Thiruvananthapuram, S. R. O. No. 1158/2024In exercise of the powers conferred by 2nd proviso to sub section 7 of section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the declaration as per sub-section 1 of section 19 to the Notification issued under sub-section (1) of section 11 as per Proceedings No. C5-103/2021/DCEKM dated 27th February 2023 and published in the Extra Ordinary Gazette No.724 dated 28th February 2023, namely:- This is a digitally signed Gazette. Proceedings No. C5-103/2021/DCEKM dated 27th February 2023 and published in the Extra Ordinary Gazette No.724 dated 28th February 2023 has been issued in accordance with the provisions of sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of 12.59 Ares of land comprised in Kadungallur Village of Ernakulam district for the construction of Elukkara - Uliyannoor bridge and its approach road.

AND WHEREAS, the District Collector, Ernakulam has reported that as per Section 19(7) of LARR Act, 2013 mentions that the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No. C5-103/2021/DCEKM dated 27th February 2023 and published in the Extra Ordinary Gazette No.724 dated 28th February 2023 and extended as per G.O.(P)No.54/2024/RD dated 14th February 2024 and published in the Extra Ordinary Gazette No. 573 dated 16 th February 2024 expired on 16.08.2024 and therefore requested to extend the time limit for publishing the 19(1) Declaration.

NOW THEREFORE, sanction is accorded to extend the time limit in publishing the Declaration for a further period of six months from the date of expiry of the 11(1) notification ie. 16.08.2024 by invoking the provisions contained in 2nd proviso to Section 19(7) of the LARR Act, 2013 with regard to the acquisition of 12.59 Ares of land comprised in Kadungallur Village of Ernakulam district for the construction of Elukkara - Uliyannoor bridge and its approach road.

(This does not form part of the notification, but is intended to indicate its general purport) Proceedings No. C5-103/2021/DCEKM dated 27th February 2023 and published in the Extra Ordinary Gazette No.724 dated 28th February 2023, has been issued in accordance with the provisions of subsection (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of 12.59 Ares of land comprised in Kadungallur Village of Ernakulam district for the construction of Elukkara - Uliyannoor bridge and its approach road. As per Section 19(7) of LARR Act, 2013, the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No. C5- 103/2021/DCEKM dated 27th February 2023 and published in the Extra Ordinary Gazette No.724 dated 28th February 2023 and extended as per G.O.(P)No.54/2024/RD dated 14th February 2024 and published in the Extra Ordinary Gazette No. 573 dated 16th February 2024 expired on 16.08.2024 and hereby extend the time limit for publishing the 19(1) Declaration.

The notification is intended to achieve the above object.
