G.O. (Rt.) No. 1360/2025/LBR. Thiruvananthapuram, 21st November 2025.

Whereas, the Government are of opinion that an industrial dispute exists between the Managing Director, Coirfed, The Kerala State Co-operative Coir Marketing Federation Ltd. No. 679, P. B. No. 4616, Alappuzha-688 012 and the workman of the above referred establishment Sri Anil P. Chacko S/o Mathayi Chacko, Palayathil Chirayil, Veeyapuram P. O., Hrippad-690 514 in respect of matters mentioned in the annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by Section 10 (1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kollam. The Labour Court will pass the award within a period of three months.

ANNEXURE

"Whether the denial of employment to Sri Anil P. Chacko, Palayathil Chirayil, Veeyapuram P. O., Harippad-690 514 LD Clerk (on contract) of Coirfed, The Kerala State Co-Operative Coir Marketing Federation Ltd. No. 679, Alappuzha-688 012, by the management is justifiable ?

If not what relief he is entitled to?"

Whereas, the Government are of opinion that an industrial dispute exists between Sri Ronak Radhakrishnan Pillai, Managing Director, Serafin Dev Impex Private Ltd., Mundakkal, Kollam and Sri Al Ameen, Puthanvila Padinjattathil, Cheriyola, Alummoodu P. O., Kollam in respect of matters mentioned in the annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by Section 10 (1) (c) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Labour Court, Kollam. The Labour Court will pass the award within a period of three months.

Whereas, the Government are of opinion that an industrial dispute exists between Sri Prathap R. Nair, Proprietor, Sunfood Corporation 'Avanthi', Kochupilammoodu, Kollam and the General Secretary, Kottarakkara Taluk Cashew Workers Union (CITU), Majeed Smaraka Mandiram, Kottarakkara in respect of matters mentioned in the annexure to this order;

And whereas, in the opinion of Government it is necessary to refer the said industrial dispute for adjudication;

Now, therefore, in exercise of the powers conferred by Section 10 (1) (d) of the Industrial Disputes Act of 1947 (Central Act XIV of 1947) the Government hereby direct that the said industrial dispute be referred for adjudication to the Industrial Tribunal, Kollam. The Industrial Tribunal will pass the award within a period of three months.

"Whether the closed down of the undertaking M/s Sunfood Corporation Ltd., Pooyappally without complying the provisions of Industrial Dispute Act 1947 is justifiable? If not what relief the workmen are entitled to?"

തൊഴിലും നൈപുണ്യവും വകുപ്പ്—കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ്—1999-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമവും സേവന വ്യവസ്ഥകളും) റഗുലേഷനുകൾ വീ≠ും ഭേദഗതി ചെയ്യുന്നതിന് അനുമതി നൽകി—ഉത്തരവ് പുറപ്പെടുവിക്കുന്നു.

ഉത്തരവ്

കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡിലെ യു.ഡി.ക്ലർക്ക് തസ്തിക യിലേയ്ക്കുള്ള തസ്തികമാറ്റ നിയമനത്തിന് യു. ഡി. ടൈപ്പിസ്റ്റിനോടൊപ്പം ഉയർന്ന ഗ്രേഡിലുള്ള സീനിയർ ഗ്രേഡ് ടൈപ്പിസ്റ്റിനുകൂടി അർഹത നൽകുന്നതിനായി, പരാമർശം (1) പ്രകാരമുള്ള സർക്കാർ ഉത്തരവിന്റെ പ്രയോജനം ബോർഡിന്റെ കാര്യത്തിലും ബാധകമാക്കുന്നതിലേയ്ക്ക് 1999-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമവും സേവന വ്യവസ്ഥകളും) റഗുലേഷനു കളിൽ ഈ ഉത്തരവിനോടൊപ്പം ചേർത്തിരിക്കുന്ന അനുബന്ധം പ്രകാരമുള്ള ഭേദഗതി വരുത്തുന്നതിന് അനുമതി നൽകി ഉത്തരവാകുന്നു.

1201 തുലാം 16. 1969-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ആക്റ്റിലെ (1969-ലെ 22-ാം ആക്റ്റ്) 7-ാം വകുപ്പ് 3-ാം ഉപവകുപ്പ് പ്രകാരം നൽകപ്പെട്ട അധികാരങ്ങൾ വിനിയോഗിച്ച് 1999 ഏപ്രിൽ 13-ാം തീയതിയിലെ സ. ഉ. (കൈ.) നമ്പർ 49/99/തൊഴിൽ നമ്പർ ഉത്തരവ് പ്രകാരം നൽകപ്പെട്ട സർക്കാർ അംഗീകാരത്തോടുകൂടി 2003 ജൂലൈ 3-ാം തീയതിയിലെ 1169-ാം നമ്പർ കേരള അസാധാരണ ഗസറ്റിൽ പ്രസിദ്ധീകരിച്ചതുമായ 1999-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമനവും സേവന വ്യവസ്ഥകളും) റഗുലേഷനുകൾ കേരള സർക്കാർ താഴെപ്പറയും പ്രകാരം ഭേദഗതി ചെയ്യുന്നു, അതായത്:—

റഗുലേഷനുകൾ

(1) ചുരുക്കപ്പേരും പ്രാരംഭവും:—(i) ഈ റഗുലേഷനുകൾക്ക് 2025-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമനവും സേവനവ്യവസ്ഥകളും) ഭേദഗതി റഗുലേഷനുകൾ എന്ന് പേര് പറയാം.

