(അച്ചടി) നമ്പർ 2/2020/വ്യവ. ഉത്തരവു്രപാേരം പുറലപ്പടുവിച്ചതും 2020 ജനുവരി 6-ം തീയതിയില െ 43-ം നമ്പർ കരേള അസാധാരണ ഗസറ്റിൽ
2എസ്.ആർ.ഒ. നമ്പർ 12/2020 ആയി ്രപസിദ്ധീരേിച്ചതുമായ 2020-ച െ കരേള സൂ്േഷ്മ- ചചറുിേട-ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങളും ഇതര വ്യവസായ സ്ഥാപനങ്ങളും സുഗമമാക്കൽ ചട്ടങ്ങൾ വീണ്ടും കഭദഗതി ചചയ്യുന്നതിനായി കരേള സർക്കാർ, ഇതിനാൽ, താലഴപ്പറയുന്ന ചട്ടങ്ങൾ ഉണ്ടാക്കുന്നു, അതായത്:—
ചട്ടങ്ങൾ
1. ചുരുക്കകപ്പരും ്രപാരംഭവും.—(1) ഈ ചട്ടങ്ങൾക്ക് 2024-ച െ കരേള സൂ്േഷ്മ- ചചറുിേട-ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങളും ഇതര വ്യവസായ സ്ഥാപനങ്ങളും സുഗമമാക്കൽ (കഭദഗതി) ചട്ടങ്ങൾ എന്ന് കപര് പറയാം.
(2) ഇവ ഉടൻ ്രപാബ്െയത്തിൽ വരുന്നതാണ്.
2. ചട്ടങ്ങളുലട കഭദഗതി.—2020-ച െകരേള സൂ്േഷ്മ-ചചറുിേട-ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങളും ഇതര വ്യവസായ സ്ഥാപനങ്ങളും സുഗമമാക്കൽ ചട്ടങ്ങളിൽ,—
(1) "ൈപ്പേറ്റ് സാ്േഷ്യര്രതം" എന്ന വാക്ക് വരുന്നിടലത്തല്ലാം അതിന് പരേം "തത്വത്തിബ്ലുള്ള അംഗീാേര സാ്േഷ്യര്രതം" എന്ന വാക്ക് തദനുസൃതമായി കചർകക്കണ്ടതാണ്.
(2) 2-ം ചട്ടം (1)-ം ഉപചട്ടത്തില െ (സി) ഖണ്ഡത്തിനുകശഷം, താലഴപ്പറയുന്ന ഖണ്ഡം കചർകക്കണ്ടതാണ്, അതായത്:—
(ഡി) "പദ്ധതിലചവെ്" എന്നതിൽ പദ്ധതിക്കുള്ള ഭൂമി, ചട്ടേിടം, പ്ലാൻ്റും ചമഷിനറിയും, പവെ േ വസ്തുക്കൾ എന്നിവയുലട മൂ്െയം, യാദൃശ്ചി േ ചചവെുൾേ, ്രപാരംഭത്തികാെ തുടങ്ങുന്നതിന് മുൻകപാ ഉള്ള ചചവെുൾേ, ്രപവർത്തന മൂധെനത്തിനുകവണ്ട മാർജിനൽ മണി എന്നിവ ഉൾചപ്പടുന്നതാുേന്നു".
(3) 3(എ) ചട്ടത്തിൽ "ക്രപാജക്ട് കാേസ്റ്റിലൻ്റ" എന്ന വാക്കിനു പരേം "പദ്ധതിലചവെിലൻ്റ" എന്ന വാക്ക് കചർകക്കണ്ടതാണ്.
(4) 5-ം ചട്ടത്തിൽ "മൂന്ന് വർഷകത്തക്ക് " എന്ന വാക്കുൾേക്ക് പരേം, "മൂന്ന് വർഷവും ആറ് മാസ്വുമായ ാേയെളവികക്കെ് " എന്ന വാക്കുൾേ കചർകക്കണ്ടതാണ്.
3(5) ഫാറം -ൽ, ്രമേനമ്പർ (2)-ൽ "ബി" ഇനത്തിൽ, "മൂന്ന് വർഷകത്തക്ക് " എന്ന II
വാക്കുൾേക്ക് പരേം "മൂന്ന് വർഷവും ആറ് മാസ്വുമായ ാേയെളവികക്കെ് " എന്ന വാക്കുൾേ കചർകക്കണ്ടതാണ്.
(6) ഫാറം '1 ബി'-യ്ക്ക് താലഴയുള്ള "സാ്േഷ്യര്രതം" എന്ന ശീർഷത്തേിന് ീേഴില,െ ( )-ം ഇനത്തിൽ "ക്രപാജക്ടുളേുമായി" എന്ന വാക്കിനു പരേം V
"പദ്ധതിളേുമായി" എന്ന വാക്ക് കചർകക്കണ്ടതാണ്.

