WHEREAS, under the provisions of subrule (1) of rule 185 of the Kerala Cooperative Societies Rules, 1969, subject to the provisions of subrule (2), (3) and (4), appointment to the categories of posts in a society other than those mentioned in subrules (2), (3) and (4) shall be made by promotion, on the basis
2of seniority in the feeder category. Provided that if the senior employee/employees in the feeder category to a post relinquishes promotion the immediate junior to the employee/employees in the feeder category shall be promoted;
AND WHEREAS, under clause (iv) of subrule (2) of rule 185 of the said Rules, substantive vacancies in the post of Assistant Secretary/Manager and equivalent posts in Primary Cooperative Societies and Urban Banks having a deposit of more than ten crores shall be filled up by promotion and direct recruitment in the ratio of 3:1;
AND WHEREAS, the Board of Directors of the Ottappalam Cooperative Urban Bank Limited No.F.1647 in Palakkad District has resolved to request the Government of Kerala through the Registrar of Cooperative Societies to exempt the said bank from the provisions of clause (iv) of subrule (2) and subrule (1) of rule 185 of the Kerala Cooperative Societies Rules, 1969 for the purpose of enabling the said bank to recruit in the post of General Manager of the said Bank by direct recruitment through the Cooperative Examination Board due to the lack of senior employee who had degree qualification in the feeder category of the said bank;
AND WHEREAS, the Registrar of Cooperative Societies has submitted the proposal of the said bank to exempt the bank from the provisions of clause (iv) of subrule (2) and subrule (1) of rule 185 of the Kerala Cooperative Societies Rules, 1969, for enabling the said bank to recruit in the post of General Manager by direct recruitment through the Cooperative Examination Board;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to exempt the said bank from the provisions of clause (iv) of subrule (2) and subrule (1) of rule 185 of the said Rules, for the purpose of enabling the said bank to recruit in the post of General Manager by direct recruitment through the Cooperative Examination Board;
3NOW, THEREFORE, in exercise of the powers conferred by rule 181 of the Kerala Cooperative Societies Rules, 1969, the Government of Kerala hereby exempt the Ottappalam Cooperative Urban Bank Limited No.F.1647 in Palakkad District from the provisions of clause (iv) of subrule (2) of rule 185 of the Kerala Cooperative Societies Rules, 1969, so as to enable the said bank to recruit in the post of General Manager by direct recruitment through the Cooperative Examination Board.

Explanatory Note
(This does not form part of the order, but is intended to indicate its general purport.)
As per the provisions of subrule (1) of rule 185 of the Kerala Cooperative Societies Rules, 1969, subject to the provisions of subrule (2), (3) and (4), appointment to the categories of posts in a society other than those mentioned in subrules (2), (3) and (4) shall be made by promotion, on the basis of seniority in the feeder category. The Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to exempt the said bank from the provisions of clause (iv) of subrule (2) and subrule (1) of rule 185 of the said Rules, for the
4purpose of enabling the said bank to recruit in the post of General Manager by direct recruitment through the Cooperative Examination Board.
This order is intended to achieve the above object.
