16.09.2014-ലെ വോള്യം 3 പാർട്ട് 3, 36-ാം നമ്പർ കേരള സർക്കാർ ഗസറ്റിൽ പ്രസിദ്ധീകരിച്ചിട്ടുള്ള അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (സംരക്ഷണം), തിരുവനന്തപുരത്തിന്റെ 21.08.2014-ലെ പ്രൊ(4)-29243/2013 നമ്പർ നിബന്ധനകളും, 04.11.2014-ലെ വോള്യം 3 പാർട്ട് 3, 43-ാം നമ്പർ കേരള സർക്കാർ ഗസറ്റിൽ പ്രസിദ്ധീകരിച്ചിട്ടുള്ള അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ, തിരുവനന്തപുരത്തിന്റെ 17.10.2014-ലെ പ്രൊ4 - 29243/2013 നമ്പർ നിബന്ധനകളും, 24.02.2015-ലെ കേരള സർക്കാർ ഗസറ്റ് വോള്യം 4 പാർട്ട് 3 8-ാം നമ്പർ പ്രകാരമുള്ള അഡീഷണൽ പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (വിജിലൻസ്), തിരുവനന്തപുരത്തിന്റെ 03.02.2015-ലെ പ്രൊ4 - 29243/2013 നമ്പർ വിÚാപനങ്ങൾക്ക് വിധേയമായി ഇ-ലേലം ചെയ്ത് വിൽക്കുന്നതാണ്.

മേൽ പട്ടികയിൽ ഉൾപ്പെടുത്തിയിട്ടുള്ളവയിൽ ഏതെങ്കിലും ഇനം/അളവ് വിൽക്കാതിരിക്കുന്ന തിനുള്ള അധികാരം ഡിവിഷണൽ ഫോറസ്റ്റാഫീസർ, പാലക്കാടിൽ നിക്ഷിപ്തമായിരിക്കും. ടി ലേലം ചെയ്യുന്ന തടി ഉൽപ്പന്നത്തിന് 20,000/- രൂപ നിരതദ്രവ്യം ലേല ദിവസത്തിന്റെ തൊട്ടു തലേദിവസം ഉച്ചയ്ക്ക് 2 മണിയ്ക്ക് മുമ്പായി അടച്ചിരിക്കണം. ഈ തുക എം.എസ്.റ്റി.സി.യ്ക്ക് ഓൺലൈൻ പ്രകാരം ഡിമാന്റ് ഡ്രാഫ്റ്റ് ഒടുക്ക­േതാണ്. ലേലത്തിൽ പങ്കെടുക്കുന്നയാളിന്റെ രജിസ്ട്രേഷൻ നമ്പർ, നിരതദ്രവ്യം അടയ്ക്കുമ്പോൾ രേഖപ്പെടുത്തിയിരിക്കണം. രജിസ്റ്റർ ചെയ്ത് നിരതദ്രവ്യം മുൻകൂർ അടയ്ക്കുന്ന ലേലക്കാരന് മാത്രമേ ക്രമപ്രകാരമുള്ള ലോട്ടുകളുടെ ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ സാധിക്കുകയുള്ളൂ.

വിജയിയായ ലേലക്കാരൻ ലേലവിലയുടെ 35% തുക ലേല സ്ഥിരീകരണ അറിയിപ്പ് ലഭിച്ച് 7 (ഏഴ്) പ്രവർത്തി ദിവസങ്ങൾക്കകം അടയ്ക്ക­േതാണ്. ടി തുക കേരള സർക്കാരിന്റെ ഇ-ട്രഷറി സംവിധാനത്തിലൂടെ അടയ്ക്ക­േതാണ്.

തിരുവനന്തപുരം പ്രിൻസിപ്പൽ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ (ഫോറസ്റ്റ് മാനേജ്മെന്റ്) അവർകളുടെ 07.06.2021 തീയതിയിലെ Pro (4)-25087/2018 കത്ത് പ്രകാരമുള്ള നിർദ്ദേശത്തിന്റെ അടിസ്ഥാനത്തിലാണ് അക്കേഷ്യ ഓറിക്കുലിഫോർമിസ് മരങ്ങളുടെ അളവ് കണക്കാക്കിയിരിക്കുന്നത്. എൻ. ആർ. നായർ വോള്യം പട്ടിക പ്രകാരമാണ് യൂക്കാലിയുടെ (ഹൈബ്രിഡ്) അളവ് കണക്കാക്കിയിരിക്കുന്നത്. പാലക്കാട് ഈസ്റ്റേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ ചെയർമാനായ മോണിറ്ററിംഗ് കമ്മിറ്റി 26.11.2024 തീയതിയിൽ അംഗീകരിച്ച Quantity Assessment Report പ്രകാരമുള്ള അളവാണ് കണക്കാക്കിയിരിക്കുന്നത്.

ഇ-ലേല നിബന്ധനകൾ

1. പൊതു നിബന്ധനകൾ

(എ). മാർക്ക് ചെയ്ത മരങ്ങളുടെ വ്യാപ്തത്തിന്റെ നിരക്കനുസരിച്ചായിരിക്കും ഇ-ലേലം നടത്തുന്നത്. മരങ്ങൾ മുറിച്ച് വീഴ്ത്തി കഷണങ്ങളാക്കി അട്ടിവെയ്ക്കുന്നതിന്റെ ചെലവ് ലേലക്കാരൻ വഹിക്കേ−താണ്.

(ബി). വിജയിയാകുന്ന ലേലക്കാരൻ എഗ്രിമെന്റ് ഷെഡ്യൂളിൽ പറയുന്ന ലേലം കൊ−ിട്ടുള്ള തോട്ടങ്ങളിൽ നിൽക്കുന്ന മാർക്ക് ചെയ്ത മരങ്ങൾ എല്ലാം തന്നെ മുറിച്ച് നീക്കം ചെയ്യേ−താണ്. മറ്റ് ഇനങ്ങളിലുള്ള മരങ്ങൾ നിലനിർത്തേ−താണ്.

(സി). ഇ-ലേലത്തിൽ പങ്കെടുക്കാൻ താത്പര്യമുള്ള ലേലക്കാരൻ തോട്ടം പരിശോധിച്ച് ഉൽപ്പന്നത്തിന്റെ അളവും ഗുണനിലവാരവും പരിശോധിച്ച് ബോധ്യപ്പെടേ−താണ്. ഇ-ലേലം കഴിഞ്ഞ് അളവും ഗുണനിലവാരവും സംബന്ധിച്ച പരാതികൾ പരിഗണിക്കുന്നതല്ല.

(ഡി). ലേലക്കാരൻ ലേലം കൊ−ിട്ടുള്ള തോട്ടങ്ങളിൽ നിൽക്കുന്ന മാർക്ക് ചെയ്ത മരങ്ങൾ ഭാഗീകമായോ പൂർണ്ണമായോ വെട്ടി ശേഖരിച്ച് നീക്കം ചെയ്യുന്നതിൽ നിന്നും വിലക്കുന്നതിന് ഭരണപരമായ കാരണങ്ങളാലോ മറ്റ് കാരണങ്ങളാലോ കേരള വനം വകുപ്പിന് (നെന്മാറ വനം ഡിവിഷന്) അധികാരമു−ായിരിക്കും.

(ഇ). ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ താത്പര്യമുള്ള വ്യക്തികൾ ആധാറിന്റെ സാക്ഷ്യപ്പെടുത്തിയ പകർപ്പോ സ്ഥിരമായ മേൽവിലാസവും കൈയ്യൊപ്പും സാക്ഷിപ്പെടുത്തിയ ബന്ധപ്പെട്ട വില്ലേജാഫീസറിൽ നിന്നും വാങ്ങിയ സർട്ടിഫിക്കറ്റും സ്ഥാപനങ്ങളാണെങ്കിൽ രജിസ്ട്രേഷൻ സർട്ടിഫിക്കറ്റിന്റേയോ ലൈസൻസിന്റേയോ പകർപ്പും നിരതദ്രവ്യത്തോടൊപ്പം ഓൺലൈനായി സമർപ്പിക്കേ−താണ്.

(എഫ്). ഇ-ലേലത്തിൽ പങ്കെടുക്കുന്ന ലേലക്കാർ വനം വകുപ്പ് ഉദ്യോഗസ്ഥർ കൈമാറുന്ന നിശ്ചിത വിസ്തൃതിയിലുള്ള തോട്ടത്തിൽ നിൽക്കുന്ന മാർക്ക് ചെയ്ത മരങ്ങൽ മാത്രം വെട്ടി ശേഖരിച്ച് നീക്കം ചെയ്യേ−താണ്. ലേലം കൊള്ളുന്ന തോട്ടത്തിലെ മറ്റ് ഇനത്തിലുള്ള മരങ്ങൾ ഒന്നും തന്നെ മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്യുവാൻ പാടുള്ളതല്ല.

(ജി). വിജയിക്കുന്ന ലേലക്കാരൻ പ്രസ്തുത ജോലിയുമായി ബന്ധപ്പെട്ട ആഫീസർമാരുമായോ, ആഫീസുമായോ ഏതെങ്കിലും തരത്തിലുളള ബന്ധം ഇല്ലെന്ന് തെളിയിക്കുന്ന ഒരു സത്യവാÜൂലം ഹാജരാക്കേ−താണ്.

ഇത്തരത്തിൽ ദർഘാസുകാരൻ/ലേലക്കാരൻ ബന്ധപ്പെട്ട ആഫീസർമാരുമായി ഏതെങ്കിലും തരത്തിലുളള ബന്ധമു−െന്ന് പിന്നീട് തെളിയിക്കപ്പെട്ടാൽ ടിയാന്റെ പേരിലുളള ദർഘാസ്/ലേലം റദ്ദു ചെയ്ത് ടിയാന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ ടി കൂപ്പ് പുനർലേലം ചെയ്യുന്നതായിരിക്കും.

(എച്ച്). ഇ ലേലത്തിന് പോസ്റ്റ് ഓഫറുകൾ യാതൊരുകാരണവശാലും പരിഗണിക്കുന്നതല്ല.

