NOTIFICATION

G.O.(P)No.16/2025/P&ARD. Dated, Thiruvananthapuram, 28 th November 2025 S. R. O. No. 1348/2025

In exercise of the powers conferred by sub-section (1) of section 2 of the Kerala Public Services Act, 1968 (19 of 1968), read with section 3 thereof, the Government of Kerala hereby make the following rules further to amend the Kerala State and Subordinate Services Rules, 1958, namely:—

RULES

1. Short title and commencement.— (1) These rules may be called the Kerala State and Subordinate Services (3rd Amendment) Rules, 2025.

(2) They shall come into force at once.

2. Amendment of the Rules.— In Part II of the Kerala State and Subordinate Services Rules, 1958, after rule 28A, the following rule shall be added, namely:—

"28B. Notwithstanding anything contained in these Rules or in the Special Rules, the appointments by promotion or by transfer in the case of posts identified for Persons with Benchmark Disabilities shall be done in accordance with the guidelines issued by Government from time to time."

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport.) At present, there is no provision in the Kerala State and Subordinate Services Rules, 1958, for allowing reservation in promotion to the employees who are Persons with Benchmark Disabilities. But as per the proviso to Section 34(1) of the Rights of Persons with Disabilities Act, 2016, reservation in promotion shall be granted to the employees who are Persons with Benchmark Disabilities in accordance with such instructions as issued by appropriate Government from time to time. Consequently, the Government have issued G.O.(P)No.5/2022/SJD dated 15th July, 2022, for implementing reservation in promotion to the employees who are Persons with Benchmark Disabilities and again issued additional guidelines as per G.O.(P)No.6/2023/SJD dated 26th October, 2023, for the same category of employees in the State Government service. in the said order, to make necessary amendments in the Kerala State and Subordinate Services Rules, 1958, on the basis of the said guidelines. Hence, the Government have decided to amend rule 28 of Part II, Kerala State and Subordinate Services Rules, 1958, accordingly.

The notification is intended to achieve the above object.
