In exercise of the powers conferred by sub-section (1) of section 10 of the Contract Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970), the Government of Kerala, after consultation with the State Advisory Contract Labour Board constituted under sub-section (1) of section 4 thereof and after having considered the conditions of work and benefits provided for the contract labour in the establishment of Kay Cee Distilleries, Thrissur and all other relevant factors,
2having found that the employment in bottling, filling, sealing, labelling, packing and despatching categories in the establishment of Kay Cee Distilleries, Thrissur is of permanent nature, hereby prohibit, with effect from the date of publication of this notification in the Gazette, the employment of contract labour in the bottling, filling, sealing, labelling, packing and despatching categories in the said establishment.

Explanatory Note
( This does not form part of the notification, but is intended its general purport.)
Under sub-section (1) of section 10 of the Contract Labour (Regulation and Abolition) Act, 1970 (Central Act 37 of 1970), Government may, after consultation with the State Advisory Contract Labour Board, prohibit by notification in the Gazette, employment of contract labour in any process, operation or other work in any establishment. The complaint of the Kay Cee Distilleries Employees Union regarding the contract labour employed in the establishment of Kay Cee Distilleries, Thrissur were accordingly referred to the State Advisory Contract Labour Board. The Advisory Board after considering all relevant factors in detail has advised the Government that as the employment of bottling, filling, sealing, labelling, packing and despatching categories in the said establishment is of a permanent nature, the employment of contract labour in the bottling, filling, sealing, labelling, packing and despatching categories in the said industrial establishment may be prohibited. The Government, after examing the matter in detail, have decided to prohibit the employment of contract labour in said categories in the establishment of Kay Cee Distilleries, Thrissur.
The notification is intended to achieve the above object.