2. നിരതദ്രവ്യം

ലേലത്തിൽ പങ്കെടുക്കുവാൻ താത്പര്യമുള്ള ലേലക്കാർ 25,000/- രൂപ നിരതദ്രവ്യമായി കെട്ടിവെക്കേ−താണ്. ഇ-ലേലത്തിൽ പങ്കെടുക്കുവാൻ ആഗ്രഹിക്കുന്ന വ്യക്തികൾ ഇ-ലേലത്തിന് മുമ്പ് നിയമ പ്രകാരമുള്ള നിരതദ്രവ്യം ഇ-പെയ്മെന്റ്/ ഇ-ട്രഷറി വഴി കെട്ടി വയ്ക്കേ−താണ്. ഇ-ലേലത്തിൽ പങ്കെടുക്കുന്ന വ്യക്തികൾ വ്യക്തിയുടെ രജിസ്ട്രേഷൻ നമ്പർ നിരതദ്രവ്യം അടയ്ക്കുമ്പോൾ രേഖപ്പെടുത്തിയിരിക്കണം.

3. ജി.എസ്സ്.ടി, വരുമാന നികുതി തുടങ്ങിയവ

(എ). ലേലത്തിൽ വിജയിയാകുന്ന ലേലക്കാരൻ അതാത് സമയങ്ങളിൽ നിലവിലുള്ള നിരക്കുകളിൽ ജി.എസ്സ്.ടി, വരുമാന നികുതി, വന വികസന നികുതി കൂടാതെ പ്രാബല്യത്തിലുള്ള മറ്റെല്ലാ നികുതികളും ഒടുക്കുവാൻ ബാധ്യസ്ഥനാണ്.

(ബി). വിജയിയാകുന്ന ലേലക്കാരൻ ലേലവുമായി ബന്ധപ്പെട്ട മുഴുവൻ ജി.എസ്സ്.ടി തുകയും, ജി.എസ്സ്.ടി നിരക്കുകളിൽ മാറ്റം വരുന്ന പക്ഷം പുതുക്കിയ നിരക്കിലുള്ള ജി.എസ്സ്.ടി തുകയും ഒടുക്കുവാൻ ബാധ്യസ്ഥനാണ്.

(സി). വിജയിയാകുന്ന ലേലക്കാരൻ ഇൻഡ്യൻ സ്റ്റാമ്പ് ആക്ട് പ്രകാരമുള്ള സ്റ്റാംമ്പ് ഡ്യൂട്ടി ഒടുക്കേ−താണ്. സ്റ്റാംമ്പ് ഡ്യൂട്ടിയിൽ എന്തെങ്കിലും കുറവുള്ളതായി പിന്നീട് ക−െത്തിയാൽ ആ തുക ലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതിന് വനം വകുപ്പിന് അധികാരം ഉ−ായിരിക്കും.

4. ഉടമ്പടി

വിജയിയാകുന്ന ലേലക്കാരൻ 5% സെക്യൂരിറ്റി തുക ലേല സ്ഥിരീകരണം അറിയിക്കുന്ന തീയതി മുതൽ 14 ദിവസത്തിനകം ഒടുക്കി ലേലത്തുകയുടെ 0.1 ശതമാനം വിലയുള്ള മുദ്രപത്രത്തിൽ ഉടമ്പടി ഒപ്പ് വയ്ക്കേ−താണ്. സെക്യൂരിറ്റി തുക (നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറുടെ പേർക്ക് Pledge ചെയ്തത്) കേരള സർക്കാരിന്റെ ട്രഷറി / ബാങ്ക് മുഖേനയുള്ള സ്ഥിരനിക്ഷേപം നടത്തിയിട്ടുള്ള രസീത് ആയിരിക്കണം. 35% ലേലത്തുകയും 5% സെക്യൂരിറ്റി തുകയും ഒടുക്കി ഉടമ്പടി ഒപ്പ് വച്ചതിനുശേഷം മാത്രമെ ജോലിതുടങ്ങുന്നതിനും 100% ലേലത്തുകയും നികുതികളും അടവാക്കിയതിനു ശേഷം മാത്രമെ ഉൽപ്പന്നങ്ങൾ നീക്കം ചെയ്യുന്നതിനും അനുവദിക്കുകയുള്ളു. ലേല തുക കണക്കാക്കുന്നത് തോട്ടത്തിൽ നിന്നും പ്രതീക്ഷിക്കുന്ന ഉൽപ്പന്നങ്ങളുടെ തിട്ടപ്പെടുത്തിയ വ്യാപ്തത്തിന് അനുസരിച്ചായിരിക്കും.

5. തുകയും നികുതികളും ഒടുക്കുന്നത്

വിജയിയായ ലേലക്കാരൻ ലേലതുകയുടെ (തിട്ടപ്പെടുത്തിയിട്ടുള്ളതും പ്രതീക്ഷിക്കുന്നതുമായ തടിയുടെ അളവിന്റേയും രേഖപ്പെടുത്തിയ നിരക്കിന്റേയും അടിസ്ഥാനത്തിൽ കണക്കാക്കിയത്) 35% ലേലത്തുകയും വനവികസന നികുതിയും ചരക്ക് സേവന നികുതിയും ലേലം സ്ഥിരീകരിക്കുന്ന അറിയിപ്പ് ലഭിക്കുന്ന തീയതിമുതൽ 7 ദിവിസത്തിനുള്ളിൽ ഒടുക്കേ−താണ്. 65% ലേലത്തുക 40 ദിവസത്തിനുള്ളിൽ ഒടുക്കാതെ വന്നാൽ 12 ശതമാനം പിഴ പലിശയോടെ 30 ദിവസത്തെ കാലാവധി ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ ദീർഘിപ്പിച്ചു നൽകുന്നതാണ്. 18 ശതമാനം പിഴ പലിശ ഒടുക്കുന്നതിന് വിധേയമായി വീ−ും 30 ദിവസത്തെ കാലാവധി കൂടി ദീർഘിപ്പിച്ച് നൽകുന്നതിന് ഒലവക്കോട് ഈസ്റ്റേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർക്ക് അധികാരമു−ായിരിക്കും. ദീർഘിപ്പിച്ചു നൽകുന്ന ര−് കാലാവധികൾക്കുള്ളിലും മേൽപറഞ്ഞ തുകകൾ ഒടുക്കുന്നതിൽ ലേലക്കാരൻ വീഴ്ചവരുത്തുന്ന പക്ഷം ലേലക്കാരൻ ഒടുക്കിയിട്ടുള്ള നിരതദ്രവ്യവും മറ്റെല്ലാ തുകകളും സർക്കാരിലേക്ക് ക−് കെട്ടുന്നതും ഉടമ്പടി റദ്ദാക്കുന്നതുമായിരിക്കും.

6. കരാർ കാലാവധി

(എ) കരാർ കാലാവധി ലേലസ്ഥിരീകരണ അറിയിപ്പ് ലഭിക്കുന്ന തീയതി മുതൽ 120 ദിവസമോ 31.05.2025 തീയതിയോ ഇതിൽ ഏതാണോ ആദ്യം വരുന്നത്, ആ തീയതി വരെയായിരിക്കും. സാധാരണഗതിയിൽ കരാർ കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതല്ല. പ്രത്യേക സാഹചര്യങ്ങളിൽ ന്യായമായ കാരണങ്ങളാൽ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ ഒരു ഹെക്ടറിന് 2500/- രൂപ നിരക്കിൽ തുക ഈടാക്കുന്നതിന് വിധേയമായി 30 ദിവസത്തേക്ക് കരാർ കാലാവധി ദീർഘിപ്പിച്ച് നൽകുന്നതായിരിക്കും. തുടർന്ന് പാലക്കാട് ഈസ്റ്റേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർ ഒരു ഹെക്ടറിന് 5000/- രൂപThis is a digitally signed Gazette. നിരക്കിൽ തുക ഈടാക്കുന്നതിന് വിധേയമായി 30 ദിവസത്തേക്ക് കൂടി ഇപ്രകാരം ദീർഘിപ്പിച്ച് നൽകുന്ന 60 ദിവസത്തിനുശേഷം യാതൊരു കാരണവശാലും കരാർ കാലാവധി ദീർഘിപ്പിച്ചു നൽകുന്നതല്ല.

(i) ദീർഘിപ്പിച്ചു നൽകിയ സമയത്തിനുള്ളിലും ഉടമ്പടി പ്രകാരം ശേഖരിച്ച ഉൽപ്പന്നങ്ങൾ നീക്കം ചെയ്യുന്നില്ലായെങ്കിൽ ആയത് സർക്കാരിലേക്ക് ക−ുകെട്ടുന്നതും അതിൽ ലേലക്കാരന് യാതൊരു അവകാശവും ഉ−ായിരിക്കുന്നതുമല്ല.

(ii)മേൽപ്രകാരമുള്ള സാഹചര്യത്തിൽ ലേലക്കാരൻ പൂർത്തിയാക്കാതെപോയ ജോലികൾ മറ്റ് ഏതെങ്കിലും തരത്തിൽ പൂർത്തിയാക്കുന്നതും, അപക്രാരം സർക്കാരിനു−ാകുവാൻ സാധ്യതയുള്ള എല്ലാ കഷ്ടനഷ്ടങ്ങൾക്കും ലേലക്കാരൻ ഉത്തരവാദിയായിരിക്കുന്നതും അപ്രകാരമു−ാകുന്ന എല്ലാവിധ നഷ്ടങ്ങളും റവന്യു റിക്കവറി ഉൾപ്പെടെ നിലവിലുള്ള നിയമപരമായ മാർഗ്ഗങ്ങളിലൂടെ ലേലക്കാരനിൽ നിന്നും ഈടാക്കുന്നതുമാണ്.

(ബി) ഉടമ്പടി പ്രകാരം മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്യുന്ന ഉൽപ്പന്നങ്ങൾ എത്തിച്ച് ശേഖരിക്കുന്ന സ്ഥലം മുൻകൂറായി ലേലക്കാരൻ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറെ അറിയിക്കേ−താണ്. ഏതെങ്കിലും സാഹചര്യത്തിൽ മുൻകൂറായി അറിയിച്ചിരുന്ന സ്ഥലത്തുനിന്നും ഉൽപ്പന്നങ്ങൾ മറ്റ് ഏതെങ്കിലും സ്ഥലത്ത് സൂക്ഷിക്കുവാൻ ഇടയാകുന്നപക്ഷം ആ വിവരവും നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറെ മുൻകൂറായി അറിയിക്കേ−താണ്..

