The final seniority list of Excise Inspectors for the period from 1-1-2004 to 30-6-2006 was finalized and published as per Order No. XD3-4188/10(1) dated 20-12-2011 of Additional Excise Commissioner (Administration). The finalized seniority list so published has been under dispute in various courts over several years. In conformity with the final Order in OA 1873/2015 dated 10-3-2020 by the Hon'ble Kerala Administrative Tribunal and also with the final judgment in OP(KAT) 182, 183, 185, 186 and 197/2020, Government, as per Order read 1st above, constituted a Committee to recast the seniority list of Excise Inspectors from 1-1-2004 to 30-6-2006. The seniority list of Excise Inspectors for the period from 1-1-2004 to 30-6-2006 has been recast and published as per Order read 4th above. Although the Committee was initially constituted to recast the disputed seniority list of Excise Inspectors for the period from 1-1-2004 to 30-6-2006, the persistent anomalies in this seniority list necessitated the recasting of all subsequent seniority lists of Excise Inspectors up to the present date.

Furthermore, the seniority lists for Circle Inspectors, Assistant Excise Commissioners, Deputy Excise Commissioners, and Joint Excise Commissioners, which were prepared based on selections made in accordance with the seniority assigned in the pre-revised seniority list, also require recasting.

Government, as per Orders read 2nd and 3rd above have authorised the Committee to prepare and submit the draft recast seniority lists of Excise Inspectors, Circle Inspectors, Assistant Excise Commissioners, Deputy Excise Commissioners and Joint Excise Commissioners, in accordance with the changes made in the recast seniority list of Excise Inspectors for the period from 1-1-2004 to 30-6-2006. The Committee submitted its report as per read 5th above.

The Committee has already prepared and submitted the draft recast seniority lists of Excise Inspectors covering the periods from 1-1-2004 to 30-6-2006, 1-7-2006 to 30-4-2019, and that of Circle Inspectors/Superintendents/Managers of Excise for the period from 1-1-2009 to 1-6-2019. The seniority lists for Circle Inspectors/Managers/Superintendents of Excise for the periods from 1-1-2009 to 31-12-2017 and 1-1-2018 to 30-9-2021 were finalizedThis is a digitally signed Gazette. and published under Order No. EXC/3/2018-XD3 dated 24-1-2019 and EXC/4033/2021-XD3 dated 23-7-2022. The Government, vide G. O. (Rt.) No. 810/2024/Taxes dated 6-9-2024, has annulled these seniority lists of Circle Inspectors pending their recasting.

The seniority of individuals up to Sri George, T. P. (Sl. No. 201) in the Excise Inspectors seniority list for the period 1-6-2001 to 31-12-2003 will remain unchanged in the cadre of Circle Inspector and Assistant Excise Commissioner. Sri George, T. P. has been assigned seniority as Circle Inspector of Excise on 1-4-2011 as Sl. No. 37, and as such, the seniority of all officers from Sl. No. 1 to Sl. No. 37 in the Circle Inspectors seniority list for the period 1-1-2009 to 31-12-2017, finalized under Order No. EXC/3/2018-XD3 dated 24-1-2019, were retained without revision. Thus, a revised seniority list of Excise Circle Inspectors/Managers/ Superintendents for the period from 1-1-2009 to 1-6-2019 has been finalised under Order No. EXC/3318/2024-XD3 dated 26-10-2024 of the Excise Commissioner, published in the Kerala Gazette Extraordinary No. 3490 dated 1-11-2024. In this revised list, the seniority of Circle Inspectors from 1-1-2012 to 1-6-2019 were updated based on their revised position in the feeder category seniority list.

The Circle Inspectors whose seniority have been revised are eligible for promotions to the cadre of Assistant Excise Commissioners in the vacancies arising between 2021 and 2025.

