मध्यप्रदेश नगर पालिका अधिनियम , 1961 (क्रमांक 37 सन् 1961 ) की धारा 355, 356 तथा 358 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, नगरपालिका शिवपुरी, नगरपालिका के क्षेत्रों के लिए एतद्वारा , जल निजी परियोजना के अंतर्गत जलमापन तथा नल संयोजन के नियमितीकरण के लिए निम्नलिखित उपविधियां बनाती है , अर्थात्ः-
उपविधियां
1. संक्षिप्त नाम, लागू होना तथा प्रारम्भ.- (1 ) इन उपविधियों का संक्षिप्त नाम जलमापन तथा नल संयोजन का नियमितीकरण उपविधियां, 2018 है ।
(2) ये नगरपालिका, शिवपुरी के क्षेत्र में लागू होंगी ।
(3 ) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगी ।

2. परिभाषाएं. इन उपविधियों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,- (क) "उपविधियों" से अभिप्रेत है , किसी रियायत की अवधि के लिए जन निजी भागीदारी योजना के अंतर्गत जल के प्रदाय के लिए रियायतग्राही और ग्राहक के बीच रियायत अवधि के लिए अधिकार और कर्तव्य;
(ख) "वाणिज्यिक संयोजन" से अभिप्रेत है, किसी संस्था/ स्वत्वधारी / संगठन जैसे होस्टल, दुकान, सिनेमाघर, धोबीखाना, सामुदायिक भवन, निजी अस्पताल , होटल , विवाह उद्यान, शोरूम , गोदाम, निजी शैक्षणिक संस्थाएं तथा इसी प्रकार की अन्य संस्थाओं द्वारा किए गए जल का उपभोग;
(ग ) "वाणिज्यिक संचालन की तारीख " से अभिप्रेत है, जल आपूर्ति योजना के निर्माण के पश्चात् सफलतापूर्वक संचालन के निरीक्षण को पूरा करने की तारीख , जो नगरपालिका, शिवपुरी द्वारा लिखित में अधिसूचित की जाएगी;
(घ) "मुख्य नगरपालिका अधिकारी " से अभिप्रेत है, मुख्य नगरपालिका अधिकारी , नगरपालिका, शिवपुरी;
(ड.) "संपर्क पाईप " घरेलू, संस्थागत, वाणिज्यिक तथा औद्योगिक भूमि, भवन, बगीचा अथवा उद्योग को जल आपूर्ति करने के लिए उनकी शाखाओं की पाइप लाइनों की प्रणाली हैं । इसमें संयोजन पाईप तथा मीटर सम्मिलित है;
(च) "रियायतग्राही " से अभिप्रेत है, नगरपालिका शिवपुरी द्वारा प्राधिकृत शिवपुरी वाटर इंफ्रास्ट्रक्चर लिमिटेड एजेन्सी, जिसे करार के अनुसार नियुक्त किया गया हो;
(छ) "उपभोक्ता" से अभिप्रेत है, कोई व्यक्ति अथवा संस्था जो वर्तमान में नगरपालिका, शिवपुरी से जल आपूर्ति का लाभ प्राप्त कर रहा हो अथवा जो भविष्य में स्वयं के नाम से अथवा प्रबंधक के रूप में रियायतग्राही के माध्यम से लाभ प्राप्त करेंग;
(ज) "संयोजन पाईप " से अभिप्रेत है, पाईप का वह भाग जो फेरूल को 'स्टॉप काक' से जोड़ता है;
(झ ) इन उपविधियों के प्रयोजन के लिए " नगर पालिका " से अभिप्रेत है , नगर पालिका, शिवपुरी;

(ञ) " घरेलू संयोजन" से अभिप्रेत है, लोगों द्वारा केवल घरेलू प्रयोजनों जैसे पेयजल, खाना बनाने, नहाने, धोने, शौचालयों की सफाई व धुलाई , घरेलू बागवानी तथा पालतू जानवरों तथा व्यक्तिगत वातानुकूलन की आवश्यकताओं के लिए किया गया जल का उपभोग;
(ट) "फेरूल " से अभिप्रेत है, मुख्य पाईप अथवा उसकी शाखाओं को संयोजन पाईप से जोड़ने वाले संयोजन पाईप का भाग;
(ठ) "औद्योगिक संयोजन" से अभिप्रेत है, उद्योगों जैसे तेल मिलों, दाल मिलों, पेपर मिलों, आईस फैक्ट्रियों, सर्विस स्टेशनों, कर्मशालाओं, फाउन्ड्रियों, पैकिंग उद्योगों द्वारा किया जाने वाला जल का उपभोग अथवा अन्य कोई उद्योग द्वारा प्रत्यक्षतः अन्तिम उत्पाद का उत्पादन करने हेतु अथवा उद्योगों में कार्यरत अथवा उनमें रूकने वाले लोगों की घरेलू आवश्यकताओं की पूर्ति करने के लिए किया जाने वाला जल का उपभोग अथवा कोई अन्य उद्योग जो उद्योग विभाग द्वारा परिभाषित किया गया हो;
(ड) "संस्थागत संयोजन " से अभिप्रेत है, संस्थाओं जैसे स्कूलों, महाविद्यालयों, कार्यालयों, अस्पतालों (सरकारी, अर्धसरकारी तथा निजी) , धर्मार्थ न्यासों, सार्वजनिक उद्यानों तथा संस्थाओं द्वारा किया जाने वाला जल का उपभोग जो लाभ के लिए नहीं चलाई जा रही हों;
(ढ) "मुख्य पाईप " से अभिप्रेत है, ऐसा पाईप जो जल आपूर्ति के प्रयोजन हेतु जल संग्राहक पाईप को जोड़ता है;
(ण) "मीटर" से अभिप्रेत है, संयोजन के माध्यम से उपभोक्ता को जल आपूर्ति की मात्रा को मापने हेतु यंत्र;
(त) "मूल्य पुनर्विलोकन समिति" से अभिप्रेत है, 5 सदस्यों से मिलकर बनी समिति, अध्यक्ष नगरपालिका, मुख्य नगरपालिका अधिकारी , नगरपालिका इंजीनियर , नगरपालिका मुख्य लेखा परीक्षक तथा रियायतग्राही का एक प्रतिनिधि;
(थ) "सर्विस पाईप " से अभिप्रेत है , ऐसा पाईप जो स्टाप काक से किसी भवन के परिसर, संस्था, वाणिज्यिक तथा औद्योगिक स्थान तथा उद्यान को जल आपूर्ति करने के लिए प्रयुक्त होता है;
(द) "स्टाप काक" से अभिप्रेत है, उपभोक्ताओं के परिसरों में जल आपूर्ति का नियंत्रण करने के लिए संयोजन पाईप के सिरे पर लगा हुआ यंत्र ।
3. रियायतग्राही के कर्तव्य.- नगर पालिका, शिवपुरी द्वारा मध्यप्रदेश नगर पालिका अधिनियम , 1961 की धारा 355, 356 और 358 के अधीन ये उपविधियां मध्यप्रदेश राजपत्र , दिनांक 9 मार्च 2018