7. സെക്യൂരിറ്റി ഡിപ്പോസിറ്റ്

(എ) ലേല സ്ഥിരീകരണ ഉത്തരവ് ലഭിച്ച് 14 ദിവസത്തിനുള്ളിൽ ലേലക്കാരൻ മുഴുവൻ 35% ലേലത്തുകയും വനവികസന നികുതിയും ചരക്ക് സേവന നികുതിയും ആദായ നികുതിയും 5% സെക്യൂരിറ്റി ഡെപ്പോസിറ്റായും ഒടുക്കേ−താണ്. സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് തുക ഉടമ്പടി വ്യവസ്ഥകൾ പ്രകാരം ജോലികൾ വിജയകരമായി നിർവ്വഹിച്ചശേഷം ജി.എസ്.റ്റി. ക്ലിയറൻസ് സർട്ടിഫിക്കറ്റ്, വരുമാന നികുതി സർട്ടിഫിക്കറ്റ് തുടങ്ങിയവ ഹാജരാക്കുന്ന മുറയ്ക്ക് മാത്രം വിട്ടുനൽകുന്നതാണ്. ജോലികൾ നിർവ്വഹിക്കുന്നതുമായി ബന്ധപ്പെട്ട് കരാറുകാരന്റെ പേരിൽ ഏതെങ്കിലും തരത്തിലുള്ള ബാദ്ധ്യതകൾ ഉ−ാകുന്നപക്ഷം ആയത് സെക്യൂരിറ്റി തുകയിൽ നിന്നും ഈടാക്കുന്നതായിരിക്കും.

(ബി) സെയിൽ കൂപ്പുകൾക്ക് ബാധകമായ എല്ലാ വ്യവസ്ഥകളും ഈ ലേലത്തിന് ബാധകമായിരിക്കും.

8. മരങ്ങളുടെ വെട്ടി ശേഖരണം സംബന്ധിച്ച പൊതു വ്യവസ്ഥകൾ

താഴെപ്പറയുന്ന വ്യവസ്ഥകൾക്ക് വിധേയമായി ഉൽപന്നങ്ങളുടെ വെട്ടിശേഖരണം നടത്തേ−താണ്.

(എ) ലേലത്തിലെടുത്തിട്ടുള്ള തോട്ടങ്ങൾ ലേലക്കാരൻ യാതൊരു കാരണവശാലും മറ്റൊരു വ്യക്തിക്കോ, സ്ഥാപനത്തിനോ കൈമാറുവാൻ പാടുള്ളതല്ല.

(ബി) നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസറിൽ നിന്നോ ആലത്തൂർ / നെല്ലിയാമ്പതി റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസറിൽ നിന്നോ രേഖാമൂലമുള്ള അനുവാദം വാങ്ങാതെ ലേലക്കാരനോ, ലേലക്കാരന്റെ ഏജന്റോ മറ്റ് ജോലിക്കാരോ കൂപ്പിനുള്ളിൽ പ്രവേശിക്കുവാൻ പാടുള്ളതല്ല.

(സി) കരാർ കാലാവധി കഴിയുന്നതുവരെ ലേലക്കാരൻ തോട്ടങ്ങളുടെ അതിരുകൾ ര−് മീറ്റർ വീതിയിൽ അതിരുകൾ വ്യക്തമാകത്തക്കവിധം അടിക്കാട് തെളിച്ച് സൂക്ഷിക്കേ−താണ്. ലേലക്കാരൻ ഇപ്രകാരം ചെയ്യാത്തപക്ഷം ആയത് ഡിപ്പാർട്ടുമെന്റലായി നിർവ്വഹിക്കുന്നതും ആയത് മൂലമു−ാകുന്ന ചെലവുകൾക്കും മറ്റ് നഷ്ടങ്ങൾക്കും ലേലക്കാരൻ ഉത്തരവാദിയായിരിക്കുന്നതും ആയത് ലേലക്കാരനിൽ നിന്നും നോട്ടീസ് നൽകി ഈടാക്കുന്നതുമായിരിക്കും.

(ഡി) കരാർ ഏറ്റെടുത്തിട്ടുള്ള പ്രദേശത്ത് ലേലക്കാരൻ സാക്ഷ്യപ്പെടുത്തിയ ഏജന്റിന്റെ സേവനം എല്ലായ്പ്പോഴും ലഭ്യമാക്കേ−താണ്. ഇപ്രകാരം കരാറുകാരൻ സാക്ഷ്യപ്പെടുത്തി ഏർപ്പെടുത്തുന്ന ഏജന്റ്/ ഏജന്റുമാരുടെ പേര്, അഡ്രസ്സ്, സാക്ഷ്യപ്പെടുത്തിയ കയ്യൊപ്പ് എന്നിവ നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ മുൻപാകെ സമർപ്പിച്ച് അംഗീകാരം വാങ്ങേ−താണ്. ലേലക്കാരൻ ഏർപ്പെടുത്തുന്ന ഏജന്റിനെ നിരസിക്കു വാനുള്ള അധികാരം നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർക്ക് ഉ−ായിരിക്കുന്നതാണ്. കേരള വനം വകുപ്പോ, കേരളാ സർക്കാരോ കരിമ്പട്ടികയിൽപെടുത്തിയിട്ടുള്ള വ്യക്തികളെ ഏജന്റായോ, ജോലിക്കാരായോ ലേലക്കാരൻ ഉൾപ്പെടുത്തുവാൻ പാടില്ല.

(ഇ) കരാറുകാരൻ ഏർപ്പെടുത്തുന്ന ഏജന്റുമാർക്കും, ജോലിക്കാർക്കും അവരുടെ പേര്, വയസ്സ്, നിലവിലെ മേൽവിലാസം, കാലാവധി എന്നിവ രേഖപ്പെടുത്തിയ രേഖാമൂലമുള്ള തിരിച്ചറിയൽ രേഖ നൽകേ−താണ്. വനം വകുപ്പ് ഉദ്യോഗസ്ഥരോ, പോലീസോ ആവശ്യപ്പെടുന്നപക്ഷം ഏത് സമയത്തും ടി തിരിച്ചറിയൽ രേഖ പരിശോധനയ്ക്കായി നൽകേ−താണ്.

(എഫ്) ലേലക്കാരനും ഏജന്റും ജോലിക്കാരും കേരളാ വനം വകുപ്പിലെ ബീറ്റ് ഫോറസ്റ്റ് ഓഫീസർ, സെക്ഷൻ ഫോറസ്റ്റ് ഓഫീസർ, ഡെപ്യൂട്ടി റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസർ, റെയിഞ്ച് ഫോറസ്റ്റ് ഓഫീസർ, ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ എന്നിവർ തടികൾ മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്യുന്നതുമായി ബന്ധപ്പെട്ട് സമയാസമയങ്ങളിൽ നൽകുന്ന നിർദ്ദേശങ്ങൾ പാലിക്കുവാൻ ബാദ്ധ്യസ്ഥരാണ്.

(ജി) ലേലക്കാരും, ഏജന്റും ജോലിക്കാരും കരാർ പ്രകാരമുള്ള ജോലികൾ നടന്നുകൊ−ിരിക്കുന്ന പ്രദേശത്ത് നിന്നും യാതൊരു കാരണവശാലും മറ്റ് വനപ്രദേശങ്ങളിലേയ്ക്ക് തീ പടരുവാനുള്ള സാധ്യതകൾ സൃഷ്ടിക്കരുത്.

(എച്ച്) ഏതെങ്കിലും കാരണവശാൽ കരാർ ജോലികൾ നടന്നുകൊ−ിരിക്കുന്ന വനപ്രദേശത്തോട് ചേർന്ന് തീ പിടുത്തമു−ാകുന്ന പക്ഷം തീ അണയ്ക്കുന്നതിനുള്ള അടിയന്തര നടപടികൾ സ്വീകരിക്കേ−തും തീ ഉ−ായിട്ടുള്ള വിവരം ബന്ധപ്പെട്ട വനം വകുപ്പ്, പോലീസ്, റവന്യൂ ഉദ്യോഗസ്ഥർ എന്നിവരെ അറിയിക്കുന്നതിനുള്ള നടപടികൾ സ്വീകരിക്കേ−തുമാണ്.

(ഐ) കരാർ വ്യവസ്ഥ പ്രകാരം വെട്ടിശേഖരിക്കുന്ന ഉൽപ്പന്നങ്ങൾക്ക് തീ മൂലമോ മോഷണം മൂലമോ മറ്റേതെങ്കിലും കാരണങ്ങളാലോ സംഭവിക്കുന്ന നാശനഷ്ടങ്ങൾക്ക് ലേലക്കാരൻ ഉത്തരവാദിയായിരിക്കു ന്നതാണ്. വെട്ടിശേഖരിക്കുന്ന ഉൽപ്പന്നങ്ങൾക്ക് നാശനഷ്ടം സംഭവിക്കുവാൻ ഇടയുള്ള സാഹചര്യത്തിൽ ആയവ ലേലക്കാരൻ ഇൻഷ്വർ ചെയ്ത് സൂക്ഷിക്കേ−താണ്.

(ജെ) ലേലക്കാരനും ലേലക്കാരന്റെ ഏജന്റും മറ്റ് ജോലിക്കാരും കേരളാ ഫോറസ്റ്റ് ആക്ട്, വന്യജീവി സംരക്ഷണ നിയമം തുടങ്ങിയ എല്ലാ വനനിയമങ്ങളും പാലിക്കുവാൻ ബാദ്ധ്യസ്ഥരാണ്. ക്രിമിനൽ കുറ്റങ്ങളിൽ പ്രതിചേർക്കപ്പെട്ടിട്ടുള്ളവർ യാതൊരു കാരണവശാലും ജോലിസ്ഥലത്ത് അനുവദനീയരല്ല.

(കെ) കരാർ എടുത്തിട്ടുള്ള തോട്ടത്തിലേയോ സമീപ റിസർവ്വുകളിലേയോ മരങ്ങൾക്ക് ഉ−ാകാവുന്ന എല്ലാവിധ നാശങ്ങൾക്കും നഷ്ടങ്ങൾക്കും കരാറുകരാൻ ഉത്തരവാദിയായിരിക്കുന്നതാണ്. ആയതുമായി ബന്ധപ്പെട്ട് നിയമപരമായി സ്വീകരിക്കുന്ന നടപടികളിൽ കരാറുകാരൻ ബാദ്ധ്യതയു−ായിരിക്കുന്നതാണ്.

