ORDER

WHEREAS, under subsection (1) of section 32 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Joint Registrar of Cooperative Societies (General), Kottayam had issued orders for suspending the Managing Committee of the appointed an administrator to manage the affairs of the said Bank under subsection
2(1) of section 32 of the said Act;
AND WHEREAS, under subsection (1) of section 32 of the said Act, the term of an administrator or administrative committee, appointed to manage the affairs of the society shall not exceed six months in aggregate provided that in the case of Co operative Society, carrying on the business of banking, appointment of administrator or administrative committee shall not exceed one year in the aggregate;
AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 32 of the said Act to manage the affairs of the Poonjar Service Cooperative Bank Limited No. 3963 in Kottayam District expired on 17 th December, 2019;
AND WHEREAS, the term of administrator of the said bank was extended for a period of six months from 18th December, 2019 to 17th June, 2020 in pursuance of notification issued under G.O.(P)No.122/2020/Coop. dated 13th October, 2020 and published as S.R.O.No.738/2020 in the Kerala Gazette Extraordinary No.2666 dated 8 th November, 2020 and further extended for a period of two years from 18th June, 2020 to 17th June, 2022 in pursuance of notification issued under G.O.(P)No.143/2022/Co op. dated 12th August, 2022 and published as S.R.O.No.878/2022 in the Kerala Gazette Extraordinary No.3118 dated 14th September, 2022, and further extended for a period of six months from 18th June, 2022 to 17th December, 2022 in pursuance of notification issued under G.O.(P)No.220/2022/Coop. dated 29th November, 2022 and published as S.R.O. No.1164/2022 in the Kerala Gazette Extraordinary No.4100 dated 2nd December, 2022 and further extended for a period of six months from 18 th December, 2022 to 17th June, 2023 in pursuance of notification issued under G.O. (P)No.43/2023/Coop. dated 24th February, 2023 and published as S.R.O.No.263/2023 in the Kerala Gazette Extraordinary No.693 dated 27th February, 2023, and further extended for a period of six months from 18th June, 2023 to 17th December, 2023 in
3pursuance of notification issued under G.O.(P)No.191/2023/Coop. dated 26th August, 2023 and published as S.R.O.No.925/2023 in Kerala Gazette Extraordinary No.2855 dated 4th September, 2023 and extended for a further period of six months from 18th December, 2023 to 17th June, 2024 in pursuance of notification issued under G.O. (P)No.42/2024/Coop. dated 2nd March, 2024 and published as S.R.O.No.252/2024 in Kerala Gazette Extraordinary No.878 dated 7th March, 2024 and the period so extended expired on 17th June, 2024;
AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said Bank could not be conducted within the extended period due to pending disposal of writ petition WP(C) 42547/2018 before the Hon'ble High Court with regard to the removal of the previous governing body and the cancellation of the election proceedings and has therefore requested the Government to extend the term of the administrator for a further period of six months from 18 th June, 2024 to 17th December, 2024 or till a newly elected committee enter upon office, whichever is earlier, to avoid administrative vacuum in the said Bank;
AND WHEREAS, the Government have considered the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of sub section (1) of section 32 of the said Act shall apply to the said Bank with certain modification and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of said Bank for a further period of six months from 18th June, 2024 to 17th December, 2024 or till a newly elected committee enters upon office, whichever is earlier;
NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala here by direct that provisions of subsection (1) of section 32 of the said Act shall apply to
4modification of substituting the words " five years " for the words "one year" and in exercise of powers under subsection (1) of section 32 of the said Act, as so modified to permit the Registrar of Co operative Societies to extend the term of the administrator appointed to manage the affairs of the said Bank for a further period of six months from 18th June, 2024 to 17th December, 2024 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said Bank.

The term of the administrator appointed under subsection (1) of section 32 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), to manage the affairs of the Poonjar Service Cooperative Bank Limited No.3963 in Kottayam District expired on 17th December, 2019. The term of administrator of the said bank was lastly extended for a further period of six months from 18 th December, 2023 to 17th June, 2024 in pursuance of notification issued under G.O. (P)No.42/2024/Coop. dated 2nd March, 2024 and published as S.R.O.No.252/2024 in Kerala Gazette Extraordinary No.878 dated 7th March, 2024 and the period so extended also expired on 17th June, 2024. The Registrar of Cooperative Societies has reported that election to the said Bank could not be conducted within the above period due to pending disposal of writ petition WP(C) 42547/2018 before the Hon'ble High Court with regard to the removal of
