തിരുവനന്തപുരം റിസർച്ച് സൗത്ത് ഡിവിഷന്റെ പരിധിയിലുള്ള പീരുമേട് റിസർച്ച് യൂണിറ്റിലെ താഴെ പറയുന്ന പ്രവർത്തികൾ നിർവ്വഹിക്കുന്നതിന് താൽപ്പര്യമുള്ള യോഗ്യരായ രജിസ്റ്റേർഡ് കരാറുകാ രിൽ നിന്നും നിലവിലുള്ളതും, സർക്കാർ കാലാകാലങ്ങളിൽ പുറപ്പെടുവിച്ചിട്ടുള്ളതുമായ ലേല നിബ ന്ധനകൾക്ക് വിധേയമായും, ഓൺലൈനായി ഇ-ദർഘാസുകൾ ക്ഷണിച്ചുകൊള്ളുന്നു.

ദർഘാസുകാരൻ വനം വകുപ്പിൽ നിലവിലുള്ളതും സർക്കാർ ഭാവിയിൽ പ്രാബല്യത്തിൽ കൊ ുവരാവുന്നതുമായ എല്ലാ നിബന്ധനകളും പി.ഡബ്ല്യൂ.ഡി വ്യവസ്ഥകളും, ഇതര വ്യവസ്ഥകളും പാലിക്കാൻ ബാദ്ധ്യസ്ഥനാണ്. ദർഘാസ് പ്രമാണങ്ങളും, ദർഘാസ് ഷെഡ്യൂളുകളും www.etenders.kerala-gov.in എന്ന വെബ്സൈറ്റിൽ ലഭ്യമാണ്. ദർഘാസിനോടൊപ്പം സമർപ്പിക്കുന്നതി നുള്ള നിരതദ്രവ്യം, ദർഘാസ് പ്രമാണവില എന്നിവ SBI -യുടെ ഇന്റർനെറ്റ് ഓൺലൈൻ ബാങ്കിംഗ് വഴിയോ മറ്റു ബാങ്കുകളുടെ കാര്യത്തിൽ NEFT വഴിയോ ഇ-ടെൻഡറിനൊപ്പം സമർപ്പിക്കേ താണ്.

NEFT വഴി ഇ-പെയ്മെന്റ് നടത്തുന്ന ദർഘാസുകാർ, ദർഘാസ് സമർപ്പിക്കുന്നതിന് കുറഞ്ഞത് 72 മണിക്കൂർ മുൻപെങ്കിലും ടെൻഡർ ഫോറത്തിന്റെ വിലയും ഇ.എം.ഡി-യും e-procurement system ൽ എത്തിച്ചേർന്നതായി ഉറപ്പുവരുത്തേ താണ്. ഈ ദർഘാസിന്റെ വിശദവിവരങ്ങൾ താഴെ ചേർക്കു ന്നു.

എല്ലാ ടെ ർ പ്രമാണങ്ങളും www.etenders.kerala-gov.in എന്ന വെബ്സൈറ്റിൽ കാണിച്ചി രിക്കുന്ന ഓൺലൈൻ കവറുകളിൽ ഓൺലൈനായി മാത്രമേ സ്വീകരിക്കുകയുള്ളൂ. നേരിട്ടോ തപാൽ മാർഗ്ഗമോ, നിശ്ചിത സമയപരിധിക്കുശേഷമോ ലഭിക്കുന്ന ദർഘാസുകൾ ഒരു കാരണവ ശാലും സ്വീകരിക്കുന്നതല്ല.

ഇ- ദർഘാസിനോടൊപ്പം 200/- രൂപയുടെ മുദ്രപത്രത്തിൽ തയ്യാറാക്കി ഒപ്പിട്ട പ്രിലിമിനറി എഗ്രിമെന്റ്, ഗസറ്റഡ് ഓഫീസർ സാക്ഷ്യപ്പെടുത്തിയ രജിസ്ട്രേഷൻ സർട്ടിഫിക്കറ്റിന്റെ പകർപ്പ്, ടെൻഡർ ഡോക്യുമെന്റ് എന്നിവ ഓൺലൈനായി സമർപ്പിക്കേ താണ്. ഇപ്രകാരം സമർപ്പിക്കാ ത്തതും അവയുടെ ഒറിജിനൽ ടെ ർ തുറക്കുന്നതിനു മുൻപ് സ്പീഡ്പോസ്റ്റ്/രജിസ്റ്റേർഡ് പോസ്റ്റ് വഴി സമർപ്പിക്കാത്തതുമായ ദർഘാസുകൾ നിരസിക്കപ്പെടുന്നതാണ്. ഇ-ടെ റുമായി ബന്ധപ്പെട്ട മറ്റു വിവരങ്ങൾ NIC ൽ നിന്നോ, www.etenders.kerala-gov.in എന്ന വെബ്സൈറ്റിൽ പറഞ്ഞിരിക്കുന്ന e-tenders help desk ൽ നിന്നോ ഈ ഓഫീസിൽ നിന്നോ (ഓഫീസ് സമയത്ത്)അറിയാവുന്നതാണ്. ഇ- പേയ്മെന്റിന് ആവശ്യമായ വിവരങ്ങൾ (കരാറുകാരൻ ഇടപാടു നടത്തുന്ന കോർ ബാങ്കിംഗ് സൗകര്യമുള്ള ബാങ്ക് അക്കൗ ിന്റെ വിശദവിവരങ്ങളും, ഇ-മെയിൽ അഡ്രസ്സും) ദർഘാസിനോ ടൊപ്പം സമർപ്പിക്കേ താണ്. ഈ വിവരങ്ങൾ ഉൾപ്പെടുത്താത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്. കരാറുകാരൻ വിവരങ്ങൾ അപ്ലോഡു ചെയ്യുന്നതിനും മറ്റുമു ാകുന്ന അസൗകര്യങ്ങൾക്കും നഷ്ട ത്തിനും വനംവകുപ്പ് ഉത്തരവാദി ആയിരിക്കുന്നതല്ല.

