अधि. 20 - एफ- 1-09-2018-अठारह - 3.- मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 ( क्रमांक 23 सन् 1956 ) की धारा 14 की उप- धारा (2 ) एवं धारा 433 तथा मध्यप्रदेश नगरपालिका अधिनियम , 1961 ( क्रमांक 37 सन् 1961 ) की धारा 355 के साथ पठित धारा 32 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, राज्य निर्वाचन आयोग के परामर्श से, एतद्वारा , मध्यप्रदेश नगरपालिका निर्वाचन नियम, 1994 में निम्नलिखित संशोधन करती है, अर्थात्ः-
संशोधन
उक्त नियमों में,
1. नियम 43 में, उप नियम ( 2 ) के पश्चात्, निम्नलिखित उप- नियम जोड़ा जाए, अर्थात्ः-
" (3) निर्वाचन लड़ने वाले अंतिम अभ्यर्थी के नाम के नीचे वाक्यांश उपरोक्त में कोई नहीं ( नोटा ) लिखा जाएगा और उसके सामने प्रतीकों के खाने में उसका प्रतीक (x ) दर्शाया जाएगा. ".
2. नियम 51 में, उप- नियम ( 1 ) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए, अर्थात्ः-
" ( 1 ) मतदाता , मतपत्र प्राप्त होने पर तत्काल मतदान कोष्ठ में जाएगा तथा वहां उस अभ्यर्थी के प्रतीक पर या उसके निकट, जिसके लिए मत देने का उसका आशय है, मतपत्र में उस प्रयोजन के लिए दिए गए उपकरण से चिन्ह बनाएगा; या ऐसी दशा में उसकी किसी भी अभ्यर्थी के लिए मत देने की इच्छा नहीं है तो वह उक्त उपकरण से " इनमें से कोई नहीं (नोटा) " के प्रतीक ( x ) पर चिन्ह बनाएगा; मतपत्र को इस तरह मोड लेगा कि उसका मत छिप जाए, मुड़े मतपत्र को मतपेटी में डालेगा तथा मतदान केन्द्र से बाहर चला जाएदा. ".
3. नियम 53 में,
(1) उप नियम (2 ) का लोप किया जाए.
(2) उप नियम ( 3 ) में, शब्द, कोष्ठक तथा अंक " या उप- नियम ( 2) " का लोप किया जाए.
(3) उप नियम (4 ) में, शब्द, कोष्ठक तथा अंक " उप नियम ( 2 ) के अधीन " का लोप किया जाए.

4. नियम 63 में,
(1) उप- नियम (3 ) के स्थान पर, निम्नलिखित उप-नियम स्थापित किया जाए, अर्थात्ः- " (3) प्रत्येक निर्वाचन कर्तव्य मतपत्र का उससे संलग्न एक प्रतिपर्ण होगा और जो ऐसे प्ररूप में होगा तथा जिसमें ऐसी प्रविष्टियां होंगी जैसी कि निर्वाचन आयोग द्वारा निर्धारित की जाएं । निर्वाचन कर्तव्य मतपत्र पर अभ्यर्थियों के नाम उसी कम में और हिन्दी में देवनागरी लिपि में लिखे जाएंगे जिसमें वे निर्वाचन लड़ने वाले अभ्यर्थियों की सूची में दर्ज हैं । निर्वाचन कर्तव्य मतपत्र पर अंतिम अभ्यर्थी के नाम के नीचे ' इनमें से कोई नहीं (नोटा)' लिखा जाएगा और उसके सामने उसका प्रतीक (x) भी दर्शाया जाएगा ।
(2) उप-नियम (7) में, खण्ड (क) के स्थान पर, निम्नलिखित खण्ड स्थापितं किया जाए , अर्थात्ः- "(क) मतदाता उस अभ्यर्थी को जिसे वह मत देना चाहता है, मतपत्र में आवंटित किए गए स्थान में कहीं भी ( या x के समान ) चिन्ह लगाकर अपना मत अभिलिखित कर सकेगा । यदि वह किसी भी अभ्यर्थी को मत नहीं देना चाहता, तो वह ' इनमें से कोई नहीं (नोटा)' के प्रतीक (x ) के सामने उसी प्रकार चिन्ह लगाएगा । कोई विशिष्ट चिन्ह अंकित करना अपेक्षित नहीं है; कोई भी चिन्ह विधिमान्य होगा । " ।
5. नियम 63 ख में,-
(1) उप-नियम (2) के स्थान पर , निम्नलिखित उप- नियम स्थापित किया जाए , अर्थात्ः- "(2) मतदान इकाई पर अभ्यर्थियों के नाम उसी क्रम में रखे जाएंगे जिस क्रम में वे चुनाव लड़ने वाले अभ्यर्थियों की सूची में आए हों ।
अंतिम अभ्यर्थी के नाम के नीचे मतदान इकाई पर " इनमें से कोई नहीं (नोटा)" अंकित किया जाएगा और उसके सामने उसका प्रतीक (x) भी दर्शाया जाएगा । " I
(2) उप-नियम (4) में , खण्ड (क) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
"(क) मतदान इकाई में चुनाव लड़ने वाले अभ्यर्थियों के नाम और प्रतीकों का तथा अंतिम अभ्यर्थी के नीचे शब्दावली (' इनमें से कोई नहीं) (नोटा) एवं उसका प्रतीक (x) को समाविष्ट करने वाला लेबल चिपकाएगा और उस इकाई को अपनी सील तथा चुनाव लड़ने वाले ऐसे अभ्यर्थी या उनके निर्वाचन अभिकर्ता 744 ( 1)

