തിരുവിതാംകൂർ-കൊച്ചി ഹിന്ദുമത ധർമ്മസ്ഥാപന നിയമം 1950-ലെ വകുപ്പ് 29-ലെ 5 ഉപവകുപ്പ് പ്രകാരവും വകുപ്പ് 35-ലെ ഉപവകുപ്പ് 2-ലെ ''ഇ'' ഖണ്ഡം പ്രകാരവും തിരുവിതാംകൂർ ദേവസ്വം ബോർഡിൽ നിക്ഷിപ്തമായിട്ടുള്ള അധികാരാവകാശങ്ങൾ പ്രകാരം പുറപ്പെടുവിക്കുന്നത് എന്തെന്നാൽ, തിരുവിതാംകൂർ ദേവസ്വം ബോർഡിലെ പാർട്ട്ടൈം ജീവനക്കാരുടെ വിരമിക്കൽ പ്രായപരിധി അവർക്ക ് എഴുപ ത് വയസ് പൂർത്തിയാകുന്ന മ ാസത്തിലെ അവസാന തീയതിയായി നിജപ്പെടുത്തിക്കൊ≠് 13-6-1985 ആർ.ഒ. സി. 8044/84/എസ്റ്റ നമ്പരായി ഉത്തരവ് പുറപ്പെടുവിച്ചി ട്ടുള്ളതാകുന്നു. ഈ ഉത്ത രവിലൂ ടെ പാർട്ട ്ടൈം ജീ വനക്കാർക്ക ് ലഭിക്ക ുന്ന ആനുക ൂല്യം തിരുവിതാംകൂർ ദേവസ്വം ബോർഡിലെ പാർട്ട്ടൈം കാരാ◊ വിഭാഗത്തിൽ ജോലി ചെയ്യുന്നവർക്ക് നൽകണമെന്ന അപേക്ഷകൾ ലഭിച്ചിരുന്നു. ഈ അപേക്ഷകൾ പരിഗണിച്ച് പാർട്ട്ടൈം കാരാ◊ തസ്തികകളിൽ ജോലി നോക്കി വരുന്ന കാരാ◊ ജീവനക്കാരുടെ വിരമിക്കൽ പ്രായപരിധി പ്രസ്തുത ജീവനക്കാർക്ക് എഴുപത് വയസ് പൂർത്തിയാകുന്ന മാസത്തിലെ അവസാന പ്രവൃത്തി ദിവസമായി നിജപ്പെടുത്തി 30-3-2021-ൽ ബോർഡ് ഉത്തരവ് പുറപ്പെടുവിച്ചു. ഇതിനകം 56 വയസ് പൂർത്തിയാക്കിയിട്ടുള്ളവരും എന്നാൽ 70 വയസ് തികഞ്ഞിട്ടില്ലാത്തവരുമായ മേൽപ്പറഞ്ഞ വിഭാഗം ജീവനക്കാരെ സർവ്വീസിൽ തിരികെ പ്രവേശിപ്പിക്കുന്നതിനും ബോർഡ് തീരുമാനിക്കുന്നു.
ബോർഡിന്റെ ഈ തീരുമാനത്തിനെതിരെ ആക്ഷേപങ്ങളോ പരാതികളോ ഉള്ളവർക്ക് ആയത് പതിനഞ്ച് ദിവസങ്ങൾക്കുള്ളിൽ സെക്രട്ടറി, തിരുവിതാംകൂർ ദേവസ്വം ബോർഡ് എന്ന വിലാസത്തിൽ രേഖാ മൂലം ബോധിപ്പി ക്കാവുന്നതാണ്. ആയവ പര ിശോധ ിച്ച് അന്തി മ വി⁄ാപനം പുറപ്പെടുവിക്കുന്നതായിരിക്കും. പ്രാഥമിക വി⁄ാപനത്തിൽ ആക്ഷേപങ്ങളോ പരാതികളോ ആരും ഉന്നയിക്കാത്തപക്ഷം ഈ വി⁄ാപനം അന്തിമ വി⁄ാപനമായി കണക്കാക്കുന്നതായിരിക്കും.

എറണാകുളം ജില്ലയിലെ കോതമംഗലം താലൂക്കിലെ താഴെപ്പറയുന്ന വില്ലേജുകളുടെ റീസർവ്വെ നടത്തണമെന്ന് ഗവൺമെന്റ ് നിർദ്ദേശിച്ചിരിക്കുന്നതിനാൽ ടി വില്ലേജുകളിൽ സർേ∆ പ്രവർത്തനങ്ങൾ വേഗംതന്നെ ആരംഭിക്കുന്നതാണെന്നും, വില്ലേജുകളിൽ ഉൾപ്പെടുന്ന മുഴുവൻ സർവ്വെ നമ്പറുകളും അതിർത്തി തിരിച്ച് സർവ്വെ ചെയ്യുന്നതാണെന്നും, 1961-ലെ കേരള സർവ്വെയും അതിർത്തിയും സംബന്ധിച്ച ആക്ടിലെ 6(1)-ാം വകുപ്പ് പ്രകാരം ഇതിനാൽ പരസ്യം ചെയ്യുന്നു.