These officers should therefore be included in the select lists for the years 2021, 2022, 2023, 2024, and 2025. The Departmental Promotion Committee (Higher) meeting for preparing the select list of Circle Inspectors/Managers/Superintendents of Excise for promotion to the cadre of the Assistant Excise Commissioner for the year 2021 was held on 18-1-2021.

24 officers were included in the select list for the year 2021 for filling up the 24 vacancies that occurred during the year 2021, and the select list was published as per G. O. (Ms.) No. 4/2021/Taxes dated 28-1-2021 (published in Kerala Gazette Extraordinary No. 356 dated 28-1-2021). Adhoc DPC (H) meeting convened on 26-7-2021, and published as per G. O. (P) No. 58/2021/TD dated 11-8-2021 (published in Kerala Gazette Extraordinary No. 2379 dated 11-8-2021) revised the above select list for including S/Sri B. Tennymon [Sl. No. 4(A)], Tomy, T. G. [Sl. No. 13(A)], Maju, T. M. (Sl. No. 20(A)) and Ajidas, S. [Sl. No. 23(A)] and also for deleting Sri M. N. Reghunathan Nair (Sl. No. 1) from the select list for 2021 and including him in the select list for the year 2019 as Sl. No. 11(A).

revised the select list for the year 2021 by deleting Sri Babu Varghese (Sl. No. 2) and including him in the select list for the year 2019 as Sl. No. 19A. Last person in the aforesaid select list, i.e. Sri Muralidharan, K. K. (Sl. No. 73 in the recast seniority list of Circle Inspectors), was given regular promotion to the cadre of Assistant Excise Commissioner as per G. O. (Rt.) No. 59/2022/Taxes dated 2-2-2022.

Sri George, T. P. has been included in the pre revised select list of Circle Inspectors for promotion to the cadre of Assistant Excise Commissioner for the year 2021, holding Sl. No. 6.

Therefore, the seniority of individuals in the cadre of Assistant Excise Commissioner up to Sri George, T. P. will remain unchanged. The last finalized seniority list of Assistant Excise Commissioners published was for the period from 1-9-2019 to 31-3-2021 (Order No. EXC-1609/2021-XD3 dated 4-9-2021 of the Excise Commissioner published in Kerala Gazette No. 44 dated 9-11-2021). The last person included in this seniority list is Sri Harikumar, P. K. who is the immediate senior eligible for promotion to the cadre of Assistant Excise Commissioner ahead of Sri George, T. P., Sri Harikumar, P. K. is also included in the select list of Circle Inspectors for promotion to Assistant Excise Commissioner for the year 2021, holding Sl. No. 5. Consequently, the seniority of all individuals from Sl. No. 7 onwards in the pre-revised select list of Circle Inspectors for 2021 must be revised according to their updated seniority in the feeder category list. But since the seniority list of Assistant Excise Commissioners has been prepared only upto Sri Harikumar, P. K., Sri George, T. P. should be the first person to be included in the proposed seniority list of Assistant Excise Commissioner.

The Circle Inspectors from Sl. No. 38 onwards in the revised seniority list of Circle Inspectors for the period from 1-1-2009 to 1-6-2019, published under Order No. EXC/3318/2024-XD3 dated 26-10-2024 by the Excise Commissioner, are now eligible for promotion to the cadre of Assistant Excise Commissioner from the year 2021. Given the occurrence of vacancies in the Assistant Excise Commissioner cadre from 2021 onward, it is anticipated that the last eligible Circle Inspector in this revised seniority list will likely be promoted to Assistant Excise Commissioner in 2025.

Considering the above facts, the Departmental Promotion Committee (Higher) held on 28-11-2024 revised the select list of Circle Inspectors/Managers/Superintendents of Excise for promotion to the cadre of the Assistant Excise Commissioner for the year 2021 and the select list was published as per Order read 6th above. cancellation of the names of the officers previously included in the select list prepared by DPC (H) dated 18-1-2021, and the inclusion of officers in accordance with the recast feeder category seniority list. In addition to this, the select list of Circle Inspectors for promotion to cadre of Assistant Excise Commissioners for the years 2022, 2023 and 2024 were also prepared by this DPC(H).

