मध्यप्रदेश आबकारी अधिनियम, 1915 (क्रमांक 2 सन् 1915) की धारा 62 की उपधारा 2(क), (घ) , (छ) और (ज) के द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , भांग नियमों में, निम्नलिखित और संशोधन करती है , अर्थात्:-
संशोधन
उक्त नियमों में,--
1. विद्यमान नियम 2 के पश्चात्, निम्नलिखित नियम जोड़ा जाए , अर्थात्:-
"2- क. औषधीय और प्रसाधन वस्तुओं के सद्भावपूर्ण विनिर्माण के प्रयोजन के लिये , मध्यप्रदेश आबकारी अधिनियम, 1915 (क्रमांक 2 सन् 1915) की धारा 16 की उपधारा ( 1 ) के अधीन विहित सीमा से अधिक भांग को , विहित फीस के संदाय किये जाने पर सहायक आबकारी आयुक्त/ जिला आबकारी अधिकारी द्वारा प्ररूप एच.डी. 1 -अ में प्रदत्त लिखित अनुज्ञा के अधीन, रखा जा सकता है और परिवहित किया जा सकता है ।
(एक) जिस जिले में कारखाना स्थित है या स्थापित किया जाना प्रस्तावित है उस जिले के सहायक आंबकारी आयुक्त/ जिला आबकारी अधिकारी को अनुज्ञप्ति के लिए

विनिर्माता निम्नलिखित रूप में आवेदन करेगा । ऐसे प्रत्येक आवेदन पत्र में निम्न विवरण का समावेश रहेगा,-
(क) आवेदक का नाम और पताः
(ख) कारखाने का नाम और अवस्थिति यदि कोई हों, जिसमें भांग का औषधीय और प्रसाधन वस्तुओं के सद्भावपूर्ण विनिर्माण के प्रयोजन के लिये उपयोग किया जाना हैः
(ग) भांग की वार्षिक आवश्यकता (किलोग्राम में):
(घ) विनिर्मित की जाने वाली सामग्री का नाम (केवल उन्हीं सामग्रीयों के नाम का उल्लेख करें, जिनके विनिर्माण फार्मोकॉपिया (भेषज रत्नावली, आयुर्वेद सार संग्रह , रसतंत्र सार संग्रह, भाव प्रकाश निघन्टु एवं स्वानुभूत योग ) के आधीन एवं आयुष विभाग , मध्यप्रदेश के सक्षम प्राधिकारी द्वारा स्वीकृति के अध्यधीन किये जाने हो)
(ड.) औषधीय एवं प्रसाधन सामग्री
क्याआवेदक सम्पाकों के विनिर्माण के लिए औषधि और प्रसाधन सामग्री अधिनियम 1940 ( 1940 का 25 (डी) ) के अधीन अनुज्ञप्ति धारित करता है, यदि ऐसा है तो अनुज्ञप्ति का प्रकार, संख्या और दिनांक लिखें ।
(दो) सहायक आबकारी आयुक्त/ जिला आबकारी अधिकारी, संचालक स्वास्थ्य सेवाएं, मध्यप्रदेश या संचालक , उद्योग , मध्यप्रदेश, यथास्थिति से परामर्श के पश्चात्, आगामी 31 मार्च को वर्ष को समाप्त होने वाले वर्ष या वर्ष के किसी भाग के लिए फीस रूपये 10000 / - के रूप में संदाय किये जाने पर, प्ररूप एच.डी. 1 - क में अनुज्ञप्ति जारी कर सकेगा ।
(तीन) आबकारी शुल्क ऐसी दरों पर जैसी कि राज्य शासन समय- समय पर निर्धारित करें, संदाय किये जाने पर अनुज्ञप्ति के अंतर्गत प्राप्त की जाने वाली भांग सहायक आयुक्त आबकारी / जिला आबकारी अधिकारी की पूर्व अनुमति से भांग नियम के नियम 15 के अधीन प्रभारी अधिकारी द्वारा जारी किये गये मांग पत्र के अनुसार और मद्यभाण्डागार अधिकारी द्वारा जारी अनुज्ञा के अधीन परिवहन की जायेगी । मध्यप्रदेश राजपत्र , दिनांक 23 अप्रैल 2018
492( 1) (चार) भांग नियमों और अनुज्ञप्ति की शर्तों के उचित पालन के लिए, अनुज्ञप्त विनिर्माता सहायक आबकारी आयुक्त / जिला आबकारी अधिकारी के पक्ष में जमानत के रूप में रूपये 25000/- की बैंक गारंटी प्रस्तुत करेगा । " ।
2. विद्यमान प्ररूप एच.डी. -1 के पश्चात्, निम्नलिखित प्ररूप जोड़े जाएं, अर्थात्:-
"प्रारूप एच.डी.1 -क
औषधीय और प्रसाधन सामग्रीयों के सद्भावपूर्ण विनिर्माण के प्रयोजन के लिये, विहित सीमा से अधिक भांग का कब्जा रखने, विनिर्माण करने या परिवहन करने के लिये विशेष अनुज्ञा भांग नियमों के नियम 2- क के अधीन, औषधीय और प्रसाधन सामग्रियों के विनिर्माण के सद्भावपूर्वक प्रयोजन के लिये, विहितं सीमा से अधिक भांग को रखने एवं परिवहन करने के लिये श्री आत्मज निवासी.. को विशेष अनुज्ञा प्रदत्त की जाती है ।
यह अनुज्ञा दिनांक से रहेगी तक और निम्नलिखित शर्तों के मान्य
शर्तें
(1) निम्नलिखित सामग्रियों (इसमें इसके पश्चात् उक्त सामग्री निर्दिष्ट है ) के विनिर्माण के लिये यह सुविधा विस्तारित है

