ORDER
G.O.(P) No.231/2024/Coop. Dated, Thiruvananthapuram, 30 th December, 2024 15th Dhanu, 1200.

WHEREAS, in exercise of the powers conferred by subsection (1) of section 32 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Joint Registrar of Cooperative Societies (General), Kottayam had issued orders superseding the administrative committee of the Kottayam Housing Cooperative
2Society Limited No.K.348 in Kottayam District and appointed an administrator to manage the affairs of the said society;
AND WHEREAS, under subsection (1) of section 32 of the said Act, the term of an administrator or an administrative committee appointed to manage the affairs of a society shall not exceed six months in the aggregate provided that in the case of a cooperative society, carrying on the business of banking, appointment of administrator or administrative committee shall not exceed one year in the aggregate;
AND WHEREAS, the said term of one year of the administrator appointed under subsection (1) of section 32 of the said Act to manage the affairs of the Kottayam Housing Cooperative Society Limited No.K.348 in Kottayam District expired on 11th November, 2014;
AND WHEREAS, the term of the administrator of the said society was extended further for a period of one year from 12th November, 2014 to 11th November, 2015 in pursuance of notification issued under G.O.(P) No.145/2015/Coop. dated 12th November, 2015 and published as S.R.O. No.840/2015 in the Kerala Gazette Extraordinary No.2805 dated 11th December, 2015, and extended for a further period of one year from 12th November, 2015 to 11th November, 2016 in pursuance of notification issued under G.O. (P)No.95/2016/Coop. dated 6th September, 2016 and published as S.R.O. No.600/2016 in the Kerala Gazette Extraordinary No.1604 dated 9th September, 2016, and extended for a further period of one year from 12th November, 2016 to 11th November, 2017 in pursuance of notification issued under G.O. (P)No.47/2018/Coop. dated 24th April, 2018 and published as S.R.O. No.307/2018 in the Kerala Gazette Extraordinary No.1301 dated 17th May, 2018, and was extended for a further period of one year from 12 th November, 2017 to 11th November, 2018 in pursuance of notification issued under G.O. (P)No.125/2018/Coop. dated 5th October, 2018 and published as S.R.O. No.715/2018 in the Kerala Gazette Extraordinary No.2555 dated 12th October, 2018 and was extended for a further period of two years from 12th November, 2018 to 11th November, 2020 in pursuance of notification issued under G.O. (P)No.87/2020/Coop. dated 8th September, 2020 and published as S.R.O.
3No.628/2020 in the Kerala Gazette Extraordinary No.2236 dated 30th September, 2020, and was extended for a further period of one year from 12 th November, 2020 to 11th November, 2021 in pursuance of notification issued under G.O. (P)No.132/2021/Coop. dated 6th September, 2021 and published as S.R.O. No.675/2021 in the Kerala Gazette Extraordinary No.2633 dated 9th September, 2021, and was extended for a further period of one year from 12 th November, 2021 to 11th November, 2022 in pursuance of notification issued under G.O.(P) No.34/2022/Coop. dated 2nd March, 2022 and published as S.R.O. No.292/2022 in the Kerala Gazette Extraordinary No.1025 dated 26th March, 2022 and was also extended for a further period of one year from 12th November, 2022 to 11th November, 2023 in pursuance of notification issued under G.O.(P) No.75/2023/Coop. dated 14th March, 2023 and published as S.R.O. No.397/2023 in the Kerala Gazette Extraordinary No.1053 dated 22 nd March, 2023 and extended for a further period of one year from 12 th November, 2023 to 11th November, 2024 in pursuance of notification issued under G.O.(P) No.7/2024/Coop. dated 18th January, 2024 and published as S.R.O. No.52/2024 in the Kerala Gazette Extraordinary No.253 dated 22nd January, 2024 and the period so extended also expired on 11th November, 2024;
AND WHEREAS, the Registrar of Cooperative Societies has reported that the election to the Board of Directors of the said society could not be conducted within the said period and has requested to permit him to extend the term of the administrator of the said society for a further period of one year from 12th November, 2024 to 11th November, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of subsection (1) of section 32 of the said Act shall apply to the said society with certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed under subsection (1) of section 32 of the said Act to manage the affairs of the said society for a further period of one year from 12th November, 2024 to 11th November, 2025 or till a newly elected committee enters upon office, whichever is earlier;
4NOW, THEREFORE, in exercise of the powers conferred by section 101 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), the Government of Kerala hereby direct that the provisions of subsection (1) of section 32 of the said Act shall apply to the Kottayam Housing Cooperative Society Limited No.K.348 in Kottayam District with the modification of substituting the words "twelve years" for the words "six months" for the purpose of enabling the Registrar of Cooperative Societies to extend the term of the administrator appointed under subsection (1) of section 32 of the said Act to manage the affairs of the said society for a further period of one year from 12 th November, 2024 to 11th November, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.

Explanatory Note

The term of the administrative committee appointed under subsection (1) of section 32 of the Kerala Cooperative Societies Act, 1969 (21 of 1969), to manage the affairs of the Kottayam Housing Cooperative Society Limited No.K.348 in Kottayam District expired on 11th November, 2014. The term of the administrator of the said society lastly extended for a period of one year from 12th November, 2023 to 11th November, 2024 in pursuance of notification issued under G.O.(P) No.7/2024/Coop. dated 18th January, 2024 and published as S.R.O. No.52/2024 in the Kerala Gazette Extraordinary No.253 dated 22nd January, 2024 and the period so extended also expired on 11th November, 2024. The Registrar of Cooperative Societies has reported that the the election to the Board of Directors of the said society could not be conducted within the period and has requested to permit him to extend the term of administrator of the said
5society for a further period of one year from 12th November, 2024 to 11th November, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society. The Government have considered the matter in detail and are satisfied that it is necessary, in public interest, to direct that the provisions of subsection (1) of section 32 of the said Act shall apply to the said society with certain modifications and to permit the Registrar of Cooperative Societies to extend the term of the administrator appointed under subsection (1) of section 32 of the said Act to manage the affairs of the said society for a further period of one year from 12 th November, 2024 to 11th November, 2025 or till a newly elected committee enters upon office, whichever is earlier, to avoid administrative vacuum in the said society.
This order is intended to achieve the above object.
