क्र. एफ 35-82-2016- दो- सी- 2.- मध्यप्रदेश शासन , आपदा प्रबंधन अधिनियम, 2005 ( 2005 का 53 ) की धारा 14 एवं 78 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण के सलाहकार के वेतन, भत्तों एवं सेवा शर्तों के संबंध में एतद्वारा, निम्नलिखित नियम बनाता है, अर्थात्:-

नियम 2018

1. संक्षिप्त नाम एवं प्रारंभ.-( i ) यह नियम राज्य आपदा प्रबंधन प्राधिकरण के सलाहकार की पदावधि और सेवा की शर्तें नियम 2018 कहलाएंगे.

(ii) यह नियम दिनांक 4 जुलाई 2016 से प्रभावशील माने जाएंगे.

2. परिभाषाएं.-(i) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) " अधिनियम" से अभिप्रेत है, आपदा प्रबंधन अधिनियम, 2005 (2005 का 53 ) ;

(ख) " सलाहकार " से अभिप्रेत है, पूर्णकालिक सलाहकार जो प्राधिकरण के एक सदस्य होंगे तथा राज्य आपदा प्रबंधन प्राधिकरण के उद्देश्यों तथा लक्ष्यों की पूर्ति एवं जिला, राज्य एवं विभागीय आपदा प्रबंधन कार्य योजनाओं के निर्माण में सतत् मार्गदर्शन देंगे तथा अधिनियम की धारा 14 की उपधारा ( 2 ) ( ख ) के अधीन मध्यप्रदेश शासन द्वारा नियुक्त होंगे.

(ग) " सदस्य" से अभिप्रेत है, धारा 14 की उपधारा ( 2 ) ( ख ) के अधीन मध्यप्रदेश शासन द्वारा नियुक्त सदस्य.

(घ) " धारा " से अभिप्रेत है , अधिनियम की धारा.

(ii) इन शर्तों और पदों का जो इन में प्रयुक्त हैं और इन नियमों में यदि भाषित नहीं हैं, किन्तु अधिनियम में परिभाषित हैं, वही अर्थ होगा जो अधिनियम में क्रमशः हैं.

3. पदावधि, वेतन और सेवा शर्तें. ( क ) प्राधिकरण के पूर्णकालिक सलाहकार की नियुक्ति मध्यप्रदेश शासन द्वारा उन सेवानिवृत्त व्यक्तियों में से की जावेगी जिनकी पद भारत सरकार के सचिव के स्तर से कम न हो और आपदा प्रबंधन या लोक प्रशासन या प्रबंधन का अनुभव हो.

(ख ) सलाहकार, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण का कार्यकाल उनके कार्यभार ग्रहण करने के दिनांक से पांच वर्षों तक अथवा आयु 65 वर्ष जो भी पहले हो तक के लिए होगा एवं पुनः नियुक्ति की पात्रता नहीं होगी.

(ग) वेतन ( सेवानिवृत्त अधिकारियों के प्रकरण में पेंशन कम करके ) मंहगाई भत्ता, आवास, मकान किराया भत्ता, दूरभाष , वाहन, चिकित्सा सुविधाएं, यात्रा भत्ता, अवकाश मुख्य सचिव मध्यप्रदेश शासन के समतुल्य देय होगा.

F. No. 35-82-2016 - II - C - 2 . In exercise of the powers conferred by Section - 14 and 78 of the Disaster Management Act , 2005 (53 of 2005 ) the State Government of Madhya Pradesh hereby makes the following rules regarding pay , allowances and Service Conditions of the Advisor of the Madhya Pradesh State Disaster Management Authority, namely :-

RULES

1. Short title and commencement .- ( i ) These rules shall be called the State Disaster Management Authority (Terms of Office and Conditions of Service of Advisor of the State Disaster Management Authority Rules , 2018 .

( ii) These rules shall be deemed to have come into force with effect from 4th July 2016.

2. Definitions :- ( 1 ) In these rules unless the context otherwise requires :-

(a) "Act " means the Disaster Management Act , 2005 ( 53 of 2005 ) ;

(b) "Advisor " means the full Time Advisor of the Authority who will be one of the members of the Authority and shall continually guide the State Disaster Management Authority to achieve the objec- tives and goals set by the State Government and in finalization of the District , State and Department specific disaster management plans and shall be appointed by Government of Madhya Pradesh under sub - section ( 2) ( b) of Section 14 of the Act.

(d) " Section" means a section of the Act .

(2) Words and expressions used herein and not defined in these rules but defined in the Act , shall have meaning respectively assigned to them in the Act .

3. Tenure, Pay and Service conditions . ( i ) Advisor, to the Authority shall be appointed by the Goverment ofMadhya Pradesh from amongst the persons retired from a post not below the rank equivalent to the post of Secretary to the Government of India and having experience in the field of Disaster Management or Public Administration or Management.

( ii ) Advisor , Madhya Pradesh State Disaster Management Authority , from the date on which he joint his duties shall hold the post for a period of five years or till he attains the age of sixty - five years , whichever is earlier and shall not be eligible for re - appointment.

(iii) Pay ( less pension in the case of retired officers ) , dearness allowance , accommodation , house rent allow- ance, telephone , vehicle , medical facilities , traveling allowance , leave as admissible to the Chief Secretary of Madhya Pradesh , shall be payable during the service period.

क्र. एफ 35-31-2013-दो- सी-2.-आपदा प्रबंधन अधिनियम, 2005 ( 2005 का 53 ) की धारा 14 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, इस विभाग की अधिसूचना क्र. एफ. 35-31-2013- दो- सी-2, दिनांक 8 जुलाई 2013 , अधिसूचना दिनांक 4 जुलाई 2016 के नियम क्र. 3 एवं 4 तथा अधिसूचना क्र. एफ.35-82-2016- दो- सी-2, दिनांक 15 मार्च 2017 को अतिष्ठित करते हुए, राज्य सरकार , एतद्वारा , राज्य आपदा प्रबंधन प्राधिकरण का पुनर्गठन करती है, अर्थात्:-