നിലവിലുള്ള എല്ലാ ലേല വ്യവസ്ഥകളും, ഇ-ദർഘാസ് വ്യവസ്ഥകളും ഈ ടെൻഡറിനും ബാധ കമായിരിക്കും. പ്രസ്തുത ദർഘാസിലെ ഏതൊരു പ്രവൃത്തിയും മുന്നറിയിപ്പു കൂടാതെ റദ്ദു ചെയ്യു ന്നതിനുള്ള പൂർണ്ണ അധികാരം താഴെ ഒപ്പിട്ടിരിക്കുന്ന അധികാരിയിലും മേലധികാരിയിലും നിക്ഷി പ്തമായിട്ടുള്ളതാകുന്നു.

വിജയിയാകുന്ന ദർഘാസുകാരൻ, ദർഘാസ് അംഗീകരിച്ച അറിയിപ്പു തീയതി മുതൽ 15 ദിവ സത്തിനുള്ളിൽ കരാർ തുകയുടെ 5 ശതമാനമോ നിയുക്ത സെക്യുരിറ്റിഡിപ്പോസിറ്റിൽ നിന്നുള്ള തുകയോ, ഏതാണോ കുറവ് ആ തുകയ്ക്കുള്ള സെക്യുരിറ്റി ഡെപ്പോസിറ്റ് സഹിതം മുദ്രപത്രത്തിൽ കരാർ ഒപ്പ് വയ്ക്കേ താണ്. ടെ ർ തീയതി ഏതെങ്കിലും കാരണവശാൽ അവധിയായി പ്രഖ്യാപി ക്കുന്നപക്ഷം തൊട്ടടുത്ത പ്രവൃത്തി ദിവസം അതേ സമയത്തും, അതേ സ്ഥലത്തും ടെ ർ നടത്തുന്ന താണ്. കൂടുതൽ വിവരങ്ങൾ തിരുവനന്തപുരം റിസർച്ച് സൗത്ത് ഡിവിഷൻ ഡെപ്യൂട്ടി ഫോറസ്റ്റ് കൺസർവേറ്ററുടെ കാര്യാലയത്തിൽ നിന്നോ പീരുമേട് റിസർച്ച് യൂണിറ്റ് ഓഫീസിൽ നിന്നോ പ്രവൃത്തി ദിവസങ്ങളിൽ അറിയാവുന്നതാണ്.

നിബന്ധനകൾ

1. ജി ഒ (എം എസ്സ്) 26/2017 വനം വന്യജീവി വകുപ്പ് തീയതി 20.05.2017 നമ്പർ സർക്കാർ ഉത്തര വിലെ എല്ലാ വ്യവസ്ഥകൾക്കും വനം വകുപ്പിൽ നിലവിലുള്ള ദർഘാസ് സംബന്ധിച്ച ഉത്തരവു കളിലെ വ്യവസ്ഥകൾക്കും കേരള ഫേറസ്റ്റ് ആക്ട് 1961, വന്യജീവി സംരക്ഷണ നിയമം 1972, വനസംരക്ഷണനിയമം 1980 എന്നിവയിലെ വ്യവസ്ഥകൾക്കും ദർഘാസുകാരൻ വിധേയനായി രിക്കുന്നതാണ്.

2. തിരുവനന്തപുരം റിസർച്ച് സൗത്ത് ഡിവിഷൻ ഡെപ്യൂട്ടി ഫോറസ്റ്റ് കൺസർവേറ്ററോ, അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്ദ്യോഗസ്ഥനോ ഹാജരായിട്ടുള്ള ദർഘാസുകാരുടെയോ അവർ ചുമതലപ്പെടുത്തിയിട്ടുള്ള പ്രതിനിധികളുടെയോ സാന്നിദ്ധ്യത്തിൽ ടെ ർ തുറക്കുന്ന തായിരിക്കും.

3. ഒരു വ്യക്തിയുടെ പേരിൽ നൽകിയിട്ടുള്ള ദർഘാസ് ഫോറം ആ വ്യക്തിക്കു മാത്രമേ (ടെ ർ ഫോറത്തോടൊപ്പം ഉള്ളടക്കം ചെയ്തിട്ടുള്ള ജോലിക്ക്) മാത്രമേ ഉപയോഗിക്കാൻ പാടുള്ളൂ. 4. ടെ ർ സമർപ്പിക്കുന്നതിനു മുൻപായി, ടെ ർ വ്യവസ്ഥകളും, സ്ഥലവും പരിശോധിച്ച് ബോദ്ധ്യപ്പെടേ താണ്. ടെ ർ സമർപ്പിച്ചതിനുശേഷം ഇത് സംബന്ധിച്ച് എന്തെങ്കിലും പരാ തികളോ ആക്ഷേപങ്ങളോ സ്വീകരിക്കുന്നതല്ല.