Eventhough a provisional seniority list of Assistant Excise Commissioners, for the period from 1-4-2021 to 31-3-2022, was published as per Order No. EXC/2501/2022-XD3 dated 5-7-2022 of Excise Commissioner, the same was not finalized. The last finalized seniority list of Assistant Excise Commissioners was for the period from 1-9-2019 to 31-3-2021 finalised and published as per Order No. EXC-1609/2021-XD3 dated 4-9-2021 (Published in Kerala Gazette No. 44 dated 9-11-2021). Since the last person included in this seniority list, Sri Harikumar, P. K. does not figure in the list of Excise Inspectors whose seniority were recast, thus the seniority list of Assistant Excise Commissioners upto 31-3-2021 does not require recast. Hence the Committee was tasked with preparing the seniority list of Assistant Excise Commissioner from 1-4-2021 only.

The Committee has reported that on verifying the occurrence of vacancies in the cadre of Assistant Excise Commissioners from 1-4-2021 and also taking in account of the select list prepared by DPC (H) dated 28-11-2024, the last person included in the select list for 2024 will get assignment in the cadre of Assistant Excise Commissioner on 1-6-2024. Hence the Committee prepared and submitted the draft seniority list of Assistant Excise Commissioners for the period from 1-4-2021 to 1-6-2024 by strictly adhering to the select list prepared by the DPC(H) dated 28-11-2024.

The cadre strength of Assistant Excise Commissioners as of 31-3-2021, stands at 34, with no changes in this cadre strength since that date. The following is the list of the Assistant Excise Commissioners in service as on 31-3-2021, based on the seniority lists, as well as the relevant promotion orders and select lists.

List of Assistant Excise Commissioners in service as on 31-3-2021

Sri Sunil S., who retired from service on 31-5-2022, upon superannuation in the cadre of Circle Inspector of Excise, was subsequently granted a notional promotion to the rank of Assistant Excise Commissioner, effective from 31-8-2019, and to the position of Deputy Excise Commissioner, effective from 25-6-2021, as per G. O. (Rt.) No. 761/2023/TD dated 3-11-2023.

However, since his promotion occurred post-retirement, he is not included in the list of Assistant Excise Commissioners in service as of 31-3-2021. Consequently, the vacancy resulting from his superannuation or his notional promotion to Deputy Excise Commissioner is not considered among the vacancies for the Assistant Excise Commissioner position.

Sri V. Rajendran was promoted to the cadre of Assistant Excise Commissioner as per G. O. (Rt.) No. 437/2020/TD dated 26-6-2020, following his selection as Sl. No. 1 by the DPC (H) meeting held on 18-6-2020, for promotion to the cadre of Assistant Excise Commissioner for the year 2020 (G. O. (Ms.) No. 56/2020/TD dated 25-6-2020, K. G. Ex. No. 1588 dated 25-6-2020). He was subsequently promoted to the position of Deputy Excise Commissioner as per G. O. (Rt.) No. 59/2022/Taxes dated 2-2-2022, following his selection as Sl. No. 1 by the DPC(H) meeting held on 31-12-2021, for promotion to Deputy Excise Commissioner for the year 2022 (G. O. (Ms.) No. 3/2022/TD dated 12-1-2022, K. G. Ex. No. 157 dated 13-1-2022). Later, in the Ad-hoc DPC (H) meeting held on 14-11-2023, his seniority in the cadre of Assistant Excise Commissioner was revised, and he was placed as Sl. No. 1(A) in the Supplementary Select List for promotion to cadre of Assistant Excise Commissioner for the year 2019, positioned between Sri K. Muraleedharan NairThis is a digitally signed Gazette. (Sl. No. 1) and Sri B. Jayachandran (Sl. No. 2). His seniority in the cadre of Deputy Excise Commissioner was also revised, placing him at Sl. No. 1(A) in the Select List for promotion to Deputy Excise Commissioner for the year 2021, between Sri Ashraf, T. K. (Sl. No. 1) and Sri Shaji, K. S. (Sl. No. 2). Notably, Sri Shaji, K. S., his immediate junior, had been promoted to the cadre of Deputy Excise Commissioner as per G. O. (Rt.) No. 85/2021/TD dated 3-2-2021. He has been subsequently promoted to the cadre of Joint Excise Commissioner also with this seniority. Hence, he should get his notional promotion in the cadre of Deputy Excise Commissioner before 3-2-2021 and for this same reason he cannot be counted among the list of Assistant Excise Commissioners in service as on 31-3-2021.