(എൽ) ലേലക്കാരൻ ആവശ്യപ്പെടുന്നപക്ഷം ലേലക്കാരന്റെ ഉത്തരവാദിത്വത്തിൽ കൂപ്പിന് പുറത്ത് ബില്ലറ്റുകൾ സൂക്ഷിക്കുവാൻ നെന്മാറ ഡിവിഷണൽ ഫോറസ്റ്റ് ഓഫീസർ അനുവാദം നൽകുന്നതാണ്.

(എം) കരാറെടുത്തിട്ടുള്ള കൂപ്പിന്റെ 100 മീറ്റർ പരിധിയിൽ സംഭവിക്കുന്ന എല്ലാവിധ നിയമവിരുദ്ധ പ്രവർത്തനങ്ങൾക്കും കരാറെടുത്തിട്ടുള്ള ലേലക്കാരൻ ഉത്തരവാദിയായിരിക്കുന്നതാണ്. ഏതെങ്കിലും തരത്തിലുള്ള നിയമ വിരുദ്ധ പ്രവർത്തനങ്ങൾ കൂപ്പിന്റെ 100 മീറ്റർ പരിധിയിൽThis is a digitally signed Gazette. Authenticity may be verified through https://compose.kerala.gov.in/

സംഭവിക്കുന്ന പക്ഷം ആയത് വനം വകുപ്പ് ഉദ്യോഗസ്ഥരോട് റിപ്പോർട്ട് ചെയ്യാത്തപക്ഷം കരാർ റദ്ദാവുന്നതാണ്.

10. മരങ്ങൾ മുറിക്കുന്നതുള്ള വ്യവസ്ഥകൾ

(എ) താഴെപ്പറയുന്ന വ്യവസ്ഥകൾക്കനുസൃതമായി മാത്രമേ മരങ്ങൾ മുറിക്കുവാൻ പാടുള്ളൂ.

(i) കരാർ എടുത്തിരിക്കുന്ന തോട്ടം 10 ഹെക്ടർ വീതമുള്ള ബ്ലോക്കുകളായി തിരിച്ച് മാത്രമേ മരങ്ങൾ മുറിച്ച് ശേഖരിച്ച് നീക്കം ചെയ്യുവാൻ പാടുള്ളൂ.

(ii) കരാർ എടുത്തിട്ടുള്ള തോട്ടത്തിൽ നിൽക്കുന്ന മറ്റ് മരങ്ങൾക്കും സസ്യജാലങ്ങൾക്കും കേടുപാടു −ാകാതെ വേണം വെട്ടി ശേഖരണം നടത്തേ−ത്.

(iii) മരങ്ങൾ മുറിച്ച് നീക്കം ചെയ്യുമ്പോൾ താഴെപ്പറയുന്ന മുൻകരുതലുകൾ കൂടി സ്വീകരിക്കേ−താണ്.

(എ) മരങ്ങൾ തോട്ടത്തിന്റെ ഉയർന്ന ഭാഗത്തുനിന്നും താഴേക്കുമാത്രമേ മുറിക്കാവൂ. തോട്ടത്തിൽ നിന്നും മരങ്ങൾ മുറിച്ച് നീക്കം ചെയ്യുവാൻ ഉദ്ദേശിക്കുന്ന വഴിയുടെ ഏറ്റവും അവസാന ഭാഗത്തുനിന്നും മാത്രമേ മരങ്ങൾ മുറിച്ച് തുടങ്ങാവൂ.

(ബി) മരങ്ങൾ പരമാവധി മൂർച്ചയുള്ള ഉപകരണം കൊ−് മുറിക്കേ−തും, മരക്കുറ്റികൾ മൺ നിരപ്പിൽ നിന്നും പരമാവധി 15 സെന്റീമീറ്റർ മുകളിലേയ്ക്ക് മാത്രം നിൽക്കുന്ന തരത്തിലും മുറിക്കേ−താണ്.

(സി) ബില്ലറ്റുകൾ വാൾ ഉപയോഗിച്ച് മാത്രമേ മുറിക്കാവൂ.

(ഡി) കരാറുകാരനിൽ നിന്നോ ഏജന്റിൽ നിന്നോ മറ്റ് ജോലിക്കാരിൽ നിന്നോ ഉ−ാകുന്ന നോട്ടക്കുറവ് മൂലം ഉ−ാകുന്ന എല്ലാ നാശനഷ്ടങ്ങൾക്കും കരാറുകാരൻ ഉത്തരവാദിയായിരിക്കുന്നതാണ്.

11. പൾപ്പ് വുഡ് ഉത്പന്നങ്ങൾ നീക്കം ചെയ്യുന്നത്.

ലേലക്കാരൻ വെട്ടിശേഖരിക്കുന്ന ഉത്പന്നങ്ങൾ സ്വന്തം ചെലവിലും ക്രമീകരണത്തിലും നിർദ്ദിഷ്ട സ്ഥലത്തേക്ക് കടത്തിക്കൊ−് പോകേ−താണ്. ഉത്പന്നങ്ങൾ ലേലക്കാരനോ അദ്ദേഹത്തിന്റെ ഏജന്റോ കടത്തിക്കൊ−് പോകേ−ത് കേരള ഫോറസ്റ്റ് പ്രൊഡ്യൂസ് ട്രാൻസിസ്റ്റ് റൂളുകളിൽ പറയും പ്രകാരം നിർദ്ദിഷ്ട പാസ്സോടുകൂടി ആയിരിക്കണം. പാസ്സുകൾ വനം വകുപ്പ് നൽകുന്നതായിരിക്കും. ലേലക്കാരൻ ഉൽപ്പന്നൾ കടത്തിക്കൊ−് പോകേ−ത് ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ അംഗീകരിച്ച വഴികളിലൂടെയും കെ.എഫ്.പിറ്റി റൂൾസ് മോട്ടോർ വെഹിക്കിൾസ് ആക്ട് എന്നിവയുടെ വ്യവസ്ഥകൾ പാലിച്ചുമായിരിക്കണം.

12. കടത്ത് പാസ്സ് നൽകുന്നത്.

ലേലക്കാരൻ അല്ലെങ്കിൽ ഏജന്റിന് ഇൻവോയിസ് നൽകിയ ശേഷം ഉൽപ്പന്നൾ കടത്തിക്കൊ−് പോകുന്നതിന് പാസ്സ് നൽകുന്നതാണ്. എന്നാൽ കടത്തിക്കൊ−് പോകാൻ അനുവദിച്ചിട്ടുള്ള ഉൽപന്നങ്ങളുടെ വില അഡ്വാൻസ് തുകയിൽ അധികരിക്കുവാൻ പാടില്ല.

(എ). ഇൻവോയിസ് തയ്യാറാക്കിയ ശേഷം ബന്ധപ്പെട്ട ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ നിർദ്ദിഷ്ട സ്ഥലത്തേക്ക് ഉൽപ്പന്നങ്ങൾ കടത്തിക്കൊ−് പോകുന്നതിന് നിയമപ്രകാരം പാസ്സിന്റെ വില ഈടാക്കിക്കൊ−് ഫോം III വെള്ള/ ഫോം III ചുവപ്പ് പാസ്സ് നൽകുന്നതായിരിക്കുംThis is a digitally signed Gazette. (ബി) ശേഖരിച്ച ഉൽപന്നങ്ങൾ തോട്ടത്തിൽ തന്നെയുള്ള ഡംബിഗ് സൈറ്റിലേക്ക് കടത്തിക്കൊ−് പോകുന്നതിന് ബന്ധപ്പെട്ട റെയിഞ്ചാഫീസർ/ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ പാസ്സിന്റെ വില ഈടാക്കിക്കൊ−് ഫോം V പെർമിറ്റുകൾ നൽകുന്നതാണ്.

(സി) വെട്ടിശേഖരിച്ച ഉത്പന്നങ്ങൾ ചെക്ക് മെഷർമെന്റിന് ശേഷം സംസ്ഥാനത്തിന് അകത്തുള്ള നിർദ്ദിഷ്ട സ്ഥലത്തേക്ക് ഒറ്റ തവണയായി കൊ−ുപോകുവാൻ കഴിയുന്നില്ലായെങ്കിൽ ആവശ്യമായ ഫോം VI മഞ്ഞ സബ്സിഡറി പാസ്സുകൾ, പാസ്സിന്റെ വില ഈടാക്കിക്കൊ−് നൽകുന്നതാണ്.

(ഡി) പാസ്സുകളുടെ കണക്കുകൾ ലേലക്കാരൻ സൂക്ഷിക്കേ−തും ര−് ആഴ്ചകൂടുമ്പോൾ ഡി.എഫ്.ഓയ്ക്ക് സമർപ്പിക്കേ−തുമാണ്.

(ഇ) ലേലക്കാരൻ ശേഖരിച്ച് അട്ടിവെച്ചിട്ടുള്ള ഉത്പന്നങ്ങൾ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറുടെയോ അദ്ദേഹം ചുമതലപ്പെടുത്തുന്ന ഉദ്ദ്യോഗസ്ഥന്റേയോ പരിശോധനയ്ക്ക് വിധേയമായിരിക്കും.

(എഫ്) ഉത്പന്നങ്ങളുടെ നിർദ്ദിഷ്ട സ്ഥലത്തേക്കോ ഇടക്കാല സ്ഥലത്തേക്കോ ഉള്ള കടത്ത് റെയിഞ്ചാഫീസർ നിർദ്ദേശിക്കുന്ന വഴികളിലൂടെ ആയിരിക്കണം

13. ഉൽപന്നങ്ങൾ കടത്തിക്കൊ−ുപോകുന്നതിനുള്ള കാലതാമസം- പാസ്സുകളുടെ കാലാവധി

ദീർഘിപ്പിക്കുന്നത് സംബന്ധിച്ച്

എടുക്കുന്നതാണ്. റെയിഞ്ചാഫീസർ തിട്ടപ്പെടുത്തുന്നതും ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർ അംഗീകരിക്കുന്നതുമായ നഷ്ടം എന്തെങ്കിലും ഉ−െങ്കിൽ അത് ഒടുക്കുന്നതിന് കരാറുകാരൻ ബാധ്യസ്ഥനായിരിക്കും. കരാർ കാലാവധി കഴിഞ്ഞാൽ ഉടൻ തന്നെ വെട്ടി ശേഖരണം പൂർത്തിയാക്കി കരാർ എടുത്തിട്ടുള്ള ഏരിയ റീപ്ളാന്റിഗിനായി തിരകെ നൽകിയില്ലായെങ്കിൽ ഒര് തൈക്ക് 10 രൂപ നിരക്കിൽ ഹെക്ടറിന് 1600 എണ്ണം/ഹെ. ക്രമത്തിൽ തൈകളുടെ വില ഒടുക്കുന്നതിന് കരാറുകാരൻ ബാധ്യസ്ഥനായിരിക്കും.

