കമല്‍പറഞ്ഞ വവിജക്കാപനതവിലലെ 4-ാക്കാഗം ഖണവികേയവില്‍, "അന്‍പതവി നക്കാലെപ മക്കാസതവിനകേഗം" എന്ന വക്കാക്കുകേള്‍ക്കു പകേരഗം "അറുപതപ മക്കാസതവിനകേഗം" എന്ന വക്കാക്കുകേള്‍ കചേർകകണ്ടതക്കാണപ.

ലപക്കാതു പ്രക്കാധക്കാനഭ്യമുള്ള ഒരു നവിശവിത വവിഷയഗം, അതക്കായതപ, കകേരളതവില്‍ 2020 ജുലലെ മുതല്‍ വവിവവിധ കകേന്ദ്ര ഏജന്‍സവികേള്‍ നടതവി വരുന്ന അകനക്വഷണങ്ങള്‍ വഴവിമക്കാറുന്നതുമക്കായവി ബന്ധലപട്ട കേക്കാരഭ്യങ്ങള്‍ വസ്തുനവിഷ്ഠമക്കായവി പരവികശക്കാധവിചപ റവികപക്കാർട്ടപ സമർപവിക്കുന്നതവിനക്കായവി എസപ.ആർ.ഒ.389/2021-ാക്കാഗം നമർ വവിജക്കാപന പ്രകേക്കാരഗം നവിയമവിച ശമ്മീ.വവി.ലകേ.കമക്കാഹനന്‍ (റവിട്ട.ലഹകകക്കാടതവി ജഡപജവി) അകനക്വഷണ കേമമ്മീഷലന കേക്കാലെക്കാവധവി 2025 നവഗംബർ 06-നപ അവസക്കാനവിച്ചു. 1952-ലലെ കേമമ്മീഷന്‍സപ ഓഫപ ഇന്‍കേക്വയറവി ആകവിലലെ 3-ാക്കാഗം വകുപപ പ്രകേക്കാരമുള്ള അധവികേക്കാരഗം വവിനവികയക്കാഗവിചപ സഗംസക്കാന സർകക്കാർ പുറലപടുവവിച പ്രസ്തുത വവിജക്കാപനലത കചേക്കാദഭ്യഗം ലചേയ്തുലകേക്കാണ്ടപ എന്‍കഫക്കാഴപസപലമനപ ഡയറക്ടകററപ ബഹുമക്കാനലപട്ട കകേരള ലഹകകക്കാടതവി മുന്‍പക്കാലകേ WP(C) No.13112/ 2021 എന്ന ഹർജവി ഫയല്‍ ലചേയ്തു. 2021 ലമയപ 7-ാക്കാഗം തമ്മീയതവിയവിലലെ പ്രസ്തുത വവിജക്കാപനഗം നടപവിലെക്കാക്കുന്നതപ തടഞ്ഞുലകേക്കാണ്ടുഗം 1952-ലലെ കേമമ്മീഷന്‍സപ ഓഫപ ഇന്‍കേക്വയറവി ആകവിലലെ
3വവിവവിധ വകുപ്പുകേളവിന്‍ കേമ്മീഴവില്‍ എലന്തങവിലഗം അധവികേക്കാരഗം വവിനവികയക്കാഗവിക്കുന്നതവികനക്കാ അലലങവില്‍ എലന്തങവിലഗം നടപടവിലയടുക്കുന്നതവികനക്കാ അഞക്കാമലത എതവിർ കേകവിയക്കായ കേമമ്മീഷലന വവിലെകവിലകക്കാണ്ടപ പ്രസ്തുത കകേസവില്‍ ബഹുമക്കാനലപട്ട കകേരള ലഹകകക്കാടതവി 2021 ആഗസപ 11-നപ ഇടകക്കാലെ ഉതരവപ പുറലപടുവവിച്ചു.
ടവി ഉതരവവിലനതവിലര സഗംസക്കാന സർകക്കാർ ബഹു.കകേരള ലഹകകക്കാടതവിയവില്‍ ഒരു റവിട്ടപ അപമ്മീല്‍ (W.A. No.1532 of 2021) സമർപവിക്കുകേയഗം 26.09.2025-ലലെ വവിധവിനഭ്യക്കായപ്രകേക്കാരഗം WP(C) നമർ 13112/2021-ല്‍ സവിഗംഗവില്‍ ജഡപജവി പുറലപടുവവിച 11.08.2021-ലലെ ഇടകക്കാലെ ഉതരവപ ശരവിവച്ചുലകേക്കാണ്ടപ ബഹു.ലഹകകക്കാടതവിയലട ഡവിവവിഷന്‍ ലബഞപ പ്രസ്തുത റവിട്ടപ അപമ്മീല്‍ തള്ളുകേയഗം ലചേയവിരുന.
ബഹു.ലഹകകക്കാടതവിയലട ഡവിവവിഷന്‍ ലബഞവിലന W.A നമർ 1532/2021-ലലെ 26.09.2025-ലലെ വവിധവിലകതവിലര ബഹുമക്കാനലപട്ട സുപ്രമ്മീഗം കകേക്കാടതവിയവില്‍ ലസ്പെഷഭ്യല്‍ ലെമ്മീവപ ലപറമ്മീഷന്‍ സമർപവിക്കുവക്കാന്‍ കകേരള സർകക്കാർ തമ്മീരുമക്കാനവിക്കുകേയണ്ടക്കായവി. വവിജക്കാപനതവില്‍ നവിശയവിചവിട്ടുള്ള കേമമ്മീഷലന കേക്കാലെയളവപ 2025 നവഗംബർ 6-നു അവസക്കാനവിചതവിനക്കാല്‍ പ്രസ്തുത കേക്കാലെയളവപ ദമ്മീർഘവിപവിചപ നല്‍കകേണ്ടതുണ്ടപ. W.P.(C) No.13112/2021-ല്‍ ബഹു. കകേരള ലഹകകക്കാടതവി പുറലപടുവവിച ഇടകക്കാലെ ഉതരവവിലലെ നവിർകദ്ദേശങ്ങള്‍കപ വവികധയമക്കായഗം ബഹു. സുപ്രമ്മീഗം കകേക്കാടതവികപ മുമക്കാലകേ സമർപവിക്കുന്ന ലസ്പെഷഭ്യല്‍ ലെമ്മീവപ ലപറമ്മീഷലന തമ്മീർപവിനുഗം വവികധയമക്കായവി കേമമ്മീഷലന കേക്കാലെക്കാവധവി 2025 നവഗംബർ 07 മുതല്‍ ആറപ മക്കാസകതകപ കൂടവി നമ്മീട്ടുവക്കാനുഗം, അതവിനക്കായവി 2021 ലമയപ 7-ാക്കാഗം തമ്മീയതവിയവിലലെ ആഭഭ്യന്തരഗം-എസപഎസപഎ 2/67/2021- ആഭഭ്യന്തരഗം നമരക്കായവി പുറലപടുവവിചതുഗം, 2021 ലമയപ 7-ാക്കാഗം തമ്മീയതവിയവിലലെ 1562-ാക്കാഗം നമർ കകേരള അസക്കാധക്കാരണ ഗസറവില്‍ എസപ.ആർ.ഒ. നമർ 389/2021 ആയവി പ്രസവിദ്ധലപടുതവിയതുമക്കായ വവിജക്കാപനഗം കഭദഗതവി ലചേയ്യുവക്കാനുഗം സർകക്കാർ തമ്മീരുമക്കാനവിച്ചു.
കമല്‍പറഞ്ഞ ആവശഭ്യഗം നവിറകവറ്റുന്നതവിനു ഉകദ്ദേശവിച്ചുലകേക്കാണ്ടുള്ളതക്കാണപ ഈ വവിജക്കാപനഗം.