जारी की जा रही हैं । नगरपालिका रियायतग्राही शिवपुरी वाटर इन्फ्रास्ट्रक्चर लिमिटेड को निम्नलिखित कर्तव्यों और दायित्वों का निर्वहन करने तथा जल आपूर्ति के प्रचालन एवं संधारण हेतु अपने अधिकार तथा शक्ति का प्रयोग करने के लिए नियोजित करती हैः-
(1 ) रियायतग्राही द्वारा जल आपूर्ति प्रारंभ करने की तारीख से नगर पालिका, शिवपुरी को योजना सौंपे जाने की तारीख तक, जिसमें रियायत अवधि को सम्मिलित करते हुए जल आपूर्ति प्रणाली के प्रचालन, योजना घटकों का संधारण, बिजली बिलों, शुद्ध जल का मूल्य, जल शुद्धिकरण के लिए अपेक्षित आवश्यक रसायन से संबंधित समस्त व्यय वहन किए जाएंगे । " वाणिज्यिक संचालन की तारीख " से उपभोक्ताओं से मासिक आधार पर जल प्रभार वसूल करने और संग्रहीत करने का कार्य रियायतग्राही द्वारा किया जाएगा । रियायत की अवधि का अवसान हो जाने के पश्चात् रियायतग्राही इस प्रणाली को (जो नगर पालिका द्वारा गठित एक समिति, जिसमें रियायतग्राही के प्रतिनिधि होंगे , द्वारा निर्धारित , संगठित , तथा सशक्त की जाएगी) अच्छी एवं चालू हाल में बिना किन्हीं दायित्वों के अंतरित करेगा । (2) रियायतग्राही समस्त उपभोक्ताओं को सर्विस पाइंट से 7 मीटर की ऊचाई तक 24 घण्टे x 7 दिन की अवधि के लिए " पर्याप्त दबाव" के साथ जल आपूर्ति उपलब्ध कराएगा । अपेक्षित सुधार/ परिशोधन शिकायतकर्ता द्वारा की गई शिकायत के 3 दिन के भीतर पूर्ण किया जाएगा । यदि खराबी मीटर से अन्यथा है तो सुधार कार्य उपभोक्ता द्वारा कराया जाएगा अथवा सुधार का व्यय उपभोक्ता द्वारा वहन किया जाएगा ।
(3) रियायतग्राही समस्त उपभोक्ताओं के लिए वाणिज्यिक प्रचालन की तारीख तक मीटर लगाया जाना सुनिश्चित करेगा । रियायतग्राही, उपभोक्ताओं को खण्ड 13 (3 ) में यथा विनिर्दिष्ट अनुसार पानी के मीटर की रीडिंग के अनुसार मासिक बिल दिए जाएंगे एवं उन उपभोक्ताओं के लिए जिनके मीटर नहीं लगे हैं संक्रमण कालावधि तक फ्लेट दर से बिल दिया जाएगा । जल प्रभार रियायत अनुबंध के अनुसार समय - समय पर पुनरीक्षित किए जाएंगे । बिल में जल प्रभार के अतिरिक्त मीटर की कीमत सम्मिलित की जाएगी । मीटर की आधी कीमत संयोजन के समय एवं शेष रकम किस्तों में 6 माह के भीतर भुगतान करनी होगी ।
(4) सम्पूर्ण नगर पालिका क्षेत्र में, "सी.पी.एच.ई.ई.ओ. मैनुअल आन वाटर सप्लाई एण्ड ट्रीटमेंट मई, 1999 के अनुसार शुद्ध तथा छना हुआ जल आपूर्ति किया जाएगा । यह जल आपूर्ति आई. एस. 10500 (यथा संशोधित) में विनिर्दिष्ट मानदण्डों के अनुसार किया जाएगा । 304 (3)

