S. R. O. No. 1133/2024
Thiruvananthapuram
In exercise of the powers conferred by section 36 of the Kerala Education Act, 1958 (6 of 1959), the Government of Kerala hereby makes the following rules further to amend the Kerala Education Rules, 1959, namely:-
2 RULES1. Short title and commencement. — (1) These rules may be called the Kerala Education (Amendment) Rules, 2024.
(2) They shall come into force at once.
2. Amendment of the rules. — In the Kerala Education Rules, 1959, in Chapter VI, for sub rule (4) of rule 3, the following sub-rule shall be substituted, namely:-
"(4) If any change of name is sanctioned after the issue of a Public Examination Certificate, the candidate concerned shall notify the change in name in the Gazette and the Commissioner for Government Examinations is authorised to make necessary correction/substitution of name in the certificate on production of such notification before him."
By order of the Governor,
RANI GEORGE,
Principal Secretary to Government.
Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.) Sub-rule (4) of rule 3 of Chapter VI, Kerala Education Rules, 1959 provides that if any change of name is sanctioned after the issue of a Public Examination Certificate, the candidates concerned shall notify the change in name in the Gazette and the notification shall be attached to his certificate. No correction/ substitution of name in the original entry is contemplated in the rules. The above rule has created difficulty to candidates, for employment and for pursuing higher studies in other States and abroad. The Honourable High Court of Kerala in a batch of Writ Petitions has directed Government to come up with an appropriate procedure to permit change/substitution of the name of an individual in his educational records.
Government have considered the matter in detail and have issued G.O(Ms)No.114/2022/GEDN dated 30th June, 2022, permitting the Commissioner for Government Examinations to carry out necessary correction/substitution of name in the Public Examination Certificate on the basis of Gazette notification evidencing change of name, by substituting sub-rule (4) of rule 3 of Chapter VI of the Kerala Education Rules, 1959.