17. കോൺട്രാക്ട് വ്യവസ്ഥകളുടെ ലംഘനത്തിനുള്ള മറ്റ് പിഴകൾ

കരാർ വ്യവസ്ഥകൾ മൊത്തമായോ ഏതെങ്കിിലും വ്യവസ്ഥകൾ മാത്രമായോ കരാറുകാരൻ ലംഘി ക്കുകയാണെങ്കിൽ താഴെപ്പറയും പ്രകാരം പുനലൂർ ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസറോ കൊല്ലം സതേൺസർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്ററോ തിട്ടപ്പെടുത്തിയ പിഴ ഒടുക്കുന്നതിന് കരാറുകാരൻ ബാദ്ധ്യസ്ഥനായിരിക്കും.

(എ) 1961 ലെ ഇൻകംടാക്സ് നിയമപ്രകാരമുള്ള ഇൻകംടാക്സ് നികുതി ഇളവിനായി കരാറുകാരൻ 27 സി ഫോറത്തിലുള്ള ഡിക്ളറേഷൻ ഉത്പന്നങ്ങൾക്കുള്ള ഇൻവേയ്സ് നൽകുന്നതിന് മുമ്പായി ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് സമർപ്പിക്കേ−താണ്.

(ബി). കരാറുകാരൻ നിർദ്ദിഷ്ട ഡിക്ളറേഷൻ സർപ്പിക്കുന്നില്ലായെങ്കിൽ ലേല തുകയോടൊപ്പം സെക്ഷൻ 6 സി പ്രകാരമുള്ള ഇൻകംടാക്സ് ഒടുക്കേ−താണ്.

19. തുക ഒടുക്കുന്നതിനുള്ള നോട്ടീസ് കൈപ്പറ്റുന്നതിന് കരാറുകാരൻ ഏർപ്പെടുത്തേ− ക്രമീകരണങ്ങൾ

കരാറുകാരന്റെ പേരിലുള്ള നോട്ടീസുകൾ ഇൻവേയ്സുകൾ എന്നിവ കൈപ്പറ്റുന്നതിന് കരാറുകാരൻ നേരിട്ടോ ഏജന്റ് മുഖേനയോ ക്രമീകരണങ്ങൾ വരുത്തുകയോ ശരിയായ പോസ്റ്റൽ മേൽ വിലാസം നൽകുകയോ ചെയ്യേ−താണ്. ഇപ്രകാരം അയയ്ക്കുന്ന നോട്ടീസുകൾ കൈപ്പറ്റാതെ തിരികെ വരുകയാണെങ്കിൽ ആയവ കേരാറുകാരൻ കൈപ്പറ്റിയതായി കണക്കാക്കി തുടർനടപടികൾ സ്വീകരിക്കുന്നതാണ്.

20. കോൺട്രാക്റ്റ് ക്യാൻസൽ ചെയ്യുന്നതിലേയ്ക്ക് നയിക്കുന്ന സംഭവങ്ങൾ

(എ) കോൺട്രാക്ട്് വ്യവസ്ഥകളിലെ ഒന്നോ അധിലധികമോ വ്യവസ്ഥകൾ കരാറുകാരൻ ലംഘിക്കുകയാണെങ്കിൽ കരാർ ക്യാൻസൽ ചെയ്യുന്നതിനും കരാറുകാരൻ കെട്ടിവെച്ചിട്ടുള്ള സെക്യൂരിറ്റി ഡെപ്പോസിറ്റ് ഉൾപ്പെടെയുള്ള തുക ക−് കെട്ടുന്നതിനും ടിയാൻ ശേഖരിച്ചിട്ടുള്ള ഉത്പന്നങ്ങൾ ക−് കെട്ടുന്നതിനും ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് അധികാരമു−ായിരിക്കും. ഈ വിവരം കരാറുകാരനെ അക്ക്നോളഡ്ജ്മെന്റ് കാർഡോടുകൂടിയ രജിസ്ട്രേഡ് കത്ത് മുഖേന അറിയിക്കുന്നതാണ്.

(ബി) കരാർ എടുത്തിട്ടുള്ള ഏരിയായ്ക്ക് ചുറ്റും 100 മീറ്റർ ചുറ്റളവിൽ അനധികൃമായി തടിമുറിച്ച് നീക്കം ചെയ്യുകയോ മറ്റ് ഏതെങ്കിലും ഉൽപന്നങ്ങൾ നീക്കം ചെയ്യുകയോ ഏതെങ്കിലും വന്യമൃഗത്തെ വേട്ടയാടുകയോ ചെയ്താൽ ആയതിന് കരാറുകാരൻ ഉത്തരവാദിയായിരിക്കുന്നതാണ്. അനധികൃമായ മരം മുറിയോ വേട്ടയാടലോ കരാറുകാരന്റെ അറിവോടുകൂടിയല്ലായെന്ന് ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് ബോധ്യമാകുന്ന വിധത്തിൽ തെളിയിച്ചില്ലായെങ്കിൽ കരാർ റദ്ദാക്കുന്നതും കരാർകാരൻ ഒടുക്കിയിട്ടുള്ള തുകയും കരാറുകാരൻ ശേഖരിച്ചിട്ടുള്ള ഉൽപന്നങ്ങളും ക−് കെട്ടുന്നതുമായിരിക്കും.

(സി) കരാർ ക്യാൻസൽ ചെയ്യുകയാണെങ്കിൽ ആതോട്ടം കരാറുകാരന്റെ നഷ്ടോത്തരവാദിത്വത്തിൽ പുനർ ലേലം ചെയ്യുന്നതായിരിക്കും. പുനർ ലേലത്തിൽ ലഭിക്കുന്ന ഏറ്റവും മുകച്ച തുകയ്ക്ക്, ആദ്യം ലേലത്തുക എത്രയെന്ന് പരിഗണിക്കാതെ ലേലം ഉറപ്പിക്കുന്നതായിരിക്കും. പുനർ ലേലത്തിൽ ആദ്യലേലത്തേക്കാൾ കുറഞ്ഞതുകയാണ് ലഭിക്കുന്നതെങ്കിൽ വ്യത്യാസമുള്ള തുക കരാറുകാരനിൽനിന്നും ഈടാക്കുന്നതും അധികം തുകയാണ് ലഭിക്കുന്നതെങ്കിൽ ആയതിന് കരാറുകാരന് യാതൊരു അവകാശവും ഉ−ായിരിക്കുന്നതല്ല. ഇങ്ങനെയുള്ള സന്ദർഭത്തിൽ വെട്ടി ശേഖരിച്ച് വെച്ച ഉൽപന്നങ്ങളുടെ അളവിലോ തൂക്കത്തിലോ കുറവ് വന്നാൽ അത് സർക്കാർ നഷ്ടമായി കണക്കാക്കുന്നതും കരാറുകാരനിൽ നിന്നും നഷ്ടം ഈടാക്കുന്നതുമായിരിക്കും.

21. നഷ്ടമോ കേടുപാടുകളോ ഉ−ാകുന്നതിൽ നിന്നുള്ള സംരക്ഷണം.

(എ) പ്രകൃതി ദുരന്തങ്ങളോ കാലാവസ്ഥാവ്യതയാനമോ അസുഖമോ മറ്റേതെങ്കിലും കാരണവശാലോ ഡിപ്പാർട്ട്മെന്റിന് ഉൽപന്നങ്ങൾ നൽകാൻ സാധിക്കുന്നില്ലായെങ്കിൽ കരാറുകാരന് യാതൊരുവിധ നഷ്ടപരിഹാരത്തിനും അർഹതയു−ായിരിക്കുന്നതല്ല.

(ബി) കരാറുകാരന് ലേലത്തിൽ വിറ്റിട്ടുള്ള ഉൽപന്നങ്ങൾ കാട്ടുതീ,വെള്ളപൊക്കം, മറ്റേതെങ്കിലും പ്രകൃതി ദുരന്തങ്ങൾ എന്നിവമൂലം ഉ−ാകുന്ന നഷ്ടത്തിനോ കേടുപാടുകൾക്കോ ഡിപ്പാർട്ട്മെന്റ് ഉത്തരവാദിയായിരിക്കുന്നതല്ല.

(സി) പ്ളാന്റേഷനിലോ താത്ക്കാലിക ഡംബിഗ് സൈറ്റിലോ സ്റ്റോക്ക് ചെയ്തിട്ടുള്ള ഉത്പന്നങ്ങൾ സംരക്ഷിക്കുന്നതിന് ഇൻഷ്യറൻസ് ഉൾപ്പെടെയുള്ള ക്രമീകരണങ്ങൾ കരാറുകാരൻ ചെയ്തിരിക്കേ−താണ്. അപ്രകാരമു−ാകുന്ന നഷ്ടത്തിന് വനം വകുപ്പ് ഉത്തരവാദിയായിരിക്കുന്നതല്ല.

22. നിയമങ്ങളും ചട്ടങ്ങളും പാലിക്കുന്നത്

(എ) 1961 ലെ കേരള ഫോറസ്റ്റ് ആക്ടും കാലാകാലങ്ങളിൽ ഭേദഗതി ചെയ്ത റൂളുകളും പാലിക്കാൻ കരാറുകാരൻ ബാധ്യസ്ഥനാണ്.

(ബി) ജി.എസ്സ്.റ്റി നിയമവും അതിൽ കാലാകാലങ്ങളിൽ ഉ−ാകുന്ന മാറ്റങ്ങളും പാലിക്കാൻ കരാറുകാരൻ ബാധ്യസ്ഥനാണ്.

(സി) ഇൻകം ടാക്സ് നിയമവും ലേലവുമായി ബന്ധപ്പെട്ട മറ്റ് കേന്ദ്ര സംസ്ഥാന നിയമങ്ങളും പാലിക്കാൻ കരാറുകാരൻ ബാധ്യസ്ഥനാണ്.

(ഡി) വർക്ക്മെൻ കോമ്പൻസേഷൻ ആക്ടും തൊഴിലാളികളെ നിയമിക്കുന്നതുമായി ബന്ധപ്പെട്ട മറ്റ് നിയമങ്ങളും അനുസരിച്ചുള്ള എന്തെങ്കിലും ബാധ്യത ഉ−ാവുകയാണെങ്കിൽ അത് കരാറുകാരൻ തന്നെ വഹിക്കേ−താണ്.