(5) सम्पूर्ण वितरण प्रणाली को 10 क्षेत्रों में विभाजित गया है । प्रत्येक क्षेत्र में प्राथमिकता से एक ओवरहेड " एलीवेटेड सर्विस रिजरवायर (ई एस आर ) " से जल आपूर्ति किया जाएगा । सम्पूर्ण नगर पालिका क्षेत्र को 10 क्षेत्रीय कार्यालयों में विभाजित किया जाएगा । इन क्षेत्रीय कार्यालयों में एक रियायतग्राही का मुख्यालय होगा । समस्त क्षेत्रों तथा मुख्य कार्यालय में शिकायतें सुनी जाएगी और उनका निराकरण किया जाएगा । उपभोक्ताओं को यहां से देयक वितरित किए जाएंगे और जल प्रभार भी संग्रहीत किए जाएंगे ।
(6) प्रत्येक उपभोक्ता को उसके परिसर में जल आपूर्ति के लिए नगर पालिका के साथ एक अनुबंध (उपभोक्ता अनुबंध) करना होगा । वर्तमान वैध उपभोक्ताओं को नवीन अनुबंध हेतु कोई फीस देय नहीं होगी ।
(7) नगर पालिका द्वारा समस्त अवैध संयोजनों को संक्रमण कालावधि के भीतर वैध संयोजनों में संपरिवर्तित किया जाएगा । रियायतग्राही द्वारा समस्त अवैध संयोजनों को वैध संयोजनों में संपरिवर्तित करने के लिए नगरपालिका की पूर्ण सहायता की जाएगी ।
(8 ) रियायतग्राही जल आपूर्ति, जल प्रभारों, मीटर संस्थापन प्रभारों के संग्रहण तथा विच्छेदन हेतु प्राधिकृत होगा । उपरोक्त समस्त कार्य नगर पालिका के पर्यवेक्षण के अधीन किए जाएंगे ।
(9) "रियायतग्राही " को नगर पालिका शिवपुरी, के क्षेत्र में जल आपूर्ति करने का पूर्ण प्राधिकार होगा । यह स्वीकार्य है कि यहां किसी नई सुविधा के निर्माण या विद्यमान सुविधाओं की क्षमताओं में विस्तार के रूप में किसी प्रकार की कोई प्रतिस्पर्धी प्रणाली स्थापित नहीं की जाएगी । इसका यह अर्थ होगा कि नगर पालिका के भीतर जल आपूर्ति तथा वितरण के लिए किसी प्रकार की प्रतिस्पर्धी सुविधा अनुज्ञात नहीं की जाएगी , परंतु स्वामियों के निजी नलकूपों को बंद नहीं किया जाएगा । नगर पालिका अथवा रियायतग्राही द्वारा इन्हें अधिकार में नहीं लिया जाएगा । नगर पालिका अपने जल स्त्रोंतो के साधनों अथवा टैंकरों द्वारा जनहित में जल आपूर्ति करने हेतु स्वतंत्र होगी ।
(10) रियायतग्राही द्वारा सम्पूर्ण प्रचालन व संधारण कार्य नगर पालिका के पर्यवेक्षण में किया जाएगा । रियायतग्राही द्वारा उपभोक्ताओं की समस्त शिकायतें निवारित की जाएंगी । यदि रियायतग्राही द्वारा शिकायतें दूर नहीं की जाएं , तो नियमानुसार नगर पालिका द्वारा निवारित की जाएंगी । मध्यप्रदेश राजपत्र , दिनांक 9 मार्च 2018

(11 ) इस जल आपूर्ति योजना में कोई गैर- राजस्व प्रणाली की व्यवस्था नहीं है किन्तु समुचित स्थानों और समयों पर धार्मिक तथा सार्वजनिक कार्यों के लिए नगर पालिका, जल आपूर्ति की वर्तमान प्रणाली के अनुसार जल की आपूर्ति करेगा । नगर पालिका, जल आपूर्ति की वर्तमान प्रणाली के अनुसार उद्यानों, प्याऊ, फायर ब्रिगेड तथा सार्वजनिक उपयोगिता वाले शौचालयों को भी जल आपूर्ति करेगा । नगर पालिका, जल आपूर्ति से संबंधित अपने संसाधनों का उपयोग करने के लिए स्वतंत्र होंगे तथा रियायतग्राही उन्हें अपने अधीन नहीं कर सकेंगे ।
(12) राजपत्र में प्रकाशन की तारीख 01.06.2017 से प्रारम्भ होकर वाणिज्यिक प्रंचालन की तारीख 01.12.2017 की अवधि संक्रमण कालावधि होगी, इस समय के दौरान मीटर को वैध संयोजनों में संस्थापित किए जाएंगे तथा अवैध संयोजनों को नियमित किया जाएगा और उनमें मीटर लगाए जाएंगे । उन उपभोक्ताओं से जिनके मीटर संक्रमण कालावधि में नहीं लग पाए हैं फ्लेट दर पर बिल दिए जाएंगे ।
(13) रियायतग्राही द्वारा मीटर उपलब्ध कराने तथा संस्थापित करने तथा अवैध संयोजनों का नियमितीकरण करने में निम्नानुसार कर्तव्यों को संपादित किया जाएगा:-
(क) रियायतग्राही, राजपत्र में अधिसूचना की तारीख से मीटर संस्थापित करने तथा अविधिमान्य जल संयोजनों का नियमितीकरण करने तथा उन्हें मीटर उपलब्ध कराने का कार्य प्रारंभ करेगा । किसी उपभोक्ता का संयोजन, जल मीटरों की अनुपलब्धता या कमी के कारण रोका नहीं
जाएगा । उस उपभोक्ता को मीटर लगने तक फ्लेट दर पर बिल दिया जाएगा ।
(ख) रियायतग्राही अपने मजदूरों तथा कर्मचारिवृन्द को उपभोक्ताओं के परिसरों में जल संयोजनों को जोड़ने का नियमितिकरण करने , नोटिस देने तथा मीटर संस्थापित करने के काम में लगाएगा ।
(ग ) ऐसे घरेलू उपभोक्ताओं के मामले में, जो रियायतग्राही से मीटर लगवाने में सहमत नहीं हो, वहां इस प्रक्रिया को नगर पालिका पूर्ण कराएगा । अन्यथा फ्लेट दर 200.00 रूपए प्रतिमाह की दर से प्रभार लिया जाएगा , जो कि गरीबी रेखा के नीचे के उपभोक्ता की स्थिति में आधा होगा । 304 (5 )