(2) अनुज्ञप्तिधारी मद्यभण्डागार से भांग (ड्रग) का क्रय कर सकेगा और उसका परिवहन मद्यभण्डागार ऑफिसर द्वारा प्रदत्त की गई अनुज्ञा के अधीन , अनुज्ञप्त परिसरों में कर सकेगा। कुल मात्रा जो यह अनुज्ञा दिये जाने की तारीख से प्रारंभ होने वाली प्रत्येक तिमाही के दौरान क्रय की जा सकेगी, ...किलोग्राम से अधिक नहीं होगी । जाएगी । किलोग्राम से अधिक भांग की मात्रा किसी भी समय कब्जे में नहीं रखी (3) अनुज्ञप्तिधारी, अनुज्ञप्त परिसरों के सिवाय उससे उक्त सामग्रियों में से किसी विनिर्माण को अन्यत्र नहीं रखेगा ।
(4) उक्त सामग्रियों के विनिर्माण से भिन्न प्रयोजन के लिये भांग की बिक्री या उनका उपयोग पूर्णतः वर्जित है ।
(5) अनुज्ञप्तिधारी , उसके द्वारा विनिर्मित सामग्रियों को धारित करने वाले पैकेट, जार या अन्य पात्र पर, सामग्री में मिश्रित किये गये भांग का अनुपात प्रदर्शित करेगा ।
(6) अनुज्ञप्तिधारी नीचे दिए प्ररूप में अनुज्ञप्ति के अधीन सौदों का वास्तविक लेखा जोखा संधारित करेगा । तहसील और भण्डागार से प्राप्त अनुज्ञाएं सावधानी पूर्वक लेखा जोखा के समर्थन में नत्थी की जाएगी । लेखा जोखा और अनुज्ञाएं दो वर्षों की अवधि के लिये संरक्षित रखे जाएंगे ।
(7) भांग के सभी भण्डार और लेखा जोखा और सभी सौदों का अभिलेख , उपनिरीक्षक से अनिम्न श्रेणी के किसी आबकारी या पुलिस अधिकारी द्वारा श्रेणी निरीक्षण के लिए उपलब्ध रहेंगा ।
(8) आबकारी आयुक्त या उसके द्वारा सम्यक् रूप से प्राधिकृत अधिकारी की मांग पर, अनुज्ञप्तिधारी अपनी अनुज्ञप्ति को सुधार के लिये और नई अनुज्ञप्ति जारी करने के लिये सुपुर्दकरेगा ।
(9) अनुज्ञा के लिये रूपये 10000 / - वार्षिक फीस संदत्त की जाएगी तथा नियमों के किसी उल्लंघन के लिए प्रतिभूति के रूप में रूपये 25000 /- की बैंक गारंटी प्रस्तुत करनी होगी । मध्यप्रदेश राजपत्र, दिनांक 23 अप्रैल 2018
492(3) (10) उपरोक्त किन्हीं शर्तों या मध्यप्रदेश आबकारी अधिनियम , 1915 (क्र. 2 सन् 1915) या उसके अधीन बनाए गए नियमों या समय- समय पर जारी किये गये किन्हीं अन्य अनुदेशों के उल्लंघन किये जाने पर, अनुज्ञापन प्राधिकारी अनुज्ञप्ति रद्द कर सकेगा ।

