Thiruvananthapuram, S. R. O. No. 1199/2024In exercise of the powers conferred by 2nd proviso to subsection 7 of section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the declaration as per sub-section 1 of section 19 to the Notification issued under sub-section (1) of section 11 as per G.O.(P)No.281/2023/RD dated 09th November 2023 and published in the Extra Ordinary Gazette No. 3622 dated 09th November 2023, namely:- This is a digitally signed Gazette. G.O.(P)No.281/2023/RD dated 09th November 2023 and published in the Extra Ordinary Gazette No. 3622 dated 09th November 2023 has been issued in accordance with the provisions of sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of land in Villiappalli, Palayad, Nadakkuthazha and Maniyur Villages of Vadakara Taluk in Kozhikode District for the widening of Kuttoth Attakund Road.

AND WHEREAS, the District Collector,Kozhikode has reported that as per Section 19 (7) of LARR Act, 2013, the 19 (1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per G.O.(P)No.281/2023/RD dated 09th November 2023 and published in the Extra Ordinary Gazette No. 3622 dated 09th November 2023 expired on 08.11.2024 and therefore requested to extend the time limit for publishing the 19(1) Declaration.

NOW THEREFORE, sanction is accorded to extend the time limit in publishing the Declaration for a further period of 6 months from the date of expiry of the 11(1) notification ie, 08.11.2024 by invoking the provisions contained in 2nd proviso to Section 19(7) of the LARR Act, 2013 with regard to the acquisition of land in Villiappalli, Palayad, Nadakkuthazha and Maniyur Villages of Vadakara Taluk in Kozhikode District for the widening of Kuttoth Attakund Road, subject to the condition that no more extension be granted under any circumstances.

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport) G.O.(P)No.281/2023/RD dated 09th November 2023 and published in the Extra Ordinary Gazette No. 3622 dated 09th November 2023 has been issued in accordance with the provisions of subsection (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of land in Villiappalli, Palayad, Nadakkuthazha and Maniyur Villages of Vadakara Taluk in Kozhikode District for the widening of Kuttoth Attakund Road. As per Section 19(7) of LARR Act, 2013, the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per G.O.(P)No.281/2023/RD dated 09th November 2023 and published in the Extra Ordinary Gazette No. 3622 dated 09th November 2023, expired on 08.11.2024 and hereby extend the time limit for publishing the 19(1) Declaration.

The notification is intended to achieve the above object.