(घ ) रियायतग्राही, अवैध जल संयोजनों के नियमितीकरण , उपभोक्ताओं के मीटर संस्थापन तथा शेष राशि की वसूली का अभिलेख रखेगा ।
(ङ) रियायतग्राही उपभोक्ताओं के परिसरों में संस्थापित मीटर के देयक संग्रहीत करेगा और उन्हें नगर पालिका में प्रतिपूर्ति के लिए प्रस्तुत करेगा । नगर पालिका द्वारा रियायतग्राही को राशि की प्रतिपूर्ति की जाएगी । जिसे रियायतग्राही उपभोक्ता से मीटर के मूल्य को संग्रहीत करने के उपरांत प्रत्येक माह नगर पालिका को जमा करेगा ।
(च) रियायतग्राही 10 प्रतिशत मीटर तथा अन्य स्पेयर यूनिट द्वारा बनाए रखेगा ।
4. नगर पालिका के कर्तव्य. नगर पालिका के कर्तव्य निम्नानुसार होंगेः- (1) नगर पालिका, अवैध जल संयोजनों को नियमित करने के लिए तथा राजपत्र में अधिसूचित किए जाने से 6 मास की कालावधि के भीतर जल मीटर संस्थापित करवाने के लिए एक आम माफी योजना तैयार और घोषित करेगी, यह आम माफी अवधि कहलाएगी । इस अवधि में मीटर संस्थापित किए जाने तक उपभोक्ता फ्लेट दर से जल प्रभार का भुगतान करेंगे ।
(2) राजपत्र में अधिसूचना की तारीख से, नगर पालिका, रियायतग्राही को मीटर लगाने में तथा समस्त अवैध संयोजनों को नियमित करने में मदद करेगी । इस प्रक्रिया के अंतर्गत उपभोक्ताओं से आवेदन लिए जाएंगे तथा करार करने की प्रक्रिया की जाएगी । फीस के साथ समस्त आवेदन नगर पालिका के कार्यालय में प्रस्तुत और जमा किए जाएंगे । इस कार्य हेतु-
(क) जल संयोजन के लिए आवेदन प्रस्तुत किए जाएंगे और स्वयं नगर पालिका द्वारा अनुज्ञा दी जाएगी ।
(ख) मीटर का मूल्य और जल संयोजन प्रभार नगर पालिका के खाते में जमा किए जाएंगे । '
(ग) नगर पालिका, रियायतग्राही को उपभोक्ताओं की सूची, उनके पते, सुरक्षा निधि तथा अतिशेष राशि की जानकारी के साथ उपलब्ध कराएगा । इस अतिशेष राशि की वसूली नगर पालिका करेगी और अवधान द्रव्य (काशन मनी) नगर पालिका के पास रहेगी । मध्यप्रदेश राजपत्र, दिनांक 9 मार्च 2018

(घ) नगर पालिका, जल संयोजनों के नियमितीकरण के लिए नोटिस जारी करने में रियायतग्राही एजेन्सी के कर्मचारिवृन्द तथा मजदूरों की मदद करेगी ।
(च) उस दशा में जहां मीटर संस्थापित किए जाने में उपभोक्ता का रियायतग्राही एजेंसी के कर्मचारिवृन्द तथा मजदूरों से कोई विवाद या असहमति है, तो उक्त विवाद का नगर पालिका द्वारा निवारण किया जाएगा । नगरपालिका का विनिश्चय उपभोक्ता एवं रियायतग्राही को लागू होगा ।
(छ) नगर पालिका, राजपत्र में अधिसूचना की तारीख से वाणिज्यिक प्रचालन की तारीख तक जल प्रभारों के समस्त बकाया को प्राप्त और जमा करेगा ।
(3) नगर पालिका तथा रियायतग्राही द्वारा संयुक्त रूप से किए जाने वाले कृत्य.-
(क) इस जल आपूर्ति योजना के अधीन मीटर संस्थापन और विकास के कार्य उपभोक्ता के हित में एक सांथ किए जाएंगे ताकि उपभोक्ता मीटर संस्थापित करवाने में रूचि ले सके । ऐसी कार्य प्रक्रिया के लिए नगर पालिका तथा रियायतग्राही क्रमशः दोनों सहमत होंगे । विवाद की स्थिति में नगर पालिका का विनिश्चय अंतिम होगा । मीटर की गुणवत्ता, पेयजल अनुबंध एवं आवेदन का प्ररूप नगर पालिका के द्वारा विनिश्चित किया जाएगा ।
(ख) कोई भी व्यक्ति अथवा संगठन, नगर पालिका / रियायतग्राही के कार्यालय में स्थाई / नए अस्थाई जल संयोजन के लिए अथवा वर्तमान जल संयोजन के अंतरण के लिए अथवा जल संयोजन में किसी परिवर्तन के लिए आवेदन प्रस्तुत कर सकेगा । नगर पालिका द्वारा अनुज्ञा दी जाकर रियायतग्राही को इसके बारे में सूचना दी जाएगी ।
(ग) नगर पालिका द्वारा नए जल संयोजन की अनुज्ञा के पश्चात् रियायतग्राही द्वारा जल संयोजन किया जाएगा ।
(घ) मीटर संस्थापित करने की प्रक्रिया जल मापन तथा संयोजन का नियमितीकरण उपविधियां, 2017 के अनुसार होगी । उपभोक्ता सुरक्षा निधि नगर पालिका कार्यालय में जमा करेगा और उसकी रसीद प्राप्त करेगा । रसीद का परीक्षण करने के पश्चात् रियायतग्राही उपभोक्ता को मीटर लगाने के लिए सूचित करेगा । 304

