Dated, Thiruvananthapuram, 28 th November, 2023 12th Vrischikam, 1199 In exercise of powers conferred by section 112 of the Factories Act, 1948 (Central Act 63 of 1948) and as required by sub-section (1) of section 115 of the said Act, the Government of Kerala hereby publish for general information the draft rules further to amend the Kerala Factories Rules, 1957.

Notice is hereby given that the said draft rules will be taken up for consideration on or afterThis is a digitally signed Gazette. Authenticity may be verified through https://compose.kerala.gov.in/

45 days from the date of publication of this notification in the official Gazette and that objections or suggestions if any, that may be received from any person in respect of the said draft rules, on or before the date specified above, will be considered by Government. All such objections and suggestions shall be addressed to the Secretary to Government, Labour and Skills (B) Department, Government Secretariat, Thiruvananthapuram – 695 001.

DRAFT RULES

1. Short title and commencement.– (1) These rules may be called the Kerala Factories (Amendment) Rules, 2023.

(2) They shall come into force at once.

2. Amendment of the Rules.– In the Kerala Factories Rules, 1957,- (i) For APPENDIX - I, the following APPENDIX shall be substituted, namely:-

" APPENDIX – 1

Note:- (1) All remittance shall be as per this schedule with effect from the date of publication of notification.

(2) 1 HP = 0.746 KW. "

(ii)  APPENDIX III, the following APPENDIX shall be substituted, namely :­

plinth area or part thereof subject building including layout of machinery and Rule 3 to a minimum Rs. 1740/- for each grant of permit thereof first time scrutiny

5 Approval of plan for construction,

modification, extension etc. of factory

building including layout of machinery and Rule 3 Rs. 1740/- for each application grant of permit thereof second and

subsequent scrutinise revision

6 Approval of plan for additional installation

or for rearrangement of layout of Rule 3 Rs. 1740/- for each application machinery which do not involve the

approval of building plans

7 Revalidation of permit issued under Rule 3 Rule 3 Fee originally paid for the last

permit

8 Amendment of license Rule 6(4) Rs. 875/- for each amendment 9 Transfer of license Rule 8(3) 25% of license fee in case of

transfer of license in favour of

legal heirs. 100% of license fee for

other transfers. If the transfer is

made without change of

ownership, amendment fee is

required.

."
