where he/she is having core banking facility and email ID) should be submitted along with the e-Auction documents. E-Auction documents without these details will not be accepted. The Forest Department will not be responsible for any inconvenience or loss to the Bidder while uploading/downloading the documents.

The bidders who wish to participate in the e-auction should produce a certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer or any other approved identity documents along with the EMD through online. Those who do not produce any approved identity card or certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity and quality of materials put up for e-auction before the commencement of the same and no complaints will be entertained after the e-auction. In case any Govt. Department requires any of the materials put up for the e-auction, the quantity remaining after their selection only will be re-auctioned. The quantity that may become ready for sale after the publication of this notification will also be included in the e-auction. Any further notification to the sale conditions that may be issued by the Government after the issuance of this notification will also be applicable to this e-auction. The unsold materials in the e-auction will be placed along with the materials that may arrive in depot will be sold on auction date shown the schedule and separate notification will not be published for the same.

The tender forms are not transferable. Incomplete tenders and tender without EMD are liable to be rejected. The undersigned reserves the right to reject any tender without assigning any reasons thereof. All other conditions prevailing in the Kerala PWD and Forest Department and modifications there of time to time are applicable to this tender also. The tenders not containing the prescribed preliminary agreement in Stamp Paper worth ` 200 will be summarily rejected. If there is no response to any of the works included in this notification, the tender will again be conducted on 17-3-2020 as per the same conditions mentioned above, at the same time and venue.

കേരള വനം വകുപ്പിൽ രജിസ്റ്റർ ചെയ്തിട്ടുള്ള (സർക്കാർ ഉത്തരവ് എം.എസ്. 26/2017/എഫ്. ആന്റ ് ഡബ്ല്യൂ. എൽ. ഡി. തീയതി 20-5-2017) നിലവിൽ യോഗ്യരായ എ, ബി, സി ക്ലാസ്സ് കോൺട്രാക്ടർമാരിൽ നിന്നും താഴെ പട്ടികയിൽ വിവരിക്കുന്ന പ്രവർത്തികൾ ഏറ്റെടുത്ത് നടത്തുന്നതിന് ഇ-ടെ≠ർ മുഖേന ദർഘാസ് ക്ഷണിക്കുന്നു. ഇപ്പോൾ നിലവിലുള്ളതും സർക്കാർ ഇനി പ്രാബല്യത്തിൽ കൊ≠ുവരുന്നതുമായ എല്ലാ നിബന്ധനകളും തടി അട്ടിവയ്ക്കുന്നത് സംബന്ധിച്ച പ്രത്യേക നിബന്ധനകളും പാലിക്കാൻ ദർഘാസുകാർ ബാദ്ധ്യസ്ഥരാണ്. ദർഘാസ് പ്രമാണങ്ങളും ദർഘാസ് ഷെഡ്യൂളുകളും www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ ലഭ്യമാണ്. ദർഘാസിനോടൊപ്പം സമർപ്പിക്കുന്നതിനുള്ള നിരതദ്രവ്യം, ദർഘാസ് പ്രമാണവില എന്നിവ എസ്. ബി. എെ.-യുടെ ഇന്റർനെറ്റ് ഓൺലൈൻ ബാങ്കിംഗ് വഴിയോ മറ്റ് ബാങ്കുകളുടെ കാര്യത്തിൽ എൻ.ഇ.എഫ്.ടി. വഴിയോ ഓൺലൈൻ ടെ≠റിനോടൊപ്പം സമർപ്പിക്കേ≠താണ്. ദർഘാസുകൾ സമർപ്പിക്കാൻ www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റ് ഉപയോഗിക്കേ≠താണ്. കരാറുകാരന് ജി. എസ്. ടി. രജിസ്ട്രേഷൻ ഉ≠ായിരിക്കേ≠താണ്.

എല്ലാ ടെ≠ർ പ്രമാണങ്ങളും www.etenders.kerala.gov.in എന്ന വെബ്സൈറ്റിൽ കാണിച്ചിരിക്കുന്ന ഓൺലൈൻ കവറുകളിൽ ഓൺലൈനായി മാത്രം സമർപ്പിക്കേ≠താണ്. വെബ്സൈറ്റിലൂടെ ഓൺലൈനായി മാത്രമേ ദർഘാസുകൾ സ്വീകരിക്കുകയുള്ളൂ. നേരിട്ടോ തപാൽമാർഗ്ഗമോ ലഭിക്കുന്ന ദർഘാസുകൾ ഒരു കാരണവശാലും സ്വീകരിക്കുന്നതല്ല. താമസിച്ചു സമർപ്പിക്കുന്ന ടെ≠റുകളും സ്വീകരിക്കുന്നതല്ല.

5. ഇ-ജിപി സംവിധാനത്തിലൂടെ നിർദ്ദിഷ്ട തീയതിയും സമയവും കഴിഞ്ഞ് ഓൺലൈനായി ദർഘാസ് സമർപ്പിക്കുന്നതിന് അനുവദിക്കില്ല. ഏതെങ്കിലും തരത്തിലുള്ള നെറ്റ്വർക്ക് പ്രശ്നങ്ങൾ, ട്രാഫിക് കൺജഷൻ മുതലായവ ഒഴിവാക്കാൻ നിർദ്ദേശിച്ചിട്ടുള്ള തീയതിക്കും സമയത്തിനും മുമ്പായിതന്നെ ദർഘാസുകാർ ബിÕുകൾ സമർപ്പിക്കണം. ബിÕർ നേരിടുന്ന ഇത്തരം പ്രശ്നങ്ങൾക്ക് വകുപ്പ് ഉത്തരവാദി ആയിരിക്കുന്നതല്ല.

6. സാധുത ഇല്ലാത്ത, സജീവ രജിസ്ട്രേഷനുമില്ലാത്ത അയോഗ്യരായ ദർഘാസുകാർ ഇ-ടെ≠റിൽ പങ്കാളിയാകാതിരിക്കാൻ കർശനമായി നിർദ്ദേശിക്കുന്നു. അത്തരം സംഭവങ്ങൾ ശ്രദ്ധയിൽപെട്ടാൽ, ആയത് വ്യാജലേലമായി കണക്കാക്കപ്പെടുകയും അങ്ങനെയുള്ള ദർഘാസുകാരെ നിലവിലുള്ള ചട്ടങ്ങൾ അനുസരിച്ച് ബ്ലാക്ക് ലിസ്റ്റിൽ ഉൾപ്പെടുത്തുന്നതുമാണ്.

7. ഡിജിറ്റൽ സി·േച്ചർ സർട്ടിഫിക്കറ്റ് (DSC) ഉപയോഗിച്ച് ബിഡ് ചെയ്യുന്ന ലേലക്കാർ ഡിജിറ്റൽ ഒപ്പുവയ്ക്കുമ്പോൾ ഇ-ടെ≠റിന്റെ ഫോം/അനക്സർ ഉൾപ്പെടെയുള്ള നിബന്ധനകളും വ്യവസ്ഥകളും വ്യ‡മായി മനസ്സിലാക്കുകയും അംഗീകരിക്കുകയും ചെയ്തതായി അംഗീകരിക്കേ≠താണ്.

8. നിയമാനുസൃതമല്ലാതെയുള്ള മറ്റേതെങ്കിലും ഭാഗത്ത് വിലയുടെ വിശദാംശങ്ങൾ രേഖപ്പെടുത്തിയാൽ ബിഡ് അയോഗ്യ മാകുകയും ബിഡ് തിരസ്ക്കരിക്കുകയും ചെയ്യും.

9. ചെയ്യേ≠ പ്രവൃത്തിയുടെ ഇനങ്ങളും ഉപ-ഇനങ്ങളും ഇതോടൊപ്പമുള്ള ഷെഡ്യൂളിൽ രേഖപ്പെടുത്തിയിട്ടുള്ളതാണ്. മറ്റുവിധത്തിൽ വ്യ‡മാക്കിയിട്ടില്ലെങ്കിൽ, ടെ≠ർ മുഴുവനായോ അല്ലെങ്കിൽ ഒരു പ്രത്യേക ജോലിക്കോ ആയിരിക്കും കാണിക്കുക. ഭാഗിക ടെ≠റുകൾ തിരസ്ക്കരിക്കുന്നതാണ്. ലേലക്കാരൻ ഓരോ ജോലിക്കും നി›യിച്ചിരിക്കുന്ന ഇ.എം.ഡി. ഒടുക്കി ഒന്നിൽ കൂടുതൽ ജോലികൾക്ക് ടെ≠റിൽ പങ്കെടുക്കാവുന്നതാണ്. എന്നാൽ ഭാഗിക ജോലിക്കായി ടെ≠ർ രേഖപ്പെടുത്തുവാൻ പാടില്ല.

11. നി›ിത സമയത്തിന് മുമ്പ് ടെ≠ർ ഇ-ജി.പി. വെബ്സൈറ്റ് www.etenders.kerala.gov.in-ൽ ഡിജിറ്റൽ സി·േച്ചർ സർട്ടിഫിക്കറ്റ് ഉപയോഗിച്ച് ഓൺലൈനായി സമർപ്പിക്കേ≠താണ്. ടെ≠ർ ക്ഷണിക്കുന്ന അധികാരിയുടെ ഓഫീസിൽ ടി ടെ≠റുകൾ ഓൺലൈനായി തന്നെ ലേലക്കാരുടെ അല്ലെങ്കിൽ അവർ അധികാരപ്പെടുത്തിയ ഏജന്റുമാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കേ≠താണ്. ഏതെങ്കിലും കാരണത്താൽ നി›ിത തീയതിയിൽ ടെ≠ർ തുറക്കാൻ കഴിയാത്ത സാഹചര്യത്തിൽ ടെ≠ർ തുറക്കേ≠ പുതുക്കിയ സമയവും തീയതിയും ഇ-ജിപി വെബ്സൈറ്റിൽ പ്രസിദ്ധീകരിക്കുന്നതാണ്. ഇ-ജിപി വെബ്സൈറ്റ് പതിവായി ഇത്തരം അപ്ഡേറ്റുകൾക്കായി പരിശോധിക്കേ≠താണ്.

ഓരോ ടെ≠റിന്റെയും ആകെ തുക വായിച്ചു മനസ്സിലാക്കേ≠താണ്. ഓൺലൈനായി സമർപ്പിച്ച ബിÕുകളുടെ തിരുത്തലിനായി യാതൊരു വ്യവസ്ഥയും ഇല്ല. എന്നാൽ ഒരേ ജോലിക്ക് ഒന്നിൽ കൂടുതൽ ബിÕ് ചെയ്തിട്ടു≠െങ്കിൽ ടെ≠റിന്റെ അവസാന തീയതിക്കും സമയത്തിനും മുമ്പായി സമർപ്പിച്ച ഏറ്റവും പുതിയ ബിÕ് ആയിരിക്കും ഇ-ജിപി -ൽ തുടർ നടപടിക്കായി സ്വീകരിക്കുന്നത്. വ്യ‡ിഗത നിരക്കിന്റെ വിശദാംശങ്ങൾ രഹസ്യമായി സൂക്ഷിക്കും. അത് പരസ്യപ്പെടുത്തുകയില്ല. ഇക്കാര്യത്തിൽ സേവന കാലതാമസത്തിന് വകുപ്പ് ഉത്തരവാദി ആയിരിക്കില്ല.