मीटर संस्थापित करने के लिए तथा मीटर का अपेक्षित मूल्य रियायतग्राही द्वारा वहन किया जाएगा जिसकी प्रतिपूर्ति नगर पालिका द्वारा की जाएगी । यह रकम रियायतग्राही द्वारा उपभोक्ता से किश्तों में ली जाएगी और नगर पालिका में जमा की जाएगी । यदि मीटर तकनीकी रूप से खराब होता है , तो वह निःशुल्क बदला जाएगा, किन्तु यदि मीटर उपभोक्ता द्वारा खराब किया जाना पाया गया तो मीटर की फीस के साथ शास्ति को सम्मिलित करते हुए बदला जाएगा ।
(ङ) समस्त फिटिंग तथा सेवा पाइप सर्विस पाइप से जोड़े जाएंगे तथा आवेदक के परिसरों का समस्त कार्य रियायतग्राही द्वारा कराया जाएगा ।
(च ) समस्त पाईपों को ऐसी रीति में रखा या लगाया जाना चाहिए कि वे ग्रीष्म की गर्मी से प्रभावित न हों या उपभोक्ता के पाईप एवं फिटिंग को क्षति न हो और न तो उसमें दूषित जल लाइन मिलने का खतरा हो , न ही जल प्रदूषण होने का खतरा हो । पाईपों . को भवन के अंदर इस रीति में लगाया जाएगा कि रियायतग्राही के कर्तव्यारूढ़ कर्मचारियों की वहां तक पहुंच हो सके । फिटिंग तथा पाइपों की सामग्री का उपयोग किए जाने के पूर्व वह रियायतग्राही के प्रतिनिधि एवं नगर पालिका द्वारा पारित तथा मंजूर किए जाएंगे । जलप्रदाय तब तक प्रारंभ नहीं किया जाएगा जब तक किं रियायतग्राही के प्रतिनिधि एवं नगर पालिका द्वारा पाइप लाइन आदि के किए गए कार्य को अनुमोदित न कर दिया गया हो ।
(छ) यदि यह पाया जाता है कि मीटर की सील तोड़ी गई है , उसे मीटर से निकालने से मीटर आंशिक रूप से क्षतिग्रस्त हो गया है तो पुनः सीलिंग तथा मरम्मत हेतु प्रभार 500 / - रूपए तक होगा ।
(4) जल टैरिफ एवं भुगतान की शर्तेः- (1 ) मीटर के माध्यम से प्रदान किए जाने वाले जल के लिए वाणिज्यिक प्रचालन की तारीख से जल टैरिफ की दरें निम्नानुसार विनिश्चित की गई थी ।

2. परिमाण उपभोक्ताओं के द्वारा जल का निर्धारित मात्रा से कम उपभोग करने पर अथवा जल का उपभोग न करने की स्थिति में उपभोक्ता द्वारा न्यूनतम रु. 30 / -प्रतिमाह भुगतान करना होगा । (2) उपभोक्ताओं को मीटर के माध्यम से प्रदान किए जाने वाले जल टैरिफ का निर्धारण रियायतग्राही एवं नगर पालिका, शिवपुरी के मध्य अनुबंध के अनुसार किया गया था । टैरिफ वाणिज्यिक संचालन की तारीख से लागू किया गया था । योजना के कार्य में अनियंत्रित कारणों से विलम्ब होने के कारण वाणिज्यिक संचालन की दिनांक में परिवर्तन हुआ है । जल टैरिफ की दरों का पुनरीक्षण अनुसूची-ट (उपाबंध- क) के अनुसार वाणिज्यिक प्रचालन की मूल दिनांक से किया जाएगा एवं तद्नुसार उपभोक्ताओं से जल टैरिफ लिया जाएगा ।
(3) रियायतग्राही मीटर रिकार्ड करने के 10 दिवस के भीतर देयक (बिल ) जारी करेगा । भुगतान के लिए अधिकतम समय 30 दिन होगा । विलम्बित भुगतान की स्थिति में रियायतग्राही विलम्ब शुल्क के रूप में उपभोक्ता से शेष राशि पर रूपए 1 प्रतिमाह का प्रभार लगाएगा । विलंब शुल्क पर विलंब शुल्क प्रभारित नहीं हो सकती ।
(4) रियायतग्राही को संयोजन काटने का अधिकार है । यदि उपभोक्ता दो माह की कालावधि के भीतर देयक का भुगतान नहीं करता है तो रियायतग्राही नगर पालिका के पूर्व अनुमोदन से संयोजन काटने के लिए प्राधिकृत रहेगा । (5) रियायतग्राही संयोजन राशि, शेष राशि, और जल देयक राशि के भुगतान के पश्चात् एक दिवस में जल संयोजन पुनः जोड़ेगा ।
(6 ) प्रत्येक तीन वित्तीय वर्षों के पश्चात्, रियायतग्राही द्वारा जल प्रभार को समिति और स्वतंत्र पर्यवेक्षक की देख रेख में दिए गए अभिबंधनों और शर्तों के अनुसार पुनरीक्षित किया जाएगा । प्रभारों को पुनरीक्षित करने की प्रक्रिया रियायत अनुबंध के निबंधनों के अनुसार की जाएगी । पुनरीक्षित जल प्रभार प्रेसिडेंट- इन- कॉउंसिल तथा साधारण परिषद् की मंजूरी के पश्चात् क्रियान्वित किया जाएगा ।
(7) नवीन कालोनियों जिन्होंने अनुज्ञा प्राप्त की है या जिनके पास विकास प्रमाण पत्र है ऐसी कालोनियों के कालोनाइजर को प्रत्येक भू- खण्ड पर वैयक्तिक संयोजन लेना होगा और ऐसे भू- खण्डों पर/ भवनों पर आवश्यक रूप से एक जल मीटर भी लगाया जाएगा । कालोनाइजर को संबंधित भू-खण्डों को वितरण के लिए , ऐसी पाईप लाइन की लागत का भुगतान करना होगा, मध्यप्रदेश राजपत्र , दिनांक 9 मार्च 2018