5. ദർഘാസ് സമർപ്പിക്കുന്നതിനു മുൻപായി ജോലി നടത്തേ സ്ഥലവും, ജോലിയുടെ സ്വഭാ വവും പരിശോധിച്ച് മനസ്സിലാക്കുകയും ആയതനുസരിച്ച് നിരക്ക് രേഖപ്പെടുത്തേ തുമാണ്. ആയതിനുശേഷം ഒരു കാരണവശാലും നിരക്ക് വർദ്ധിപ്പിക്കുന്നതല്ല.

6. ദർഘാസ് ഫോറത്തിൽ രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്ക്, ജോലി പൂർത്തിയാക്കാൻ കഴിയുന്ന തിലും വളരെ കുറവാണെന്ന് ഡെപ്യൂട്ടി ഫോറസ്റ്റ് കൺസർവേറ്റർ, റിസർച്ച് സൗത്ത് ഡിവി ഷൻ്, തിരുവനന്തപുരത്തിന് ബോദ്ധ്യപ്പെടുന്ന പക്ഷം ആയത് സംബന്ധിച്ച് ദർഘാസുകാ രനിൽ നിന്നും തൃപിതികരമായ വിശദീകരണം നൽകാൻ ആവശ്യപ്പെടുന്നതും ഇത്തരം സന്ദർഭത്തിൽ ദർഘാസ് അംഗീകരിക്കുന്നതിനു മുൻപായി രേഖപ്പെടുത്തിയിട്ടുള്ള നിരക്കിന്റെ 10% പരമാവധി (30,000/-രൂപ) പ്രത്യേക/ അധിക സെക്യൂരിറ്റിയായി ഒടുക്കുവാൻ ആവശ്യപ്പെ ടുന്നതുമാണ്.വിശദീകരണം തൃപ്തികരമല്ലാത്ത പക്ഷം അഥവാ വിശദീകരണം നൽകിയിട്ടില്ലാ യെങ്കിൽ, ഏറ്റവും കുറഞ്ഞ നിരക്ക് രേഖപ്പടുത്തിയിട്ടു െങ്കിലും ആയത് നിരസിക്കുന്നതി നുള്ള അധികാരം ഡെപ്യൂട്ടി ഫോറസ്റ്റ് കൺസർവേറ്റർ, റിസർച്ച് സൗത്ത് ഡിവിഷൻ്, തിരുവ നന്തപുരത്തിൽ നിക്ഷ്പിതമാണ്.

8. ലഭിച്ചിട്ടുള്ള ദർഘാസുകൾ ഒന്നാം ഭാഗം തിരുവനന്തപുരം റിസർച്ച് സൗത്ത് ഡിവിഷൻ ഡെപ്യൂട്ടി ഫോറസ്റ്റ് കൺസർവേറ്ററോ, അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്ദ്യോഗസ്ഥനോ 22.12.2023 തീയതി പകൽ 1 മണിക്ക് അദ്ദേഹത്തിന്റെ ചേംബറിൽ വച്ച് ഹാജരായിട്ടുള്ള ദർഘാസുകാരുടെ സാന്നിദ്ധ്യത്തിൽ തുറക്കുന്നതാണ്.

9. മേൽ പറഞ്ഞിരിക്കുന്ന പ്രവൃത്തികൾ ഏതു സമയത്തും വനം വകുപ്പ് ഉദ്ദ്യോഗസ്ഥർക്ക് പരി ശോധന നടത്താവുന്നതും പരിശോധന വേളയിൽ ഉദ്ദ്യോഗസ്ഥർ നിർദ്ദേശിക്കുന്ന കാര്യങ്ങൾ കരാറുകാരൻ നിർവ്വഹിക്കേ തുമാണ്.

10. മേൽ പ്രവൃത്തിയിൽ വരുന്ന തേക്ക് വിത്ത് ശേഖരണം ഫെബ്രുവരി 1-ന് ആരംഭിച്ച് ഫെബ്രുവരി 10-ാം തീയതിയ്ക്കകം പൂർത്തിയാക്കി രേഖാമൂലം ബന്ധപ്പെട്ട ഓഫീസറുടെ പക്കൽ ഏൽപ്പിക്കേ താണ്.

Special Terms and Conditions

1. The retail sale is governed by the General Terms & Conditions (GTC), Buyer Specific Terms & Conditions (BSTC) and Special Terms & Conditions (STC) of the e-auction. In case of any conflict or differences among any of the provisions of GTC, BSTC & STC, the provisions of STC will supersede the others in the particular e-auction. The terms & conditions, including the list of materials appearing on the date of e-auction is final and binding on the participant buyers.

2. Kerala Forest Department, the owner/seller, will be hereinafter referred to as 'Principal' and 'MSTC Ltd.', the Selling Agent of Kerala Forest Department will be hereinafter referred to as 'MSTC'. Wherever the word Buyer, Purchaser, Successful Buyer is indicated, it will be referred to as 'Successful Buyer'.

3. ഢമഹശറശ്യ േ ീള ആശറെ : All offers by buyers will be valid for acceptance by MSTC for a period of 7 (Seven) days. In case the 7th day falls on a holidy or remains closed for Principal/ MSTC, the validity of the offer will be deemed to be automatically extended up to the next working day of Principal/MSTC.