जो वहां उपस्थित हों और जो अपनी सील लगाने के इच्छुक हों, उनकी सील लगाकर सुरक्षित करेगा । " ।
6. नियम 63 (ठ) में, किया जाए, अर्थात्ः उप-नियम (3) में खण्ड (ख ) के स्थान पर, निम्नलिखित खण्ड स्थापित "(ख) उस अभ्यर्थी के नाम और प्रतीक के सामने वाली मतदान इकाई पर बटन को दबा कर अपना मत अभिलिखित करेगा जिसके लिए मतदान करने का उसका आशय है : ऐसी दशा में उसकी उनमें से किसी को भी मत देने की इच्छा नहीं है तो वह ' इनमें से कोई नहीं (नोटा) एवं उसके प्रतीक (x ) के सामने वाले बटन को दबाएगा और । " ।
7. नियम 69 में, उप नियम (3) के स्थान पर, निम्नलिखित उप-नियम स्थापित किया जाए , अर्थात्:-
"(3) किसी वार्ड में समस्त मतदान केन्द्रों के संबंध में गणना पूर्ण कर ली जाने के पश्चात्, रिटर्निंग ऑफिसर अंतिम परिणाम पत्र (शीट) प्ररूप 22 में परिणाम संकलित करेगा। वह प्ररूप 20 में की गई प्रविष्टियों के आधार पर प्रत्येक अभ्यर्थी के पक्ष में डाले गए निर्वाचन कर्तव्य मतों की संख्या भी उसमें अभिलिखित करेगा और तब वह प्रत्येक अभ्यर्थी के पक्ष में डाले गए विधिमान्य मतों तथा 'इनमें से कोई नहीं (नोटा)' के अधीन डाले गए मतों की संख्या का योग करेगा और उसके पश्चात् उसकी घोषणा करेगा ।" ।ri
8. नियम 69 ख में,--
(1) उप- नियम (1) एवं (2) के स्थान पर, निम्नलिखित उप- नियम स्थापित किए जाए, अर्थात्ः- "(1) रिटर्निंग ऑफिसर का यह समाधान हो जाने के पश्चात्, कि मतदान मशीन से छेड़छाड़ नहीं की गई है, वह उसमें अभिलिखित मतों की गणना कन्ट्रोल यूनिट पर दिए गए समुचित बटन पर " रिजल्ट" अंकित होगा, को दबा कर करेगा जिससे कुल मतदान और प्रत्येक अभ्यर्थी को प्राप्त हुए मत तथा ' इनमें से कोई नहीं (नोटा)' को प्राप्त मत इस प्रयोजन हेतु प्रदर्शन पटल पर प्रदर्शित हो जाएंगे ।
(2) जैसे ही प्रत्येक अभ्यर्थी एवं 'इनमें से कोई नहीं '(नोटा)' को प्राप्त मत कन्ट्रोल यूनिट पर प्रदर्शित हो जाते हैं, रिटर्निंग ऑफिसर, मध्यप्रदेश राजपत्र, दिनांक 30 जून 2018

(क) प्रत्येक अभ्यर्थी को अलग - अलग प्राप्त मतों की संख्या
(ख) ' इनमें से कोई नहीं (नोटा)' को प्राप्त मतों की संख्या गणना परिणाम पत्रक, प्ररूप 21 क, में तत्स्थानी प्रविष्टियां में अभिलिखित एवं उन्हें आख्यापित कराएगा ।
(2) उप - नियम (2) के पश्चात्, निम्नलिखित उप- नियम जोड़ा जाए, अर्थात्ः-
"(3) वार्ड के प्रत्येक मतदान केन्द्र पर गणना पूर्ण होने के पश्चात्, तत्स्थानी प्रविष्टियां प्ररूप 22 में अंतिम परिणाम शीट में प्रविष्ट की जांएगी । प्रत्येक अभ्यर्थी के पक्ष में दर्ज निर्वाचन कर्त्तव्य मतों की संख्या तथा वे जो प्रत्येक वार्ड में नोटा के अधीन दर्ज है, घोषित किए जाएंगे ।" ।
9. प्ररूप 21क एवं 22 के स्थान पर, निम्नलिखित प्ररूप स्थापित किए जाएं , अर्थात्ः-
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, राजीव निगम , उपसचिव.

