No. 1378/2023In exercise of the powers conferred by 2nd proviso to subsection 7 of section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the declaration as per sub-section 1 of section 19 to the Notification issued under sub-section (1) of section 11 as per Proceedings No. DCKTM/5017/2020-G2 dated 24th July 2022 and published in the Extra Ordinary Gazette No. 2565 dated 03rd August 2022, namely:- This is a digitally signed Gazette. As per Proceedings No. DCKTM/5017/2020-G2 dated 24th July 2022 and published in the Extra Ordinary Gazette No. 2565 dated 03rd August 2022, the notification in accordance with the provisions of subsection (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of land in Vazhapally East & Changanassery Villages of Kottayam district for the construction of Flyover at Railway Junction in Changanassery Bypass, has been issued.

AND WHEREAS, the District Collector, Kottayam has reported that as per Section 19(7) of LARR Act, 2013 mentions that the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No. DCKTM/5017/2020-G2 dated 24th July 2022 and published in the Extra Ordinary Gazette No. 2565 dated 03rd August 2022 and extended as per G. O. (P)No. 164/2023/RD dated 05th July 2023 and published in the Extra Ordinary Gazette No. 2236 dated 06th July 2023 will expire on 02/02/2024 and therefore requested to extend the time limit for publishing the 19(1) Declaration.

NOW THEREFORE, sanction is accorded to extend the time limit in publishing the Declaration for a further period of 6 months from the date of expiry of the 11(1) notification ie. 02/02/2024 by invoking the provisions contained in 2nd proviso to Section 19(7) of the LARR Act, 2013 with regard to the acquisition of land in Vazhapally East & Changanassery Villages of Kottayam district for the construction of Flyover at Railway Junction in Changanassery Bypass, as the last chance on the condition that no more extension be granted under any circumstances.

(This does not form part of the notification, but is intended to indicate its general purport) As per Proceedings No. DCKTM/5017/2020-G2 dated 24th July 2022 and published in the Extra Ordinary Gazette No. 2565 dated 03rd August 2022, the notification in accordance with the provisions of sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of land in Vazhapally East & Changanassery Villages of Kottayam district for the construction of Flyover at Railway Junction in Changanassery Bypass, has been issued. As per Section 19(7) of LARR Act, 2013, the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No. DCKTM/5017/2020-G2 dated 24th July 2022 and published in the Extra Ordinary Gazette No. 2565 dated 03rd August 2022 and extended as per G. O. (P)No. 164/2023/RD dated 05th July 2023 and published in the Extra Ordinary Gazette No. 2236 dated 06th July 2023 will expire on 02/02/2024 and hereby extend the time limit for publishing the 19(1) Declaration.

The notification is intended to achieve the above object.