इसके लिए नगर पालिका/ रियायतग्राही द्वारा विनिश्चित किए गए विनिर्दिष्ट व्यास के पाईप होंगे , वही पाईप लाइन अन्य कालोनियों तक बढ़ाई जा सकती है इसके लिए नगर पालिका के पास अधिकार होगा ।
(8) मध्यप्रदेश नगर पालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 ) के उपबंधो के अनुसार और इसके अधीन बनाए गए नियम, के साथ कालोनाइजर नियम के अनुसार, यदि किसी कालोनाइजर को जल आपूर्ति के लिए ओव्हरहेड वाटर टंकी एवं जल स्त्रोतों का निर्माण करने की न्यूनतम अपेक्षा होती है, चूंकि उक्त जल आपूर्ति योजना का संचालन हो रहा है, अतः कालोनाइजर ' एक ओव्हरहेड वाटर टैंक का निर्माण करेगा अथवा वह टैंक, नलकूप और मोटर पम्प के निर्माण की राशि नगर पालिका के कार्यालय में जमा करेगा । ऐसे टैंक के निर्माण के लिए कॉलोनाइजर नगर पालिका, शिवपुरी को ओ. एच.टी. की भूमि का अंतरण करेगा । विशेष परिस्थितियों में कॉलोनाइजर या रहवासियों का संघ परिमाण जल आपूर्ति की इच्छा करते हैं, तो यह बाध्यता होगी कि नगर पालिका/ रियायतग्राही की अनुशंसाओं के अनुसार कार्रवाई की जाएगी ।
(9) गरीबी रेखा के नीचे के घरेलू संयोजन हेतु, संयोजन प्रभार का 50 प्रतिशत साधारण प्रभार होगा ।

In exercise of the powers conferred by section 355, 356 and 358 of the Madhya Pradesh Municipal Council Act, 1961 ( No. 37 of 1961 ) , the Municipal Council , Shivpuri , for areas of Municipal Council , hereby , makes the following byelaws for Water Metering and Regularization of connection under Public Private Project mode namely: -
BYELAWS
1. Short title , application and commencement.- ( 1 ) These byelaws may be called the Water Metering and Regularization of Connection Byelaws , 2018 .
(2) They shall be applicable in the area of Municipal Council , Shivpuri .

(3) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2 . Definitions- In these bylaws , unless the context other wise requires , -
(a) "Byelaws " means the right and duty between the Concessionaire and Customer for water supply under the public - private partnership scheme for a concession period;
(b) "Commercial connection " means the consumption of water drawn by the institution / proprietor / organization like Hostels , Shops , Theatres , Laundries , Community Halls , Private Hospitals , Hotels , Marriage Garden , Showroom , Godowns , Private Educational Institutions and similar other institutions .
(c) "Commercial operation date " means the date of finishing successful operational inspection after the construction of Water Supply Scheme , which shall be notified by the Municipal Council , Shivpuri in writing;
(d) "Chief Municipal Officer " means Chief Municipal Officer ofMunicipal Council , Shivpuri ;
(e) "Communication Pipe " is system of pipe lines of their branches for the supply of water to domestic , institutional , commercial and industrial land , house , garden or industry . Including Connection pipe and meter ;
( 1) "Concessionaire " means Shivpuri Water Infrastructure Ltd. , agency authorized by Municipal Council , Shivpuri which has been appointed in accordance with the agreement;

(g) "Consumer" means any person or institution currently getting the benefit of water supply from Municipal Council , Shivpuri or shall get the benefit in future on its own name or as a manager through Concessionaire ;
(h) "Connection pipe " means part of pipe which connects ferule to stop cock;
(i) "Council" means Municipal Council , Shivpuri for the purpose of these byelaws;
(j ) "Domestic connection " means the consumption of water drawn by the people for the need of only domestic purposes like drinking , cooking , bathing , washing , cleaning and flushing of toilets , household gardening , pet animals and individual air conditioning;
2 ( k) "Ferule" means part of connection pipe to connect main pipe or branches to connection pipe ;
(1) " Industrial connection" means the consumption of water done by industries like Oil Mills , Dal Mills , Paper Mills , Ice Factories , Service Station , Workshop Foundries , Packing Industries or any other industry which consumes water for producing the final product directly or for the purpose of serving domestic needs of the people working or staying in the industries and any other industry which is defined by Industries Department ;
(m) " Institutional connection" means the consumption of water drawn by the institutions like school , colleges , offices , hospitals ( Government , Semi- Government and private) , Charitable Trust, public gardens and institutions not run for profit ;

304 ( 13) (n) "Main pipe" means pipe which is connecting to the water collecting pipe for water supply purpose ;
(0) "Meter" means device for measuring quantity of water supplied to consumer through the connection ;
(p) "Price Review Committee " means Committee which consists of 5 members , the President Municipal Council , Chief Municipal Officer , Municipal Engineer , Municipal Chief Auditor and one representative of the Concessionaire ;
(q) " Service pipe" means pipe which is used for water supply from stop cock to premise of house , institution , Commercial and industrial place and garden ;
(r) " Stop cock" means a device which is fitted at end of connection pipe to control water supply in premises of consumers .
3. Duties of concessionaire- The Municipal Council , Shivpuri is issuing these byelaws under section 355 , 356 and 358 of the Madhya Pradesh Municipal Council Act , 1961. The council enters to employ the Concessionaire Shivpuri Water Infrastructure Ltd. to discharge the following duties and obligations and exercise its right and power for water supply operation and maintenance: -
(1) All the expenditure regarding operation of the water supply scheme , maintenance of the scheme components , मध्यप्रदेश राजपत्र, दिनांक 9 मार्च 2018