വിശദീരേണക്കുറിപ്പ്
(ഇത് വിജ്ഞാപനത്തിലൻ്റ ഭാഗമാുേന്നതല്ല. എന്നാൽ അതിലൻ്റ ചപാതു ഉകദ്ദശ്യം ചവളിലപ്പടുത്തുന്നതിന് ഉകദ്ദശിച്ചു ചാേണ്ടുള്ളതാുേന്നു.)
2020-ച െ കരേള സൂ്േഷ്മ-ചചറുിേട-ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങളും ഇതര വ്യവസായ സ്ഥാപനങ്ങളും സുഗമമാക്കൽ ചട്ടങ്ങൾ, 2020 ജനുവരി 6-ം തീയതിയില െ സ. ഉ. (അച്ചടി) നമ്പർ 2/2020/വ്യവ. ഉത്തരവ് ്രപാേരം പുറലപ്പടുവിക്കുയേും 2020 ജനുവരി 6-ം തീയതിയില െ 43-ം നമ്പർ കരേള അസാധാരണ ഗസറ്റിൽ എസ്.ആർ.ഒ.
നമ്പർ 12/2020 ആയി ്രപസിദ്ധീരേിക്കുയേും ചചയ്തു. വ്യവസായവും ധാതുക്കളും സംബന്ധിച്ച വിഷ്യനിർണ്ണയസമിതി ്രപസ്തുത ചട്ടങ്ങളിൽ "പദ്ധതിലചവെ്" എന്നതിന് നിർവ്വചനം നൽണേലമന്നും, പദ്ധതിലചവെിൽ എലന്താലക്കയാണ് ഉൾചപ്പടുന്നത് എന്നതിന് വ്യക്തത വരുത്തണലമന്നും ശുപാർശ ചചയ്തിരുന്നു. ൂേടാലത, 2019-ച െ കരേള സൂ്േഷ്മ, ചചറുിേട, ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങളും ഇതര വ്യവസായ സ്ഥാപനങ്ങളും സുഗമമാക്കൽ ആ്േറ്റിൽ വന്ന കഭദഗതിൾേക്കനുസരിച്ച് ആവശ്യമായ മാറ്റങ്ങൾ ചട്ടങ്ങളിൽ ഉൾചക്കാള്ളിക്കുന്നതിനുമായി ്രപസ്തുത ചട്ടം കഭദഗതി ചചയ്യുവാൻ സർക്കാർ തീരുമാനിച്ചു.
കമൽപ്പറഞ്ഞ ്െേഷ്യം നിറകവറ്റുന്നതിന് ഉകദ്ദശിച്ചുലാേണ്ടുള്ളതാണ് ഈ വിജ്ഞാപനം.

G. O. (P) No. 48/2024/ID. Dated, Thiruvananthapuram, 13th December, 2024 28th Vrischikam, 1200 S. R. O. No. 30/2025

In exercise of the powers conferred by section 14 of the Kerala Micro Small and Medium Enterprises and other Enterprises Facilitation Act, 2019 (16 of 2019), the Government of Kerala hereby make the following rules further to amend the Kerala Micro Small Medium Enterprises and Other Enterprises Facilitation Rules, 2020 issued by notification under G. O. (P) No. 2/2020/ID dated 6th January, 2020 and published as S.R.O. No.12/2020 in the Kerala Gazette Extraordinary No. 43 dated 6th January, 2020, namely:—
RULES
1. Short title and commencement.—(1) These rules may be called the Kerala Micro Small Medium Enterprises and Other Enterprises Facilitation (Amendment) Rules, 2024;
(2) They shall come into force at once.
2. Amendment of the Rules.—In the Kerala Micro Small Medium Enterprises and Other Enterprises Facilitation Rules, 2020,—
(1) wherever the words "acknowledgment certificate" occurs the words and symbol, "Certificate of in principal approval" shall be substituted according to its context.
(2) after clause (c) of sub-rule (1) of rule 2, the following clause shall be inserted, namely:—
"(d) "project cost" shall include the value of land, building, plant and machinery, miscellaneous articles, contingent expenses, commencement or post-operative expenses, and marginal money for working capital of the project".
(3) in rule 5, for the words "three years" the words "three years and six months" shall be substituted.
5(4) in form II in serial number 2, in item (b) for the words "three years" "three years and six months" shall be substituted.

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.) The Kerala Micro Small Medium Enterprises and Other Enterprises Facilitation Rules, 2020 was issued under G. O. (P) No. 2/2020/ID. dated 6th January, 2020 and published as S. R. O. No. 12/2020, in the Kerala Gazette Extraordinary No. 43 dated 6th January, 2020.
Subject Committee (Industries and Minerals) suggested to give definition to the term 'project cost' and also to specify what will be included in the project cost. The Government have decided to amend the said rules as suggested by the Subject Committee and also to incorporate necessary changes in the rules in accordance with the latest amendment to the Kerala Micro Small and Medium Enterprises and Other Enterprises Facilitation Act, 2019.
The notification is intended to achieve the above object.