Sri M. N. Reghunathan Nair was promoted to the cadre of Assistant Excise Commissioner as per G. O. (Rt.) No. 85/2021/Taxes dated 3-2-2021. He expired on 4-9-2021 while still serving in the cadre of Assistant Excise Commissioner. Subsequently, he was granted a notional promotion to the rank of Assistant Excise Commissioner with effect from 4-9-2019, as per G. O. (Rt.) No. 247/2022/TD dated 1-4-2022. Furthermore, he was granted a notional promotion to the cadre of Deputy Excise Commissioner with effect from 25-6-2021, as per G. O. (Rt.) No. 696/2023/Taxes dated 4-10-2023. Hence he is included in the list of Assistant Excise Commissioners in service as on 31-3-2021.

Sri Babu Varghese was promoted to the post of Assistant Excise Commissioner as per G. O. (Rt.) No. 85/2021/Taxes dated 3-2-2021, and to the position of Deputy Excise Commissioner as per G. O. (Rt.) No. 59/2022/Taxes dated 2-2-2022. Later, he was granted notional promotions to the cadre of Assistant Excise Commissioner and Deputy Excise Commissioner, with effect from 5-9-2019 and 29-6-2021, respectively, as per G. O. (Rt.) No. 854/2022/Taxes dated 2-11-2022. As a result, he is included in the list of Assistant Excise Commissioners in service as of 1-4-2021.

Sri Teny Mon, B. was initially superseded in the Select List of Circle Inspectors/ Managers/Superintendents of Excise for promotion to the cadre of Assistant Excise Commissioner for the year 2021, as per the G. O. (Ms.) No. 4/2021/Taxes dated 28-1-2021, (K. G. Ex. No. 356 dated 28-01-2021), following the decision of the Adhoc Departmental Promotion Committee (Higher) meeting held on 18-1-2021. However, he was later included in the revised Select List for the year 2021 as Sl. No. 4(A), placed between Sri Sunu, C. (Sl. No. 4) and Sri Harikumar, P. K. (Sl. No. 5), by the Departmental Promotion Committee (Higher) meeting held on 26-7-2021 (G. O. (P) No. 58/2021/TD dated 11-8-2021, published inThis is a digitally signed Gazette. K. G. Ex. No. 2379 dated 11-8-2021). Following this, he was promoted to the cadre of Assistant Excise Commissioner as per G. O. (Rt.) No. 560/2021/TD dated 13-8-2021. In addition, he was granted notional promotion to the cadre of Assistant Excise Commissioner (G. O. (Rt.) No. 903/2022/Taxes dated 22-11-2022) with effect from the date on which his immediate junior, Sri Harikumar, P. K., took charge in the post of Assistant Excise Commissioner, i.e., 30-3-2021. He was also included in the Seniority List of Assistant Excise Commissioners for the period from 1-9-2019 to 31-3-2021, where he was placed as Sl. No. 22A, between Sri Sunu, C. (Sl. No. 22) and Sri Harikumar, P. K. (Sl. No. 23), in the order published under EXC/1675/2022-XD3 dated 1-4-2023 of the Excise Commissioner (published in K. G. No. 52 dated 26-12-2023). Furthermore, the Adhoc Departmental Promotion Committee (Higher) meeting held on 28-11-2024 also included him in the revised Select List for the year 2021, where he was placed at Sl. No. 3, between the aforementioned individuals, as per the published order. Although Sri Teny Mon, B. is included in the Seniority List of Assistant Excise Commissioners as of 30-3-2021, since his actual promotion to the cadre was only on 13-8-2021, he is not considered as part of the Assistant Excise Commissioners in service as on 31-3-2021, in order to maintain the cadre strength. Consequently, one occurrence of vacancy prior to his regular promotion (i.e., on or before 13-08-2021) will have to be kept unassigned in order to maintain the cadre strength.