12. വസിക്കുന്ന പ്രദേശത്തെ താലൂക്കിൽ നിന്നുള്ള സോൾവൻസി സർട്ടിഫിക്കറ്റിന്റെ പകർപ്പുകൾ സമർപ്പിക്കേ≠താണ്. അല്ലാത്തപക്ഷം ഓരോ ബില്ലിന്റെയും 20% ബിൽ തുക നിലനിർത്തും. പാൻ കാർഡുമായി കരാർ വയ്ക്കുമ്പോൾ പരിശോധനയ്ക്കായി ആദായ നികുതി അതോറിറ്റിക്ക് മുമ്പായി സമർപ്പിച്ച ആദായ നികുതി റിട്ടേൺസിന്റെ പകർപ്പാണ് ബിÕർ സമർപ്പിക്കേ≠ത്. അല്ലാത്തപക്ഷം 20% നികുതി കിഴിവിൽ കുറയ്ക്കും. ഉടമസ്ഥാവകാശം അല്ലെങ്കിൽ പങ്കാളിത്ത കമ്പനിയുടെ കാര്യത്തിൽ മേൽപ്പറഞ്ഞ പ്രകാരം ഉടമയ്ക്കോ ഉടമസ്ഥർക്കോ പങ്കാളികൾക്കോ സൂചിപ്പിച്ച സർട്ടിഫിക്കറ്റുകൾ സമർപ്പിക്കേ≠ത് ആവശ്യമാണ്.

13. ഏറ്റവും കുറഞ്ഞ ടെ≠ർ അംഗീകരിക്കുന്നതാണ്. കാരണം മാനദfiങ്ങളുടെ സ്വഭാവവും സാമ്പത്തിക നിലയും തൃപ്തികരമാണെന്ന് കാണാം. അതുകൊ≠ുതന്നെ ടെ≠ർ അംഗീകരിക്കുന്ന അധികാരിക്ക് ഏതെങ്കിലും കാരണത്താൽ തന്നെ ടെ≠ർ സ്വീകരിക്കുവാനോ നിരസിക്കുവാനോ ഉള്ള അധികാരങ്ങൾ ഉ≠ായിരിക്കും. ഇത്തരം പ്രവൃത്തികൾക്കെതിരെ അപ്പീൽ സാധ്യമല്ല.

14. 23-2-1976-ലെ ജി.ഒ.(പി) 62/1976/എ.ഡി. അനുസരിച്ച് പുറപ്പെടുവിച്ച രേഖകൾ 9-3-1976-ലെ ഗസറ്റ് പ്രസിദ്ധീകരിച്ചിട്ടുള്ളത്, പ്രവൃത്തികൾക്കായി രേഖാമൂലമുള്ള ടെ≠ർ തയ്യാറാക്കുന്ന ഏതൊരു വ്യ‡ിക്കും ബാധകമായിരിക്കും.

15. തടി വ്യാപാരികൾ, വിൽപന കൂപ്പ് കോൺട്രാക്ടർമാർ എന്നിവരൊഴികെ വനം വകുപ്പിന്റെ പരിധിയിലുള്ള തടി വ്യാപാരത്തിൽ ഏർപ്പെട്ടിരിക്കുന്ന മറ്റ് വ്യ‡ികൾ സമർപ്പിച്ചിട്ടുള്ള ടെ≠ർ ഡിവിഷൻ സ്ഥിതിചെയ്യുന്ന സ്ഥലമോ അടുത്തുള്ള ഡിവിഷനുകളോ സ്വീകരിക്കില്ല.

16. വലിപ്പത്തിന്റെ ഷെഡ്യൂൾ, നിർദ്ദിഷ്ട പ്രവർത്തനങ്ങളുടെ നിർവ്വചനങ്ങൾ, കരാറിന്റെ വ്യവസ്ഥകൾ എന്നിവ ഇ-ജിപി വെബ്സൈറ്റിൽ കാണാൻ കഴിയും. കൃത്യമായ തിരുത്തലുകളോ അല്ലെങ്കിൽ കൃത്യതയ്ക്കുവേ≠ിയുള്ള ഉത്തരവാദിത്വമോ സർക്കാർ സ്വീകരിക്കുന്നില്ലെന്ന കാര്യം തീർച്ചയായും മനസിലാക്കും. വ്യവസ്ഥാപിത ഡിപ്പാർട്ടുമെന്റ ് ഉദ്യോഗസ്ഥനെ വിവേചനാധികാരത്തിൽ, ഒഴിവാക്കൽ, കിഴിവ്, അല്ലെങ്കിൽ കൂട്ടിച്ചേർക്കലുകളിലൂടെ മാറ്റം വരുത്താൻ ഷെഡ്യൂൾ ബാധ്യതയുള്ള കരാർ ഈ തുകയുടെ അടിസ്ഥാനത്തിൽ തുകയുടെ തുക ടെ≠ർ തുകയുടെ അടിസ്ഥാനത്തിൽ ആയിരിക്കും.

17. ഇ-ജിപി വെബ്സൈറ്റിൽ നിന്നുള്ള ടെ≠ർ ഫോമുകളും ജനറൽ സ്പെസിഫിക്കേഷനുകളും സൗജന്യമായി ഡൗൺലോഡ് ചെയ്യാം. നിർദ്ദിഷ്ട ഓൺലൈൻ ഫോർമാറ്റിൽ സമർപ്പിക്കാത്തതും ഷെഡ്യൂളിൽ രേഖപ്പെടുത്തിയിരിക്കുന്ന നിരക്കുകൾ, അളവ്, യൂണിറ്റുകൾ എന്നിവയിൽ അക്കത്തിലും അക്ഷരത്തിലും രേഖപ്പെടുത്തലുകൾ വരുത്താത്തതും തെറ്റുകൾ ഉള്ളതും, ടെ≠ർ നോട്ടീസ്, ടെ≠ർ ഷെഡ്യൂൾ, ടെ≠ർ ക≠ീഷൻസ്, അനക്സേഴ്സ് തുടങ്ങിയവയിൽ ഒപ്പ് രേഖ പ്പെടുത്താതെയും അപ്ലോഡ് ചെയ്തിട്ടുള്ള ടെ≠റുകളും നിരസിക്കുന്നതാണ്.

18. ടെ≠ർ സ്വീകരിക്കുന്ന അവസാന തീയതിക്ക് ശേഷം വരുന്ന പോസ്റ്റ് ഓഫറുകളോ റെപ്രസെന്റേഷനോ അംഗീകരിക്കുന്നതല്ല.

19. ദർഘാസിൽ പങ്കെടുത്ത് ഏറ്റവും കുറഞ്ഞ നിരക്ക് രേഖപ്പെടുത്തിയിട്ടുള്ള ര≠് പേരുടെ ഒഴികെ ദർഘാസിൽ പങ്കെടുത്തിട്ടുള്ള വിജയികളാവാത്ത ദർഘാസുകാരുടെ നിരതദ്രവ്യം ടെൻഡർ നടപടികൾ അവസാനിക്കുന്ന മുറയ്ക്ക് തിരികെ നൽകുന്നതാണ്. ദർഘാസ് ഉറപ്പിച്ചവയിൽ നിന്നും ജോലി തുടങ്ങുന്നതിനുള്ള എഗ്രിമെന്റ ് വെച്ച് കഴിഞ്ഞാൽ ര≠ാം ദർഘാസുകാരന്റെ നിരതദ്രവ്യവും മടക്കി നൽകുന്നതാണ്. e-procurement സിസ്റ്റത്തിലെ XML ഫയൽ വഴി ബാങ്ക് മുഖേനയാണ് തുക മടക്കി നൽകുന്നത്. ടി സേവനത്തിൽ ഉ≠ാകുന്ന കാലതാമസത്തിന് വകുപ്പ് ഉത്തരവാദി ആയിരിക്കുന്നതല്ല.

21. വിജയിയായ ദർഘാസുകാരൻ ദർഘാസ് തുകയുടെ 10% പരമാവധി 5 ലക്ഷം രൂപ സെക്യൂരിറ്റി ഡെപ്പോസിറ്റായി നിക്ഷേപിക്കേ≠തും, ദർഘാസ് അംഗീകരിക്കുന്ന ദിവസം മുതൽ 10 ദിവസത്തിനുള്ളിൽ ദർഘാസ് തുകയുടെ 0.1% മൂല്യമുള്ള സ്റ്റാമ്പ് പേപ്പറിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുമായി ഉടമ്പടി ഒപ്പ് വയ്ക്കേ≠തുമാണ്. സെക്യൂരിറ്റി തുക ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ പേരിൽ ഗവൺമെന്റ ് ട്രഷറിയിൽ πഡ്ജ് ചെയ്ത് നിക്ഷേപിക്കേ≠തുമാണ്. നി›ിത സമയ പരിധിക്കുള്ളിൽ സെക്യൂരിറ്റി ഒടുക്കാത്തതോ എഗ്രിമെന്റ ് ഉടമ്പടി ഒപ്പ് വയ്ക്കാത്തതുമായ ടെ≠റുകൾ റദ്ദാക്കപ്പെടും.

23. സ്റ്റാക്ക് പ്രവൃത്തി അവസാനിക്കുന്നതുവരെ കരാറുകാരൻ ക്രമീകൃതവും വ്യവസ്ഥാപിതവുമായ രീതിയിൽ പ്രവർത്തിക്കുമെന്ന് കരാറുകാരൻ ഉറപ്പു വരുത്തണം.

24. ഷെഡ്യൂളിൽ പരാമർശിച്ചിട്ടുള്ള അളവ് മാത്ര ഏകദേശമാണ്. തോട്ടത്തിൽ നിന്ന് ശേഖരിച്ച മുഴുവൻ മരവും വിറകും കരാറുകാരൻ നിയമാനുസൃതം അട്ടിവയ്ക്കേ≠താണ്.

