WHEREAS, under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the term of an administrator or an administrative committee appointed to manage the affairs of the society shall not exceed one year in the aggregate;
2AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 33 of the said Act to manage the affairs of the Kunnathur Taluk Residence Welfare Cooperative Society Limited No.Q.1513 in Kollam District expired on 12th November, 2018;
AND WHEREAS, under subsection (1A) of section 33 of the said Act the Government may, by notification in the Gazette, for reasons to be recorded, permit the Registrar of Cooperative Societies to extend the term of the administrator or administrative committee appointed to manage the affairs of a society for a further period not exceeding one year in the aggregate or till a newly elected committee enters upon office, whichever is earlier;
AND WHEREAS, the term of the administrator of the said society was extended for a further period of six months from 13th November, 2018 to 12th May, 2019 in pursuance of notification issued under G.O(P)No.14/2020/Coop. dated 24th February, 2020 and published as S.R.O No.172/2020 in the Kerala Gazette Extraordinary No.765 dated 5th March, 2020, and the term was further extended for a period of two years from 13th May, 2019 to 12th May, 2021 in pursuance of notification issued under G.O(P)No.36/2021/Coop. dated 16th February, 2021 and published as S.R.O No.196/2021 in the Kerala Gazette Extraordinary No.806 dated 18th February, 2021 and the term was further extended for a period of two years from 13th May, 2021 to 12th May, 2023 in pursuance of notification issued under G.O(P)No.177/2021/Coop. dated 24th November, 2021 and published as S.R.O No.896/2021 in the Kerala Gazette Extraordinary No.3529 dated 1st December, 2021 and the period so extended also expired on 12th May, 2023;
AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period and has requested to permit him to extend the term of the administrator of the said society for a further period of two years from 13 th May, 2023 to 12th May, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society;
3AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the said society with certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to mange the affairs of the said society for a further period of two years from 13 th May, 2023 to 12th May, 2025 or till a newly elected committee enters upon office, whichever is earlier;
NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the Kunnathur Taluk Residence Welfare Cooperative Society Limited No.Q.1513 in Kollam District with the modification of substituting the words "six years and six months" for the words "one year" and in exercise of the powers under subsection (1A) of section 33 of the said Act, as so modified, permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the said society for a further period of two years from 13th May, 2023 to 12th May, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.

Explanatory Note

The term of the administrator appointed under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), to manage the affairs of the Kunnathur Taluk Residence Welfare Cooperative Society Limited No.Q.1513 in Kollam District expired on 12th May, 2018. The term was extended
4for a further period of six months from 13th November, 2018 to 12th May, 2019 in pursuance of notification issued under G.O(P)No.14/2020/Coop. dated 24th February, 2020 and published as S.R.O No.172/2020 in the Kerala Gazette Extraordinary No.765 dated 5th March, 2020, and the term was further extended for a period of two years from 13th May, 2019 to 12th May, 2021 in pursuance of notification issued under G.O(P)No.36/2021/Coop. dated 16th February, 2021 and published as S.R.O No.196/2021 in the Kerala Gazette Extraordinary No.806 dated 18th February, 2021 and the term was further extended for a period of two years from 13th May, 2021 to 12th May, 2023 in pursuance of notification issued under G.O(P)No.177/2021/Coop. dated 24th November, 2021 and published as S.R.O No.896/2021 in the Kerala Gazette Extraordinary No.3529 dated 1st December, 2021 and the period so extended also expired on 12th May, 2023. The Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within extended period and has requested to extend the term of the administrator for a further period of two years from 13th May, 2023 to 12th May, 2025 to avoid administrative vacuum.
The Government have examined the matter in detail and are satisfied that it is necessary, in public interest to permit the Registrar of Cooperative Societies to extend the term of the administrator of the said society for a further period of two years from 13th May, 2023 to 12th May, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.
This order is intended to achieve the above object.
