क्र. एफ- 22-01-2018- आठ. मध्यप्रदेश मोटरयान नियम, 1994 में संशोधन का निम्नलिखित प्रारूप जिसे कि राज्य सरकार, मोटरयान अधिनियम, 1988 ( 1988 का सं. 59 ) की धारा 96 की उपधारा ( 2 ) के खण्ड ( तैंतीस ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) द्वारा अपेक्षित किये गये अनुसार उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है , जानकारी के लिये , एतद्वारा प्रकाशित की जाती है और एतद्वारा यह सूचना दी जाती है कि उक्त संशोधन प्रारूप पर इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से 30 दिवस का अवसान होने पर विचार किया जावेगा.
किसी भी ऐसी आपत्ति या सुझाव पर , जो उक्त संशोधन के प्रारूप के संबंध में किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्रमुख सचिव, मध्यप्रदेश शासन परिवहन विभाग , कक्ष क्रमांक 327 , मंत्रालय , वल्लभ भवन, भोपाल में प्राप्त हों, द्वारा विचार किया जावेगा.
प्रारूप संशोधन
उक्त नियमों में नियम 77 में,-
(1) उप नियम ( 1 - ग ) के पश्चात् निम्नलिखित उप नियम अन्तःस्थापित किए जाएं, अर्थात्: -
( 1 - घ ) प्रत्येक मंजिली गाड़ी का अनुज्ञा पत्र स्वीकृत करने के लिये यह अनिवार्य शर्त होगी कि प्रत्येक मंजिली गाड़ी में ग्लोबल पोजीशनिंग सिस्टम ( जी. पी. एस. ) तथा सी. सी. टी. व्ही. कैमरे लगे हों;

(1 - ङ) मंजिली गाड़ी अनुज्ञापत्र धारक , अनुज्ञा से आच्छादित मंजिली गाड़ी/संविदा वाहन में चालक तथा परिचालक की नियुक्ति करने से पहले संबंधित पुलिस से उनके चरित्र सत्यापन प्रमाण पत्र प्राप्त करेगा तथा अनुज्ञा पत्र स्वीकृतिकर्ता प्राधिकारी के समक्ष प्रस्तुत करेगा. "
(2) उप नियम ( 2 ) के पश्चात् निम्नलिखित उप नियम अन्तःस्थापित किए जाए,, अर्थात्:-
" ( 2-क) किसी स्कूल/शैक्षणिक संस्था की बस को किसी भी मार्ग के लिये अस्थाई/ स्थाई अनुज्ञा पत्र स्वीकृत नहीं किया जाएगा जिसके विनिर्माण के 15 वर्ष पूर्ण हो चुके हैं. "
NOTICE
No. F 22-01-2018 - VIII . The following draft of amendment in the Madhya Pradesh Motor Vehicles Rules , 1994 , which the State Government proposes to make in exercise of the powers conferred by clauses (xxxiii ) of sub section (2) of section 96 of the Motor Vehicles Act , 1988 ( No. 59 of 1988), is hereby published as required by sub - section (1) of section 212 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft of amendment will be taken into consideration on the expiry of thirty days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received from any person with respect to the said draft of amendment on or before the expiry of the period specified above will be considered by the Principal Secretary, Government of Madhya Pradesh , Transport Department, Room No. 327 , Mantralaya, Vallabh Bhawan , Bhopal .
DRAFT OF AMENDMENT
In the said rules , in rule 77 ,-
(1) After sub - rule ( 1 - c ) , the following sub - rules shall be inserted , namely :-
"( 1-d) It shall be mandatory condition for granting permit to every Stage carriage that Global Positioning System (GPS ) and Close Circuit television ( CCTV) cameras are fitted in every stage carriage;
(1 -e) The Stage carriage Permit holder Prior to appointing the Driver and Conductor in the Stage Carriage/ Contract Carriage covered under the permit, shall obtained character Verification certificate issued by the concerned Police Station and shall produce the same before the permit granting authority. " .
(2) After sub - rule (2) , the following sub - rule shall be inserted , namely :-
"(2-a) No temprory/permanent permit shall be granted for any route to any School/Education Institution bus which has completed 15 years from the year of manufacture . " .
क्र. एफ - 22-12-2016- आठ.- मोटरयान अधिनियम, 1988 ( 1988 का सं. 59 ) की धारा 112 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य सरकार, एतद्वारा , प्रदेश की स्कूल/शैक्षणिक बस हेतु 40 किमी प्रतिघंटा अधिकतम गति सीमा निर्धारित करती है .
F 22-12-2016 - VIII. In exercise of the powers conferred by Sub - Section ( 2 ) of section 112 of the Motor Vehicles Act, 1988 ( No. 59 of 1988 ) the State Government by this notification , hereby, fixes 40 k.m. per hour maximum speed of a school /educational insititution Buses .
क्र. एफ- 22-15-2017- आठ. मध्यप्रदेश मोटरयान नियम, 1994 में संशोधन का निम्नलिखित प्रारूप जिसे राज्य सरकार, मोटरयान अधिनियम, 1988 ( 1988 का क्रमांक 59 ) की धारा 28 की उपधारा ( 2 ) के साथ पठित धारा 38 की उपधारा ( 2 ) , धारा 65 की उपधारा (2) तथा 96 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, बनाना प्रस्तावित करती है , उक्त अधिनियम की धारा 212 की उपधारा ( 2 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की, जिनके की उससे प्रभावित होने की संभावना है, जानकारी के लिये 282( 1)

एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है कि उक्त संशोधन प्रारूप पर इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से 15 दिवस का अवसान होने पर, विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव पर, जो कि उक्त संशोधन के प्रारूप के संबंध में किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्रमुख सचिव, मध्यप्रदेश शासन , परिवहन विभाग , कक्ष क्रमांक 327 वल्लभ भवन भोपाल कार्यालयीन समय के दौरान प्राप्त हो, राज्य सरकार द्वारा विचार किया जायेगा .
प्रारूप संशोधन
उक्तनियमों में, -
1. नियम 5 - क को, 5 - क ( 1 ) के रूप में पुनर्क्रमांकित किया जाए और तत्पश्चात् निम्नलिखित उप- नियम अंतः स्थापित किया जाए, अर्थात्: -
( 2) आवेदक , आधार कार्ड या सक्षम प्राधिकारी द्वारा जारी फोटोयुक्त अन्य परिचय प्रमाण - पत्र प्रस्तुत किये जाने के पश्चात्, सीधे तौर पर भी चालक अनुज्ञप्ति प्राप्त कर सकेगा. "
2. नियम 5 - क के पश्चात् निम्नलिखित नियम अंतः स्थापित किया जाए, अर्थात्:-
" ( 5 - ख ) अनुज्ञप्ति प्राधिकारी , अनुज्ञप्तिधारी को अनुज्ञप्ति प्रदाय करते समय यह सुनिश्चित करेगा कि चालक अनुज्ञप्ति स्वीकृति से संबंधित अंतर्विष्ट समस्त अभिलेखों सहित मूल नस्ती, कम्प्यूटर द्वारा स्कैन करने के पश्चात् निम्नलिखित निर्बन्धनों के साथ , अनुज्ञप्ति धारक की अभिरक्षा में दी गई है :-
(एक) अनुज्ञप्ति धारक , अनुज्ञप्ति प्राधिकारी /न्यायालय/किसी प्राधिकारी के कार्यालय द्वारा माँगे जाने पर उसकी अभिरक्षा में दी गई मूल नस्ती प्रस्तुत किए जाना सुनिश्चित किए जाने हेतु एक बंधपत्र/ शपथपत्र प्रस्तुत करेगा.
(दो) मूल नस्ती खो जाए/ नष्ट हो जाने /विरूपित हो जाने की दशा में अनुज्ञप्तिधारक संबंधित पुलिस को दी गई सूचना की प्रति प्रस्तुत करेगा.
(तीन) चालक अनुज्ञप्ति के धारक को अपेक्षित फीस जमा करने के पश्चात् कम्प्यूटर में स्कैन अभिलेखों की, द्वितीय प्रति उपलब्ध कराई जाएगी . "
3. नियम 27 में, उप- नियम ( 1 ) के खण्ड ( छ ) के पश्चात् निम्न खण्ड अंतः स्थापित किया जाए, अर्थात्:-
" (ज ) आवेदक, सक्षम प्राधिकारी द्वारा जारी किए गए फोटोयुक्त आधार कार्ड या अन्य किसी परिचय प्रमाण - पत्र प्रस्तुत किये जाने के पश्चात् सीधे तौर पर भी परिचालक अनुज्ञप्ति भी प्राप्त कर सकेगा. "
4. नियम 46 - क को 46- क( 1 ) के रूप में पुनःक्रमांकित किया जाए और तत्पश्चात् निम्नलिखित उप- नियम अंतः स्थापित किया जाए, अर्थात्:-
" ( 2) रजिस्ट्रीकृत स्वामी आधार कार्ड या सक्षम प्राधिकारी द्वारा जारी किये गये फोटोयुक्त कोई अन्य परिचय प्रमाण- पत्र प्रस्तुत करने के पश्चात् स्मार्ट कार्ड में सीधे तौर पर रजिस्ट्रीकरण प्रमाण - पत्र प्राप्त कर सकते हैं. "
5. नियम 46- क के पश्चात् निम्नलिखित नियम अंतः स्थापित किया जाए, अर्थात्: -
"46- ख प्ररूप 20 में मूल आवेदन को सुसंगत अभिलेख सहित कम्प्यूटर द्वारा स्कैन किया जाएगा और तत्पश्चात् रजिस्ट्रीकृत वाहन स्वामी को निम्नलिखित शर्तों के अधीन अभिरक्षा में दिया जाएगा : -
(क) वाहन स्वामी , रजिस्ट्रीकृत प्राधिकारी या न्यायालय के कार्यालय द्वारा मांगे जाने पर उसकी अभिरक्षा में दी गई मूल नस्ती प्रस्तुत किया जाना सुनिश्चित करते हुये बंधपत्र/ शपथ पत्र प्रस्तुत करेगा.
(ख) मूल नस्ती खो जाने/नष्ट हो जाने/विरूपित हो जाने की दशा में रजिस्ट्रीकृत वाहन स्वामी, संबंधित पुलिस को दी गई सूचना की प्रति प्रस्तुत करेगा.

