In exercise of the powers conferred by 2nd proviso to subsection 7 of section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), the Government of Kerala hereby extend the time limit in publishing the declaration as per sub-section 1 of section 19 to the Notification issued under sub-section (1) of section 11 as per Proceedings No.K3-566493/2023 dated 28th December 2024 and published in the Extra Ordinary Gazette No.4121 dated 30th December 2024, namely:- This is a digitally signed Gazette. Proceedings No.K3-566493/2023 dated 28th December 2024 and published in the Extra Ordinary Gazette No.4121 dated 30th December 2024 has been issued in accordance with the provisions of subsection (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of 1.3398 Hectares of land in Karippur, Nedumangad and Aruvikkara villages of Thiruvananthapuram district for the development of Nedumangad-Aruvikkara-Vellanad road (Reach-1).

AND WHEREAS, the District Collector, Thiruvananthapuram has reported that as per Section 19(7) of LARR Act, 2013 mentions that the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No.K3-566493/2023 dated 28th December 2024 and published in the Extra Ordinary Gazette No.4121 dated 30th December 2024 expired on 29-12-2025 and therefore requested to extend the time limit for publishing the 19(1) Declaration.

NOW THEREFORE, sanction is accorded to extend the time limit in publishing the Declaration for a further period of twelve months from the date of expiry of the 11(1) notification ie, 29-12-2025 by invoking the provisions contained in 2nd proviso to Section 19(7) of the LARR Act, 2013 with regard to the acquisition of 1.3398 Hectares of land in Karippur, Nedumangad and Aruvikkara villages of Thiruvananthapuram district for the development of Nedumangad-Aruvikkara-Vellanad road (Reach-1).

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport.) Proceedings No.K3-566493/2023 dated 28th December 2024 and published in the Extra Ordinary Gazette No.4121 dated 30th December 2024 has been issued in accordance with the provisions of subsection (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 with regard to the acquisition of 1.3398 Hectares of land in Karippur, Nedumangad and Aruvikkara villages of Thiruvananthapuram district for the development of Nedumangad-Aruvikkara-Vellanad road (Reach-1). As per Section 19(7) of LARR Act, 2013, the 19(1) Declaration has to be published within 12 months from the date of issuance of 11(1) Notification (preliminary notification) and that the 11(1) Notification issued as per Proceedings No.K3-566493/2023 dated 28th December 2024 and published in the Extra Ordinary Gazette No.4121 dated 30th December 2024 expired on 29-12-2025 and therefore extend the time limit for publishing the 19(1) Declaration.

The notification is intended to achieve the above object.