4. കിുെലരശേീി : The intending buyer or his authorized representative may inspect the materials as per the schedule mentioned above, between 10 hrs. and 17 hrs. on any working day at the location specified with the prior intimation to the Depot Officer concerned. The detailed descriptions of all lots including annexure, if any, are available at the respective Divisional Forest Office also.

5. The description/quality indicated are furnished to enable buyers to quote their rates. Buyers are advised to quote their rates only after inspection of items at site. In case, the buyers do not prefer to inspect, neither the sale could be invalidated nor the buyer can make any claim/compensation whatsoever on account of any defect in description, deficiency in the quantity. Notwithstanding anything contained in the e-auction sale notice or advertisement issued as to description and particulars of material put up for sale, the sale is on "As is Where is and no Complaint Basis" only. No plea or misunderstanding or ignorance or conditions put forth subsequent to any confirmation of sale shall be accepted. The Principle of "Caveat Emptor" (let the buyer be aware) will apply.

6. Conditional offers will not be accepted/entertained.

13. Remittance of Balance Amount and Removal of Lots:

(a) The successful buyer should remit the payments as per the following manner:

(i) Immediately on receipt of the acceptance letter from MSTC, the buyer shall remit the entire amount of the materials (less EMD), Chalan for the balance amount the taxes will be issued by the Depot Officer concerned with a currency up to 7 working days.

(ii) The mode of payment is through e-treasury of Government of Kerala or DD drawn from a Nationalized Bank payable at respective station in favour of ,Divisional Forest Officer or by cash in the respective Treasury.

(iii) If any amount is charged by Bank for clearing the DD, the same shall be borne by the buyer himself. If the DD is dishonoured by the Bank, the bidder who remitted the DD will be treated as defaulter and necessary actions will be initiated against him as per the law and as per sale conditions.

(iv) If the buyer fails to remit the amount as prescribed in the Acceptance Letter within the prescribed time period, the offer will be treated as cancelled and all remittance including EMD will be forfeited without giving any notice and the lots will be re-auctioned.

(v) If the last day prescribed for remittance happens to be a public holiday, the amount can be remitted without penalty on the next working day.

(vi) The material will be delivered only to the successful buyer or their authorized representatives against presentation of e-Auction Identity Card issued by MSTC.

If the successful buyer desires to authorize a representative or an agent for delivery, in such case, the buyer shall produce suitable Power of Attorney or authorization letter duly attested by a Notary Public authorizing his representative or agent to lift the materials from Principal.

(vii) If the successful buyer clears all his dues, is allowed to remove lots without paying any ground rent within 7 days. He is allowed to remove the materials for another 7 days by paying ground rent @ 10 per cubic meter.

(viii) The successful buyer will be solely responsible for removal and transport of sand from sale depot once sold. The department is not responsible for any loss or damage to the materials kept at depot compound, once it is sold.

(ix) The measurement of the sand will be done in accordance with the volume in m³ of sand loaded on Lorry/vehicle viz, length of platform (in meter) x breadth of platform (in meter) x height of this sand (in meter) loaded on lorry/vehicle.

(x) The buyer needs to obtain transit pass from the Depot Officer for transportation.

14. Penalty for the defaulters:

Under no circumstances the lots will be allowed to be removed beyond the above time period. If the buyer fails to remove the lots within the prescribed time limit, the lots will be re-auctioned and all moneys remitted by the buyer will be forfeited without any notice to the buyer.

15. Other Conditions:

(a) Blacklisted buyers will not be allowed to participate in any e-auctions.

(b) The successful buyers are bound to abide by changes in terms & conditions of e-auction consequent upon any amendments in the existing Kerala Forest Act, 1961 or extant Rules.

(c) All the litigations related to e-auction will be entertained only in the Courts within the jurisdiction of the Depot Officer concerned.

16. Principal/MSTC reserves the right to accept/reject and cancel any offer, amend the quantity under any lot or withdraw any lot at any stage under this sale after acceptance of sale/issue of sale order/deposit of full sale value by the buyer, without assigning any reason thereof and the value of such material paid for, shall be refundable. Principal/MSTC shall not be responsible for any damages/loss whatsoever to buyers on account of such withdrawal, at any stage from the e-auction sale.

17. Force majeure: Principal/MSTC will not be in any way responsible for failure to deliver the material due to cause beyond their control such as strike, lockout, cessation of work by labourers, shortened hours, act of God or other causes of other contingencies whatsoever.

The buyer shall not be entitled to cancel the contract and the period of delivery shall automatically get extended proportionately.

18. Conduct during delivery: Buyers shall solely be responsible for movement and proper behaviour of their deputies, agents and labourers within Principal premises. If any damage is caused to the Government property, the buyer is responsible to make good such damage to the satisfaction of Principal and the decision of Principal in this regard shall be final and binding.

19. Accidents etc. to buyer's labourer: Principal/MSTC will not any point of time be responsible for any injuries caused due to accident within the premises or at the place of work and the buyer will make proper arrangement for medical attention and treatment to his labour representative.The buyer will be solely responsible for any claim arising out of the employment, injuries to labourers in the course of the employment under any statute. It is the responsibility of the buyer to provide necessary safety appliances (like hand gloves, tools, helmet, safety goggles, boots etc.) to the labourers who are engaged for handling of the goods.

20. Black Listing: If it is found that the buyer is not following the terms and conditions of payment, delivery or other conditions of the e-auction and also indulging in any malpractices either by himself or by his agents, deputies or observer, such buyer are liable to be blacklisted and appropriate action will be taken as deemed fit by Principal.

