NOTIFICATION

F.No. 7/1/2021-FCS : In exercise of the powers conferred by the sub Sec (1) of Section 102 of the Consumer Protection Act, 2019 ((35 of 2019), the Administrator, Union Territory of Lakshadweep hereby makes the following Rules namely:-

1. Short title and commencement: (1) These rules may be called Lakshadweep Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Rules, 2021

(2) They shall come in to force on such date as the Administrator may, by Notification in the Official Gazette, prescribe.

2. Definitions: (1) In these rules, unless the context otherwise requires:-

(a) 'Act' means the Consumer Protection Act, 2019 (35 of 2019)

(b) 'Member' means a Member of the District Commission or the State Commission as the case may be;

(c) 'President' means the President of the District Commission or the State Commission as the case may be;

(d) 'Administrator' means the Administrator of the Union Territory of Lakshadweep appointed under article 239 of the Constitution of India;

(e) 'Administration' means Administration of the Union Territory of Lakshadweep.

2. Salaries and allowances payable to President and Members of District Commission:- (1) The president shall receive an honorarium of Rs. 450/-(Rupees Four Hundred and Fifty) only per day of sitting.

(2) A member shall receive an honorarium of Rs. 200/-(Rupees Two Hundred) only per day of sitting.

(3) Seal and emblem: The office seal and emblem of the District Commission shall be such as the administration may specify.

(4) Place of sitting:- The sitting of the District Commission shall be convened by the President. The sitting shall ordinarily be at the office of the District Commission at Kavaratti, provided that sitting may also be convened at other centers, if the situation warrants.

(5) Staffs:- The Director (Food, Civil Supplies and Consumer Affairs) U. T. of Lakshadweep shall depute such staffs, as may be necessary, to assists the District Commission in its day- to -day work and to perform such other functions as are provided under the Act or these rules as are assigned by the President.

(6) T A/DA: The President or Member shall be eligible for TA/DA at the same rate as are admissible to Group 'A' officers of the Lakshadweep Administration. Since the appointment President and members of Commission is Part-Time, they may allow TA/DA from their resident to Head Quarter (Kavaratti)/Duty point and return, if the journey is performed for official purpose.

3. Salaries and allowances payable to President and members of the State Commission:-:- (1) The president shall receive an honorarium of Rs.750/(Rupees Seven Hundred and Fifty) only per day of sitting.

(2) A member shall receive an honorarium Rs. 300/-(Rupees Three Hundred) only per day of sitting.

(3) Seal and emblem: The office seal and emblem of the State Commission shall be such as the administration may specify.

(4) Place of sitting:- The sitting of the State Commission shall be convened by the President. The sitting shall ordinarily be at the office of the State Commission at Kavaratti, provided that sitting may also be convened at other centers, if the situation warrants.

(5) Staffs:- The Director ( Food, Civil Supplies and Consumer Affairs), U. T. of Lakshadweep shall depute such staffs, as may be necessary, to assists the State Commission in its day- to -day work and to perform such other functions as provided under the Act or these rules as are assigned by the President.

4. Medical fitness: No person shall be appointed as President or Member unless he is declared medically fit by an authority specified by the Lakshadweep Administration in this behalf.

5. Casual vacancy:-In case of a casual vacancy in the office of President in the State Commission or District Commission, as the case may be, the Administration shall have the power to appoint the senior most Member to officiate as President.

6. Declaration of Financial and other Interests:-The President or member shall, before entering upon his office declare his assets, and his liabilities and financial and other interests 7. Oaths of office and secrecy:-Every person appointed to be the President or member shall, before entering upon his office, make and subscribe an oath of office in Form I and oath secrecy in Form II annexed to these rule.

8. The honorarium, sitting fee and other allowances shall be defrayed out of the Consolidated Fund of India

9. The terms and conditions of the service of the President and the members of the District Commission and the State Commission shall not be varied to their disadvantage during their tenure of office.
