DECLARATION

G.O.(P)No.1/2024/RD

Dated, Thiruvananthapuram,03/01/2024 WHEREAS, under sub-section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, Kerala Gazette Extraordinary No. 3652 dated 27/10/2022 (G.O(P) No.271/2022/RD dated 27/10/2022) and amended as per Kerala Gazette Extraordinary No. 818 dated 06/03/2023 (G.O(P) No. 75/2023/RD dated 06/03/2023), Kerala Gazette Extraordinary No. 2095 dated 22/06/2023 (G.O(P) No. 153/2023/RD dated 20/06/2023) in respect of the land specified in the schedule below has been published;

AND WHEREAS, the appropriate Government is satisfied after considering the report made by the Collector under sub-section (1) of Section 15 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land specified in the schedule below has to be acquired for a public purpose.

NOW, THEREFORE, the appropriate Government hereby declares under Section 19 of the Act, that the land specified in the Schedule below and measuring 2.0755 Hectares to be the same, a little more or less, is needed for a public purpose, to wit for the construction of Varkala Bypass and direct the Special Tahsildar, L.A,General Thiruvananthapuram to take order for the acquisition of the land.

A plan of the land is kept in the Office of the Special Tahsildar, L.A,General Thiruvananthapuram and may be inspected at any time during office hours.

2013 ലെ ഭൂമി ഏറ്റെടുക്കലിൽ ന്യായമായ നഷ്ടപരിഹാരത്തിനും സുതാര്യതയ്ക്കും പുനരധിവാസത്തിനും പുനഃസ്ഥാപനത്തിനുമുള്ള അവകാശ ആക്ട് വകുപ്പ് 11 ഉപവകുപ്പ് (1) പ്രകാരമുള്ള വിജ്ഞാപനം 27/10/2022-ലെ 3652-ാാം നമ്പർ അസാധാരണ ഗസറ്റിലും (27/10/2022-ലെ സ.ഉ(അച്ചടി) നം.271/2022/റവ), തിരുത്തൽ വിജ്ഞാപനം 06/03/2023-ലെ 818-ാാം നമ്പർ കേരള അസാധാരണ ഗസറ്റിലും (06/03/2023-ലെ സ.ഉ(അച്ചടി) നം.75/2023/റവ), 22/06/2023-ലെ 2095-ാാം നമ്പർ കേരള അസാധാരണ ഗസറ്റിലും (20/06/2023-ലെ സ.ഉ(അച്ചടി) നം. 153/2023/റവ) പ്രകാരം പ്രസിദ്ധീകരിച്ചിട്ടുള്ളതിനാലും;

താഴെ പട്ടികയിൽ വിവരിക്കുന്ന ഭൂമി ഒരു പൊതുകാര്യത്തിനായി പൊന്നുംവിലയ്ക്ക് എടുക്കേണ്ടതുണ്ടെന്ന് 2013-ലെ ഭൂമി ഏറ്റെടുക്കലിൽ ന്യായമായ നഷ്ടപരിഹാരത്തിനും സുതാര്യതയ്ക്കും പുനരധിവാസത്തിനും പുനഃസ്ഥാപനത്തിനുമുള്ള അവകാശ ആക്ട് 15-ാാം വകുപ്പ് (1)- ാാം ഉപവകുപ്പ് പ്രകാരം സ്ഥലമെടുപ്പ് ആഫീസർ തയ്യാറാക്കിയ റിപ്പോർട്ട് പരിഗണിച്ച് സമുചിത സർക്കാരിന് ബോധ്യപ്പെട്ടതിനാലും ;

ഇപ്പോൾ അതിനാൽ പ്രസ്തുത നിയമത്തിന്റെ 19-ാാം വകുപ്പ് പ്രകാരം താഴെ പട്ടികയിൽ വിവരിച്ചിട്ടുള്ളതും ഏകദേശം 2.0755 ഹെക്ടർ അല്ലെങ്കിൽ അതിൽ അൽപം കൂടുതലോ കുറവോ, വിസ്തീർണ്ണം വരുന്നതുമായ ഭൂമി ഒരു പൊതു ആവശ്യത്തിന്, അതായത് വർക്കല ബൈപ്പാസ് നിർമ്മാണത്തിന് ആശ്യമുണ്ടെന്ന് സമുചിത സർക്കാർ ഇതിനാൽ പ്രഖ്യാപിക്കുകയും, പ്രസ്തുത ഭൂമി പൊന്നും വിലക്കെടുക്കുന്നതിന് സ്പെഷ്യൽ തഹസിൽദാർ, എൽ.എ, ജനറൽ, തിരുവനന്തപുരം എന്നയാളോട് നിർദ്ദേശിക്കുകയും ചെയ്യുന്നു.

സ്ഥലത്തിന്റെ ഒരു രൂപരേഖ സ്പെഷ്യൽ തഹസിൽദാർ, എൽ.എ, ജനറൽ, തിരുവനന്തപുരം ഓഫീസിൽ സൂക്ഷിച്ചിട്ടുള്ളതും ഓഫീസ് സമയത്ത് എപ്പോൾ വേണമെങ്കിലും അത് പരിശോധിക്കാവുന്നതുമാണ്.