In exercise of the powers conferred by Sub- Section (2 ) of Section 14 and Section 433 of the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) and sub- section (2) of Section 32 read with Section 355 of the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961 ) , the State Government , with consultation of the State Election Commission , hereby , makes the following amendments in the Madhya Pradesh Nagarpalika Nirvanchan Niyam , 1994 , namely : -
AMENDMENT
In the said rules, -
1. In rule 43 , after sub - rule (2) , the following sub- rule shall be added , namely: -
"(3) Below the name of last contesting candidate , the phrase ' None of the above (NOTA) ' shall be Written and its symbol (x) shall be displayed against it in the column of symbols ." .
2. In rule 51 , for sub - rule ( 1 ) , the following sub - rule shall.be substituted , namely: -
" ( 1 ) A voter on receiving the ballot paper shall forthwith proceed to the voting compartment , and shall make a mark on the ballot paper with the instrument supplied for the purpose on or near the symbol of the candidate for whom he intends to vote ; or , in case if he does not wish to vote for any of the candidates , he shall with the same instrument make a mark on the symbol (x) of मध्यप्रदेश राजपत्र, दिनांक 30 जून 2018

"None of the above ( NOTA ) " ; fold the ballot paper so as to conceal his vote ; insert the folded ballot paper into the ballot box and quit the polling station . " .
3. In rule 53-
(1) Sub - rule (2) shall be omitted.
(2) in sub - rule (3) , the words bracket and figure " or sub- rule (2) " shall be omitted .
(3) in sub -rule(4) , the words bracket and figure " under sub - rule (2 ) " shall be omitted .
4. In rule 63 , -
(1) for Sub - rule (3) the following sub-rule shall be substituted , namely: -
" (3) . Every Election Duty ballot paper shall have a counter foil attached thereto and shall be in such form and shall have such particulars as may be determined by the Election Commission . The name of candidates shall be arranged in the E.D. ballot paper in the same order in which they appear in the list of contesting candidates and shall be in Hindi Devanagri script . Below the last candidate , the phrase "None of the above ( NOTA) " shall be Written and its symbol (x) shall be shown against it on the E.D. ballot paper .

(2) In sub - rule (7) , for clause ( a) the following clause substituted , namely: -
" (a) the voter may record his vote by making a mark (like or x) anywhere in the space allotted to the candidate for whom he wants to vote ; if he does not wish to vote for any candidate , he shall make similar mark against the symbol (x) of " None of the above (NOTA) " There is no particular mark required to be made ; any mark can be accepted as valid. " .
5. In rule 63 B , -
(1) For sub- rule (2) , the following sub - rule shall be substituted , namely: -
"(2) The name of candidates shall be arrange on the balloting unit in the same order in which they appear in the list of contesting candidates . ,
Below the last candidate , the expression "None of the above ( NOTA) " shall be Written and its symbol (x) shown against it on the balloting unit. " .
(2) In sub - rule (4 ) , for clause (a) , the following clause shall be substituted , namely: - मध्यप्रदेश राजपत्र, दिनांक 30 जून 2018

"(a) fix the label containing names and symbols of the contesting candidates and the below the last candidate the phrase " None of the above ( NOTA) " and its symbol (x) in the balloting unit and secure that unit with his seal and the seals of such of the contesting candidates or their election agents who are present there and are desirous of affixing the same . " .
6. In rule 63 L , in sub- rule (3) , for clause (b) , the following clause shall be substituted , namely: -
" (b) record his vote by pressing the button on the balloting unit against the name and symbol of the candidate for whom he intends to vote , in case he does not wish to vote for any , of them he shall press button against " None of the above (NOTA) " and its symbol (x) ; and . " .
7. In rule 69 , for sub - rule (3) , the following sub - rule shall be substituted , namely: -
" (3) After the counting in respect of all polling stations in a ward has been completed , the Returning Officer shall compile the result in the final result sheet in form 22 . He shall also record there in the number of E.D. votes cast in favour of each candidate on the basis of entries in form 20 and then total up the number of valid votes polled for each candidate , as well as the total votes polled under " None of the above (NOTA) " , and thereafter announce the same . " .
8. In rule 69 B , -
( 1) for sub - rules ( 1) and (2) , the following sub - rules shall be substituted , namely: - 744 (9)

" ( 1 ) After the retuning officer is satisfied that a voting machine has in fact not been tampered with , he shall have the votes recorded therein counted by pressing the appropriate button marked " Result " provided in the control unit where by the total votes polled and votes polled to each candidate and to " None of the above ( NOTA) " , shall be displayed on the display panel provided for the purpose .
(2) As the votes casted to each candidate and " None of the above (NOTA) " , are displayed on the control unit , the Returning Officer shall have ,
(a) the number of such votes cast separately in favour of each candidate .
(b) the number of votes cast under " None of the above ( NOTA) :, recorded in corresponding entries of the result sheet in Form 21A and have announcement made thereof. " .
(2) After sub - rule (2) , the following sub - rule shall be added, namely: -
" (3) After completion of counting of all polling stations of a ward , the corresponding entries shall be made in the final result sheet in Form 22. The valid voters recorded on E.D. ballot papers in favour of each candidate and those recorded under 'NOTA ' in each ward shall be announced . " .
9 . For form 21 A and 22 , the following forms shall be substituted , namely: -