(ii) ഈ റഗുലേഷനുകൾ ഉടൻ പ്രാബല്യത്തിൽ വരുന്നതാണ്.

(2) റഗുലേഷനുകൾക്കുള്ള ഭേദഗതി:—1999-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമനവും സേവനവ്യവസ്ഥകളും) റഗുലേഷനുകളിൽ,— (i) അദ്ധ്യായം II-ലെ 6-ാം റഗുലേഷനിന് കീഴിലുള്ള പട്ടികയിൽ,—

(എ) വിഭാഗം-ബി-യിൽ, ക്രമ നമ്പർ 4 "അപ്പർ ഡിവിഷൻ ക്ലർക്ക്" എന്ന തസ്തികയ്ക്കെതിരെ (3)-ാം കോളത്തിലെ ഉൾക്കുറിപ്പിലെ (ബി)-യിലെ "യു. ഡി. ടൈപ്പിസ്റ്റുമാർ, കോൺഫിഡൻഷ്യൽ അസിസ്റ്റന്റുമാർ എന്നിവരിൽ നിന്നും തസ്തിക മാറ്റം മുഖേന" എന്നീ വാക്കുകൾക്കും ചി"ങ്ങൾക്കും പകരം "യു. ഡി. ടൈപ്പിസ്റ്റുമാർ, സീനിയർ ഗ്രേഡ് ടൈപ്പിസ്റ്റുമാർ, കോൺഫിഡൻഷ്യൽ അസിസ്റ്റന്റുമാർ എന്നിവരിൽ നിന്നും തസ്തിക മാറ്റം മുഖേന" എന്ന വാക്കുകളും ചി"ങ്ങളും ചേർക്കേ≠താണ്;

(ബി) വിഭാഗം-ബി-യിൽ, ക്രമ നമ്പർ 4-നും അതിനു എതിരെയുള്ള ഉൾക്കുറിപ്പുകൾക്കും താഴെയുള്ള കുറിപ്പിനു മുമ്പാകെ "(1)" എന്ന അക്കവും ബ്രാക്കറ്റുകളും ചേർക്കേ≠തും നിലവിലുള്ള കുറിപ്പിനു ശേഷം താഴെപ്പറയുന്ന കുറിപ്പ് ചേർക്കേ≠തുമാണ്, അതായത്:—

"(2) സീനിയറായ/കൂടുതൽ സർവ്വീസുള്ള, പ്രമോഷന് പൂർണ്ണ യോഗ്യതയുള്ളതുമായ എൽ. ഡി. ക്ലർക്കിനെ മറികടന്ന് യു. ഡി. ടൈപ്പിസ്റ്റ്, സീനിയർ ഗ്രേഡ് ടൈപ്പിസ്റ്റ്, കോൺഫിഡൻഷ്യൽ അസിസ്റ്റന്റ ് തസ്തികയിലുള്ളവർക്ക് യു. ഡി. ക്ലർക്ക് തസ്തികയിലേക്ക് തസ്തികമാറ്റ നിയമനം അനുവദിക്കാൻ പാടില്ല".

(ഇത് വി⁄ാപനത്തിന്റെ ഭാഗമാകുന്നതല്ല. എന്നാൽ അതിന്റെ പൊതുഉദ്ദേശ്യം വെളിപ്പെടുത്തുന്നതിന് ഉദ്ദേശിച്ചിട്ടുള്ളതാണ.്)

യു. ഡി. ക്ലർക്ക് തസ്തികയിലേയ്ക്കുള്ള തസ്തികമാറ്റ നിയമനത്തിന് യു. ഡി. ടൈപ്പിസ്റ്റിനോ ടൊപ്പം ഉയർന്ന ഗ്രേഡിലുള്ള സീനിയർ/സെലക്ഷൻ ഗ്രേഡ് ടൈപ്പിസ്റ്റ്/കോൺഫിഡൻഷ്യൽ അസിസ്റ്റന്റുമാർക്ക് അർഹത നൽകുന്ന 9-7-2002-ലെ ജി. ഒ. (പി) നമ്പർ 34/2002/പി & എ.ആർ. ഡി. ഉത്തരവിന്റെ ആനുകൂല്യം ബോർഡിന്റെ കാര്യത്തിലും ബാധകമാക്കുന്നതിനായി 1999-ലെ കേരള കള്ള് വ്യവസായ തൊഴിലാളി ക്ഷേമനിധി ബോർഡ് സ്റ്റാഫ് (നിയമനവും സേവനവ്യവസ്ഥകളും) റഗുലേഷനുകളിൽ അനുയോജ്യമായ ഭേദഗതി ചെയ്യുവാനുള്ള ബോർഡ് തീരുമാനം സർക്കാർ അംഗീകരിച്ചു.

മേൽപ്പറഞ്ഞ ആവശ്യത്തിന് വേ≠ിയുള്ളതാണ് ഈ വി⁄ാപനം.
