ORDER

WHEREAS, under the provisions of Rule 188 of the Kerala Cooperative Societies Rules, 1969, every society shall adopt the staff pattern indicated in Appendix III to these rules, according to the type and class to which it belongs. Provided that where any society cannot adopt such staff pattern due to its financial position, the members of the committee may work in an honorary capacity in lieu of appointing any paid
2employee. Provided further that where any society is in need of any change in the pattern of staff including the scale of pay under special circumstances the same may be made by the society with the prior approval of the Registrar of Cooperative societies;
AND WHEREAS, the Board of Directors of the Pullukulangara Service Co operative Bank Limited No. 2992 in Alappuzha District, has resolved to request the Government to exempt the said bank from the provisions of rule 188 of the Kerala Co operative Societies Rules, 1969, for the purpose of regularising the appointments made through promotion to the unsanctioned Branch Manager post in the said Bank during the period from 01st April, 2009 to 31st March, 2016 ;
AND WHEREAS, the Registrar of Cooperative Societies has forward the resolution of the Board of Directors of the said Bank to the Government and has recommended to exempt the said Bank from the provisions of Rule 188 of the Kerala Cooperative Societies Rules,1969, for the purpose of enabling the said bank to regularise the appointments made through promotion to the unsanctioned Branch Manager post in the said bank during the period from 1st April, 2009 to 31st March, 2016;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary to exempt the Pullukulangara Service Cooperative Bank Limited No.2992 in Alappuzha District from the provisions of rule 188 of the Kerala Co operative Societies Rules, 1969, so as to enable the said Bank to regularise the appointments made through promotion to the unsanctioned Branch Manager post in the said Bank during the period from 01st April, 2009 to 31st March, 2016 ;
NOW, THEREFORE, in exercise of the powers conferred by rule 181 of the Kerala Cooperative Societies Rules, 1969, the Government of Kerala hereby exempt the Pullukulangara Service Cooperative Bank Limited No.2992 in Alappuzha District from
3the provisions of Rule 188 of the said Rules, so as to enable the said Bank to regularise the appointments made through promotion to the unsanctioned Branch Manager post in the said Bank during the period from 01st April, 2009 to 31st March, 2016.

As per rule 188 of the Kerala Cooperative Societies Rules, 1969, every society shall adopt the staff pattern indicated in Appendix III to these rules, according to the type and class to which it belongs. Provided that where any society cannot adopt such staff pattern due to its financial position, the members of the committee may work in an honorary capacity in lieu of appointing any paid employee. Provided further that where any society is in need of any change in the pattern of staff including the scale of pay under special circumstances the same may be made by the society with the prior approval of the Registrar of Cooperative societies. As per the order No. JRGALP/215/2021CRP(1) dated 19/02/2021 of the Joint Registrar of Cooperative Societies (General), Alappuzha, three Branch Manager posts were sanctioned to the Pullukulangara Service Cooperative Bank Limited No. 2992 in Alappuzha District with effect from 01st April, 2016. However, the bank had granted promotions from the post of Accountant to the post of Branch Manager from 01st April, 2009, onwards without obtaining the prior approval of the Registrar of Cooperative Societies. The Board of Directors of the Pullukulangara Service Cooperative Bank Limited No. 2992 in Alappuzha District has resolved to request the Government to exempt the said Bank from the provisions of Rule 188 of the Kerala Cooperative Societies Rules, 1969, so as
4to enable the said Bank to regularise the appointments made through promotion to the unsanctioned Branch Manager post in the said Bank during the period from 01 st April, 2009 to 31st March, 2016 . The Government have considered the matter in detail and have decided to exempt the said bank from the above provisions of rule 188 of the Kerala Cooperative Societies Rules, 1969, so as to enable the said Bank to regularise the appointments made through promotion to the unsanctioned Branch Manager post in the said Bank during the period from 01st April, 2009 to 31st March, 2016.
This order is intended to achieve the above object.