(ഇ) കരാർ വ്യവസ്ഥകളോ കേരള വനം നിയമവും അതുമായി ബന്ധപ്പെട്ട മറ്റ് നിയമങ്ങളോ ലംഘിക്കുക യാണെങ്കിൽ ആയത് ലേലം ക്യാൻസൽ ചെയ്യുന്നതിനും കരാർ റദ്ദാക്കുന്നതിനും കാരണമാവുകയും കരാറുകാരൻ ഒടുക്കിയിട്ടുള്ള തുക ക−ുകെട്ടുന്നതിനും കാരണമായി തീരും.

23. കരാർ വ്യവസ്ഥകളുടെ ലംഘനം

(എ) കരാറുകാരൻ ഏതെങ്കിലും കരാർ വ്യവസ്ഥ ലംഘിക്കുകയും കേരള വനം വകുപ്പ് ആയത് മൂലം കരാർ റദ്ദാക്കാതിരിക്കുകയും ചെയ്താൽ ഓരോ വ്യവസ്ഥാ ലംഘനത്തിനും 1000 രൂപ വെച്ച് പിഴ ഈടാക്കുന്നതിന് ഡിവിഷണൽ ഫോറസ്റ്റ് ആഫീസർക്ക് അധികാരമു−ായിരിക്കും. അപ്രകാരം കരാർ വ്യവസ്ഥകളുടെ ലംഘനം കണക്കാക്കുമ്പോൾ ലേലം ചെയ്ത യൂണിറ്റ് 1 യൂണിറ്റായി കണക്കാക്കു ന്നതാണ്. ഇതിനെതിരെയുള്ള അപ്പീലുകൾ പരിഗണിക്കുന്നത് ഒലവക്കോട് ഈസ്റ്റേൺ സർക്കിൾ ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റരിൽ നിക്ഷിപ്തമായിരിക്കുകയും അദ്ദേഹത്തിന്റെ തീരുമാനം അന്തിമവും പാലിക്കുവാൻ ബാധ്യസ്ഥവുമായിരിക്കും. കരാർ ലംഘനം സംബന്ധിച്ച് പിഴ ഈടാക്കുന്നതിനുള്ള ഉത്തരവ് നേരിട്ടോ രജിസ്ട്രേഡ് കത്ത് മുഖേനയോ ഡെസ്പാച്ച്ചെയ്ത് 15 ദിവസത്തിനുള്ളിൽ അപ്പീൽ പരിഗണിക്കേ−താണ്. മതിയായ കാരണങ്ങൾ ഉ−െങ്കിൽ കാലതാമസം മാപ്പാക്കുന്നതിന് ചീഫ് ഫോറസ്റ്റ് കൺസർവേറ്റർക്ക് വിവേചനാധികാരം ഉ−ായിരിക്കുന്നതാണ്.

(ബി) രജിസ്ട്രേഡ് കത്ത് മുഖേനയോ നേരിട്ടോ പിഴ ഒടുക്കുന്നതിനുള്ള നോട്ടീസ് കൈപ്പറ്റ് 15 ദിവസത്തിനുള്ളിൽ കരാറുകാരൻ പിഴ ഒടുക്കേ−താണ്.

24. മുൻകൂട്ടി കാണാനാകാത്ത സാഹചര്യങ്ങൾ

കേരള വനം വകുപ്പിന്റെ നിയന്ത്രണത്തിന് അതീതമായ കാരണങ്ങളാൽ ലേലത്തിൽ നിന്നും പിൻമാറേ−ി വന്നാലോ കരാർ അസാധുവാക്കേ−ി വന്നാലോ അത് മുലം കരാറുകാരന് ഉ−ാകുന്ന നഷ്ടം നികത്തുന്നതിന് വനം വകുപ്പിന് ബാധ്യത ഉ−ായിരിക്കുന്നതല്ല.

25. കോടതിയുടെ അധികാര പരിധി

(എ) കരാറുമായി ബന്ധപ്പെട്ട എന്തെങ്കിലും തർക്കങ്ങൾ ഉ−ാവുകയാണെങ്കിൽ അത് ആലത്തൂർ / നെല്ലിയാമ്പതി റെയിഞ്ച് ഏരിയകളിൽ വെച്ച് ഉ−ായ തർക്കമായി പരിഗണിക്കുന്നതും അതുമൂലമു−ാകാവുന്ന കേസ്സുകൾ ആലത്തൂർ മുൻസിഫ് കോടതിയുടെ പരിധിയിൽ വരുന്നതുമായിരിക്കും.

(ബി) കരാറുമായി ബന്ധപ്പെട്ട വ്യവസ്ഥകൾ വ്യാഖ്യാനം ചെയ്യുന്നതിനുള്ള അധികാരി കേരള വനം വകുപ്പ് ആയിരിക്കുകയും വനം വകുപ്പിന്റെ തീരുമാനം അന്തിമവും കരാറുകാരന് ബാധകമായിരിക്കുന്നതുമാണ്.

It is hereby notified for the information of the public that the right of collection and removal of marked Acacia auriculiformis, Eucalyptus (Hybrid),Cashew and Misc. trees with or without bark by way of out-right sale specified in the schedule appended below will be sold in e-auction on 13.01.2025 at 1.30 PM subject to the terms and conditions of sale of Timber in Government Timber Depots published in Government Gazette No: 43 Vol. V dated 01.11.2016 vide Notification No. Pro (4) 26243/13 dated: 26.09.2016 of the Addl. Principal Chief Conservator of Forests (Protection) Thiruvananthapuram, subject to the conditions published by M/s MSTC Ltd through website www.mstcecommerce.com and as per general conditions of the sale of tree growth prevailing in the Department and also subject to the following conditions. The participants of e-auction should remit Earnest Money Deposit through e- payment /e treasury before the conduct of e-auction. The participants should also put their Registration Number while effecting EMD payment. E-AUCTION SCHEDULE

E-auction Conditions

1. General Conditions

a) The e-auction will be conducted on the basis of rate quoted as per the statement attached as Annexure. The bid shall be fixed for the bidder who quote highest rate with bark. The cost of felling, conversion, transportation and stacking shall be borne by the bidder.

b) The successful bidder/purchaser shall extract all marked trees from plantations allotted (hereinafter referred to as Timber & Firewood) and shall retain all other trees.

c) Intending bidders may inspect the plantations and satisfy themselves with the area of plantation, quantity and quality of the produce before participating in the e-auction. Complaints if any regarding quality and quantity etc. received after the e-auction will not be entertained.

d) The Kerala Forest Department (Nemmara Forest Division) reserves the right to refrain from permitting harvesting and the removal from any particular plantations or unit, fully or partly thereof, depending upon the Administrative and operational exigencies and in the interest of Kerala Forest Department (Kerala Government) not withstanding such units is allotted and agreed to be supplied to the purchaser.

e) Intending bidders should produce a certified copy of Aadhar or a certificate from the concerned Village officer showing their permanent address and duly attesting their signature for individual and a certified copy of registration or license for firms along with earnest money deposit through online.

f) The participating bidders have the rights only for collection and removal of marked standing trees with in the specified area handed over by the ForestThis is a digitally signed Gazette. Authenticity may be verified through https://compose.kerala.gov.in/

Department officials, and will not have any right for removal of any other tree species standing in the plantation.

g) The successful bidders should give an undertaking that he is not related to any officer having control of the work. If this is proved otherwise it shall result in cancellation of the contract and resale of the coupe at the risk and loss of bidder/purchaser.

h) No post offer is permitted in the e-auction.

i) 2. Earnest Money Deposit

Intending Bidders should deposit an Earnest Money Deposit (EMD) of Rs. 25,000/- (Rupees Twenty five Thousand only) for participating in the e- auction. The participants of e-auction should remit Earnest Money Deposit through e-payment / e treasury before the conduct of e-auction. The participants should also put their Registration Number while effecting EMD payment.

3. GST, Income Tax etc.

a) The successful bidders have to pay FDT (Forest Development Tax), GST, Income Tax, and all other relevant taxes and charges at the rate prevailing from time to time.

b) The Purchaser shall pay all the GST amounts due to the auction and the purchaser will be liable for the payment of GST in new tariff if any amendments occurred from time to time.

c) The purchaser should pay stamp duty as per Indian Stamp Act. The deficit/ insufficient payment of stamp value, if any found at a later date, will be recoverable from the purchaser by Kerala Forest Department for onward transmission to the concerned Authority.

4. Agreement

The successful bidder shall execute an agreement on a stamp paper worth 0.1% of the total value after remitting the Total Sale value and 5% of Security Deposit within 14 days from the date of intimation of confirmation. The security deposit shall be in the form of fixed deposit pledged in favour of the Divisional Forest Officer, Nemmara from any District/Sub Treasury/Bank. The bidder will be permitted to commence the work and transport the yield collected from the plantations only after the above payment and execution of agreement.

5. Procedure for Payment of total sale value

The successful bidder has to pay the 35% of total sale value along with

FDT and GST within 7 days from the date of intimation of confirmation of the e-

auction and balance 65% of total sale value within 40 days from the date of

intimation of confirmation of the e-auction. In the case of failure to remit the total

sale value within 40 days, extension for 30 days shall be granted by the DFO, Nemmara subject to the realization of the 12% penal interest for total sale value. In the case of failure to remit the amount within the extended period, further extension of 30 days shall be granted by the Chief Conservator of Forests, Eastern Circle, Palakkad subject to the realization of 18% penal interest for total sale value. Failing this the bid shall be cancelled and all the money including the EMD remitted by the bidder will be forfeited to the Government. If the purchaser fails in getting extension as described above, the contract will be cancelled.

6. Contract Period

a) The period of contract will be 120 days from the date of intimation of confirmation or 31.05.2025 whichever is earlier. No extension of period of contract shall be granted on ordinary ground. Under very special circumstances, for good and sufficient reasons, the Divisional Forest Officer,Nemmara may grant extension of time for 30 days on realization of penalty for completion of the work @ Rs. 2500/Ha and the Chief Conservator of Forests, Eastern Circle, Palakkad may grant further extension of time for 30 days on realization of penalty for completion of the work @ Rs. 5000/Ha No more extension will be allowed.

i. If the bidder fails to remove the entire produce within the above extended period, the whole items collected by the bidder as per the agreement will be forfeited to government and the bidder shall not have any right on the produce confiscated to Government.

ii. In the above circumstances the balance work to be executed by the bidder shall be completed by other means and all the loss sustained to Government in this regard shall be realized from the bidder through legal means including Revenue Recovery Act in force.

b) The purchaser should declare the final destination of extracted items under the contract. In case of any deviation or if the purchaser wants to stock the same at an intermediate depot/s he shall furnish the details of the same to the Divisional Forest Officer, Nemmara.