The following individuals were granted regular promotions to the cadre of Assistant Excise Commissioners, as per the Orders mentioned against their names, having been included in the Select List of Circle Inspectors/Managers/Superintendents of Excise for promotion to the cadre of Assistant Excise Commissioner for the year 2021 (published as per G. O. (Ms.) No. 4/2021/Taxes dated 28-1-2021, in K. G. Ex. No. 356 dated 28-1-2021, and later revised as per G. O. (P) No. 58/2021/TD dated 11-8-2021, published in K. G. Ex. No. 2379 dated 11-8-2021). Their promotions were in accordance with their seniority assigned in the feeder category seniority list of Circle Inspectors for the period from 1-1-2009 to 1-6-2019, which was later revised and published as per Order No. EXC/3318/2024-XD3 dated 26-10-2024.

Their positions in the select list of Circle Inspectors for promotion to the cadre of Assistant Excise Commissioners were also revised by the DPC (H) held on 28-11-2024. Hence corresponding adjustments in their date of promotions to the cadre of Assistant Excise Commissioner are required to be brought in by granting them notional promotions subject to Rule 23(c) of Volume I, Part I of the Kerala Service Rules strictly as per the revised select list.

for their promotion to the cadre of Assistant Excise Commissioner and the same has been identified and entered in the draft seniority list of Assistant Excise Commissioners prepared by the Committee.

List of Regular Promoted Assistant Excise Commissioners

The following individuals were granted temporary promotions to the cadre of Assistant Excise Commissioner, as per the respective orders listed against their names, prior to the revision of the feeder category Seniority List and in the absence of a Select List for promotion to the cadre of Assistant Excise Commissioner for the relevant period.

List of Circle Inspectors who have been temporarily promoted to the cadre of Assistant

Excise Commissioners

The following individuals, listed in the Table-IV below were granted temporary promotions to the cadre of Assistant Excise Commissioner but were not selected for promotion to the cadre of Assistant Excise Commissioner by the Adhoc Departmental Promotion Committee (Higher) meeting held on 28-11-2024 and hence are not included in the select list of Circle Inspectors published as per Order read 6th above, as they had retired on superannuation prior to the occurrence of vacancies for their promotion. The Committee has submitted the following recommendation for consideration by the Government.

"Honorable High Court of Kerala in its judgement dated 11-6-2024 in WP(C) No. 37185

of 2023 have held that even when the appointment of an officer is nullified as per the de facto

doctrine, all the orders passed by the officer are saved and also the salary and allowances paid

to him shall not be recovered. The de facto doctrine saves the acts of the officers de facto

performed within the scope of their assumed official authority. Whatever defects there may be

in the nature of their appointment it is based upon the principle of public policy and necessity.