25. കരാറിൽ ഉൾപ്പെട്ട സ്ഥലത്തിന്റെയും തടികളുടെയും ബില്ലറ്റിന്റെയും ഫയർവുഡിന്റെയും സുരക്ഷാ ഉത്തരവാദിത്വം കരാറുകാരനിൽ നിക്ഷിപ്തമായിരിക്കും. തടികളോ/ബില്ലറ്റുകളോ/വിറകുകളോ കത്തിച്ച് നശിപ്പിക്കപ്പെടുകയോ നഷ്ടപ്പെടുകയോ ചെയ്താൽ ആയതിന്റെ നിലവിലുള്ള ഷെഡ്യൂൾ നിരക്ക് പ്രകാരമുള്ള തുകയും തേക്ക്, ഈട്ടി എന്നിവയുടെ കാര്യത്തിൽ ഡിപ്പോയിലെ ഏറ്റവും ഉയർന്ന നിരക്കിലുള്ള തുക കോൺട്രാക്ടറിൽ നിന്ന് ഈടാക്കുന്നതാണ്. മുകളിൽ പറഞ്ഞിരിക്കുന്ന സുരക്ഷയിൽ തീ, മോഷണം, ജൈവപരമായ ഇടപെടൽ എന്നിവ ഉൾപ്പെടുത്തിയിട്ടുള്ളതാണ്.

27. മറ്റ് വിവരങ്ങൾ ഏതെങ്കിലും പ്രവൃത്തി ദിവസങ്ങളിൽ ഓഫീസ് സമയങ്ങളിൽ പുനലൂരിലെ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ, ടിമ്പർ സെയിൽസ്, പുനലൂരിൽ നിന്ന് കൂടുതൽ വിവരങ്ങൾ ലഭ്യമാണ്.

28. കരാർ വ്യവസ്ഥയിൽ എന്തെങ്കിലും ആവശ്യമു≠െങ്കിൽ മാറ്റങ്ങൾ വരുത്താനുള്ള എല്ലാ അധികാരങ്ങളും ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, സതേൺ സർക്കിൾ, കൊല്ലം.

31. കോൺട്രാക്ടർ എന്നറിയപ്പെടുന്ന വിജയിയായ കരാറുകാരൻ (അനുബന്ധം 13)-ൽ പറയുന്ന നിർദ്ദിഷ്ട ഫോറത്തിൽ ടി ജോലിയുടെ ചുമതലയുള്ള ഉദ്യോഗസ്ഥനിൽ നിന്നും രസീത് പ്രകാരമുള്ള സ്റ്റോക്കും അതിർത്തിയും ബോധ്യപ്പെട്ട് ഉടമ്പടി തീയതിയിൽ പറയും പ്രകാരം ജോലികൾ പരിശോധിച്ച് ബോദ്ധ്യപ്പെട്ട് ഏറ്റെടുക്കുകയും പാർട്ട് 2-ൽ പറയുന്ന ജോലികൾ ഫോറസ്റ്റ് ഡിപ്പാർട്ട്മെന്റ ് ഓഫീസറുടെ കാലാകാലങ്ങളിലുള്ള നിർദ്ദേശ പ്രകാരം പൂർത്തീകരിക്കേ≠തുമാണ്.

32. കരാർ കാലാവധി ടെൻഡർ ഷെഡ്യൂളിൽ ആയിരിക്കണം. ഡിപ്പാർട്ട്മെന്റിന്റെ നിയന്ത്രണത്തിനപ്പുറം കാരണങ്ങളാൽ ഈ മേഖലയിൽ നടപ്പാക്കാൻ കഴിയുന്ന വകുപ്പുകൾ ഗവൺമെന്റോ വകുപ്പിനോ ഏറ്റെടുക്കുന്നില്ലെങ്കിൽ വനംവകുപ്പിന്റെ കരാർ ഹ്രസ്വമായി അവസാനിക്കും. അത്തരം സാഹചര്യങ്ങളിൽ നഷ്ടപരിഹാരം നൽകാൻ വകുപ്പില്ല.

33. കരാർ പ്രദേശത്ത് നടക്കുന്ന പ്രവൃത്തിയുടെ മേൽനോട്ടത്തിനായി കോൺട്രാക്ടർ ചുമതലപ്പെടുത്താൻ ഉദ്ദേശിച്ചിട്ടുള്ള ആളുകളുടെ പേര്, വിലാസം, കയ്യൊപ്പ്, എെ. ഡി. പ്രൂഫ് എന്നിവ അടങ്ങിയ ഒരു ലിസ്റ്റ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് സമർപ്പിക്കേ≠തും ടി ലിസ്റ്റിൽ ഉൾപ്പെടാത്ത ഏതെങ്കിലും കരാർ ജീവനക്കാരൻ ടി പ്രദേശത്ത് പ്രവേശിക്കാൻ അനുവദിക്കുന്നതുമല്ല. കൂടാതെ ഏതെങ്കിലും ജീവനക്കാരനെ കരാർ പ്രദേശത്ത് നിന്ന് നീക്കം ചെയ്യാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ ഉത്തരവിടുന്നപക്ഷം കോൺട്രാക്ടർ ആയത് നടപ്പിലാക്കേ≠താണ്. ടി കരാർ കാലയളവിൽ തന്നെ ടി ഡിപ്പാർട്ട്മെന്റിന്റെ മറ്റേതെങ്കിലും കരാർ ജോലിയിൽ ഉൾപ്പെട്ടിരിക്കുന്ന ആളുകളെ ടി കരാറിൽ ഉൾപ്പെടുത്താൻ പാടില്ല.

34. പുനലൂർ ടിമ്പർ സെയിൽസ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ രേഖാമൂലമുള്ള അനുമതിയോടുകൂടി മാത്രമേ കരാറുകാരനോ ടിയാന്റെ ആളുകളോ കരാർ പ്രദേശത്ത് പ്രവേശിക്കുവാൻ പാടുള്ളൂ.

35. കരാറുകാരൻ അല്ലെങ്കിൽ ടിയാന്റെ തൊഴിലാളികൾക്ക് താമസിക്കുവാൻ ഷെഡുകൾ കെട്ടുന്നതിന് സ്ഥലം ആവശ്യമാണെങ്കിൽ റെയിഞ്ച് ഓഫീസർ കരാർ പ്രദേശത്തിനകത്തോ പുറത്തോ ഉള്ള മതിയായ സ്ഥലം അനുവദിക്കും. കരാറുകാരനും ടിയാന്റെ ആളുകളും ഉപയോഗിക്കുന്ന ഉപകരണങ്ങളും മറ്റ് വസ്തുക്കളും ശേഖരിക്കുന്നതിന് അത്തരം അംഗീകൃത സൈറ്റുകൾ മാത്രം ഉപയോഗിക്കേ≠താണ്.

36. കരാർ പ്രദേശത്ത് പ്രവർത്തിക്കുന്ന കരാറുകാരും ഏജന്റുമാരും മറ്റ് ജീവനക്കാരും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ അല്ലെങ്കിൽ ഈ കരാർ പ്രവർത്തനവുമായി ബന്ധപ്പെട്ട് ചുമതലപ്പെട്ട മറ്റേതെങ്കിലും ഓഫീസർ നൽകിയ എല്ലാ ഉത്തരവുകളും പാലിക്കേ≠താണ്.

37. ഏത് സാഹചര്യത്തിലായാലും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ അനുമതി ഇല്ലാതെ കരാറുകാരൻ മറ്റേതെങ്കിലും കരാറുകാരെ ടി ജോലി നിർവ്വഹിക്കാൻ ചുമതലപ്പെടുത്താൻ പാടില്ല.

38. 1961-ലെ കേരള വന നിയമം, 1972-ലെ വന്യജീവി സംരക്ഷണ നിയമം എന്നിവ പ്രകാരമുള്ള ചട്ടങ്ങൾക്കനുസൃതമായി കരാർ കാലാവധിക്കനുസരിച്ച് പ്രവർത്തിക്കുവാൻ കോൺട്രാക്ടർ ബാദ്ധ്യസ്ഥനാണ്.

39. കോൺട്രാക്ടർ, അയാളുടെ അംഗീകൃത ഏജന്റുമാർ, കരാർ ഏരിയയിൽ ഏർപ്പെട്ടിരിക്കുന്ന മറ്റ് ജീവനക്കാർ എന്നിവർ ഡിപ്പോ വാച്ചറുടെ പദവിയിൽ കുറയാത്ത ഒരു വനം ഉദ്യോഗസ്ഥൻ ആവശ്യപ്പെടുന്നപക്ഷം കാട്ടുതീ തടയുക, വനം കുറ്റകൃത്യംതടയുക എന്നീ കാര്യങ്ങളിൽ കരാർ പ്രദേശം ഉൾപ്പെടുന്ന ഡിപ്പോ പരിസരത്ത് വനംവകുപ്പ് ജീവനക്കാർക്ക് സഹായം നൽകേ≠താണ്.

40. 1961-ലെ കേരള വന നിയമം, 1972-ലെ വന്യജീവി സംരക്ഷണ നിയമം എന്നിവ പ്രകാരം കരാർ പ്രദേശത്ത് അനധികൃത മരംമുറിയോ മറ്റ് വനം കുറ്റങ്ങളോ നടന്നാൽ ആയതിന് ടി നിയമപ്രകാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ ചുമത്തുന്ന പിഴ ഈടാക്കുന്നതും ടി നിയമപ്രകാരമുള്ള ശിക്ഷാനടപടികൾക്ക് വിധേയമാക്കുന്നതുമാണ്.

41. കരാറുകാരൻ തന്റെ ഏജന്റുമാർക്കും മറ്റ് ജീവനക്കാർക്കും കരാർ പ്രദേശത്ത് പ്രവേശിക്കുന്നതിനും ജോലി ചെയ്യുന്നതിനും ഒരു രേഖാമൂലമുള്ള അധികാരം നൽകണം. ഇപ്രകാരം അധികാരം നൽകിയിട്ടുള്ളത് ബീറ്റ് വനം ഓഫീസർ റാങ്കിൽ താഴെ അല്ലാത്ത ഏതെങ്കിലും വനം ഓഫീസർ പരിശോധനയ്ക്ക് വിധേയമാക്കേ≠താണ്. കരാറുകാരനോ ടിയാന്റെ ഏജന്റോ മറ്റ് ജീവനക്കാരോ വരുത്തുന്ന എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദി ആയിരിക്കുന്നതാണ്. കരാറുകാരനോ ടിയാന്റെ ഏജന്റോ കരാർ പ്രദേശത്ത് യഥാർ∞ കാരണങ്ങളില്ലാതെ തുടർച്ചയായി ഏഴ് ദിവസത്തിൽ കൂടുതൽ ഹാജരാകാതിരുന്നാൽ ടി കരാർ റദ്ദാക്കുന്നതും വനം വകുപ്പ് തന്നെ ടി കരാർ ഏറ്റെടുത്ത് നടത്തുന്നതും ആയതുമൂലമു≠ാകുന്ന സർക്കാർ നഷ്ടത്തിന് കരാറുകാരൻ തന്നെ ഉത്തരവാദി ആയിരിക്കുന്നതുമാണ്.