താഴെപ്പറയുന്ന ഭൂമിയുടെ ഉള്ളിലോ അഥവാ അവയോട് ചേർന്നോ സ്ഥിതിചെയ്യുന്ന രജിസ്റ്റർ ചെയ്ത ഭൂമികളിൽ അവകാശമു≠െന്ന് തേർച്ച ചെയ്യുന്ന ഏതൊരാളെയും നേരിട്ടോ ഏജന്റ ് മുഖേനയോ സ്ഥലത്ത് ജോലിചെയ്യുന്ന സർവ്വെയറുടെ അടുത്ത് ഹാജരാകുന്നതിനും അതിരുകൾ കാണിച്ചുകൊടുക്കുന്നതിനും അതിനോട് ബന്ധപ്പെട്ട വിവരങ്ങൾ നൽകുന്നതിനുംവേ≠ി അതതുസമയം ആവശ്യപ്പെടുമ്പോൾ ഹാജരാകുന്നതിനുംവേ≠ി ഇതിനാൽ കാണിച്ചുകൊള്ളുന്നു.
പ്രസ്തുത ആക്ടിലെ 6(2) വകുപ്പുപ്രകാരം ഈ പരസ്യം താഴെ പറയുന്ന ഭൂമികളിൽ അവകാശ ബന്ധമുള്ള ഏതൊരാൾക്കുമുള്ള സാധുവായ നോട്ടീസായി കണക്കാക്കപ്പെടുന്നതാണ്:—
(എ) സർവ്വെ ചെയ്യുന്നതിനായി നിർമ്മാർ÷നം ചെയ്യേ≠ ആവശ്യം ഉ≠ായേക്കാവുന്ന വല്ല മരങ്ങളോ കുറ്റിക്കാടുകളോ വേലികളോ നിൽക്കുന്ന വിളകളോ അഥവാ സാരവത്തായ മറ്റ് തടസ്സങ്ങളോ 15 ദിവസത്തിനകം മുറിച്ചുകളയുകയോ നീക്കംചെയ്യുകയോ ചെയ്ത് അതിരുകളോ മറ്റ് ലൈനുകളോ വെടിപ്പാക്കണമെന്നും;
(ബി) കൊടിപിടിക്കുന്നവരെയും ചെയിൻമാൻമാരെയും നിയോഗിച്ച് അതതുസമയം ആവശ്യമായേക്കാവുന്ന സമയത്തേക്കും കാലത്തേക്കും തൊഴിലാളികളെ ഏർപ്പെടുത്തണമെന്നും;
(സി) അനുയോജ്യമായ സർവ്വെ അടയാളങ്ങൾ നൽകണമെന്നും മറ്റുപ്രകാരത്തിൽ പ്രസ്തുത ആക്ടോ അ ത ു ്ര പ ക ാ ര മ ു ≠ ാ ക്ക ിയി ട്ട ുള്ള ച ട്ട ങ്ങേ ള ാ അ ന ു സര ി ച്ച് ആ വ ശ ്യ െ പ്പ േ ട്ടക്ക ാ വ ു ന്ന സഹായങ്ങൾ സർവ്വെയർക്ക് നൽകണമെന്നും ഇതിനാൽ ആവശ്യപ്പെടുന്നു.
മേൽപ്പറഞ്ഞ (എ) മുതൽ (സി) വരെയുള്ള ഖfiങ്ങൾ പ്രകാരമുള്ള ഈ അഭ്യർ∞നകൾ അനുസരിക്കുന്നതിൽ ആരെങ്കിലും വീഴ്ചവരുത്തുകയാണെങ്കിൽ ജോലി കൂലിപ്പണിക്കാരെക്കൊ≠് ചെയ്യിക്കുന്നതും ആയതിന്റെ ചെലവ് ആക്ടിലും അതുപ്രകാരം ഉ≠ാക്കിയിട്ടുള്ള ചട്ടങ്ങളിലും വ്യവസ്ഥ ചെയ്തിട്ടുള്ളതുപോലെ വീഴ്ചവരുത്തിയിട്ടുള്ളവരിൽനിന്നും വസൂലാക്കാവുന്നതുമാണ്.

വിഷയം:—ന്യായവില നിർണ്ണയം—ശ്രീ. ജെയിംസ്, മൺപുരയ്ക്കൽ ഹൗസ്, കു≠ന്നൂർ എന്നയാളുടെ അപേക്ഷ—സംബന്ധിച്ച്.
സൂചന:—(1) കുന്നത്തുനാട് ഭൂരേഖ തഹശീൽദാരുടെ 27-10-2021-ലെ റിപ്പോർട്ട്.
(2) ലാൻഡ് റവന്യൂ കമ്മീഷണറുടെ 11-12-2019-ലെ എൽ.ആർ.എ3-54674/2018-ാം നമ്പർ പരിപത്രം.