21. In the event of any dispute in connection with this sale, the decision of Principal/MSTC shall be final and binding on the parties to the e-auction sale. Further any such dispute, doubts or differences of opinion arising at the time of payment or Delivery, buyers shall agree and abide by the decision of Principal.

22. No interest will be paid to the purchaser on the amount paid or deposited by him and on the amount refundable to him, if any.

23. The terms and conditions are supplementary to the remedy available under the law.

24. Any auctioned materials shall not be sold or parted with any of the employees of Principal/MSTC.

25. Complaints/grievances from buyers regarding sale shall be addressed to the Grievance Redressal Committee constituted under the Chairmanship of Circle Chief Conservator of Forest, for the purpose of adjudicating complaints regarding e-auction of timber. The Grievance Redressal Committee is authorized to take decisions relating to the grievance or complaints which include cancellation/confirmation of the offer, imposing of any penalty and forfeiture of EMD and matters related thereto.

It is hereby notified that Teak timber IV, Teak Poles & Teak billets collected through thinning & final felling from 2015 TP Muthalathodu, 2010 TP Kumbhavurutty, 1960 TP Pallimundan, 1987 TP Alinjamon & 1987 TP Kodamala in Achencovil Range and 1960 TP Mlamthadam at Kallar Range will be sold through e-Auction as shown in the schedule, by M/S MSTC Ltd, Bangalore, subject to the conditions published by the M/S MSTC Ltd and in the Kerala Gazette No. 49 Vol. IV dated. 15.12.2015 vide Notification No. Pro. (4) 26243/13 dated: 21.11.2015 of the Additional Principal Chief Conservator of Forests (P) Thiruvananthapuram and other conditions prevalent in the Forest Department. Besides the quantity shown in the schedule, the quantity if any delivered to dumping depots before the date of e-Auction and that could be lotted immediately before the e-auction will also be placed in the proposed e-auction. Those who wish to participate in the e-auction have to remit EMD as shown in the schedule as e-payment before the e-auction through MSTC limited. Registration number of the bidder should be entered while remitting the EMD amount. Bidders those who are registered and have remitted the EMD before the e- auction will be permitted to take part in the e-auction. Successful bidders will have to remit 35% of the bid amount within 7 (seven) days after obtaining the confirmation of e-auction sale from MSTC. If any successful bidder fails to remit the 35% amount within the stipulated time, the EMD will be forfeited to Govt. and which is non-refundable under any circumstances. If any of the Banks demand a commission for converting the Demand Draft to cash, the bidder will have to suffer the commission charges. ദർഘാസ് സ്വീകരിക്കുന്ന അവസാന തീയതിയായ 19.12.2023 പകൽ 3.30-ന് ഹാജ രുളള കരാറുകാരുടെ സാന്നിദ്ധ്യത്തിൽ താഴെ ഒപ്പിട്ടിട്ടുളള ആളോ അദ്ദേഹം അധികാര പ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ടെ റുകൾ തുറക്കുന്നതായിരിക്കും. ദർഘാസുകൾ കൈമാറ്റം ചെയ്യുവാൻ പാടുളളതല്ല. മൂന്നാർ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ പേരിൽ പണയപ്പെടുത്തിയതും ദേശീയ/ഷെഡ്യൂൾഡ് ബാങ്കിൽ നിന്നും ലഭിക്കുന്നതു മായ നിശ്ചിത തുകയ്ക്കുളള ഡിമാൻഡ് ഡ്രാഫ്റ്റ് നിരതദ്രവ്യമായി ദർഘാസിനോടൊപ്പം സമർപ്പിക്കേ താണ്. അപൂർണ്ണമായ ദർഘാസുകൾ നിരസിക്കുന്നതായിരിക്കും. ഏതെ ങ്കിലും ദർഘാസുകൾ കാരണം ബോദ്ധ്യപ്പെടുത്താതെ നിരസിക്കുന്നതിനുളള അധി കാരം താഴെ ഒപ്പിട്ടിരിക്കുന്ന ആളിൽ നിക്ഷിപ്തമായിരിക്കും. വനം വകുപ്പിലും പൊതുമ രാമത്ത് വകുപ്പിലും നിലവിലുളളതും കാലാകാലങ്ങളിൽ പുറപ്പെടുവിക്കുന്നതുമായ കരാർ വ്യവസ്ഥകൾ ഈ ജോലികൾക്കും ബാധകമായിരിക്കും. കരാറുകാരൻ നിർദ്ദിഷ്ട മാതൃകയിൽ 200/- രൂപ മുദ്രപത്രത്തിൽ പ്രഥമിക ഉടമ്പടി ദർഘാസിനോടൊപ്പം സമർപ്പി ക്കേ താണ്. പ്രാഥമിക ഉടമ്പടി ഇല്ലാത്ത ദർഘാസുകൾ നിരസിക്കുന്നതാണ്. വനം വകുപ്പിലും പൊതുമരാമത്ത് വകുപ്പിലും നിലവിലുളളതും കാലാകാലങ്ങളിൽ പുറപ്പെടു വിക്കുന്നതുമായ കരാർ വ്യവസ്ഥകൾ ഈ ജോലിക്കും ബാധകമായിരിക്കും. ലഘു ദർഘാസിൽ വിജയിയാകുന്ന കരാറുകാരൻ വിജയിയാകുന്ന അറിയിപ്പ് ലഭിച്ചതിന് ശേഷം നിർദ്ദിഷ്ട തുക സെക്യൂരിറ്റിയായി ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറുടെ പേരിൽ ഒടുക്കി കരാർ ഒപ്പിട്ട് പ്രവർത്തി ആരംഭിച്ച് നിർദ്ദിഷ്ട സമയപരിധിക്കുളളിൽ പ്രവർത്തി പൂർത്തീകരിക്കേ താണ്.