42. ടി ജോലിയുടെ ചുമതലയുള്ളതോ ടി ജോലിയുമായി നേരിട്ട് ബന്ധമുള്ളതോ ആയ ഏതെങ്കിലും ഗവൺമെന്റ ് ഉദ്യോഗസ്ഥരുമായി കരാറുകാരന് താഴെപ്പറയുന്ന പ്രകാരമുള്ള ബന്ധങ്ങൾ പാടുള്ളതല്ല [അ—ൻ, അമ്മ (ര≠ാനമ്മ), മകൻ (ഭർത്താവിന്റെ മകൻ), മകന്റെ ഭാര്യ, മകൾ (ഭർത്താവിന്റെ മകൾ), മകളുടെ ഭർത്താവ്, സഹോദരങ്ങൾ, സഹോദര ഭാര്യമാർ, സഹോദരി (ര≠ാനമ്മയുടേയോ ര≠ാന—ന്റേയോ മകനോ മകളോ), സഹോദരീ ഭർത്താവ്, അ—ന്റെ അമ്മ, അ—ന്റെ അ—ൻ, അമ്മേടെ അമ്മ, അമ്മേടെ അ—ൻ, മകന്റേയും മകളുടേയും മക്കൾ].

44. കോൺട്രാക്ടറോ ടിയാന്റെ ജീവനക്കാരോമൂലം വനംവകുപ്പിനു≠ാകുന്ന ഏതെങ്കിലും തരത്തിലുള്ള ബാദ്ധ്യത കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ തീർപ്പാക്കുന്നതും ആയതിന് ഡിപ്പാർട്ട്മെന്റ ് ഉത്തരവാദി ആയിരിക്കുന്നതുമല്ല.

45. കരാറുകാരൻ കരാർ ജോലികൾക്കായി ടി പ്രദേശത്ത് താമസിക്കുന്ന ആദിവാസികൾക്ക് മുൻഗണന നൽകേ≠താണ്.

46. വനത്തിനും വന്യജീവികൾക്കും യാതൊരു കേടുപാടും വരുത്താതെ കരാറുകാരൻ യന്ത്രം/ട്രാക്ടർ ഉപയോഗിച്ച് അട്ടിവയ്പ്പ് നടത്താവുന്നതും ആയത് സംബന്ധിച്ച് സത്യവാങ്മൂലം ടെ≠ർ സമർപ്പിക്കുന്നതിനോടൊപ്പം അനുബന്ധം 1 ആയി എഴുതി സമർപ്പിക്കേ≠തുമാണ്.

47. പാർട്ട് 2 ടെ≠റിൽ പ്രദർശിപ്പിച്ചിട്ടുള്ള ജോലിയുടെ വിവിധ ഇനങ്ങളുടെ സമയ ക്രമങ്ങളും ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥർ സമയാസമയങ്ങളിൽ നൽകുന്ന നിർദ്ദേശങ്ങളും പാലിക്കേ≠താണ്. കേരള വനം വകുപ്പിന്റെ ഉദ്യോഗസ്ഥർ നിർദ്ദേശിച്ച വിവിധ ഇനങ്ങളുടെ സമയപരിധി കർശനമായും പാലിക്കണം.

48. 1970-ലെ കരാർ ലേബർ (റെഗുലേഷൻ & അബോളിഷൻ) ആക്ടിൽ നിർദ്ദേശിച്ച പ്രകാരം കരാർ കിട്ടി ഒരു മാസത്തിനകം കരാറുകാരൻ ലൈസൻസിന് അപേക്ഷിക്കേ≠തും ലൈസൻസ് നേടേ≠തുമാണ്. കൂടാതെ എല്ലാ ദിവസവും 20-ൽ കൂടുതൽ ജോലിക്കാരെ ജോലിക്ക് നിയോഗിക്കേ≠തുമാണ്. ടി വ്യവസ്ഥ ലംഘിക്കുന്നപക്ഷം 1974-ലെ കേരളാ കരാർ ലേബർ (റെഗുലേഷൻ & അബോളിഷൻ) റൂൾ 24 പ്രകാരം ലൈസൻസ് ഫീസ്, സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് എന്നിവയ്ക്ക് തുല്യമായ തുക കരാറുകാരന്റെ ബില്ലിൽ നിന്നും മുന്നറിയിപ്പ് കൂടാതെ തിരിച്ച് പിടിക്കുന്നതാണ്.

49. ടി കരാർ ജോലി ചെയ്യുന്നതിനായി ജോലിക്കാരെ ചുമതലപ്പെടുത്തുകയോ ഒഴിവാക്കുകയോ ചെയ്യുന്നത് കരാറുകാരന്റെ മാത്രം ഉത്തരവാദിത്വം ആയിരിക്കും. വനം വകുപ്പ് ആയതിന് ഉത്തരവാദി ആയിരിക്കുന്നതല്ല.

50. എംπോയീസ് സ്റ്റേറ്റ് ഇൻഷ്വറൻസ് ആക്ട്, 1948, എംπോയീസ് പ്രോവിഡന്റ ് ഫ≠് ആക്ട് 1952, പലവക പ്രോവിഡന്റ ്സ് ആക്ട് 1976 എന്നീ നിയമങ്ങൾക്ക് വിധേയമായി കരാറുകാരൻ പ്രവർത്തിക്കേ≠താണ്. കരാർ ജോലിയിൽ ഏർപ്പെട്ടിരിക്കുന്ന ജീവനക്കാരുടെ പേരും മറ്റ് വിവരങ്ങളും കേരള വനം വകുപ്പിനെ അറിയിക്കേ≠തുമാണ്.

51. കരാറുകാരൻ കരാർ പ്രദേശം കാട്ടുതീ, കയ്യേറ്റം, മനുഷ്യരുടെയും മൃഗങ്ങളുടെയും ശല്യം എന്നിവയിൽ നിന്നും സംരക്ഷിക്കേ≠താണ്. കരാർ പ്രദേശത്തോ ചുറ്റുപാടിലോ കാട്ടുതീ ശ്രദ്ധയിൽപ്പെട്ടാൽ ആയത് കെടുത്തുവാനായി വാച്ചർമാരുടെയോ മറ്റ് തൊഴിലാളികളുടെയോ സേവനം ഉപയോഗപ്പെടുത്താവുന്നതും അപ്രകാരം ആവശ്യമായ നടപടികൾ സ്വീകരിച്ചശേഷം ഏറ്റവും ചുരുങ്ങിയ സമയത്തിനുള്ളിൽ ഏത് വിധേനയും ബന്ധപ്പെട്ട ഉദ്യോഗസ്ഥനെ അറിയിക്കേ≠തുമാണ്. കരാറുകാരന്റെയോ ടിയാന്റെ തൊഴിലാളികളുടെയോ അശ്രദ്ധമൂലം തീ പിടിത്തം ഉ≠ായാൽ ആയതുമൂലം ഉ≠ാകുന്ന സർക്കാർ നഷ്ടം കരാറുകാരനിൽ നിന്നും ഈടാക്കുന്നതാണ്.

52. കരാറുകാരൻ കരാർ നടപടിയുടെ ഷെഡ്യൂളിൽ പറഞ്ഞിരിക്കുന്ന എല്ലാ പ്രവർത്തനങ്ങളും അല്ലെങ്കിൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ നിർദ്ദേശപ്രകാരം വകുപ്പ് ആവശ്യപ്പെടുന്ന മറ്റേതെങ്കിലും പ്രവർത്തനങ്ങളും ചെയ്യേ≠താണ്.

53. അളവെടുക്കൽ പുസ്തകത്തിൽ അളവെടുക്കുകയും റെക്കോർഡ് ചെയ്യുകയും ചെയ്യുന്ന സമയത്ത് സൈറ്റിലെ കോൺട്രാക്ടറോ അധികാരമുള്ള പ്രതിനിധിയോ സന്നിഹിതരായിരിക്കണം. ആയത് പരിശോധിച്ച് ബോധ്യപ്പെട്ട് ഒപ്പിടേ≠തും തീയതി രേഖപ്പെടുത്തേ≠തുമാണ്. അളവെടുക്കുന്ന സമയം എടുക്കുന്ന സമയത്ത് സൈറ്റിലെ കോൺട്രാക്ടർ/അധികാരപ്പെടുത്തിയ പ്രതിനിധി ഹാജരാകാത്തപക്ഷം അളവെടുപ്പ് പുസ്തകത്തിൽ രേഖപ്പെടുത്തിയിരിക്കുന്ന അളവുകൾ കരാറുകാരനെ ബാധിക്കുന്നതാണ്. ഇക്കാര്യത്തിൽ ഒരു പരാതിയും ഇല്ലാത്തതാണ്.

54. ഓരോ ഭാഗം ബില്ലിന്റെയും 10% തുക നിക്ഷിപ്തമായ തുകയായി നിലനിർത്തപ്പെടും, ആയത് കരാർ പ്രകാരം ജോലി പൂർത്തിയാകുന്ന മുറയ്ക്ക് ബാധ്യത ഉ≠െങ്കിൽ അത് തീർപ്പാക്കിയശേഷം നൽകുന്നതായിരിക്കും.

55. കാലാകാലങ്ങളിൽ അറിയിച്ചതുപോലെ ആദായനികുതി അല്ലെങ്കിൽ ഗവൺമെന്റിനാൽ നിർദ്ദേശിച്ചിട്ടുള്ള നികുതി എന്നിവപോലുള്ള എല്ലാ നിയമാനുസൃത ഇളവുകളും കോൺട്രാക്ടർക്ക് നോട്ടീസയയ്ക്കാതെ ബില്ലിൽ നിന്ന് കുറയ്ക്കപ്പെടും.

56. കോൺട്രാക്ടർ ടി കരാർ ജോലി സംബന്ധിച്ച അന്തിമ ബിൽ പാസാക്കുന്നതിന് മുൻപ് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ മുൻപാകെ സാധുവായ നികുതി ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റുകൾ ഹാജരാക്കേ≠താണ്.

57. ജോലി തൃപ്തികരമല്ലെങ്കിൽ തൃപ്തികരമായ രീതിയിൽ ജോലി പൂർത്തിയാക്കുന്നതുവരെ ഭാഗികമായോ പൂർണ്ണമായോ ബിൽ തുക അനുവദിക്കാതെ തടഞ്ഞ് വെയ്ക്കുന്നതായിരിക്കും.