Electricity bills , cost of raw water , necessary chemicals required for water purification shall be born by concessionaire from the date of commencement of water supply to the date of handing over the scheme to Municipal Council , Shivpuri including concession period . From the " Commercial operation date " function of charging and collecting water charges from consumers on monthly basis shall be done by the Concessionaire . After Expiry of concession period the Concessionaire shall transfer this system in good , running condition (which shall be determined , organized and empowered by a committee consisted by Municipal Council , which shall have the representatives of Concessionaire ) without any liabilities .
(2) The Concessionaire shall provide water supply to all the consumers for duration of 24 x 7 with residual pressure up to the height of 7 meters at service point . The required repairing/ rectification shall be completed within 3 days of complaint at the cost of the complainant . If the damage is beyond the meter then the repair work shall be done by the consumer or the expense for repair shall be borne by the consumer .
(3) Concessionaire shall ensure metering for all consumers by the start of Commercial Operation Date . The Concessionaire shall serve monthly bills to the consumers according to the reading of the water meter as specified in clause 13 ( 3) and for those consumers who have not installed the meter will serve flat rate bill upto transition period . time to time as per concession agreement . In addition the bill , water charges shall include the meter cost . Half of the meter cost shall be paid at the time of connection and remaining amount shall be paid within 6 months in installments .
(4) In the entire municipal council area , pure and filtered water shall be supplied as per CPHEEO - Manual on Water Supply and Treatment May , 1999. This water supply shall be done as per the guidelines specified in I.S. 10500 (Asamended) .
(5) The entire distribution system has been divided into 10 zones . Each zone served preferably by a overhead Elevated Service Reservoir ( ESR) . Whole Municipal Council area shall be divided into 10 zonal offices . Out of these zonal offices one shall be the head office of the Concessionaire . In all zones and the main office , the complaints shall be heard and redressed . The bills of consumers shall be distributed from here and also water charges shall also be collected .
(6) Every consumer shall have to enter into an agreement (consumer agreement) with the Municipal Council , for supply of water to his premises . current legal consumers shall not be paid any fees for new agreement .
(7) The Municipal Council shall convert all the illegal connections into legal connections within transition period . The Concessionaire shall completely help Municipal Council to make the illegal connections legal .

(8) Concessionaire shall have authority for water supply, collection of water charges , installation charges of meter and disconnection . All above works shall be done under the supervision of Municipal Council .
(9) " Concessionaire " shall have absolute authority to supply water in area of Municipal Council , Shivpuri . It is agreed that there shall be no commission of any similar system competing by way of construction of a new facility or augmentation of capacities of existing facilities . It means any similar competing facilities for water supply and distribution within Municipal Council shall not be allowed , but individual tubewell of owner shall not be closed , it shall not be taken over by the Council or Concessionaire . Municipal Council shall be free to supply water by means of its water sources or tankers in public interest .
(10) All the Operation and Maintenance works of water supply by the Concessionaire shall be done under the supervision of Council . All complaints of the consumer shall be redressed by Concessionaire . If the complaints are not redressed by the Concessionaire , then it shall be redressed by Council as per the rule .
( 11 ) There shall not be a system of non - revenue in this water supply scheme . But for religious and social work on the appropriate places and time , the Council shall supply the water as per the present system of water supply . The Council shall also supply water for the gardens , pyaau , fire brigade and public utility washrooms as per the present system of water supply . The Municipal Council 304 ( 17)

shall be independent to use the resources regarding water supply and concessionaire shall not make it to their subjection .
(12) The date of publication in the Gazette shall begin from 01.06.2017 and the term of the commercial operation date 01.12.2017 shall be called transition period , during this time the meter shall be installed in valid connections and illegal connections shall be regularized and meters shall be installed . During the transition period those consumers who have not the meter installed , shall be served flat rate bills .
(13) The concessionaire shall perform the following duties to make available and install the meters and regularization of the illegal connections : -
(a) The concessionaire shall start the work of establishing meter and regularization of invalid water connections and providing them meters from the date of gazette notification . Connection of any consumer shall not be stopped due to unavailability or lack of water meter .
The consumer shall be served bill by flat rate upto installation of meter .
(b) The concessionaire shall put its labour and staff for regularization of assembling the water connections , serving notice and establishing meters in the premises of the consumer .
(c) In the case of such household consumers , who does not agree to take meter from the concessionaire , the Municipal Council shall complete the process otherwise the flat rate shall be charged at the rate of मध्यप्रदेश राजपत्र , दिनांक 9 मार्च 2018

200.00 rupees per month , which would be half in case of Below Poverty Line consumer .
(d) The concessionaire shall keep the record of regularization of invalid water connections , establishment of consumers meter and recover the balance amount .
(e) Concessionaire shall raise the bill for meter installed in consumers premises and the same shall be submitted to Municipal Council for reimbursement . Municipal Council shall reimburse the amount to concessionaire . Concessionaire shall deposit the meter cost to Municipal Council every month after collecting from the consumer .
(f) The concessionaire shall keep the 10 % of meters and other spares as stand by unit .
4. Duties of Municipal Council.- Duties of Municipal Council shall be as follows : -
(1) Municipal Council shall prepare and announce an Amnesty plan for regularizing illegal water connections with penalties and installing water meters within a period of 6 months from Gazette Notification , it's called Amnesty Period . During this period consumers shall pay water charge as per flat rate till the meter is installled .
(2) From the date of gazette notification , the Municipal Council shall help the concessionaire to put up the meter and to make the valid all the invalid connections . Under this process applications shall be received from the consumer and the process of making agreement shall be done. All the applications with the fees shall be submitted and deposited in the office of Municipal Council . For this work - 304 ( 19)