(ग) वाहन के रजिस्ट्रीकृत स्वामी को अपेक्षित फीस जमा करने के पश्चात् कम्प्यूटर में स्कैन अभिलेखों की द्वितीय प्रति उपलब्ध कराई जाएगी. "
6. नियम 164 का लोप किया जाए .

The following draft of amendment in the Madhya Pradesh Motor Vehicles Rules , 1994 , which the State Government proposes to make in exercise of the powers conferred by sub- section (2 ) of Section 28 read with sub - section (2 ) of Section 38 , sub - section (2) , of Section 65 and sub - section (2) of Section 96 of the Motor Vehicles Act , 1988 ( No. 59 of 1988 ) , is hereby published as required by sub - section (2) of Section 212 of the said Act , for the information of all persons likely to be affected thereby and notice is hereby given that the said draft of amendment will be taken in to consideration on the expiry of 15 days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received from any person with respect to the said draft of amendment on or before the expiry of the period specified above will be considered by the Principal Secretary, Government of Madhya Pradesh , Transport Department , Bhopal during office hours at Vallabh Bhawan Room No. 327 .
DRAFT OF AMENDMENT
In the said rules ,-
1 Rule 5 - A Shall be renumbered as rule 5- A ( 1 ) and thereafter following sub- rule shall be inserted , namely :-
2. " (2) The applicant may also obtain driving license directly after producing the Adhar Card or any other identity certificate with photo issued by the competent Authority . "
3. After Rule 5 - A the following Rule shall be inserted, namely : ---
"(5 -B) The licensing authority at the time of delivering the driving license to the holder shall ensure that the original file , containing all documents relating to the grant of driving license , after scanning it by the computer, is given in the custody of license holder under following restriction:-
(i) The license holder shall submit a bond/affidavit to ensure the production of original file given in his custody on demand by the office of the licensing authority/court/any authority.
(ii) In case the original file lost/destroyed/mutilated , the holder of license shall submit the copy of information given to the police concerned.
(iii) The holder of driving license shall be provided duplicate copy of the documents scanned in computer after depositing the requisite fee . "
4. In rule 27 , in sub - rule ( 1 ) after clause ( g ) , the following clause shall be inserted namely :---
"(h) The applicant can also obtain conductor license directly after producing the Adhar Card or any other identity certificate with photo issued by the competent Authority. "
5. Rule 46- A Shall be renumbered as " 46 - A ( 1 ) " and thereafter following sub- rule shall be inserted , namely :-
"(2) The registered owner can also directly obtain the registration certificate in smart card after producing Athar card or any other identity certificate with photo issued by the competent Authority. " 282(3)

6. After Rule 46-A, the following Rule shall be inserted , namely :-
"46-B . The original application in form - 20 submitted along with relevant document shall be scanned by the computer and thereafter given in the custody of registered owner of vehicle under following conditions :-
(a) The vehcle owner shall submit a bond/affidavit to ensure the production of original file given in his costody on demand by the office of the registering authority or court .
(b) In case the original file is lost/destroyed/ mutilated , the owner of registered vehicle shall submit the copy of information given to the police concerned.
(c) The registered owner of the vehicle shall be provided duplicate copy of the documents scanned incomputer after depositing the requisited fee .
7. Rule 164 shall be omitted .