58. ജോലി ചെയ്യുന്നതിനിടയിൽ പ്രവർത്തിയുടെ പുരോഗതിയും തൊഴിലാളിയുടെ ഉചിതമായ നിർവഹണം തൃപ്തികര മല്ലെന്നോ അല്ലെങ്കിൽ ഈ കരാറിൽ പറഞ്ഞിരിക്കുന്ന ഏതെങ്കിലും പ്രവർത്തികൾ ഏറ്റെടുത്തിട്ടില്ലെന്നോ ഭാഗികമായി മാത്രം ചെയ്യുകയോ ചെയ്തു എന്ന് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ ക≠െത്തിയാൽ, ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ നൽകിയിട്ടുള്ള 15 ദിവസത്തെ നോട്ടീസ് കാലാവധിക്കുശേഷം ടി കരാർ റദ്ദാക്കുന്നതും ടി പ്രവർത്തികൾ ഡിപ്പാർട്ടുമെന്റ ് ഏറ്റെടുത്ത് നിർവഹിക്കുന്നതും ആയതുമൂലം ഉ≠ാകുന്ന കഷ്ട നഷ്ടങ്ങൾക്ക് കരാറുകാരൻ ഉത്തരവാദി ആയിരിക്കുന്നതുമാണ്. എന്നാൽ ഈ കരാറിൽ വകുപ്പിന് ഉ≠ായേക്കാവുന്ന ലാഭത്തിന് കരാറുകാരന് അർഹതയു≠ായിരിക്കില്ല.

59. കരാറുകാരൻ ജോലി പാതിവഴിയിൽ ഉപേക്ഷിക്കുകയാണെങ്കിൽ കരാറുകാരന് കിട്ടേ≠ ബില്ലുകൾ തടഞ്ഞ് വെയ്ക്കുകയും EMD-യും സെക്യൂരിറ്റി ഡെപ്പോസിറ്റും ക≠ുകെട്ടുന്നതുമാണ്. കൂടാതെ കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ഡിപ്പാർട്ടുമെന്റ ് തന്നെ ബാക്കി ജോലികൾ ഏറ്റെടുത്ത് നിർവഹിക്കുന്നതായിരിക്കും. ആയതിനായി ടി ജോലി പുനർ ദർഘാസ് ചെയ്യുന്നതും അടിയന്തിര ജോലികൾ പുനർ ദർഘാസ് നടപടികൾ പൂർത്തിയാകുന്നതിനുമുമ്പായി ഡിപ്പാർട്ടുമെന്റിൽ നിലവിലുള്ള വ്യവസ്ഥകൾ പ്രകാരം ചെയ്യുന്നതും ടി ജോലിക്ക് ചിലവാകുന്ന തുക കരാറുകാരനിൽ നിന്നും ഈടാക്കുന്നതുമാണ്.

60. ടി കരാറിലെ ഏതെങ്കിലും നിബന്ധനയോ അല്ലെങ്കിൽ ഈ കരാറിനോടനുബന്ധിച്ച ടെ≠ർ വ്യവസ്ഥകൾ അല്ലെങ്കിൽ കൺഫർമേഷൻ ഓർഡറിലെ വ്യവസ്ഥകളോ കരാറുകാരൻ ലംഘിക്കുകയാണെങ്കിൽ അതിൽ അടങ്ങിയിരിക്കുന്ന തെന്താണെങ്കിലും ഫോറസ്റ്റ് ആക്ട്, 1961 വന്യജീവികൾ (സംരക്ഷണം) നിയമം 1972, പ്രകാരം ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുയോജ്യമായ ശിക്ഷ നൽകുന്നതും പരമാവധി ശിക്ഷയായി കരാർ റദ്ദാക്കുകയും സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് ക≠ുകെട്ടുകയും ചെയ്യും. കരാർ റദ്ദാക്കുന്നതിന്റെ അനന്തരഫലമായി സർക്കാരിന് ഉ≠ാകുന്ന എല്ലാ നഷ്ടങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദി ആയിരിക്കുന്നതാണ്.

61. കരാർ കാലാവധി സാധാരണയായി യാതൊരു കാരണവശാലും ദീർഘിപ്പിച്ച് നൽകുന്നതല്ല. എന്നിരുന്നാലും നി›ിത സമയപരിധിക്കകം ജോലികൾ പൂർത്തീകരിക്കാൻ സാധിക്കാത്തതിന്റെ കാരണം തൃപ്തികരമാണെന്ന് ബോധ്യപ്പെടുന്ന പക്ഷം കരാറുകാരന്റെ കാലയളവ് ഒന്ന്/മൂന്ന്/ആറ് എന്നീ മാസങ്ങളായി Divisional Forest Officer/CCF/APCCF എന്നിവർക്ക് ദീർഘിപ്പിച്ച് നൽകാവുന്നതാണ്.

62. കരാറിന്റെ കാലാവധി അവസാനിക്കുന്ന സമയത്ത് കരാറിന്റെ എല്ലാ അവകാശങ്ങളും അവസാനിക്കുന്നതും കൂടാതെ ഏതെങ്കിലും ആവശ്യത്തിനായി കരാർ പ്രദേശത്ത് പ്രവേശിക്കാൻ പാടില്ലാത്തതുമാണ്. കരാറിന്റെ കാലാവധി തീരുമ്പോൾ കരാറുകാരനെയോ അയാളുടെ ഏതെങ്കിലും ആളുകളെയോ ഈ പ്രദേശത്ത് ക≠െത്തുകയാണെങ്കിൽ കരാറുകാരന് നിയമാനുസൃതമായ ഉത്തരവാദിത്വം ഉ≠ായിരിക്കുന്നതാണ്. കൂടാതെ പ്രോസിക്യൂഷൻ നടപടി നേരിടാൻ ബാദ്ധ്യസ്ഥനുമാണ്.

63. തൊഴിലാളികൾക്ക് ഏതെങ്കിലും തരത്തിലുള്ള കുടിശ്ശിക വന്നാൽ ആയത് 1923-ലെ തൊഴിലാളികളുടെ നഷ്ടപരിഹാര നിയമം അല്ലെങ്കിൽ തൊഴിലാളികൾക്കുള്ള നിയമാനുസൃതമായ മറ്റ് വ്യവസ്ഥകൾ പ്രകാരവും ടി തുക കോൺട്രാക്ടർ നൽകേ≠താണ്. അങ്ങനെ ചെയ്യുന്നതിൽ പരാജയപ്പെടുന്നത് ഈ കരാർ നിബന്ധനകളുടെയും വ്യവസ്ഥകളുടെയും ലംഘനമായി കണക്കാക്കും.

64. കരാർ ജോലി തീർപ്പായതിനുശേഷം കരാറുകാരന്റെ പേരിൽ ഏതെങ്കിലും തരത്തിലുള്ള ബാദ്ധ്യത ക≠െത്തിയാൽ ടി തുക കോൺട്രാക്ടറുടെ സെക്യൂരിറ്റി തുകയിൽ നിന്നോ പാർട്ട് ബില്ലിൽ നിന്നോ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ ഈടാക്കുന്നതാണ്. അല്ലെങ്കിൽ 1968-ലെ റവന്യൂ റിക്കവറി ആക്ട് പ്രകാരമുള്ള നടപടികൾ മുഖേന കോൺട്രാക്ടറുടെ സ്ഥാവര ജംഗമ വസ്തുക്കളിൽ നിന്നും ഈടാക്കുന്നതാണ്. കരാർ പ്രകാരമുള്ള ജോലികൾ ചെയ്ത് തീർത്ത് ബാദ്ധ്യതകൾ തിട്ടപ്പെടുത്തി ബാദ്ധ്യത ഉ≠െങ്കിൽ ആയത് തിട്ടപ്പെടുത്തിയ ശേഷം ന്യായമായ സമയത്തിനുള്ളിൽ സെക്യൂരിറ്റി തുക മടക്കി നൽകുന്നതാണ്.

65. കരാർ പ്രവൃത്തിയുടെ പ്രത്യേക സാഹചര്യങ്ങൾ കണക്കിലെടുത്ത് ആവശ്യമെന്ന് ക≠ാൽ പ്രത്യേക വ്യവസ്ഥകൾ കൂട്ടിച്ചേർക്കാൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു≠ായിരിക്കുന്നതാണ്.

66. കരാർ ഉടമ്പടി അല്ലെങ്കിൽ സ്ഥിരീകരണ ഉത്തരവ് അല്ലെങ്കിൽ ടെ≠ർ എന്നിവ പ്രകാരമുള്ള എല്ലാ വ്യവസ്ഥകളോ അല്ലെങ്കിൽ ഏതെങ്കിലും വ്യവസ്ഥകളോ ലംഘിക്കപ്പെടുകയാണെങ്കിൽ കരാർ റദ്ദാക്കപ്പെടുകയും സെക്യൂരിറ്റി തുക പിടിച്ചെടുത്ത് ടി കോൺട്രാക്ടറുടെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി പ്രവൃത്തിക്ക് റീ-ടെ≠ർ നടത്തുന്നതുമാണ്.

67. ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറും കരാറുകാരനുമായി തർക്കം ഉ≠ായാൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ തീരുമാനം അന്തിമമായിരിക്കും. ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ തീരുമാന തീയതി മുതൽ ര≠് മാസത്തിനകം കോൺട്രാക്ടർക്ക് ബന്ധപ്പെട്ട ഫോറസ്റ്റ് സർക്കിളിന്റെ ചുമതലയുള്ള ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർക്ക് അല്ലെങ്കിൽ ഓഫീസർക്ക് അപ്പീൽ നൽകാവുന്നതാണ്. അപ്പീൽ തീരുമാനം അന്തിമവും അത് അനുസരിക്കാൻ കോൺട്രാക്ടർ നിയമപരമായി ബാദ്ധ്യസ്ഥനുമായിരിക്കും.

68. ഡിപ്പോ ഓഫീസർ/ഡിപ്പോ സ്റ്റാഫ് എന്നിവരുടെ നിർദ്ദേശ പ്രകാരമുള്ള സ്ഥലത്ത് വേണം സ്റ്റാക്കിംഗ് നടത്തേ≠ത്.

69. മെയിൻ പാസിന്റെ അടിസ്ഥാനത്തിൽ തടികൾ വരുന്ന മുറയ്ക്ക് അട്ടിവയ്ക്കേ≠താണ്.

70. ഡിപ്പോ ഓഫീസറുടെയോ ഡിപ്പോ ഓഫീസർ അധികാരപ്പെടുത്തുന്ന ആളുടെയോ നിർദ്ദേശാനുസരണം തടികൾ ഇനം, ക്ലാസ്, ഗുണമേ∑ എന്നിവയുടെ അടിസ്ഥാനത്തിൽ അട്ടിവയ്ക്കേ≠താണ്.

