S. R. O. No. 1349/2023
WHEREAS, under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the term of an administrator or an administrative committee appointed to manage the affairs of a society shall not exceed one year in the aggregate;
2AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 33 of the said Act to manage the affairs of the Neelamperoor Labour Contract Cooperative Society Limited No.A.906 in Alappuzha District expired on 22nd June, 2019;
AND WHEREAS, under subsection (1A) of section 33 of the said Act, the Government may, by notification in the Gazette, for reasons to be recorded, permit the Registrar of Cooperative Societies to extend the term of the said administrator or administrative committee for a further period not exceeding one year in the aggregate or till a newly elected committee enters upon office, whichever is earlier;
AND WHEREAS, the term of the administrator of the said society was extended for a further period of one year from 23rd June, 2019 to 22nd June, 2020 in pursuance of notification issued under G.O(P)No.75/2020/Coop. dated 19th August, 2020 and published as S.R.O.No.552/2020 in the Kerala Gazette Extraordinary No.1980 dated 3rd September, 2020, and the term was further extended for a period of one year from 23rd June, 2020 to 22nd June, 2021 in pursuance of notification issued under G.O(P)No.117/2021/Coop. dated 27th July, 2021 and published as S.R.O.No.581/2021 in the Kerala Gazette Extraordinary No.2292 dated 2nd August, 2021, and further extended for a period of one year from 23rd June, 2021 to 22nd June, 2022 in pursuance of notification issued under G.O(P)No.3/2022/Coop. dated 4th January, 2022 and published as S.R.O.No.42/2022 in the Kerala Gazette Extraordinary No.111 dated 7th January, 2022 and further extended for a period of one year from 23rd June, 2022 to 22nd June, 2023 in pursuance of notification issued under G.O(P)No.31/2023/Coop. dated 31st January, 2023 and published as S.R.O.No.165/2023 in the Kerala Gazette Extraordinary No.375 dated 2nd February, 2023 and the period so extended also expired on 22nd June, 2023;
AND WHEREAS, the Registrar of Cooperative Societies has reported that election to the Board of Directors of the said society could not be conducted within the extended period due to the society was under liquidation and the
3liquidator was appointed by the Registrar of Cooperative Societies and he assumed charge on 5th August, 2023. The Registrar has requested the Government to extend the term of the administrator for a further period of one month and thirteen days from 23rd June, 2023 to 5th August, 2023 to avoid administrative vacuum in the said society;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the said society with certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the said society for a further period of one month and thirteen days from 23rd June, 2023 to 5th August, 2023 since the Liquidator assumed charge on 5th August, 2023;
NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the Neelamperoor Labour Contract Cooperative Society Limited No.A.906 in Alappuzha District with the modification of substituting the words "five years one month and thirteen days" for the words "one year" and in exercise of the powers under subsection (1A) of section 33 of the said Act, as so modified, permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the said society for a further period of one month and thirteen days from 23rd June, 2023 to 5th August, 2023 to avoid administrative vacuum in the said society, since the liquidator taken charge on 5th August, 2023.

4The term of the parttime administrator appointed under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969) to manage the affairs of the Neelamperoor Labour Contract Cooperative Society Limited No.A.906 in Alappuzha District expired on 22nd June, 2019. The term of the administrator of the said society was lastly extended for a further period of one year from 23rd June, 2022 to 22nd June, 2023 in pursuance of notification issued under G.O(P)No.31/2023/Coop. dated 31st January, 2023 and published as S.R.O.No.165/2023 in the Kerala Gazette Extraordinary No.375 dated 2nd February, 2023 and the period so extended also expired on 22nd June, 2023. The Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period and also the liquidator is taken charge on 5th August, 2023 to the process of winding up of the society, since the revitalization of the society is not possible and has requested to extend the term of the administrator for a further period of one month and thirteen days from 23rd June, 2023 to 5th August, 2023 to avoid administrative vacuum, since the liquidator taken charge upon office. The Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the said society for a further period of one month and thirteen days from 23rd June, 2023 to 5th August, 2023 to avoid administrative vacuum in the said society, since the liquidator assumed charge on 5th August, 2023.
This order is intended to achieve the above object.
