2024 ഡിസംബർ 19. വിഷയം: —കാസറഗോഡ് ജില്ല എക്സൈസ് എംπോയീസ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എസ്. 224—സമാപ്തീകരണം—ലിക്വിഡേറ്ററെ നിയമിച്ച് ഉത്തരവ് പുറപ്പെടുവിക്കുന്നത്—സംബന്ധിച്ച്.

സൂചന:—(1) കേരള സഹകരണ നിയമം 66-ാം വകുപ്പ് പ്രകാരം നിയമിതനായ അന്വേഷണ ഉദ്യോഗസ്ഥനായ കാസറഗോഡ് അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) ഓഫീസിലെ ചെമ്മനാട് യൂണിറ്റ് ഇൻസ്പെക്ടറുടെ 26-8-2023-ലെ 447/2023/സി നമ്പർ അന്വേ ഷണ റിപ്പോർട്ട്.

(2) ഈ ഓഫീസിലെ 12-7-2024-ലെ ഇതേ നമ്പർ നോട്ടീസ്.

(3) അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) കാസറഗോഡിന്റെ 26-10-2023-ലെ 1103/2022/ഒ എെ. നമ്പർ കത്ത്.

കാസറഗോഡ് ജില്ല എക്സൈസ് എംπോയീസ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എസ്. 224 17-11-1995-ൽ രജിസ്റ്റർ ചെയ്യുകയും 28-1-1996-ൽ പ്രവർത്തനം ആരംഭിക്കുകയും ചെയ്ത സംഘത്തിന്റെ പ്രവർത്തന പരിധി കാസറഗോഡ് ജില്ല മുഴുവനുമാണ്. മേൽ പറഞ്ഞ സംഘത്തിന്റെ ഭരണസമിതിയുടെ കാലാവധി അവസാനിച്ചതിനു ശേഷം 3 അംഗ അഡ്മിനിസ്ട്രേറ്റീവ് കമ്മിറ്റി ചാർ÷് എടുത്തിരുന്നെങ്കിലും ഭരണസമിതി തെരഞ്ഞെടുപ്പ് നടത്തുകയോ സംഘത്തിന്റെ പ്രവർത്തനം മെച്ചപ്പെടുത്തുകയോ ചെയ്തിരുന്നില്ല. തുടർന്നുള്ള കാലയളവിൽ സംഘത്തിൽ ഭരണസമിതിയോ അഡ്മിനിസ്ട്രേറ്റ് കമ്മിറ്റിയോ ചാർ÷െടുത്തിരുന്നില്ല.

സംഘം നിലവിൽ പ്രവർത്തനരഹിതമാണെന്നും നിയമാവലിയിൽ വ്യവസ്ഥ ചെയ്തിട്ടുള്ള പ്രവർത്തനങ്ങളൊന്നും തന്നെ ഏറ്റെടുത്ത് നടത്തിയിട്ടില്ലെന്നും സംഘത്തെ പുനരു÷ീവിപ്പിക്കുന്നതിന് യാതൊരു സാഹചര്യവും നിലവിലില്ല എന്നും സൂചന (1) അന്വേഷണത്തിൽ ബോധ്യപ്പെട്ടതായി അന്വേഷണ ഉദ്യോഗസ്ഥൻ റിപ്പോർട്ട് ചെയ്തിട്ടു≠്. സംഘത്തിന്റെ പ്രവർത്തനം പുനരു÷ീവിപ്പിക്കുന്നതിന് യാതൊരു സാഹചര്യവും നിലവിൽ ഇല്ലാത്തതിനാൽ കേരള സഹകരണ നിയമം വകുപ്പ് 71 പ്രകാരമുള്ള തുടർനടപടികൾ സ്വീകരിക്കാവുന്നതാണെന്ന് സൂചന (3) കത്ത് പ്രകാരം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ (ജനറൽ) കാസറഗോഡ് ശുപാർശ ചെയ്തിട്ടു≠്.

മേൽ സാഹചര്യത്തിൽ സംഘം പ്രവർത്തനം തുടർന്ന് കൊ≠ുപോകുന്നതിനുള്ള സാധ്യതയില്ലായെന്ന് ബോധ്യമാകയാൽ 1969-ലെ കേരള സഹകരണ നിയമം 71 (1) വകുപ്പ് അനുസരിച്ച് സംഘം സമാപ്തീകരിക്കാതിരിക്കുവാൻ വല്ല കാരണവും ബോധിപ്പിക്കുവാനു≠െങ്കിൽ ആയത് 7 ദിവസത്തിനകം രേഖാമൂലം ബോധിപ്പിക്കണമെന്നും അല്ലാത്തപക്ഷം മേൽ നടപടികൾ സ്വീകരിക്കുന്നതാണെന്നും കാണിച്ചുകൊ≠് സൂചന (2) പ്രകാരം സംഘത്തിന്റെ അവസാന ഭരണസമിതി അംഗങ്ങളായ അഡ്മിനിസ്ട്രേറ്റീവ് കമ്മിറ്റിയംഗങ്ങൾക്ക് നോട്ടീസ് നൽകിയിരുന്നു. ഇക്കാര്യത്തിൽ അഭിപ്രായം അറിയിക്കണമെന്ന് കാണിച്ചുകൊ≠് കേരള സംസ്ഥാന സഹകരണ ബാങ്ക്, സർക്കിൾ സഹകരണ യൂണിയൻ കാസറഗോഡ് എന്നിവർക്കും നോട്ടീസ് നൽകിയിരുന്നു. എന്നാൽ നി›ിത സമയപരിധി കഴിഞ്ഞിട്ടും ആരുംതന്നെ യാതൊരു ആക്ഷേപമോ അഭിപ്രായമോ അറിയിച്ചിട്ടില്ല. ഈ സാഹചര്യത്തിൽ 1969-ലെ കേരള സഹകരണ നിയമം 71 വകുപ്പ് അനുസരിച്ച് എന്നിൽ നിക്ഷിപ്തമായിരിക്കുന്ന അധികാരം ഉപയോഗിച്ച് താഴെ പറയുന്ന ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.

ഉത്തരവ്

1. കാസറഗോഡ് ജില്ല എക്സൈസ് എംπോയീസ് സഹകരണ സംഘം ക്ലിപ്തം നമ്പർ എസ്. 224 കേരള സഹകരണ നിയമം 71(1)-ാം വകുപ്പ് പ്രകാരം കാസറഗോഡ് സഹകരണ സംഘം അസിസ്റ്റന്റ ് രജിസ്ട്രാർ ഓഫീസിലെ ചെമ്മനാട് യൂണിറ്റ് ഇൻസ്പെക്ടറെ സംഘത്തിന്റെ ലിക്വിഡേറ്ററായി നിയമിച്ചുകൊ≠് ഉത്തരവാകുന്നു.

2. ലിക്വിഡേറ്റർ 72(2) വകുപ്പ് പ്രകാരം സംഘത്തിന്റെ എല്ലാ റിക്കാർഡുകളുടെയും ആസ്തികളുടെയും ചാർ÷് ഉടനെ ഏറ്റെടുക്കേ≠തും സംഘം പ്രവർത്തനം സമാപ്തീകരിക്കുന്നതിന് വേ≠ നടപടികൾ സ്വീകരിക്കേ≠തുമാണ്.