നിബന്ധനകൾ

1. ജി.ഒ (എം.എസ്സ്) 26/2017 വനം വന്യജീവി വകുപ്പ് തീയതി 20.05.2017 എന്ന സർക്കാർ ഉത്തരവിലെ എല്ലാ വ്യവസ്ഥകൾക്കും വനം വകുപ്പിൽ നിലവിലു ളള ദർഘാസ് സംബന്ധിച്ച ഉത്തരവുകളിലെ വ്യവസ്ഥകൾക്കും കേരള ഫോറസ്റ്റ് ആക്ട് 1961, വന്യജീവി സംരക്ഷണ നിയമം 1972-ലെ വ്യവസ്ഥ കൾക്കും ദർഘാസുകാരൻ വിധേയനായിരിക്കുന്നതാണ്.

2. മൂന്നാർ ഡിവഷണൽ ഫോറസ്റ്റ് ഓഫീസറോ, അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്യോഗസ്ഥനോ ഹാജരായിട്ടുളള ദർഘാസുകാരുടേയോ അവരുടെ ചുമതല പ്പെടുത്തിയിട്ടുളള പ്രതിനിധികളുടേയോ സാന്നിദ്ധ്യത്തിൽ ലഘു ദർഘാസ് തുറക്കുന്നതായിരിക്കും.

3. ഒരു വ്യക്തിയുടെ പേരിൽ നൽകിയിട്ടുളള ലഘു ദർഘാസ് ഫോറം ആ വ്യക്തിക്കുമാത്രവും ലഘു ദർഘാസ് ഫോറത്തോടൊപ്പം ഉളളടക്കം ചെയ്തി ട്ടുളള ജോലിക്കും മാത്രമേ ഉപയോഗിക്കാൻ പാടുളളൂ.

സ്ഥകൾ മനസ്സിലാക്കിയിരിക്കേ താണ്. എഗ്രിമെന്റ് കരട് ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസിൽ നിന്നും ലഭ്യമാകുന്നതാണ്. ലഘു ദർഘാസ് വ്യവസ്ഥ കളും മനസ്സിലാക്കിയിരിക്കേ താണ്. പൂരിപ്പിച്ച ലഘു ദർഘാസ് സമർപ്പിച്ച ശേഷം എഗ്രിമെന്റ് വ്യവസ്ഥകൾ മനസ്സിലാക്കിയിരുന്നില്ല എന്ന വാദമോ വ്യവ സ്ഥകൾ സംബന്ധിച്ച് എന്തെങ്കിലും പരാതികളോ പരിഗണിക്കുന്നതല്ല.

5. സന്നദ്ധ ദർഘാസ് സമർപ്പിക്കുന്നതിന് മുമ്പായി ജോലി നടത്തേ സ്ഥലവും, ജോലിയുടെ സ്വഭാവവും പരിശോധിച്ച് മനസ്സിലാക്കുകയും ആയതനുസരിച്ച് നിരക്ക് രേഖപ്പെടുത്തേ തുമാണ്.

6. നിശ്ചിത തീയതിക്കും സമയത്തും ലഭിക്കാത്ത അപേക്ഷകളും ആവശ്യമായ രേഖകൾ ഉൾപ്പെടുത്താത്തതോ നിശ്ചിത ഫോറത്തിലും നിശ്ചിത ക്രമത്തിലും എഴുതാത്തതോ ആയ ദർഘാസുകൾ പരിഗണിക്കുന്നതല്ല.

7. ദർഘാസിൽ എന്തെങ്കിലും തിരുത്തലുകൾ വരുത്തിയിട്ടു െങ്കിൽ ആയത് ദർഘാസുകാരൻ തന്നെ ഇനീഷ്യൽ ചെയ്തിരിക്കേ താണ്.

8. സാധാരണ ഗതിയിൽ കുറഞ്ഞ നിരക്കിൽ രേഖപ്പെടുത്തിയിട്ടുളള ദർഘാസ് സ്വീകരിക്കുന്നതായിരിക്കും. പക്ഷേ തീരുമാനമെടുക്കാൻ അധികാരമുളള ഉദ്യേഗസ്ഥന് ഒരു കാരണവും പറയാതെ തന്നെ ദർഘാസ് സ്വീകരിക്കുവാനോ നിരസിക്കുവാനോ അധികാരം ഉ ായിരിക്കും.

9. ദർഘാസ് തുക രേഖപ്പെടുത്തിയിട്ടുളള ദർഘാസ് തുറന്ന് ര ് മാസത്തിനകം ഓഫർ പിൻവലിക്കുവാൻ ദർഘാസുകാരെ അനുവദിക്കുന്നതല്ല.