71. ഡിപ്പോ ഓഫീസറോ അദ്ദേഹം അധികാരപ്പെടുത്തുന്ന ആളുടെയോ നിർദ്ദേശാനുസരണം ഈട്ടി, തേക്ക്, ഹാർഡ്വുഡ്, ബില്ലറ്റ്, ഫയർവുഡ് എന്നിവ പ്രത്യേകം നിർദ്ദേശിക്കുന്ന സ്ഥലത്ത് അട്ടിവയ്ക്കേ≠താണ്.

72. സോഫ്റ്റ് വുഡും ജംഗിൾ വുഡും നാശം ഒഴിവാക്കുന്നതിന് ആദ്യം അട്ടിവയ്ക്കേ≠താണ്.

73. എല്ലാ ക്ലാസിൽപ്പെട്ട തടികളും ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ/ഡിപ്പോ ഓഫീസറുടെ നിർദ്ദേശാനുസരണം ഗുണമേ∑യുടെയും ഗർത്ത് ക്ലാസിന്റെയും അടിസ്ഥാനത്തിൽ അട്ടിവയ്ക്കേ≠താണ്. ഹയർ ഗർത്ത് ക്ലാസിലും ലോവർ ഗർത്ത് ക്ലാസിലും വരുന്ന തടികൾ വെവ്വേറെയാണ് അട്ടിവയ്ക്കേ≠ത്. ഷോർട്ട് ലോഗും നീളമുള്ള ലോഗും പ്രത്യേകം അട്ടിവയ്ക്കേ≠താണ്. നല്ല തടികളും മോശം തടികളും പ്രത്യേകം അട്ടിവയ്ക്കേ≠താണ്.

74. വ്യവസ്ഥ 6-ൽ പരാമർശിക്കുന്ന രീതിയിൽ ഡിപ്പോ ഓഫീസർ എല്ലാ തടികളും അട്ടിവയ്ക്കുന്നതിന് മുമ്പ് പരിശോധിക്കേ≠താണ്.

75. ഡിപ്പോയിലെ സ്റ്റോക്കിന്റെ അടിസ്ഥാനത്തിലും മാർക്കറ്റ് ട്രെന്റിന്റെയും അടിസ്ഥാനത്തിലും ഓരോ ലോട്ടിലും വയ്ക്കേ≠ തടികളുടെ അളവ് ഡിപ്പോ ഓഫീസർ തീരുമാനിക്കും. ഒരു ലോട്ടിൽ കയറ്റുമതി ഇനം തേക്കും ഈട്ടിയും ഒരെണ്ണം വീതം ഉ≠ായിരിക്കും. കയറ്റുമതി ഇനത്തിൽപ്പെട്ട തടികൾ അല്ലാത്തവ 4 ക്യു. മീ. വരെയുള്ള ലോട്ടുകൾ ആയിരിക്കും.

ജംഗിൾവുഡ് 8 ക്യു. മീ. വരെയുള്ള ലോട്ടുകൾ ആയിരിക്കും. ബില്ലറ്റും, ഫയർവുഡും ഡിപ്പോ ഓഫീസറുടെ നിർദ്ദേശാനുസരണം അട്ടിവയ്ക്കേ≠താണ്.

76. തടികൾ വാങ്ങുന്ന ആൾക്ക് തടികൾക്ക് എന്തെങ്കിലും ന്യൂനതകൾ ഉ≠െങ്കിൽ കാണത്തക്കവിധത്തിൽ തടികൾ അട്ടിവയ്ക്കേ≠താണ്.

77. ഉന്നത ഉദ്യോഗസ്ഥർക്ക് പരിശോധിക്കത്തക്ക രീതിയിൽ തടികൾക്കിടയിൽ ആവശ്യമായ അകലം ഉ≠ായിരിക്കേ≠താണ്.

78. തടികൾ അട്ടിവെച്ചതിനുശേഷം കോൺട്രാക്ടർ തടികളിൽ ചിസൽ നമ്പറിംഗ് നടത്തേ≠താണ്.

79. അട്ടി വയ്ക്കലിനും ചിസൽ നമ്പറിംഗിനും ശേഷം ഡിപ്പോ ഓഫീസർ/ഡിപ്പോ സ്റ്റാഫ് ഫൈനൽ ക്ലാസിഫിക്കേഷൻ നടത്തേ≠താണ്.

80. ഫൈനൽ ക്ലാസിഫിക്കേഷനിൽ തെറ്റായ ക്ലാസിഫിക്കേഷൻ ഉ≠ായാൽ ആയത് ഡിപ്പോ ഓഫീസറുടെയോ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെയോ നിർദ്ദേശാനുസരണം കോൺട്രാക്ടർ വീ≠ും അട്ടിവയ്ക്കേ≠താണ്.

81. അട്ടിവച്ച തടികൾക്കോ, ഡിപ്പോയിൽ ഇതിനകം കിടക്കുന്ന തടികൾക്കോ, നിലവിൽ നിൽക്കുന്ന മരങ്ങൾക്കോ കെട്ടിടങ്ങൾക്കോ മറ്റു നിർമ്മിതികൾക്കോ യാതൊരുവിധ കേടുപാടുകളും വരുത്താൻ പാടുള്ളതല്ല.

അപ്രകാരം നഷ്ടം വരുത്തിയാൽ ആയത് കോൺട്രാക്ടറുടെ ഉത്തരവാദിത്വമായിരിക്കും. അപ്രകാരമുള്ള നഷ്ടം കോൺട്രാക്ടറിൽ നിന്നും ഈടാക്കുന്നതാണ്. അപ്രകാരം കഴിയാതെ വന്നാൽ ആയത് റവന്യൂ റിക്കവറി നിയമപ്രകാരം ഈടാക്കുന്നതാണ്.

82. വരുന്ന തടികൾ ഒരേ സമയം ഡിപ്പോ ഓഫീസർമാരുടെ നിർദ്ദേശാനുസരണം അട്ടി വയ്ക്കേ≠താണ്. യാതൊരു കാരണവശാലും ഒരു ക്ലാസിൽപ്പെട്ട തടികൾ മറ്റൊരു ലോട്ടിൽ ഉൾപ്പെടാൻ പാടില്ല.

83. മേൽ പരാമർശിക്കുന്ന എല്ലാ ജോലികളും പൂർത്തിയായാൽ മാത്രമേ അന്തിമ ബില്ല് നൽകുകയുള്ളൂ.

84. ടെ≠ർ നോട്ടീസ് അനുസരിച്ച് രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്കുകൾ പ്രകാരമുള്ള ജോലികൾ കരാറിന്റെ കരട് എഗ്രിമെന്റ ിലെ വ്യവസ്ഥകൾ അനുസരിച്ചും സമയാസമയങ്ങളിൽ വകുപ്പുതലത്തിൽ പുറപ്പെടുവിക്കുന്ന റൂളുകളും ഉത്തരവുകളും അനുസരിച്ചുവേണം നിർവ്വഹിക്കേ≠ത്.

85. ജി.എസ്.റ്റി. ഒഴികെയുള്ള തുകയാണ് അടങ്കലിൽ ഉൾപ്പെടുത്തിയിരിക്കുന്നത്. ആയതിനാൽ ജി.എസ്.റ്റി. ഉൾപ്പെടെയുള്ള തുകയ്ക്കാണ് ടെ≠ർ രേഖപ്പെടുത്തേ≠ത്.

All bid/tender documents are to be submitted online only and in the designated online cover(s)/envelope(s) on the www.etenders.kerala.gov.in website and tenders submitted manually/through post will not be entertained. Late tenders also will not be accepted.

Online tenders/bids are to be accompanied with a preliminary agreement executed in Kerala Stamp Paper worth ` 200. Tenders/bids received online without the scanned copies of relevant documents, preliminary agreement etc. will not be considered and shall be summarily rejected. The hard copy of attested copy of Registration Certificate, Bid document, EMD exemption Certificate (if any) and preliminary agreement in original would be submitted offline subsequently in a sealed cover superscribing the name of work and tender number to the office of the Divisional Forest Officer, Timber Sales Division, Punalur through Speed Post/Registered Post before opening of the tender, failing which such tenders will be rejected. Any further clarification on this tender can be obtained from NIC, the e-tender helpdesk number available in the www.etenders.kerala.gov.in website and from the office of the Divisional Forest Officer, Timber Sales Division, Punalur during office hours. The details regarding e-payment (bidder's bank account number where he/she is having core banking facility and e-mail ID) should be submitted along with the tender. Tenders without these details will not be accepted. Technical bid and financial bid shall be submitted in their respective designated online covers. The sanctioned estimate is exclusive of GST. So the contractor should quote the rate inclusive of PAC with GST.

The Forest Department will not be responsible for any inconvenience or loss to the bidder while uploading/ downloading the bid.

The successful tenderer should submit a solvency from the revenue authorities or a bank guarantee issued by a nationalized bank for 10% of the tender amount. The successful tenderer should also execute an agreement in the prescribed format in a stamp paper worth 0.1 % of PAC value within 10 days from the date of intimation of acceptance of the tender after furnishing security deposit equal to 10% of the tender amount or ` 5,00,000 whichever is less.

1. Online tenders are invited from eligible A, B and C class contractors registered in the Forest Department in pursuance of G.O.(Ms.) No. 26/2017/F&WLD dated 20-5-2017 for stacking of timber, billets and firewood received from various plantations mentioned in the schedule.

2. The conditions embodies in this notification form part and parcel of the agreement to be executed for work tendered for.

3. The tender document (s) may be download free of cost from the e-Government Procurement (e-GP) website www.etenders.kerala.gov.in. No payment is required for downloading the tender documents from the above website; however a bid submission fee, as mentioned in the tender notice is required to be submitted along with online bid.

4. Only those bidders having a valid and active registration, on the date of submission, shall submit bids online on the e-GP website. All bids shall be submitted online on the e-GP website only in the relevant envelop (s)/cover(s), as per the type of tender. No manual submission of bids shall be entertained for the tenders published through e-GP system under any circumstances.

5. The e-GP system shall not allow submission of bids online after the stipulated date & time. The bidder is advised to submit the bids well before the stipulated date & time to avoid any kind of network issues, traffic congestion etc. in this regard; the department shall not be responsible for any kind of such issues faced by the bidder.

6. Ineligible bidders who do not posses valid & active registration, on the date of bid submission, are strictly advised to refrain themselves from participating in this tender. If such instances are noticed, the same shall be treated as fake bidding by respective bidder and such bidder shall be black listed as per departmental rules in force.

7. The bidders, who submit their bids for this tender after digitally signing using their Digital Signature Certificate (DSC), accept that they have clearly understood and agreed the terms and conditions including the Form/Annexure of this tender.

8. Mention of price details at any place other than the designated place, shall disqualify the bid and the bid shall be summarily rejected.

