मध्यप्रदेश माल और सेवाकर अधिनियम, 2017 )2017 का1 9 (की धारा 11 की उप धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकार, इस बात से संतुष्ट होते हुए कि ऐसा करना जनहित में आवश्यक है और जीएसटी परिषद की सिफारिशों के आधार पर , एतद्वारा , हस्तशिल्प की वस्तुओं , जिनका विवरण नीचे दी गई सारणी के कॉलम (3) में विनिर्दिष्ट है, जो कॉलम (2) में दी गई तत्संबंधी प्रविष्टि में यथाविनिर्दिष्ट टैरिफ मद, उप शीर्ष, शीर्ष या अध्याय के अंतर्गत आती हैं, के अंतःराज्यीय आपूर्ति को उस हद तक छूट देती है जिस हद तक इस पर उक्त अधिनियम की धारा 9 के अंतर्गत लगाए जाने वाला राज्य कर उक्त सारणी के कॉलम (4) में विनिर्दिष्ट दर से अधिक होता है ।
स्पष्टीकरण : इस अधिसूचना के उद्देश्य के लिए अभिव्यक्ति "हस्तशिल्प की वस्तुएं " से अभिप्राय ऐसी वस्तुओं से है जो कि मुख्य रूप से हाथ से बनाई गई हों चाहे इनके बनाए जाने की प्रक्रिया में इसमें कुछ औजार या मशीनों का उपयोग क्यों न करना पड़ा हो; ऐसी वस्तुएं देखने में आकर्षक होती हैं और इसमें इसी तरह के कुछ काम हुए रहते हैं; इनकी अपनी विशेषता होती है जो कि सौंदर्यपरक,

क्रमांक एफ-ए- 3-23-2018-1- पांच( 69 ) .- भारत के संविधान के अनुच्छेद 348 के खण्ड (3 ) के अनुसरण में, इस आशय की अधिसूचना क्रमांक एफ- ए- 3-23-2018-1- पांच ( 69 ) , दिनांक 27 जुलाई 2018 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.

In exercise of the powers conferred by sub - section ( 1 ) of section 11 of the Madhya Pradesh Goods and Services Tax Act, 2017 (19 of 2017), the State Government, on being satisfied that it is necessary in the public interest so to do , on the recommendations of the Council, hereby exempts the intra- state supplies of handicraft goods , the description ofwhich is specified in column (3) of the Table below, falling under the tariff item , sub- heading, heading or Chapter, as specified in the corresponding entry in column (2) , from so much State tax leviable thereon under section 9 of the said Act as is in excess of the rate specified in column (4) of the said Table.
Explanation For the purpose of this notification , the expression " handicraft goods " means - Goods predominantly made by hand even though some tools or machinery may also have been used in the process ; such goods are graced with visual appeal in the nature of ornamentation or in - lay work or some similar work of a substantial nature; possess distinctive features, which can be aesthetic , artistic , ethnic or culturally attached and are amply different from mechanically produced goods of similar utility.