Such a doctrine was introduced into the law as a matter of policy and necessity, to protect the

interest of the public and the individual whose interests were involved in the official acts of

persons exercising the duties of an office without being lawful officers. Aforementioned

doctrine was applied by a full bench of Honorable High Court of Kerala in P. S. Menon Vs

State of Kerala (AIR 1970 Kerala 165) and held as follows:—

"The doctrine was engrafted as a matter of policy and necessity to protect the interest of

the public and individuals involved in the official acts of persons exercising the duty of

an officer without actually being one in strict point of law. But although these offices are

not officers de jure they are virtue of the particular circumstances, officers, in fact, whose

acts, public policy requires should be considered valid "

In the light of the above judgments, this Committee is of the view that the official acts

performed and also the salary and allowances received by such officers whose seniority has

been downgraded as a result of the recast of the seniority list needs to be saved as per the de

facto doctrine. The pensionary benefits in the designation and scale on which it was calculated

also needs to be saved in accordance with this de facto doctrine."

It is decided to forward this recommendation of the Committee to Government for consideration.

TABLE-IV

List of Circle Inspectors who have been temporarily promoted to the cadre of Assistant

Excise Commissioners but not liable for regular promotion

Sri Naushad, I., who is listed as Sl. No. 90 in the Recast Final Seniority List of Circle Inspectors/Managers/Superintendents of Excise for the period from 1-1-2009 to 1-6-2019, published in Order EXC/3318/2024-XD3 dated 26-10-2024 by the Excise Commissioner, retired from service on superannuation on 31-5-2023 while still holding the position of Circle Inspector. In the Adhoc Departmental Promotion Committee (Higher) meeting held on 28-11-2024, he was selected for promotion to the cadre of Assistant Excise Commissioner before his date of superannuation and was placed as Sl. No. 3 in the Select List for the year 2023. Therefore, he is also eligible for notional promotion, as outlined above.

Along with Sri Naushad, I., the following individuals, included in the Select Lists of Circle Inspectors/Managers/Superintendents of Excise for promotion to the cadre of Assistant Excise Commissioner, as selected by DPC(H) dated 28-11-2024, are also eligible for promotion to the cadre of Assistant Excise Commissioner. Their promotions are to be granted with notional effect from the respective dates of occurrence of vacancies for their promotion to the cadre.

List of Circle Inspectors of Excise to be promoted to the cadre of AEC

Thus, all individuals included in the Select List of Circle Inspectors/Managers/ Superintendents of Excise for promotion to the cadre of Assistant Excise Commissioner, as prepared by the DPC (H) meeting held on 28-11-2024 and published as per Order read 6th above, are eligible to be promoted to the cadre of Assistant Excise Commissioner in the vacancies that arose between 1-4-2021 and 1-6-2024. Eventhough the Committee has prepared and submitted the draft provisional seniority list of Assistant Excise Commissioners for the period from 1-4-2021 to 1-6-2024, the Committee has recommended that the provisional seniority list may be published only up to the specific period for which notional promotions are granted.

Government, as per Order read 7th above, have given notional promotion to the 35 senior most Circle Inspectors included in the select list for 2021 and 2022 published as per Order read 6th above. The last officer granted provisional promotion to the cadre of Assistant Excise Commissioner is Sri. Jimmy Joseph who has been notionally promoted to the vacancy that arose on 1-6-2022. The next vacancy in the cadre of Assistant Excise Commissioner arose only on 1-2-2023. Hence, as of now, the provisional seniority list of Assistant Excise Commissioners for the period from 1-4-2021 to 31-12-2022 only can be published.

The draft seniority list as prepared by the Committee, reports and recommendations of the Committee, revised select list and feeder category seniority list were examined in detail along with other relevant records. It has been decided to forward the recommendation of the Committee regarding the de facto doctrine to the Government for consideration. 31-12-2022, which was prepared, recommended and submitted by the Committee, is found to be in congruence with the cadre strength ratio, previous seniority lists, recast feeder category seniority list, revised select lists, notional promotion order and also Government Orders passed in this regard and hence is hereby accepted.

In the above circumstances, the Provisional Seniority List of Assistant Excise Commissioners for the period 1-4-2021 to 31-12-2022 is herewith published. Objections if any, regarding the above seniority list should be submitted to the undersigned with valid documents within 7 days from the date of this order. The objections received after 7 days from the date of this order will not be considered.
