WHEREAS, under subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969, a society may, with the previous sanction in writing of the Registrar, invest the whole or any portion of its funds in the purchase or lease of land on the acquisition, construction or renewal of any building that may be
2necessary to conduct its business. The amount of funds so invested shall be recouped on such terms as may be determined in each case by the Registrar;
AND WHEREAS, the Board of Directors of the Mananthavady Cooperative Urban Society Limited No. W 221 in Wayanad District has resolved to request the Government to exempt the said society from the provision of subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969 for the purpose of enabling the said society to ratify the purchase of land by the society without the consent of Registrar. Since the society already invested its funds for the purchase of 2 ares 61.1 square meter of land for an amount of Rs. 1,46,13,511/ (Rupees One Crore Forty six Lakhs thirteen thousand five hundred and eleven only) including registration and stamp duty charges that may be necessary to conduct its business;
AND WHEREAS, the Registrar of Cooperative Societies has reported that Board of Directors of the Mananthavady Cooperative Urban Society Limited No. W 221 in Wayanad District had utilized its fund for the purchase of land 2 ares 61.1 square meter for an amount Rs. 1,46,13,511/ (Rupees One Crore Forty Six Lakhs thirteen thousand five hundred and eleven only) including registration and stamp duty charges without obtaining prior sanction from the Registrar of Co operative Societies as stipulated in subrule (1) of rule 54 of the Kerala Co operative Societies Rules, 1969. Now the Registrar of Cooperative Societies has resolved to request the Government of Kerala to exempt the said society to ratify the purchase of land from the provisions of subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969 for the purchase of 2 ares 61.1 square meter of land which is necessary to conduct its business;
AND WHEREAS, the Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to permit the Registrar of Co operative Societies to exempt the Mananthavady Cooperative Urban Society Limited No. W 221 in Wayanad District from the provision of subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969, so as to enable the said society to ratify the purchase of land to invest Rs. 1,46,13,511/ (Rupees One Crore Forty Six Lakhs thirteen thousand five hundred and eleven only) including
3registration and stamp duty charges for the purchase of 2 ares 61.1 square meter of land;
NOW, THEREFORE, in exercise of the powers conferred by rule 181 of the Kerala Cooperative Societies Rules, 1969, the Government of Kerala hereby permit the Registrar of Cooperative Societies to exempt Mananthavady Co operative Urban Society Limited No. W 221 in Wayanad District from the provision of subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969, so as to enable the said society to ratify the purchase of land by the society without the consent of Registrar for an amount of Rs.1,46,13,511/ (Rupees One Crore Forty six Lakhs thirteen thousand five hundred and eleven only) including registration and stamp duty charges for the purchase of 2 ares 61.1 square meter of land.

Explanatory Note

The Registrar of Cooperative Societies has recommended and forwarded the resolution of the Board of Directors of the said society to the Government to exempt the said society from the provision of subrule (1) of rule 54 of the said Rules for the purchase of land 2 ares 61.1 square meter. The Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to permit the Registrar of Cooperative Societies to ratifying the purchase of land by the Mananthavady Cooperative Urban Society Limited No. W 221 in Wayanad District from the provision of subrule (1) of rule 54 of the Kerala Cooperative Societies Rules, 1969, so as to enable the said society to accord sanction to invest Rs.1,46,13,511/ (Rupees One Crore Forty six Lakhs thirteen thousand five hundred and eleven only) for the purchase of land 2 ares 61.1 square meter.
This order is intended to achieve the above object.