9. The items and sub-heads of works to be done are enumerated in the subjoined schedule. Unless otherwise specified, the tender must be for the whole or any individual work and part tenders are liable to rejection. A bidder may tender for more than one work with the EMD specified in each case, but shall not tender for any part of a work, unless specifically so required.

10. Tenderers should quote uniform percentage of the departmental estimate rate at which they can take up the work specified in the schedule both in figures and words. Tender duly signed using bidders Digital Signature Certificate shall be submitted online on e-GP website: www.etenders.kerala.gov.in before the time specified. The tender will be opened online at the office of the tender inviting authority on date and time specified, in the presence of those bidders or their authorized agents who wish to be present. In case it is not possible to open the tenders on the specified date due to any valid reason the revised time and date of opening of tenders will be published on e-GP website. The bidders shall check the e-GP website regularly for such updates.

The total amount of each tender will be read out. There is no provision for correction of bids once submitted online. However, multiple bids can be submitted by the bidder, in case of corrections, till the last date & time of bid submission and the most recent/latest bid submitted before the stipulated date & time of bid submission shall only be considered by e-GP for further processing. Details of individual rates will be treated as confidential and will not be read out. The department shall not be responsible for any service delay in this regard.

11. Bidder must produce copies of solvency certificates clearly indicating to what extent they are solvent from the Tahsildar of Taluk where they reside, if required by the department for verification during agreement execution.

Otherwise 20% of bill amount will be retained in each bill. The bidder must produce copy of recent return statement filed by the bidder before the appropriate income tax authority along with the necessary income tax documents, if required by the department for verification during agreement execution with PAN Card. Otherwise 20% tax will be deducted. In case of proprietary or partnership firm, it will be necessary to submit certificates above mentioned for the proprietor or proprietors and for each of the partners as the case may be.

12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per G.O. (P) 62/1976/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976 shall be binding on any person who makes a written tender for the works.

14. The tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in timber trade within the limits of the Forest Division in which working area is situated or by the adjacent Divisions will not be accepted.

15. Schedule of quantities, specifications of work to be done and conditions of contract to be entered into can be seen on the e-GP website. It shall be definitely understood that the Government does not accept any responsibility for the corrections or completeness of the schedule, that the schedule is liable to alteration by omissions, deductions or additions at the discretion of the competent department officer set forth in the conditions/of contract. The bidder will be however base this tender amount in the case of lump sum tender on the basis of those quantities etc.

16. Tender forms and general specifications can be downloaded free of cost from e-GP website. Tenders not submitted in such prescribed online format or submitted incomplete in any respect whatever such as unattested errors and corrections in rates, quantities, units or amounts (figures not expressed in words), total of contract not entered, etc. and those submitted without uploading the signed copies of the tender notice, tender schedule, tender conditions, annexures, preliminary agreement etc. connected with the tender and published in the website shall be summarily rejected.

17. Post offers and representations sent after receipt of the tender in respect of the work shall at no account be considered.

18. The Earnest Money Deposit of the unsuccessful bidders will be refunded immediately after tabulating tenders keeping only the EMD of the L1 and L2 bidders. The EMD of the L2 bidder will also be refunded after award of contract/execution of agreement. The refund of amount to be made through the bank as per XML file provided by the e-procurement system on the next working day from the date of generation of XML file and also provides confirmation to NIC on the same. The department is not responsible for any service delay in this regard.

19. Solicitors fee, if any, to be paid to the Law Officers of Government for scrutinizing or drawing up of agreements will be paid and the same recovered from the successful bidder.

20. Before submitting the tender, the tenderer, is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of with can be had for perusal from the Divisional Forest Officer, Timber Sales Division, Punalur on any working day during office hours. He should also be thorough about the field conditions, terrain, labour availability etc. No plea of ignorance of the agreement conditions and field conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

21. The successful tenderer shall furnish a security deposit of an amount equal to 10% of the total PAC value limited to a maximum of ` 5,00,000 and execute an agreement on a stamp paper worth 0.1% of PAC value within 10 days in the approved form, the same of which can be had from the Divisional Forest Officer, Timber Sales Division, Punalur for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Timber Sales Division, Punalur. If the security is not remitted and the agreement executed within the stipulated time the tender will automatically stand cancelled.

22. Failure to remit the security deposit and to execute the agreement, within the time specified in the conditions 21 above, will lead to cancellation of the tender by the Divisional Forest Officer, and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderer. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter however will not be entitled for gain, if any.

23. The contractor shall ensure that the stacking work proceeds from the end of the depot to the other end in an orderly and systematic manner.

24. The quantity mentioned in the schedule is only approximate and the contractor is bound to work the full quantity of timber and firewood collected from the plantation and entrusted to him.

25. The contractor shall be responsible for the safety of contractor area and safety of all timber, billets/firewood entrusted to him. If any of the logs/billets/firewood be burnt, lost rendered useless or otherwise destroyed their value calculated at the current schedule rate will be recovered from the contractor and in the case of Teak and Rose wood logs, the value calculated at the highest sale rate for the class in the depot obtained during the year prior to the date on which such timer is found lost shall be recovered from the contractor. In the case of billets/ firewood the value calculated at the schedule rate or average sale rate of the depot, whichever is higher will recovered. The above mentioned safety shall include safety of contract area from fire, theft and biotic interference.

26. The Divisional Forest Officer reserves to himself the power to eliminate any log/logs entrusted to the contractor from stacking it is found during the course of the contract by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

27. Further particulars can be had from the Divisional Forest Officer, Punalur on any working days during office hours.

28. All powers to make alteration if any required in the agreement condition shall be vested with Chief Conservator of Forests, Southern Circle, Kollam.

29. The VDA will not be paid for PWD items.

30. VDA at the time of tender will only be allowed for other items.

31. The successful tenderer hereinafter referred as "the contractor" shall take over the area after executing the agreement in the prescribed form (Appendix 13) from the Officer-in-Charge on the date specified in the confirmation order after verifying the boundaries and the stock by giving a receipt and signing on the sketch of the area and should commence the work on the date as specified in the confirmation order. He/She should complete all works as per the prescribed time schedule and the specifications in the Schedule of items of work shown in Part-II tender and directions given by the officers of the Kerala Forest Department from time to time.

32. The period of contract shall be as in the tender schedule. The Kerala Forest Department may also short-close the contract in case the area is taken over by the Government or the department is not able to continue with the works to be executed in the area due to reasons beyond the department's control. The department is not bound to pay any compensation in such cases.

33. The contractor shall furnish to the Divisional Forest Officer a list showing the name and address along with specimen signature and Electoral ID Card/other valid ID proof issued by the Government/Statutory authority in respect of the Agent/Sub agent/Authorized representative and other employees intended to be employed by the contractor for supervision of the work in the contract area and no person not approved by the Divisional Forest Officer, shall be employed by the contractor for the said work. Whenever the Divisional Forest Officer orders the removal of any of the contractor's employees from the contract area, the contractor shall immediately carry out the orders. The contractor shall not engage for this contract any person, already engaged by the department for any other work during the same period.

34. The contractor shall not enter or send his employees into the working area mentioned in the Schedule without previously obtaining a license for the purpose granted by the Divisional Forest Officer, Timber Sales Division, Punalur.

35. If the contractor or his workmen require any place for putting up sheds for their accommodation, the Range Officer shall allot sufficient space inside or outside the contract area. The contractor and his men shall use only such approved sites for putting up sheds and collecting and storing of implements and other materials used for the work.

36. The contractor, his agents and other employees working in the contract area shall carry out all orders issued by the Divisional Forest Officer or any other officer in charge of the work in connection with this contract work.

37. The contractor shall not sublet the work to any other agent or agents under any circumstances without the approval of the Divisional Forest Officer.

38. The contractor binds himself to act during the period of contract in accordance with the provisions of the Kerala Forest Act 1961, Wildlife (Protection) Act 1972 and Rules framed there-under.

39. The contractor, his authorized agents and other employees engaged by him in the contract area shall be bound to render such assistance as may be required of them by any Forest Officer of and above the rank of a Depot Watcher in putting out fires and in preventing the commission of any forest offence or its detection within the Depot compound in which the contract area is situated.

40. If any illicit fellings or any other offence under Kerala Forest Act 1961, Wildlife (Protection) Act 1972 and other related Acts and Rules thereunder as modified from time to time, are noticed within the contract area, the contractor shall be held responsible for the same and shall pay such penalty as may be imposed by the Divisional Forest Officer and shall also be liable for prosecution under the respective Act and Rules thereof.

41. The contractor shall furnish to his agents and other employees a written authority for entering and working in the contract area and this authority shall be produced for inspection by any Forest Officer not below the rank of a Beat Forest Officer. The contractor shall be deemed responsible for all cases of commission and omission not only of himself, but also of his agents and all other employees engaged by him. If the contractor/authorized representative are not available in the contract area continuously for 7 days without genuine reasons, the contract is liable to be cancelled and the work will be undertaken by the department or got done otherwise at the risk and cost of the contractor.

42. The contractor should have no relationship on any Government servant who is incharge of the work or who has any direct control over the work the relationship in this case means father, mother (including stepmother), son (including step son), son's wife, daughter (including step daughter), daughter's husband, brothers (including step brother), brother's wife, sister (including step sister), sister's husband, father's father, father's mother, mother's mother, mother's father, son's son, son's daughter, daughter's son, daughter's daughter, son's son's wife, son's daughter's husband, daughter's son's wife & daughter's daughter's husband as shown in appendix-2.

43. If it is found at any time during or after the period of the contract that the contractor has violated condition 43 above, during the period of the contract the contract shall be liable to be cancelled and the security deposit forfeited to Government and the loss caused to the Government, by the cancellation of the contract shall be made good by the contractor.

44. Contractor should employ or engage his own workmen and should strictly abide by all requirements under the Labour Legislation in force from time to time including the Payment of Wages Act 1932; the Minimum Wages Act, 1948; Industrial Disputes Act 1947; Employees' Provident Fund Act 1952; Workmen's Compensation Act, 1923; the Contract Labour (Regulation and Abolition) Act, 1970 etc. If the Kerala Forest Department incurs any liability in respect of any person employed or engaged by contractor, contractor shall indemnify and keep harmless the Kerala Forest Department to the extent of such liability incurred by the Kerala Forest Department. 45. The contractor shall give preference to tribals if any residing in the locality for the tendered works.

46. The contractor may execute works through mechanized means provided he state the same as far as possible while submitting the tender and execute such mechanized works without causing any damage to forests and wildlife of the area. The same should be submitted in annexure-I format appended.

47. The work should be carried out as per the specifications and the time schedule in the schedule of items of work shown in Part-II tender and directions given by the authorized personnel of the Kerala Forest Department from time to time. The time schedule of different items of work as instructed by the Kerala Forest Department officials should be strictly adhered to.

