G.O . (Rt.) No. 1159/2024/LBR. Thiruvananthapuram, 12th November 2024.
Whereas, the Government are of opinion that an industrial dispute exists between (1) Dr. Ajmal, President, Alliance Empire Apartment Owners Association, Building No. 4780 A, Alliance Empire, Eranchipalam P. O., Kozhikode-673 006, (2) Chief Executive Officer, Alliance Homes Prestige Center, Registrar Office Road, Kannur-670 006 and the Caretaker of the above referred establishment Sri Prakasan Mamiyil, Madhavam, Kodalnadakkavu, Pantheerangavu P. O., Kozhikode-673 019 in respect of matters mentioned in the annexure to this order;
And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now, therefore, in exercise of the powers conferred by Section 10(1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kozhikode. The Labour Court will pass the award within a period of three months.

"Whether the termination of Sri Prakasan Mamiyil, Caretaker, by the management of Alliance Empire Apartment Owners Association, Building No. 4780 A, Alliance Empire, Eranchipalam P. O., Kozhikode-673 006, is justifiable or not? If not, what relief he is entitled to get?"

Whereas, the Government are of opinion that an industrial dispute exists between (1) Sri Habeeb Rahman, Managing Director, Thrana Facility Management, J. N. Junction, Kaloor.
(2) The Secretary, Kent Mahal Owners Association, Kent Mahal Brahmapuram, Ernakulam-682 303 and the workman of the above referred establishment represented by the General Secretary, Loading Unloading & General Workers Union (I. N. T. U. C.), Brahmapuram P. O.-682 303 in respect of matters mentioned in the annexure to this order;
And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;
Now, therefore, in exercise of the powers conferred by Section 10(1) (d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Alappuzha. The Industrial Tribunal will pass the award within a period of three months.

Read:—(1) Letter No. OAID-2/20 & 3/20 dated 20-6-2024 from the Presiding Officer, Industrial Tribunal, Thrissur.
(2) Letter No. LCO/3151/2024-IR(4) dated 4-11-2024 from the Labour Commissioner, Thiruvananthapuram.
ORDER
As per the letter read as 1st paper above, the Presiding Officer, Industrial Tribunal, Thrissur requested to transfer the OA ID No. 02/2020 & 03/2020 to Industrial Tribunal, Palakkad or to Labour Court, Ernakulam. As per letter read as 2nd paper above the Labour Commissioner has recommended transfer of OA ID No. 02/2020 & 03/2020 to Industrial Tribunal, Palakkad.
Government have examined the matter in detail and are pleased to accord sanction for the transfer of O A ID No. 02/2020 & 03/2020 to Industrial Tribunal, Palakkad.
