ORDER
G.O.(P)No.227/2024/Coop. Dated, Thiruvananthapuram, 19 th December , 2024 04th Dhanu, 1200 S. R. O. No. 1180/2024
WHEREAS, under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the term of an administrator or an administrative committee appointed to manage the affairs of a society shall not exceed one year in the aggregate;
2AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 33 of the said act to manage the affairs of the T.D. Medical College Employees Cooperative Society Limited No. A 980 in Alappuzha District expired on 23rd November, 2022;
AND WHEREAS, under subsection (1A) of section 33 of the said Act, the Government may, by notification in the Gazette, for reasons to be recorded, permit the Registrar of Cooperative Societies to extend the term of the said administrator or administrative committee appointed to manage the affairs of a society for a further period not exceeding one year in the aggregate or till a newly elected committee enters upon office, whichever is earlier;
AND WHEREAS, term of the administrator of the said Society was extended for a period of one year from 24th November, 2022 to 23rd November, 2023 in pursuance of notification issued under G.O.(P) No. 56/2023/Coop. dated 3rd March, 2023 and published as S.R.O. No. 296/2023 in the Kerala Gazette Extraordinary No. 772 dated 3rd March, 2023 and extended further for a period of one year from 24 th November, 2023 to 23rd November, 2024 in pursuance of Notification issued under G.O(P) No.35/2024/Coop dated 26th February, 2024 and published as S.R.O.No. 225/2024 in the Kerala Gazette Extra ordinary No. 780 dated 01st March, 2024 and the term so extended also expired on 23rd November, 2024 ;
AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the said period and has requested to extend the term of the administrator for a further period of one year from 24th November, 2024 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum ;
AND WHEREAS, the Government have examined the matter in detail and are
3satisfied that it is necessary, in public interest, to direct that the provisions of sub section (1A) of Section 33 of the said Act shall apply to the T.D Medical College Employees Cooperative Society Limited No. A 980 in Alappuzha District with certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the said administrator appointed to manage the affairs of the said society for a further period of one year from 24th November, 2024 to 23rd November, 2025 or till a newly elected committee enters upon office, whichever is earlier;
NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby direct that the provisions of subsection (1A) of section 33 of the said Act shall apply to the said society with the modification of substituting the word "three years" for the words "one year" and in exercise of powers under subsection (1A) of section 33 of the said Act as so modified, permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the T.D Medical College Employees Cooperative Society Limited No. A 980 in Alappuzha District for a further period of one year from 24th November, 2024 to 23rd November, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.

Explanatory Note

The term of the administrator appointed under subsection (1A) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969) to manage the affairs of the
4T.D Medical College Employees Cooperative Society Limited No. A 980 in Alappuzha District expired on 23rd November, 2024. The Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period and has requested to permit him to extend the term of the administrator for a further period of one year from 24 th November, 2024 to 23rd November, 2025. The Government have examined the matter in detail and are satisfied that it is necessary, in the public interest, to direct that provisions of sub section (1A) of section 33 of the said Act shall apply to the said society with certain modifications and permit the Registrar Cooperative Societies to extend the term of administrator of the said society for a further period of one year from 24 th November, 2024 to 23rd November, 2025 to avoid administrative vacuum.
This order is intended to achieve the above object.