10. ആരുടെ ദർഘാസാണോ സ്വീകരിച്ചിട്ടുളളത്, ആ വിവരം വ്യക്തിയെ ദർഘാ സിൽ കൊടുത്തിരിക്കുന്ന വിലാസത്തിൽ രജിസ്റ്റേഡ് കത്ത് മുഖാന്തിരം അറിയിക്കുന്നതാണ്. വിജയിയായ ദർഘാസുകാരൻ 7 ദിവസത്തിനകം ടിയാന്റെ ചിലവിൽ വാങ്ങിയിട്ടുളള നിശ്ചിത തുകയ്ക്കുളള മുദ്രപ്പത്രത്തിൽ ഒരു ഉടമ്പടി ഒപ്പ് വയ്ക്കേ താണ്. ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പ് വയ്ക്കുന്ന തിൽ പരാജയപ്പെട്ടാൽ ദർഘാസ് റദ്ദാക്കുന്നതും ടിയാൻ കെട്ടിവച്ചിട്ടുളള നിര തദ്രവ്യം വനം വകുപ്പിലേക്ക് ക ുകെട്ടുന്നതുമാണ്. തുടർന്ന് ജോലികൾ ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ തൊട്ടടുത്ത നിരക്ക് രേഖപ്പെടുത്തിയിട്ടു ളള ആളിനെക്കൊ ് ചെയ്യിക്കുന്നതുൾപ്പെടെയുളള മറ്റ് മാർഗ്ഗങ്ങൾ കൂടി നട ത്തുന്നതാണ്. ഇതിൽ വച്ച് സർക്കാരിന് എന്തെങ്കിലും നഷ്ടം ഉ ാകുന്ന പക്ഷം ആയത് ആദ്യ ദർഘാസുകാരൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവദിക്കുന്ന ന്യായമായ സമയത്തിനുളളിൽ ഒടുക്കിയില്ലായെങ്കിൽ ആയത് പൊതുമുതലിനുളള കുടിശ്ശികയായി കണക്കാക്കുന്നതും ആയത് 1981-ലെ കേരള റവന്യൂ റിക്കവറി ആക്ടിലെ വ്യവസ്ഥകൾ പ്രകാരമോ, സർക്കാരിന് യുക്തമെന്ന് തോന്നുന്ന മാർഗ്ഗങ്ങളിലൂടെയോ ഈടാക്കുന്നതാണ്. സർക്കാരിന് എന്തെങ്കിലും നേട്ടമു ാകുന്നപക്ഷം അതിൽ വീഴ്ചക്കാരന് യാതൊരു അവ കാശവും ഉ ായിരിക്കുന്നതല്ല.

11. വിജയിയാകുന്ന ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പ് വയ്ക്കുന്ന സമയത്ത് കോൺട്രാക്ട് തുകയുടെ 3 % പരമാവധി 5,00,000/- (അഞ്ച് ലക്ഷം രൂപ മാത്രം) രൂപ സെക്യൂരിറ്റിയായി ഒടുക്കേ താണ്. ജോലി പൂർത്തിയാക്കി, ബന്ധപ്പെട്ട ഓഫീസിൽ നിന്നും ലഭ്യമാകുന്ന ബാദ്ധ്യതാ രഹിത സർട്ടിഫിക്കറ്റ് ഹാജരാക്കുന്ന മുറയ്ക്ക് മാത്രമേ സെക്യൂരിറ്റി വിടുതൽ ചെയ്യുകയുളളൂ.

12. വിജയിയാകുന്ന ദർഘാസുകാരൻ ഉടമ്പടി ഒപ്പുവയ്ക്കുന്ന സമയത്ത് സോൾവൻസി സർട്ടിഫിക്കറ്റിൽ ഉൾപ്പെട്ടിട്ടുളള വസ്തുതകൾ വിൽക്കുകയോ, പണയം വയ്ക്കുകയോ കൈമാറ്റം ചെയ്യുകയോ ചെയ്യില്ലെന്ന് ഒരു സമ്മത പത്രം നൽകേ താണ്.

കളോ, പരാതികളോ ഒരു കാരണവശാലും പരിഗണിക്കുന്നതല്ല.

14. ദർഘാസിൽ പങ്കെടുത്തിട്ടുളള വിജയികളാകാത്ത ദർഘാസുകാരുടെ നിരത ദ്രവ്യം സന്നദ്ധ ദർഘാസ് നടപടികൾ അവസാനിക്കുന്ന മുറയ്ക്ക് തിരികെ നൽകുന്നതാണ്.

15. ദർഘാസിനോടൊപ്പമുളള ഷെഡ്യൂളിൽ പറയുന്ന അളവുകൾ ഏകദേശമായി രിക്കും, ജോലികൾ ചെയ്തുവരുമ്പോൾ അളവുകളിൽ വ്യത്യാസം വരാവുന്ന താണ്.

