In exercise of the powers conferred by section 33 read with sub-section (1) of section 9 of the Kerala Fishermen Welfare Societies Act, 1980 (Act 7 of 1981), the Government of Kerala hereby make the following rules further to amend the Kerala Fishermen Welfare Societies (Determination of Strength of Committees and Conduct of Election) Rules, 1980, issued under G.O. (P)No.12/81/TF&PD dated 11th January, 1981 and published as S.R.O.No.201/81 in the Kerala
2 notification issued under G.O.(P) No.24/2023/F&PD dated 9th January, 2023 and published as S.R.O.No.49/2023 in the Kerala Gazette Extraordinary No.105 dated 11th January, 2023, namely:-RULES
1. Short title and commencement :- (1) These rule may be called the Kerala Fishermen Welfare Societies (Determination of Strength of Committees and Conduct of Election) Amendment Rule, 2024
(2) It shall come into force at once.
2. Amendment of the Rules :- In the Kerala Fishermen Welfare Societies (Determination of Strength of Committees and Conduct of Election) Rules, 1980, clause (a) of sub-rule (1) of rule 6 shall be omitted.

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport).
The Kerala Fishermen Welfare Societies (Determination of Strength of Committees and Conduct of Election) Rules, 1980 was notified by the Government under G.O.(P)No.12/81/TF&PD dated 11th January 1981 and published in the Kerala Gazette Extraordinary No.125 dated 12th February, 1981. The Hon'ble Supreme Court of India in its judgment dated 5th July 2018 in W.P(C) No.1151/2017 held that 'the Union Government and State Government shall take steps with regard to the repeal of the provisions where leprosy has been treated as a stigmatic disability'. Hence, the Government have decided to amend the above said Rule and omit the words "or is a leper" from clause (a) of sub-rule (1) of Rule 6 of the above said Rule vide notification issued under G.O.(P)No.24/2023/F&PD dated 9th January, 2023 and published as S.R.O.No.49/2023 in the Kerala Gazette Extraordinary No.105 dated 11th January, 2023. Now the Government have intended to amend the said rule to remove the discrimination and disqualification meted by deaf, mute or blind for being elected or nominated as a member to the committee of the society. Hence the Government have decided to omit clause (a) of sub-rule (1) of Rule 6 of the said rule for the above said purpose.