ശ്രീ. ജെയിംസ്, മൺപുരയ്ക്കൽ ഹൗസ്, കു≠ന്നൂർ എന്ന കക്ഷി, കുന്നത്തുനാട് താലൂക്ക്, വെങ്ങോല വില്ലേജ്, ബ്ലോക്ക് 21, റീസർവ്വെ നമ്പർ 391/13-ൽപ്പെട്ട വസ്തുവിന്റെ ന്യായവില പുനർനിർണ്ണയിക്കുന്നതിനാണ് അപേക്ഷ സമർപ്പിച്ചിട്ടുള്ളത്.
അപേക്ഷാ വസ്തു അടിസ്ഥാന നികുതി രജിസ്റ്റർ പ്രകാരം 'പുരയിടം' എന്ന് രേഖപ്പെടുത്തിയിട്ട് ഉള്ളതും ന്യായവില രജിസ്റ്ററിൽ 'ഗവൺമെന്റ ് പ്രോപ്പർട്ടി' കാറ്റഗറിയിൽ തെറ്റായി ഉൾപ്പെട്ട് ആർ ഒന്നിന് Re. 1 വില നി›യിക്കപ്പെട്ടിട്ടുള്ളതാണെന്നും സൂചന (1) പ്രകാരം റിപ്പോർട്ട് ചെയ്തിട്ടു≠്. ടി വസ്തു അടിസ്ഥാന നികുതി രജിസ്റ്ററിൽ പുറമ്പോക്ക് എന്ന് രേഖപ്പെടുത്തിയിട്ടുള്ളതാണെങ്കിലും ടി വസ്തുവിന്റെ മുൻ ഉടമകൾക്ക് പി. എഫ്. 87/70 നമ്പർ പ്രകാരം പട്ടയം ലഭിച്ചിട്ടുള്ളതാണെന്ന് റിപ്പോർട്ട് പ്രകാരം കാണുന്നു.
അപേക്ഷാ വസ്തുവിന്റെ സമാനസ്വഭാവമുള്ളതും കുന്നത്തുനാട് താലൂക്ക്, വെങ്ങോല വില്ലേജ്, ബ്ലോക്ക് 21, സർവ്വെ 390/9-ൽപ്പെട്ടതുമായ വസ്തു അപേക്ഷാ വസ്തുവിന് കിഴക്ക് വശത്തുള്ള പഞ്ചായത്ത് റോഡിന് കിഴക്ക് വശം ചേർന്ന് സ്ഥിതി ചെയ്യുന്നതും ആയതിന് ന്യായവില രജിസ്റ്റർ പ്രകാരം 'റസിഡൻഷ്യൽ πോട്ട് വിത്ത് പഞ്ചായത്ത് റോഡ് ആക്സസ്' കാറ്റഗറിയിൽ ആർ ഒന്നിന് ` 1,00,000 ന്യായവില നി›യിച്ചിട്ടുള്ളതുമാണെന്ന് ഭൂരേഖ തഹശീൽദാർ റിപ്പോർട്ട് ചെയ്തിട്ടു≠്.
അപേക്ഷാ വസ്തു 'റസിഡൻഷ്യൽ πോട്ട് വിത്ത് പഞ്ചായത്ത് റോഡ് ആക്സസ്' കാറ്റഗറിയിൽ ഉൾപ്പെടുത്തി ആർ ഒന്നിന് ` 1,00,000 ന്യായവില നി›യിക്കാവുന്നതാണെന്ന് സൂചന (1) പ്രകാരം കുന്നത്തുനാട് ഭൂരേഖ തഹശീൽദാർ ശുപാർശ ചെയ്തിട്ടു≠്.
ന്യായവില നിർണ്ണയത്തിലെ അപാകതകൾ 1959-ലെ കേരള സ്റ്റാമ്പ് ആക്ട് സെക്ഷൻ 28എ, പ്രസ്തുത നിയമത്തിന് കീഴിലുള്ള 1995-ലെ കേരള സ്റ്റാമ്പ് (ഫിക്സേഷൻ ഓഫ് ഫെയർ വാല്യു ഓഫ് ലാൻഡ്) ചട്ടം 3 എന്നിവ പ്രകാരം ന്യായവില നിർണ്ണയിച്ച് ചട്ടം 4 പ്രകാരമുള്ള വി⁄ാപനവും പ്രസിദ്ധപ്പെടുത്തേ≠തു≠്.

Who never claims any right over the above mentioned land shall within a period of 4 (four) months appear or file written statement before the undersigned for specifying the nature of such right.
During interval between the publication of this proclamation and the date fixed by the Notification u/s 19 no right shall be acquired in or over the above mentioned land except under a grand or contract in writing made or entered into by, or on behalf of government or by or on behalf of some person to whom such right or power to create the same was vested when the proclamation was published, or by succession from such person and no clearings shall be made on such land, nor shall any person cut, collect, or remove any forest produce nor shall set fire to such land or kindle or leave burning any fire in such manner as to endanger the same.
No patta shall without the previous sanction of the Government be granted in such land, and every patta granted without such sanction shall be null and void.