16. ജോലി പൂർത്തിയാക്കി നിശ്ചിത ഫോറത്തിലുളള ബില്ല് തയ്യാറാക്കി സമർപ്പി ക്കുന്ന മുറയ്ക്ക് ജോലി നിർവ്വഹണം തൃപ്തികരമെങ്കിൽ ബിൽ തുക മാറി നൽകുന്നതാണ്. തുക നൽകുന്നത് ഇ-പേയ്മെന്റ് ആയി മാത്രമായിരിക്കും. 17. ദർഘാസ് ഷെഡ്യൂളിൽ കാണിച്ചിരിക്കുന്ന ജോലികളുടെ അളവിൽ സ്ഥല ത്തിന്റെ പ്രത്യേകത അനുസരിച്ച് കുറവ് വരുത്താനോ ജോലി ക്യാൻസൽ ചെയ്യാനോ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് അധികാരമു ായിരിക്കും. ആയത് വിജയിയായ ദർഘാസുകാരന് ബാധകമായിരിക്കും. ദർഘാസ് ഷെഡ്യൂളിൽ ഉൾപ്പെട്ടിട്ടില്ലാത്ത ഏതെങ്കിലും ഐറ്റങ്ങൾ വ്യക്തമായ കാരണ ങ്ങളാൽ ഉൾപ്പെടുത്തേ തു െങ്കിൽ ആ ജോലി ചെയ്യുന്നതിന് വിജയിയായ ദർഘാസുകാരൻ ബാദ്ധ്യസ്ഥനായിരിക്കും. ആയതിന് നിലവിലുളള ഫോറസ്റ്റ് ഷെഡ്യൂൾ റേറ്റ് പ്രകാരം കോട്ട് ചെയ്ത നിരക്ക് പ്രകാരം തുക മാറി നൽകു ന്നതായിരിക്കും.

18. കോൺട്രാക്ടർ വാഗ്ദാനം ചെയ്തിട്ടുളള ടെൻഡറുകൾ നടപ്പിലാക്കുന്നത് പ്രായോഗികമല്ലെന്ന് ബോദ്ധ്യപ്പെട്ടാൽ കോൺട്രാക്ട് സിസ്റ്റം അല്ലാത്ത മറ്റ് മാർഗ്ഗങ്ങളിലൂടെ നടപ്പിലാക്കുന്നതിനുളള അവകാശം കേരള വനം വകുപ്പിൽ നിക്ഷിപ്തമായിരിക്കും.

19. ദർഘാസ് നടത്തുന്ന സമയത്ത് നിലവിലുളള എല്ലാ നികുതികളും ഈ ദർഘാ സിനും ബാധകമായിരിക്കും.

20. ടി ജോലികൾക്കായി തൊഴിലാളികളെ നിയമിക്കുമ്പോൾ ടി പ്രദേശത്തെ പട്ടിക വർഗ്ഗ വിഭാഗത്തിൽപ്പെട്ട തൊഴിലാളികൾക്ക് മുൻഗണന നൽകേ താ ണ്.

21. കരാറുകാരൻ പ്രവർത്തികൾ ചെയ്യുന്നതുവഴി ഉ ായേക്കാവുന്ന യാതൊരു അപകടങ്ങൾക്കും വനം വകുപ്പ് ഉത്തരവാദി ആയിരിക്കില്ല.

22. കരാറുകാരൻ പ്രവർത്തികൾ ചെയ്യുന്നതുവഴി വന സമ്പത്തിന് യാതൊരു നാശനഷ്ടങ്ങളും സംഭവിക്കാൻ പാടില്ലാത്തതാണ്. അത്തരത്തിലു ാകുന്ന നാശനഷ്ടങ്ങൾക്കുളള നഷ്ടപരിഹാര തുക കരാറുകാരനിൽ നിന്നും ഈടാ ക്കുന്നതാണ്.

23. കരാറുകാരൻ പ്രവർത്തികൾക്കായി കൊ ുവരുന്ന തൊഴിലാളികൾക്കും സാധന സാമഗ്രികൾക്കും ഉ ായേക്കാവുന്ന അപകടങ്ങൾക്കും/നാശനഷ്ട ങ്ങൾക്കും വനം വകുപ്പ് ഉത്തരവാദിയായിരിക്കില്ല.

The wildlife warden, Silent Valley reserves all the right to exclude any class or quantity of materials shown in the schedule above for sale. EMD amount of 20,000 can be remitted through online payment system to MSTC by 2 p.m. on the previous day of the e-auction. The buyer registration number has to be mentioned while paying the EMD. If the sale value of bid materials is not paid within the specified time period against any of the bid lot by the H1 bidder, the EMD will be forfeited.

The successful bidder, 35% of the bid value after adjusting the EMD already remitted shall be paid within 7 working days of issuance of acceptance letter. The mode of payment is through e-treasury of Government of Kerala.

e-Auction document and connected records are available in the website: www.mstcecommerce.com. All bids/e-auction documents are to be submitted online only and in the designated online cover(s) on the www.mstcecommerce.com website and e-auction document submitted manually/through post will not be entertained.

The bidders who wished to participate in the e-auction should produce a certificate showing the permanent address and signature of the bidders duly attested by the concerned Village Officer or any other approved Identity document along with the EMD through online. Those who do not produce any approved Identity Card or Certificate will not be eligible to participate in the e-auction.

Intending persons may ensure the quantity or quality of materials put up for e-auction before the commencement of the same and no complaints will be entertained after e-auction. The quantity may become ready for sale after the publication of this notification will also be included in the tender cum auction. Any further notification to the sale conditions that may be issued by the Government after the issuance of this notification will also be applicable to this tender cum auction. The unsold materials in the e-auction will be placed along with the materials that may in the dumping depots on subsequent dates will be sold on the next auction date shown in the schedule and separate notification will not be published for the same.

If any modifications or change in the sale conditions are intimated by the Additional Principal Chief Conservator of Forests (FM), Thiruvananthapuram that will also be applicable to this e-auction. The undersigned reserves the right to alter the quantities of the materials mentioned in the above schedule or to cancel the e-auction of any material without further notice.