In exercise of the powers conferred by clause ( d) , ( g) and (h ) of sub- section (2) of section 62 of the Madhya Pradesh Excise Act , 1915 ( No. II of 1915) , the State Government , hereby, makes the following further amendments in the Bhang Rules , namely: -
AMENDMENTS
In the said rules , -
1. After existing rule II , the following rule shall be inserted , namely : - " II -A. For the purposes of the bona fide manufacturing medicinal and toilet preparations , Bhang in excess of the limit prescribed under sub - section ( 1 ) of section 16 of the Madhya Pradesh Excise Act, 1915 (No. II of 1915 ) may be possessed and transported under a written permit in Form H.D.1 - A granted by the Assistant Excise Commissioner/ District Excise Officer on payment of prescribed fee.
(i) Manufacturer shall apply for permit to the Assistant Excise Commissioner/ District Excise Officer of the district in which factory is established or is proposed to be established in the following manner , every such application shall comprise the following description-
(a) Name and address of the applicant ;
(b) Name and location of the factory, if any , in which Bhang is to be used for bona fide manufacture of medicinal and toilet preparations ;
(c) Annual requirement of Bhang ( in kilograms) ;
(d) Name of preparations which are to be manufactured (mention only those preparations which are to be manufactured under pharmacopeia ( Bheshaj Ratanawali , Ayurved Sar Sangarh , Rastantra Sar Sangarh , Bhav Prakash Nighantu and Swanubhut Yog) and subject to the permission of competent मध्यप्रदेश राजपत्र, दिनांक 23 अप्रैल 2018

authority of the AYUSH Department, Government of Madhya Pradesh;
(e) Whether the applicant holds a licence under medicinal and toilet preparation Act , 1940 ( No. 25 of 1940) , if so , write , number and date of licence .
(ii) Assistant Excise Commissioner/ District Excise Officer , after consultation with the Director , Health Services , Madhya Pradesh or the director , Industries , Madhya Pradesh as the case may be , may issue licence in Form H.D.1 - A upon payment of Rupees 10,000 as fees , for the year or part of the year ending on the 31st March ( next following)
(iii) On payment of Excise duty on such rates as the State Government may, from time to time determine , Bhang to be received under the licence shall be transported with the prior permission of Assistant Excise Commissioner/ District Excise Officer in accordance with the letter of demand issued by the Officer- in -charge under rule 15 of Bhang Rules and under a permit issued by warehouse officer .
(iv) Licenced manufacturer shall submit a bank guarantee of Rs, 25,000 / - as security in favour of Assistant Excise Commissioner / District Excise Officer for proper observance of Bhang Rules and conditions of the licence .
2. After existing Form H.D - 1 , the following form shall be inserted , namely : -

(1) The privilege extends to be the manufacturer of the following preparations ( hereinafter called the said preparation ): -

Note: (This privilege shall extent to those preparations only which are to be manufactured under pharmacopeia ( Bheshaj Ratanawali , Ayurved Sar Sangarh , Rastantra Sar Sangarh , Bhav Prakash Nighantu and Swanubhut Yog) of which has been approved by the competent authority of Ayush Department .
(2) The permit holder may purchase the bhang from the warehouse and transport it to the licensed premises under a permit granted by the warehouse officer . The aggregate quantity that can be purchased during each quarter commencing from the date of the grant of this .kg . permit shall not exceed .. .kg . No quantity exceeding ..... ofbhang shall be possessed at any time .
(3) The permit holder shall not keep bhang or manufacture any of the said preparations therefrom except in the licensed premises .
(4) The sale of bhang and use thereof for the purpose other than the manufacture of the said preparations is absolutely prohibited .

(5) The permit holder shall indicate on the packet , jar or other receptacle containing the preparation manufactured by him , the proportion of bhang, mixed in the preparations .
(6) The permit holder shall maintain true accounts of the transactions under the permit in the format below . Permits from the tehsil and warehouses shall be carefully filed in support of the accounts . The accounts and permits shall be preserved for a period of two years .
(7) All stock of bhang and accounts and all records of transactions shall be open to inspection by any excise or police officer not below the rank ofa Sub - Inspector .
(8) The permit holder shall on the requisition of Excise Commissioner or any officer duly authorized by him , deliver up his permit for amendment and for issue of a fresh permit .
(9) A fee of rupees 10,000 / - per annum shall be paid for permit and a bank guarantee of Rupees 25,000 / - shall be submitted as security for any contravention of rules .
( 10) On breach of any of the above conditions or of the Madhya Pradesh Excise Act , 1915 (NO . II of 1915) or of the rules made thereunder , or of any other instruction issued from time to time , the licensing authority may cancel the permit. " .