7. Security Deposit

a) The successful bidder shall remit Security Deposit of 5% of total sale value within 14 days from the date of intimation of confirmation. The security deposit will be refunded only after the successful completion of contract after producing the clearance certificates of GST, Income Tax, etc. If there is any liabilities outstanding in this respect to the Government that will be adjusted from the security deposit of the contractor.

b) All the conditions in respect of Sale Coupes will also be applicable for this auction.

8. General conditions to be observed during extraction

a) The purchaser shall not assign or transfer the allotted plantations to any other person or party.

b) The Purchaser shall not enter or send their men into the area assigned for extraction without obtaining a licence from the Divisional Forest Officer, Nemmara and without written permission from Range Forest Officer, Alathur/Nelliyampathy.

c) The Purchaser shall keep the boundaries of the contract area well cleared of undergrowth and shrub to a width of 2 meters and keep the cairns and the boundary stones intact. If the Purchaser fails to do so the work, the same will be done by Kerala Forest Department and cost thereof will be recovered from the Purchaser in addition to any loss or damages as assessed by the Divisional Forest Officer, Nemmara after giving notice to the Purchaser.

d) A duly authorized agent of the purchaser shall be present at all the times in the contract area. Purchaser may employ an agent or agents to assist them in the work but no such agent shall be considered as duly authorized agent unless his name, residence and a specimen of his signature have been submitted to the Divisional Forest Officer and approved by him. Divisional Forest Officer reserves to himself the power to object to any of those men appointed as such, by the Purchaser on sufficient grounds. The Purchaser shall not engage as their agent or workmen or any person blacklisted by the Kerala Forest Department or Government.

e) The Purchaser shall provide each of their agents and workmen with a written authorization which should show his name, age, present residential address and period for which it is valid. The authorization must always be produced in the contract area when demanded by any Kerala Forest Department officials or Police officials.

f) The Purchaser, their agent and workmen shall comply with the orders and instructions issued by the authorized officers of Kerala Forest Department including Beat Forest Officers, Section Forest Officers, Deputy Range Forest Officers, Range Forest Officers and Divisional Forest Officer from time to time in the matter of collection and removal of produce under the contract.

g) The Purchaser, their agents and workmen employed by them in the contract area are bound to fire protect the entire contract area specified in the schedule and to ensure that, no fire escapes from the contract area to the adjoining areas.

h) If any fire occurs in the adjacent forest area the Purchaser, their agents and workmen shall render necessary assistance and use their best efforts to extinguish the fire and they shall in all cases give immediate notice of the occurrence of the fire to nearest Forest, Police or Revenue Officer and to the nearest Officer of Kerala Forest Department.

i) The Purchaser shall be liable for any loss caused to the produce collected by them by the way of fire, theft or any other means caused due to any action or omission by purchaser's officials or their agents. Purchaser may insure the produce collected by them from the allotted area against fire, theft or any other loss as per the Rules governing the insurance of goods and shall pay to the Kerala ForestThis is a digitally signed Gazette. Department the value of any such produce lost due to fire, theft or any other means.

j) The Purchaser, their agent and workmen shall abide by the Kerala Forest Act, Wildlife Protection Act and other enactments relating to protection and conservation of forest and Bio-diversity therein as well as Rules made there under and shall assist officers of Kerala Forest Department and Police Officers in preventing commission of any offence or in detecting such offences within or in the vicinity of the contract area. Purchaser or their authorized agents or their workmen shall not indulge in felling or causing damage to any other trees other than marked Acacia auriculiformis as the case may be from the working area allotted to them. If any such actions are committed the contract shall be liable to be cancelled and suitable compensation as assessed by the competent authority shall be recovered from them. Further they shall be dealt with as per the provisions under Kerala Forest Act and Rules. They shall not knowingly give any shelter within the contract area to any person who has committed any criminal offence.

k) The Purchaser will be liable for any damage or loss caused to other trees in the plantation or reserve. The Purchaser shall be fully responsible for all the acts or commissions and omissions of themselves, their agents and of all the persons authorized or employed by them to cut, collect, store and transport the Pulpwood under the contract.

l) The Divisional Forest Officer will give permission to keep the billets outside the coupe if requested by the contractor at his risk.

m) The contractor will be liable for all the illegal activities occurred within 100 m perimeter of the coupe. Any such activities noticed will be reported to the forest officials by the contractor, otherwise the contract will be cancelled.

9. Felling Rules

a) The trees should be felled by following the below furnished Rules.

i. The contract area shall be divided into blocks of approximately 10.00 Ha extent to confine felling and transporting operations to one block at a time.

ii. The felling shall be done in such a manner that no damage is caused to other forest growth standing in the contract area. When felling trees standing near public roads or thorough fares, red flags with warning notice shall be put up at places on either side of such roads at least one hectometer away from the felling point. Trees falling across the roads must be removed and obstruction cleared immediately.

iii. Purchaser shall cut, collect, and remove the items from the contract area in accordance with the following felling rules.

(a) Felling shall be commenced from the top of the slope or areas farthest from the extraction path and shall proceed in a systematic fashion.

(b) Felling shall be done with a sharp instrument and tree shall be cut as near to the ground as possible, stumps being not more than 15 cm in height.

(c) Billeting should be done by saws.

(d) Any negligence on the part of the purchaser/his workmen will entail penalty and the loss sustained by the Kerala Forest Department will be made good from the Purchaser.

11. Transportation of Pulpwood

The Purchaser would transport the items to the destination of the Purchaser at his own cost and arrangements. The produce shall be transported by purchaser or their duly approved agent only under the cover of passes issued by Kerala Forest Department as stipulated in Kerala Forest Produce Transit Rules. Passes will be issued by Kerala Forest Department. Purchaser shall transport the produce only along the routes approved by the Divisional Forest Officer in accordance with KFPT Rules as well as provisions of Motor Vehicles Act and Rules made there under.

12. Issue of transit permit

a) Divisional Forest Officer in whose jurisdiction the produce is delivered shall arrange for the issue of transit permit for transport of the produce to the Purchaser's specified final destination in Form-III white/ III Red as the case may be on payment of the cost of passes as per Rules.

b) Where the produce is to be transported to intermediate dumping sites within the plantation area itself the concerned Range Officer/Divisional Forest Officer will issue the required Form-V permits to the Purchaser for transportation of the produce from collection site to dumping site on payment of cost of passes.

c) If the quantity of items released after check measurement could not be transported by the Purchaser to final destination within the state in a single consignment, then necessary Form VI (Yellow) Subsidiary Passes will be issued on demand by the Purchaser after realizing the cost of passes thereof.

d) The account for use of such permits shall be maintained by the purchasers and shall be produced to the concerned Divisional Forest Officer on fortnightly basis.

e) The transportation shall be done on the route or routes prescribed by the concerned Range Forest Officer up to the intermediate depot or final destination as the case may be.

f) No transportation will be allowed from the contract area during night time between 6 pm and 6 am.

13. Delay in Transportation- Imposing fine for extension of transit passes

18. Of Income Tax and Payment thereon

a) In order to claim exemption from paying Income Tax under the provisions of Income Tax Act, 1961 and the rules made there under the amendments made from time to time, the purchaser shall furnish a self declaration of 'Form -27C' to the concerned Divisional Forest Officer, before raising the invoice for allotted Pulpwood quantities.

b) If the Purchaser does not furnish the above declaration, he shall pay income tax as provided in section 06-C of the Income Tax Act along with the sale price.

19. Purchaser responsible for receiving notices for payment

The purchaser shall make his own arrangements to receive the notice/invoices for payments and other communications in person or through his authorized agent and shall furnish the correct postal address at which notices and other communications can be sent. If the same are received back unserved or undelivered, it will be construed that such notices or communications are deemed to have been served on the purchaser.

20. Events leading to cancellation of contract

a) In the event of failure on the part of the Purchaser to fulfill the conditions in the contract within the time limit prescribed, The Divisional Forest Officer may cancel the allotment and forfeit all the amounts paid by the Purchaser including the security deposit, duly reverting/confiscating the material released from the plantations at site. This will be informed to the Purchaser through registered letter under acknowledgement.

b) Purchaser shall be responsible for any illicit felling or removal or trees or other produce or hunting of any wild animal within 100 m of the contract area. Unless otherwise proved, to the satisfaction of the Divisional Forest Officer such illicit felling or hunting may render this contract liable to be cancelled in addition to forfeiture of all amounts paid by the purchaser and of all stock of produce collected under the contract but not removed from the area.

c) On cancellation of the agreement the unit will be re-auctioned or disposed otherwise at the risk and loss of the Purchaser. When the unit is so re-auctioned or disposedThis is a digitally signed Gazette. Authenticity may be verified through https://compose.kerala.gov.in/

whatever best amount is offered may be accepted irrespective of the original value of the unit auctioned. The balance amount due to Kerala Forest Department if any will be recovered from the Purchaser but who will not be entitled to any excess amount if obtained by such disposal. In such a case the decrease in the volume/weight ratio of the material already extracted, if any, will also be treated as a loss to Kerala Forest Department and is recoverable from the Purchaser.

d) If the value fetched in the re-auction is less than that obtained in the original auction the difference between them together with all incidental expenditure for fixing up of the auction including notification charges as assessed by the Divisional Forest Officer concerned will be recovered from the defaulting bidder through legal means including Revenue Recovery Act in force. If the value fetched in the re auction is more than that obtained in the original auction, the first bidder will not be eligible for any claim due to this.

21. Indemnity for any loss or damage

(a) The purchaser shall not be entitled to claim any compensation whatsoever in case the Kerala Forest Department is not able to supply of extracted produce from the said unit due to unforeseen circumstances like floods, cyclone, tempest, disease, pest, drought or any other natural calamities.

(b) The Kerala Forest Department will not be responsible for any loss or damage that may be caused to the produce sold to the purchaser as a result of fire, floods, theft or any other calamity.

