क्र. सी- 1069- चार -12-17-2017.- भारत के संविधान के अनुच्छेद 229 के खंड 2 सहपठित मध्यप्रदेश उच्च न्यायालय की अधिसूचना क्रमांक 7056/दो- 14-32/36 भाग -1 , दिनांक 12 जुलाई 1960 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए माननीय मुख्य न्यायाधिपति, राज्यपाल की पूर्व स्वीकृति से , निदेश देते हैं कि मध्यप्रदेश शासन वित्त विभाग , भोपाल की अधिसूचना क्रमांक एफ 8-2009- नियम- IV, दिनांक 20 जुलाई 2017 के अन्तर्गत घोषित एवं जैसा कि समय - समय पर संशोधित किया गया, मध्यप्रदेश वेतन पुनरीक्षण नियम, 2017, उच्च न्यायालय के अधिकारी एवं कर्मचारी तथा निवर्तमान राज्य प्रशासनिक अधिकरण के तत्कालीन कर्मचारी जो मध्यप्रदेश पुनरीक्षण नियम, 2009 के अन्तर्गत वर्तमान वेतनमान में पदस्थ है, पर, वित्त विभाग की अधिसूचना के संलग्नक -1 में विनिर्दिष्ट अनुसार दिनांक 1 जनवरी 2016 से लागू होगा.
(1) परन्तु यह कि मध्यप्रदेश वेतन पुनरीक्षण नियम 2017 के नियम 6 के अन्तर्गत विहित विकल्प, उच्च न्यायालय के अधिकारियों एवं कर्मचारियों तथा निवर्तमान राज्य प्रशासनिक अधिकरण के तत्कालीन कर्मचारियों द्वारा इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशित होने के दिनांक से तीन माह के भीतर प्रयोग में लाया जायेगा.
(2) परन्तु यह भी कि मध्यप्रदेश वेतन पुनरीक्षण नियम 2017 के किसी भी उपबंध के शिथिलिकरण या प्रवर्तन के निलंबन के विषय में शासन द्वारा प्रयोक्तव्य शक्तियां , उच्च न्यायालय के अधिकारियों तथा कर्मचारियों तथा निवर्तमान राज्य प्रशासनिक अधिकरण के तत्कालीन कर्मचारियों के प्रकरण में जैसा कि नियम 16 में उपबंधित है, माननीय मुख्य न्यायाधिपति द्वारा प्रयोग की जायेगी.
टीप.- उपरोक्त मंजूरी D. O. No. 253/II - 15-19/1944/2015 , दिनांक 27 जून 2015 द्वारा प्रेषित उच्च न्यायालय मध्यप्रदेश अधिकारी एवं कर्मचारी भर्ती और सेवा की शर्तें ( वर्गीकरण, नियंत्रण , अपील तथा आचरण ) नियम 1996 एवं उच्च न्यायालय मध्यप्रदेश एवं निवर्तमान मध्यप्रदेश राज्य प्रशासनिक अधिकरण के तत्कालीन कर्मचारियों के संबंध में संविलयन एवं सेवा की शर्तें, सेवा नियम 2006 की प्रथम अनुसूची में वेतनमान में संशोधन हेतु प्रेषित अनुशंसा तथा समय - समय पर उच्च न्यायालय द्वारा विचार में लिये जा सकने वाली एवं प्रेषित की जाने वाली अनुशंसाओं के अध्यधीन है .

No. C- 1069 - IV- 12-17/ 2017 . In exercise of the powers conferred by Article 229 (2) of the Constitution of India read with High Court Notification No.7056 - II - 14-32-36 Part- I , dated the 12th July, 1960, Hon'ble the Chief Justice , with the previous approval of the Governor , has been pleased to direct that the Madhya Pradesh Revision of Pay Rules , 2017 , promulagated under Madhya Pradesh Finance Department , Bhopal , Notification No. F. 8 -I- 2016/Niyam/ IV, dated 20th July, 2017 and as amended from time to time , shall apply to the officers and employees of the High Court and the erstwhile staff of the Abolished State Administrative Tribunal , holding posts in the existing pay scales of pay under the M.P.P.R. Rules , 2009 as specified in Annexure - I of the notification of the Finance Department shall be applicable from the 1st January, 2016 :-
(1) provided that the option prescribed under Rule 6 of the Madhya Pradesh Revision of Pay Rules 2017 , shall be exercised by the officers and employees of the High Court and the erstwhile staff of the Abolished State Administrative Tribunal within three months from the date of publication of this notification in the " Madhya Pradesh Gazette" .
(2) provided further that the power exercisable by the Government in the matter of relaxation or suspension of operation of any of the provisions of the Madhya Pradesh Revision of Pay Rules , 2017 in the case of the officers and employees of the High Court and the erstwhile staff of the Abolished State Administrative Tribunal , as provided in Rule 16, shall be exercised by Honourable the Chief Justice .
Note : The above approval is subject to the recommendation for amendents in the pay scales in the First Schedule of the High Court of Madhya Pradesh Officers and Employees Recruitment and Conditions of Service (Classification , Control , Appeal and Conduct) Rules , 1996 and the High Court of Madhya Pradesh (Absorption and Conditions of Services in respect of Officers and Employees of Abolished Madhya Pradesh Administrative Tribunal ) Service Rules , 2006 sent vide D.O. No.253/II - 15-19/1944/2015 , dated 27-06-2015 and recommendations which may be considered and sent by the High Court from time to tirne.
