WHEREAS, under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the term of an administrator or an administrative committee appointed to manage the affairs of a society shall not
2exceed one year in the aggregate;
AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 33 of the said Act to manage the affairs of the Thirur Taluk Pattikajathi Pattikavarga Welfare Sahakarana Sangham Limited No. M.912 in Malappuram District expired on 15th October, 2021;
AND WHEREAS, under subsection (1A) of section 33 of the said Act, the Government may, by notification in the Gazette, for reasons to be recorded, permit the Registrar of Cooperative Societies to extend the term of the said administrator or administrative committee to manage the affairs of a society for a further period not exceeding one year in the aggregate or till a newly elected committee enters upon office, whichever is earlier;
AND WHEREAS, the term of the administrator of the said society was extended for a further period of two years from 16th October, 2021 to 15th October, 2023 in pursuance of notification issued under G.O.(P) No.119/2023/Coop dated 17th May, 2023 and published as S.R.O. No.615/2023 in the Kerala Gazette Extraordinary No.1788 dated 29th May, 2023 and the term was extended for a further period of one year from 16th October, 2023 to 15th October, 2024 in pursuance of notification issued under G.O.(P) No.100/2024/Coop dated 14th June, 2024 and published as S.R.O. No.523/2024 in the Kerala Gazette Extraordinary No.1946 dated 20th June, 2024 and the period so extended also expired on 15th October, 2024;
AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period due to some technical reasons and has requested to extended the term of the administrator for a further period of one year from 16th October, 2024 to 15th October, 2025 or till a newly elected committee enters up on office, whichever is earlier to avoid administrative vacuum in the said society;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the said society with
3certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the administrator to manage the affairs of the Thirur Taluk Pattikajathi Pattikavarga Welfare Sahakarana Sangham Limited No. M.912 in Malappuram District for a further period of one year from 16th October, 2024 to 15th October, 2025 or till a newly elected committee enters upon office, whichever is earlier;
NOW, THEREFORE, in exercise of the powers conferred by subsection 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969) the Government of Kerala hereby direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the Thirur Taluk Pattikajathi Pattikavarga Welfare Sahakarana Sangham Limited No. M.912 in Malappuram District with the modification of substituting the words "four years" instead of "one year" and in exercise of the powers under subsection (1A) of section 33 of the said Act, as so modified, permit the Registrar of the Cooperative Societies to extend the term of administrator appointed to manage the affairs of the said society for a further period of one year from 16th October, 2024 to 15th October, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.

Explanatory Note

The term of the administrator appointed under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969) to manage the affairs of the Thirur Taluk Pattikajathi Pattikavarga Welfare Sahakarana Sangham Limited No.M.912 in Malappuram District expired on 15th October, 2021. The term extended under subsection (1A) of section 33 of the Kerala Co operative Societies Act, 1969 for a period of two years from 16th October, 2021 to
415th October, 2023 in pursuance of notification issued under G.O.(P) No.119/2023/Coop dated 17th May, 2023 and published as S.R.O. No.615/2023 in the Kerala Gazette Extraordinary No.1788 dated 29th May, 2023 and the term of the said society was extended for a further period of one year from 16th October, 2023 to 15th October, 2024 in pursuance of notification issued under G.O.(P) No.100/2024/Coop dated 14th June, 2024 and published as S.R.O. No. 523/2024 in the Kerala Gazette Extraordinary No.1946 dated 20th June, 2024 and the period so extended also expired on 15th October, 2024. The Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the expiry of the said period and has requested to extend the term of the administrator for a further period of one year from 16th October, 2024 to 15th October, 2025 to avoid administrative vacuum. The Government have considered the matter in detail and are satisfied that it is necessary, in public interest, to permit the Registrar of Cooperative Societies to extend the term of the administrator of the said society for a further period of one year from 16th October, 2024 to 15th October, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.
This order is intended to achieve the above object.