In exercise of the powers conferred by section 3 of the Commissions of Inquiry Act, 1952 (Central Act 60 of 1952) the Government of Kerala hereby make the following amendment to the notification issued under No.HomeSSA2/67/2021 Home dated 7th May, 2021 and published as S.R.O. No.389/2021 in the Kerala Gazette Extraordinary No.1562 dated 7th May, 2021 appointing Shri V.K.Mohanan [(Retired High Court Judge) Valiyaparambil House, House No. 7/252C, Thiruvathira, Ambadimukku, Kakkanad, Kochi20] as Commission of Inquiry to examine objectively into a definite matter of public importance, namely, the matters relating to the diversion of investigations conducted by various Central Agencies in Kerala from July 2020, and to submit a report in that regard namely:
AMENDMENT
In the above said notification, in the 4th paragraph, for the words "within fifty four months" the words "within sixty months" shall be substituted.

Explanatory Note
(This does not form the part of the notification, but is intended to indicate its general purport.)
The term of office of Shri V.K.Mohanan, (Rtd. High Court Judge) Commission of Inquiry appointed vide notification issued as S.R.O. No.389/2021, to examine
5objectively into a definite matter of public importance, namely, the matters relating to the diversion of investigations conducted by various Central Agencies in Kerala from July 2020, and to submit a report in this regard expired on 6 th November, 2025. The Enforcement Directorate had preferred WP(C) No.13112 of 2021, before the Hon'ble High Court of Kerala challenging the said notification, issued by the State Government in exercise of the powers under section 3 of the Commissions of Inquiry Act, 1952. The Hon'ble High Court of Kerala has granted an interim order on 11 th August, 2021 staying the operation of the said notification dated 7 th May, 2021 and restraining the 5th respondent Commission from exercising any power or taking any action under the provisions of the Commissions of Inquiry Act, 1952.
A Writ Appeal (W.A. No. 1532 of 2021) was preferred by the State before the Hon'ble High Court of Kerala against the order dated 11th August, 2021. And as per the judgment dated 26.09.2025, the division bench of the Hon'ble High Court has dismissed the Writ appeal, by affirming the interim order dated 11.08.2021 passed the Single Judge in WP(C) No.13112/2021.
The State Government has decided to prefer Special Leave Petition before the Hon'ble Supreme Court against the judgment dated 26.09.2025 of the Division bench of Hon'ble High Court in W.A. No.1532/2021. As the period of the Commission specified in the notification has expired on 6th November, 2025 it is necessary to extend the said period. Therefore Government have decided to extend the term of the Commission for a further period of six months from 7th November, 2025 and consequently amend the notification issued under No.HomeSSA2/67/2021Home dated 7th May, 2021 and published as S.R.O. No.389/2021 in the Kerala Gazette Extraordinary No.1562 dated 7th May 2021, subject to the directions issued by the Hon'ble High Court of Kerala in W.P.(C) No.13112 of 2021 and further subject to the outcome of the Special Leave Petition to be filed before the Hon'ble Supreme Court of India.
The notification is intended to achieve the above object.
