ORDER
G.O.(P)No.228/2024/Coop. Dated, Thiruvananthapuram, 20th December, 2024 05th Dhanu, 1200 S. R. O. No. 1193/2024
WHEREAS, under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the term of an administrator or an administrative committee appointed to manage the affairs of a society shall not exceed one year in the aggregate;
2AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 33 of the said Act to manage the affairs of the Kuttanad Marketing Cooperative Society Limited No. A194 in Alappuzha District expired on 2nd August, 2007;
AND WHEREAS, under subsection (1A) of section 33 of the said Act, the Government may, by notification in the Gazette, for reasons to be recorded, permit the Registrar of Cooperative Societies to extend the term of the said administrator or administrative committee for a further period not exceeding one year in the aggregate or till a newly elected committee enters upon office, whichever is earlier;
AND WHEREAS, the term of the administrator of the said society was extended further for a period of one year from 3rd August, 2007 to 2nd August, 2008 in pursuance of notification issued under G.O(P)No.45/2008/Coop.dated 12th February, 2008 and published as S.R.O. No. 233/2008 in the Kerala Gazette Extraordinary No.415 dated 28th February, 2008, and extended for a further period of one year from 3rd August, 2008 to 2nd August, 2009 in pursuance of notification issued under G.O(P)No.7/2009/Coop. dated 3rd January, 2009 and published as S.R.O. No. 36/2009 in the Kerala Gazette Extraordinary No.135 dated 16th January, 2009 and extended further for a period of one year from 3 rd August, 2009 to 2nd August, 2010 in pursuance of the notification issued under G.O.(P)No.157/2010/Coop. dated 17th September, 2010 and published as S.R.O. No. 926/2010 in the Kerala Gazette Extraordinary No.2218 dated 27th September, 2010, and extended further for a period of two years from 3rd August, 2010 to 2nd August, 2012 in pursuance of the notification issued under G.O.(P)No.135/2011/Coop. dated 21st September, 2011 and published as S.R.O. No.615/2011 in the Kerala Gazette Extraordinary No. 1832 dated 28th September, 2011 and the period so extended also expired on 2nd August, 2012.
3AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period and the society is under process of liquidation and the liquidator has been appointed and assumed charge on 10th August, 2023, and has requested to extend the term of the administrator of the said society for a further period of eleven years and eight days from 3rd August, 2012 to 10th August, 2023, to avoid administrative vacuum in the said society;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of the sub section (1A) of section 33 of the said Act shall apply to the said society with certain modification and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed to manage the affairs of the said society for a further period of eleven years and eight days from 3rd August, 2012 to 10th August, 2023 , to avoid administrative vacuum;
NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby direct that the provisions of Subsection (1A) of Section 33 of the said Act, shall apply to the Kuttanad Marketing Cooperative Society Limited No. A 194 in Alappuzha District with the modification of substituting the words " sixteen years and eight days " for words "one year" and in exercise of the powers under subsection (1A) of section 33 of the said act, as so modified, permit the Registrar of Cooperative Societies to extend the term of the Administrator for a further period of eleven years and eight days from 3rd August, 2012 to 10th August, 2023 to avoid administrative vacuum in the said society.

The term of the Administrator appointed under subsection (1) of section 33 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), to manage the affairs of the Kuttanad Marketing Cooperative Society Limited No. A 194 in Alappuzha District expired on 2nd August, 2007. The term of the administrator was lastly extended for a period of two years from 3rd August, 2010 to 2nd August, 2012 in pursuance of the notification issued under G.O.(P)No.135/2011/Coop. dated 21st September, 2011 and published as S.R.O No. 615/2011 in the Kerala Gazette Extraordinary No.1832 dated 28th September, 2011 and the period so extended also expired on 2 nd August, 2012.
The Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the extended period due to the society is under process of liquidation and the liquidator has been appointed and assumed charge on 10th August, 2023 and has requested to extend the term of the administrator of the said society for a further period of eleven years and eight days from 3rd August, 2012 to 10th August, 2023, to avoid administrative vacuum. The Government have examined the matter in detail and are satisfied that it is necessary, in public interest to permit the Registrar of Cooperative Societies to extend the term of the administrator of the said society for a further period of eleven years and eight days from 3rd August, 2012 to 10th August, 2023, to avoid administrative vacuum in the said society.
This order is intended to achieve the above object.