(c) Where the material is stocked in the plantation sites/temporary dumping yard, the Purchaser shall make his own arrangement to safeguard the produce in an appropriate manner besides insuring the same against any calamities.

22. Observance of Acts and Rules

(a) The Purchaser shall at all times abide by the provisions of Kerala Forest Act 1961 as amended from time to time and Rules made there under:

(b) The provisions of GST as amended from time to time shall apply to this auction on confirmation and the Purchaser shall abide by the provisions of GST Rules.

(c) The provisions of Indian Income Tax and other Central/State Acts as applicable to the auction shall apply to the auction on the confirmation and the Purchaser shall abide by the provisions of these Acts and Rules.

(d) Liabilities under the workmen's compensation Act and other Acts and Rules relating to the workers engaged by the Purchaser/his agents shall be borne by the Purchaser.

(e) Any infringement of contract conditions and provisions of relevant acts (Kerala Forest Act & Other related Acts) and Rules made there under as amended from time to time will entail cancellation of auction, termination of agreement and forfeiture of the amounts already paid and confiscation of produce in the unit.

23. Breach of conditions of agreement

(a) If the Purchaser commits a breach of any of the terms and conditions of contract and if the Kerala Forest Department does not propose to terminate the contract on account thereof, the Divisional Forest Officer may impose a penalty of Rs. 1000/- for each such breach. For computation of the breach of the terms and conditions of the contract the auctioned unit will be taken as one unit. An appeal against such orders shall lie with the Chief Conservator of Forests, Eastern Circle, Palakkad whose decision shall be final and binding. However, such an appeal should be preferred within 15 days from the date of dispatch of the order imposing penalty, by registered post or in person. The Chief Conservator of Forests, Eastern Circle, Palakkad may condone the delay in preferring the appeals at his discretion for valid reasons.

(b) Penalties levied shall be paid by the Purchaser within 15 days of dispatch by Registered Post or the notice of demand for payment. In case of failure such amount shall be recovered from the security deposit with 15% interest from the due date.

24. Force-Majeure

The Kerala Forest Department may revoke the contract and withdraw from the compliance of the sale in the event of circumstances beyond its control and in such an event it shall not be liable for any damage or loss, if any, caused to the Purchaser.

25. Jurisdiction of Court

a) All disputes arising out of or anyway connected with the contract shall be deemed to have arisen in Alathur / Nelliyampathy Range areas and within the jurisdiction of Munsiff Court, Alathur which court shall determine such disputes.

b) Kerala Forest Department shall be the authority to interpret all or any of the conditions laid down within the contract and their decision shall be final and binding on Purchaser.

9. കേേം സ്ഥിരലപ്പടുേിയ വിവരം കേേം ലോണ്ട ആളിലന അറിയിക്കുന്ന ീയ ി മു ല് 15 ്ിവസേിനേം ബാക്കി മുഴുവന് കേേത്തുേയും നിയമാനുസൃ മായ നികു ിേളും കേേത്തുേയുലട 10% വരന്ന ലസേൂരിറ്റി തുേയും കുറഞ്ഞ ് 500/- രൂപ അടച്ച് മുഴുവന് തുേയ്ക്കുള്ള കസാള്ക്വന്സി സർട്ടി ിക്കറ്റ് ഹാജരാക്കി 200/- രൂപയുലട മുദ്രപത്രേില് നിേവിലുള്ള വയവസ്ഥേള്ക്ക്ക് വികധയമായി ഉടമ്പടി ഒപ്പ് ലവകക്കണ്ട ാണ്.

10. ക്ക ായ ോരണമുലണ്ടങ്കില് 15 ്ിവസേിനേം പ്രസ്തു തുേേള്ക് അടയ്ക്കുന്ന ിനും േരാർ ഒപ്പ് ലവക്കുന്ന ിനും സാധിക്കാല വന്നാല് ആയ ിന് 18% പേിേകയാടു കൂടി 15 ്ിവസം കൂടി ഡിവിഷണല് ക ാറസ്റ്റ് ഓ ീസർക്ക് അനുവ്ിക്കാവന്ന ാണ്.

14. കേേം സ്ഥിരലപ്പടുേിയ വിവരം കേേം ലോണ്ടയാളിലന അറിയിക്കുേയും, ടിയാന് കേേത്തുേ അടക്കുേയും ലെയ്ത ിനു കേഷം േശുവണ്ടി കേഖരണം ടിയാന് നടോ ിരിക്കുേകയാ, ടിയാന് നടോന് സാധിക്കാ ിരിക്കുേകയാ ലെയ്താല് അടച്ച കേേത്തുേ ടിയാന് ിരിച്ചു േഭിക്കുന്ന ിനും ഏല ങ്കിലും രേിലുള്ള നടപരിഹാരം േഭിക്കുന്ന ിനും യാല ാരവിധ അവോേവമുണ്ടായിരിക്കുന്ന ല്ല.

15. കേേേില് വിജയിക്കുന്ന ആള്ക് 09.03.1976ലേ കേരള സർക്കാർ സറ്റില് പരസയലപ്പടുേിയ 23.02.1976ലേ ജി.ഒ(പി) 62/76/എഡി നമ്പർ ഉേരവിലേ വയവസ്ഥേള്ക് അനുസരികക്കണ്ട ാണ്.

16. കേേം ലോണ്ട ആള്ക് േരാറില് ഒപ്പ ലവച്ച കേഷം കേഖരിക്കുന്ന േശുവണ്ടി മുഴുവന് 1976 ലേ കേരള അസംസ്കൃ േശുവണ്ടി (വി രണവം വിപണനവം) ഉേരവ് പ്രോരം കേരള വണ്ലമെ് േശുവണ്ടി കുേേ സംഭരണേിനും അ ാ ് ോേേ് നിശ്ചയിക്കുന്നതും ഏജന്സിക്കും സർക്കാർ അകപ്പാള്ക് നിശ്ചയിക്കുന്ന വിേ നിരക്ക് അനുസരിച്ച് വില്കക്കണ്ട ാണ്.

17. കനഴ്സറിേള്ക് ഉണ്ടാക്കുന്ന ിന് ആവേയമുള്ള പക്ഷം േശുമാവ് ക ാട്ടങ്ങളില് നിന്ന് നല്ല രം േശുവണ്ടി വിത്തുേള്ക് അം ീകൃ വിേ നല്േി ല രലഞ്ഞടുക്കുന്ന ിനുള്ള അവോേം വനംവകുപ്പിന് ഉണ്ടായിരിക്കും.

18. േരാർ ോേയളവില് എല്ലായ്കപ്പാഴും േശുമാവേള്ക്ക്ക് ചുറ്റുമുള്ള ോടുേള്ക് 5 മീറ്റർ ചുറ്റളവില് േരാറുോരന് ലന്ന ലവട്ടി നീക്കം ലെയ്തിരിക്കണം. ക ാട്ടേില് യാല ാര ോരണവോലും േളപിടിക്കാല കനാക്കി സംരക്ഷികക്കണ്ട ് േരാറുോരലെ ചുമ േയാണ്. ോട്ടു ീ മൂേകമാ ഉണക്കു മൂേകമാ മറ്റു വല്ല വിധേിലുള്ള ോരണങ്ങളിെയലടകയാ എലന്തങ്കിലും നടം കനരിട്ടാല് ആയ ിന് യാല ാരവിധ നടപരിഹാരേിനും േരാറുോരന് അവോേം ഉണ്ടായിരിക്കുന്ന ല്ല.

19. ഡിവിഷണല് ക ാറസ്റ്റ് ഓ ീസറുലട കരഖാമൂേമുള്ള അനുവാ്ം കൂടാല പാട്ടേിലനടുേ സ്ഥേം മലറ്റാരാള്ക്ക്ക് കേമാറ്റം ലെയ്യുവാകനാ സ്ഥേം മുഴുവനാകയാ ഭാ ീേമാകയാ ഏല്പ്പിച്ചുലോടുക്കുവാകനാ പാടുള്ള ല്ല. അങ്ങലന നല്ോനുള്ള അകപക്ഷ യാല ാര ോരണവം ോണിക്കാല ള്ളാനുള്ള അധിോരം ഡിവിഷണല് ക ാറസ്റ്റ് ഓ ീസർക്ക് ഉണ്ടായിരിക്കും.

24. ഉല്പ്പന്നങ്ങള്ക് പാട്ടസ്ഥേത്തു നിന്നം നീക്കം ലെയ്യുന്ന ിന് ആവേയമായ പാസ്സ് ഡിപ്പാർട്ടുലമെില് നിന്നം നല്കുന്ന ായിരിക്കും. കേഖരിക്കുന്ന ഉല്പ്പന്നേിലെ അളവ് േരാറുോരന് നല്കുന്ന ് മാസാന്തയ േണക്കുേളില് ോണിക്കുന്ന ് ഡിപ്പാർട്ട്ലമെില് നല്കുന്ന പാസ്സുേളുമായി ബന്ധലപ്പട്ട ായിരിക്കണം. പാട്ടസ്ഥേേിന് ു‍റലമയുള്ള വനങ്ങളില് നിന്നം ഉല്പ്പന്നങ്ങള്ക് കേഖരിക്കുവാന് േരാറുോരലന അനുവ്ിക്കുന്ന ല്ല.

േരാർ സ്ഥേത്തു നിന്നം സാധനങ്ങള്ക് രാവിലേ 6 മണി മു ല് കവകുകന്നലര 6 മണി വലര മാത്രകമ നീക്കം ലെയാന് അനുവ്ിക്കുേയുള്ളൂ.

25. നിയമാനുസൃ മായി കേേേിന് കേഷം നല്കുന്ന വാഗ്ദാനങ്ങള്ക് വല്ലതും ഉലണ്ടങ്കില് അവ സവീേരിച്ച് നിയമാനുസൃ മായ നടപടിേള്ക് അ ിന്കമല് കേലക്കാള്ളുന്ന ായിരിക്കും.

a) കേേ സംഖയ 1 േക്ഷം രൂപകയാ അ ില് കൂടു കോ ആലണങ്കില് വാഗ്ദാന സംഖയ കേേ സംഖയയുലട 10% കേക്കാള്ക് കുറയാന് പാടില്ല.

b) കേേ സംഖയ 1 േക്ഷം രൂപകയക്കാള്ക് കുറവാലണങ്കില് വാഗ്ദാന സംഖയ കേേ സംഖയയുലട 20% േില് കുറയാന് പാടില്ല.