48. Contractor should apply and obtain the License prescribed under the Contract Labour (Regulation and Abolition) Act, 1970 and Rules there under within one-month of the award of the contract, provided the contractor employs more than 20 workers on any day. Failure to do so will attract penalty and an amount equivalent to the fees for license and the Security Deposit to be deposited as per Rule 24 of the Kerala Contract Labour (Regulation and Abolition) Rules, 1974 and the same will be recovered from contractor's bills without any notice.

49. The contractor shall be fully responsible for the omissions and commissions of the labourers engaged by him in connection with the execution of the work. The Kerala Forest Department will not undertake any responsibility of the labourers engaged by the contractor.

50. Contractor should comply with the provisions of Employees State Insurance Act,1948, Employees Provident Fund Act 1952 and Miscellaneous Provisions Act 1976. The name and other details of employees engaged by the contractor should be intimated to the Kerala Forest Department.

51. The area should be protected from forest fire, encroachment, human and animal disturbances etc. by the contractor. He shall prevent the fire spreading outside the area into the adjoining forest or plantations. If any forest fire is noticed in the plantation or surrounding area, it should be extinguished immediately with the help of watchers/ other local labourers. The contractor/authorized agent shall intimate the fire incident to Division/Range Office or Officers of Kerala Forest Department by any means of communication within the shortest possible time after making necessary arrangements for fire fighting. The contractor and his agents are bound to render every help to the Department in extinguishing fire if it breaks out in the neighbourhood of the contract area. If the fire incidence is due to any negligence or lapses on the part of the contractor or his employees or labourers, the loss sustained to the Department on account of fire will be assessed and the same will be recovered from the contractor.

52. The contractor will carry out all operations mentioned in the schedule of operations or any other activities as required by the department as per the instructions of the Divisional Forest Officer.

53. The contractor or authorized representative shall be present at the site at the time of taking measurements and recording in measurement book and shall sign the same after getting satisfied by him/her that the entries made are correct and the date of signing also shall be entered. If the contractor/authorized representative is not present at the site purposefully at the time of taking/recording the measurements, the measurements so recorded in the measurement book shall be binding on the contractor and no complaint in this regard shall be entertained.

54. 10% amount of each part bill will be withheld as retention amount which will be released after the complete execution of the works assigned to him as per the agreement and the liability if any, in respect of this contract is settled.

55. All statutory deductions like Income Tax or any tax stipulated by Government as notified from time to time will also be deducted from the bills without any notice to the contractor.

56. The contractor shall produce valid tax clearance certificates to the satisfaction of the Divisional Forest Officer before the final payment is made to him.

57. In case the work is not satisfactory payments/bills either part or in full will be retained until satisfactory completion of the work.

58. If in the course of working, it is found, by the Divisional Forest Officer that the progress of work and the timely execution of work is not satisfactory or any of the works specified in this agreement are not completed or left undone within the stipulated time, the agreement shall be subject to cancellation after fifteen days written notice issued by the Divisional Forest Officer and such of the works will be undertaken by the department or got done otherwise at the risk and cost contractor. But the contractor shall not be entitled to any profit the department may derive in this arrangement.

59. In case the work is abandoned mid way, all the bills due to the contractor will be impounded and Earnest Money Deposit as well as Security Deposit will be forfeited. The Kerala Forest Department will make necessary arrangements to carry out balance works at the risk and cost of the contractor. The department will proceed with retendering process and all emergency works in between the retendering and finalization of retender will be executed departmentally through any of the methods practiced in the department at the risk and cost of the contractor and all the expenditure incurred for executing such works shall be recovered from the contractor.

60. Notwithstanding anything herein contained, if the contractor violates any condition of this agreement or the conditions of the tender attached to this agreement or the conditions in the confirmation order for which no penalty has been expressly provided in this agreement or violates any provision of the Forest Act, 1961; Wildlife (Protection) Act, 1972 and Rules framed there under the Divisional Forest Officer may inflict any punishment which he thinks suitable for the violation so caused, the maximum punishment for which may amount to cancellation of the agreement and the forfeiture of the security deposit and part bill due to the Contractor besides making him liable for all loss which the Government may sustain in consequence of the cancellation of the contract.

61. No extension of the period of the contract shall ordinarily be granted. But if, however, the delay in completing the work in the contract area within the period specified, in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted by the Divisional Forest Officer/Officer in charge of Circle/ Officer in charge of Region for one/three/six months respectively.

62. On the expiry of the period of the contract, all rights of the contractor shall cease absolutely and he shall not be allowed entry into the contract area for any purpose whatsoever. If the contractor or any of his men is found in the area after the expiry of the contract he shall be liable to be send out summarily and shall also be liable for prosecution.

63. If any amount becomes due to any workmen' or mazdoor engaged by the contractor as per Workmen's Compensation Act, 1923 or as per provisions of labour or other similar laws, such amounts shall be paid by the contractor. Failure to do so will be considered as a breach of the terms and conditions of this agreement.

64. The security deposit or any portion of it as may be available at the expiry of the contract period- after settlement of the contractor's liabilities will be refunded to him within a reasonable time from date of termination of the contract period. On expiry of the contract, all items of money found due to the Government under this contract or in respect of any other contract entered into by the contractor with the Government if not paid within the time specified by the Divisional Forest Officer shall be recovered from the security deposit of this contract or any other contract entered into by the contractor with the Government and from the part bills, if any, due to the contractor and shall also be recovered from the assets movable and immovable of the contractor, as if such sums are arrears on land revenue under the provisions of the Kerala Revenue Recovery Act,1968 for the time being in force and in such other manner as the Government may deem fit.

65. The Divisional Forest Officers may add such other special conditions as would be deemed required considering the nature of circumstances of the work.

66. If the contractor violates all or any of the conditions laid down in this agreement or Confirmation Order or Tender, the contract is liable to be cancelled and the Security Deposit forfeited apart from getting the work done at the risk and cost of the contractor.

67. In case of any dispute arising between the Divisional Forest Officer, and the contractor on any matter arising out of this contract other than one as to which the decision of the Divisional Forest Officer is final the contractor may, within two months of the date of the order of the Divisional Forest Officer appeal to the Conservator of Forests or the Officer in charge of the Forest Circle whose decision thereon shall be final and legally binding on the contractor.

68. Stacking has to be done in the area allotted for the purpose as per the directions of the Depot Officer/Depot staff.

69. The timber has to be stacked on Main Pass basis in the order first come first.

70. The timber has to be stacked species wise, girth class wise and quality class wise as per the direction of the Depot Officer/Depot staff.

71. Rose wood, Teak, Jungle wood, Billet and firewood are to be stacked in separate area of the depot yard as per the direction of the Depot Officer/Depot staff.

72. The softwood and miscellaneous species are to be stacked first to avoid deterioration. They are to be stacked within 7 days of delivery.

73. Each class of timber is to be stacked in such a way that within each quality class and girth class the higher girth class and lower girth class are stacked separately, short logs and lengthy logs are stacked separately good timber and defective timber are stacked separately so as to form lots of short logs, lengthy logs, good logs and defective logs of lower and higher girth class as per the direction of Depot Officers/Divisional Forest Officer. The details of timber classification & sub-classification to be followed is given as Annexure II &III.

74. Each log of timber is to be inspected by the depot officer before stacking to ensure correctness of classification and also to enable girth wise and quality class wise stacking of logs as mentioned in condition (6) above.

76. Stacking should be done in such a way that the defects of the timber are visible to the officials and potential buyers.

77. The stacking should be done leaving sufficient space between logs in the lot to enable measurement of each log by the depot staff and inspecting officials.

78. Chisel numbering of the logs are to be done by contractor after the completion of stacking.

79. Final classification of the logs will be done by the depot staff after stacking and chisel numbering of logs.

80. The logs that are found miss-classified at the time of final classification are to be restacked with correct girth and quality class as per the direction of the Divisional Forest Officer/Depot Officer by the contractor.

81. No damage should happen to the timber stacked, timber already present in the depot yards, existing trees, building or any structures in the depot premises. If any such damages happens, the damages will be recovered from the tenderer by all means including revenue recovery proceedings.

82. Lotting will also be done by the depot officers simultaneously. In no case logs of one lot should be present in another lot.

83. Final payment will be released only after finishing all the above works.

84. The tenderer by submitting this document hereby undertakes to carryout the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other Departmental rules and orders issued from time to time.

85. The tenderer shall quote in the appropriate column in the tender a firm percentage of the basic rate per hectare of raising the plantation and the maintenance of the plantation up to third year or as in the Schedule both in figures as well as in words. In the case of the tenderer quoting different total amount in words and figures also, lower of the same only be considered valid and shall be binding on him/her. If the Kerala Forest Department feels that the total amount quoted or item wise rate of any of the items quoted is unworkable due to variance to the lower side to an abnormal level with the Kerala Forest Department's estimated rates, the tenderer may be required to furnish satisfactory explanation on the above respect. In such an event, the Kerala Forest Department has the option to collect a Special/Extra Security Deposit to the tune of 10 % of the quoted amount subject to a maximum of ` 30,000 (Rupees Thirty Thousand Only) from the tenderer before issuance of confirmation orders. If the explanation furnished is not found satisfactory or no explanation is furnished, the Kerala Forest Department has the right to deny the offer of work to the tenderer even though he/ she is the lowest tenderer.

86. The tenderer whose tender is accepted will be informed regarding acceptance of his tender by a Confirmation Order issued by registered letter bearing the address mentioned in the tender. The successful tenderer, within ten days of issue of confirmation of his tender, shall have to execute an agreement in the prescribed form (Appendix 11) on a proper non-judicial stamp paper (0.1% of PAC) to be supplied by him at his cost. A further period up to 10 days shall be allowed by the Divisional Forest Officer for signing agreement subject to realization of a time of Rs. 100 per day. If the Contractor fails to execute the agreement during the extended period also, the tender will be cancelled, and the Earnest Money Deposit submitted by the tenderer shall stand forfeited to the Kerala Forest Department. The work will be retendered at the risk and cost of the tenderer or through any other method (including through the next higher tenderer). The loss, if any, to the Government consequent to the default, if not paid by the defaulter within a reasonable time specified by the Divisional Forest Officer, shall be treated as arrears on public revenue to be recovered from the defaulter under the provisions of the Kerala Revenue Recovery Act 1968 and in such other manner as the Government may deem fit. The defaulter however will not be entitled for gain, if any.

87. The sanctioned estimate is exclusive of GST. So the contractor should quote the rate inclusive of PAC with GST.

Tender form can be had from the office of the undersigned on request in writing till 1 p. m. on the date of tender on payment of its cost and taxes. The last date and time of receipt of tender in sealed cover superscribing the name of the work is 3 p. m. on the tender date.