(a) an application for water connection shall be submitted and permission shall be granted by the Municipal Council itself;
(b) cost of meter and water connection charges shall be deposited in the account of Municipal Council ;
(c) the Municipal Council shall provide the list of consumers with the information of their address , caution money and balance amount to the concessionaire . This balance amount shall be recovered by Municipal Council and will own the caution money
(d) the Municipal Council shall help the staff and labours of concessionaire agency for issuing notices of regularization of water connections .
(e) in case the consumer has any disputes or disagreement with the staff and labour of concessionaire to establish the meter , the Municipal Council , shall redress the said dispute . The decision of Municipal Council shall be applicable to consumer and concessionaire .
(f) the Municipal Council shall receive and deposit all the arrears of water charges from date of Gazette Notification till the date of commercial operation .
(3) Function to be Performed jointly by the Municipal Council and Concessionaire : -
(a) Under this water supply scheme the establishment and development of meter shall work together in the interest of consumer so that the consumer may have interest for establishing meter . be final . Quality of meter , format of application and agreement shall be decided by Municipal Council .
(b) Any individual or organization may submit an application to the office of Municipal Council / Concessionaire office for permanent/new temporary water connection or transfer of present water connection or for a change in the water connection . The permission shall be granted by the Municipal Council and Concessionaire shall be informed about it.
(c) After permission of new water connection granted by the Municipal Council , Concessionaire will make the connection .
(d) The process of installing meter shall be according to Water Metering and Regularization of connection Byelaws , 2017. The consumer shall deposit the caution money in Municipal Council office and shall get the receipt of it . After examination of the receipt , concessionaire shall inform the consumer to installed meter . The cost of meter and meter installation shall be beared by the concessionaire which shall be reimbursed by Municipal Council . This amount shall be taken from consumer by concessionaire in installments and shall be deposited in Municipal Council . If the meter is found technically faulty , then it shall be replaced free , but if the meter is found tempered by the consumer , मध्यप्रदेश राजपत्र, दिनांक 9 मार्च 2018
304 (21 ) then it shall be replaced with the cost of meter including penalty .
( e) All fittings and service pipes shall be connected from the service pipe and all works shall be done by the concessionaire to the applicant's premises .
(f) All the pipes should be kept or fixed in a manner that they should not be affected by the summer hit or the pipe and fittings of the consumer should not be destroyed , neither it should not be in danger to get connected with the drainage line nor there should be a danger of water pollution . Pipe should be fixed inside the house in a manner that the on duty employees of the concessionaire may have approach upto that place . Before using the material of fitting and pipe it shall be passed and sanctioned by the representative of concessionaire and Municipal Council . The water supply shall not start upto the time that the representative of concessionaire and Municipal Council has approved the same .
(g) If it is found that the seal of meter is broken, taken out of the meter is damaged partially then upto Rs . 500 / - shall charged for resealing or repairing.

Note: -
1. The Below Poverty Line consumers identified by Municipal Council , Shivpuri shall be charged at half rate of the tariff mentioned in the table above . In case of not consuming the water or consuming the water less than the minimum fixed quantity minimum charge of Rs . 30 / - per month shall have to paid by the consumer .
2. In case of not consuming the water or consuming the water less than the minimum fixed quantity by bulk consumers minimum charge of Rs . 30 / - per month shall have to paid by the consumer .
(2) The fixation of water tariff for the water supplied to the consumers through meter was done according to the agreement between Concessionaire and Municipal Council , Shivpuri . The tariff was applicable from the commercial operation date . Due to uncontrolable reasons the work of water supply scheme has delayed and commercial operation date has changed . The rate of water teriff shall be revised according to Scheduled- K (Annexure- A) from the original commercial operation date and the water teriff shall be charged to consumers accordingly .
(3) The concessionaire shall issue the bill within 10 days of meter recording . The maximum time for payment shall be 30 days . On delayed payment the concessionaire shall charge Rs . 1 per month on the balance amount of the consumer as a late fee . Late fees cannot be charged on the late fees .

(4) The concessionaire has a right of disconnection. If the consumer does not pay the bill within a period of two months , the concessionaire is authorized for disconnection with a prior approval of the Municipal Council .
(5) The concessionaire shall reconnect the water connection in 1 day after payment of connection amount , balance amount and water bill amount .
(6) The concessionaire water charge shall be revised after each of three financial years this will be done according to the commitments and conditions given in the monitoring of the committee and the independent supervisor . Process to revise the charges shall be done according to the terms of the Concessions agreement . The revised water charges shall be implemented after sanction of President in Council and General Assembly .
(7) The new colonies which have got permission or have the certificate of development in their favour , the colonizers of such colony shall have to take individual connections on every plot and a water meter shall also be installed on such plots / houses compulsorily. The colonizer has to pay such cost of pipe line borne by him for distribution to the respective plots for specified diameter of pipe decided by the Municipal Council / concessionaire . The same pipeline can be extended to the other colonies , the Municipal Council shall have right for the same .

(8) In accordance with the provisions of the Madhya Pradesh Nagar Palaika Adhiniyam , 1961 (No. 37 of 1961 ) and the rules made thereunder as well as per the provisions of Colonizers rules ; If any , It shall be the Minimum requirement for the colonizer to construct a over head tank for water supply . As the said water supply scheme is being operated , therefore the colonizers shall construct an overhead tank or otherwise he has to deposit the amount of construction of tank, boring and motor pump in the office of Municipal Council . For the construction of such tank, the colonizer has to transfer a land of OHT to the Municipal Counsil , Shivpuri . In the special condition colonizer or union of residence wants to bulk supply , it shall be obliged to take action according to the recommendation of the Municipal Council /concessionaire .
(9) Connection charge for domestic connection of Below Poverty Line shall be 50% of the normal charge .
