Explanatory Note
(This does not form part of the order, but is intended to indicate its general purport.)
4 Treasurer or any other officer arises, the committee in office shall request theState Co-operative Election Commission within thirty days of arising of such vacancy to appoint a Presiding Officer to conduct election. A vacancy arose in the office of President of the Atholi Project Skill Development Multi Purpose Industrial Co-operative Society Ltd. No. S IND (D) 413 in Kozhikode District due to the resignation of the President. There was a delay in submitting application to the Kerala State Co-operative Election Commission for appointing a Presiding Officer to conduct election to the post of President in the said society and therefore the application was rejected by the Election Commission. The society requested Government through the Director of Industries and Commerce to grant relaxation from the provisions of sub-rule (2) of rule 43 of the Kerala Co-operative Societies Rules, 1969. The Director of Industries and Commerce recommended Government to grant relaxation to the said society for conducting the election to the post of President. The Government have examined the matter in detail and are satisfied that it is necessary, in public interest, to grant relaxation from the provisions of sub-rule (2) of rule 43 of the Kerala Co-operative Societies Rules, 1969 so as to enable the conduct of election to the post of President in the said society.
The order is intended to achieve the above object.
