क्र.एफ 1-59 / 2018 / 20-1:: भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल , एतद्वारा , मध्यप्रदेश स्कूल शिक्षा (शैक्षणिक संवर्ग) से संबंधित निम्नलिखित सेवा शर्तें एवं भर्ती नियम बनाते हैं , अर्थात्ः-

1. संक्षिप्त नाम तथा प्रारंभ-
(1 ) इन नियमों का संक्षिप्त नाम " मध्यप्रदेश राज्य स्कूल शिक्षा सेवा (शैक्षणिक संवर्ग) , सेवा शर्ते एवं भर्ती नियम , 2018 " है ।
(2) ये नियम दिनांक 01 जुलाई 2018 से प्रवृत्त होंगे ।
2. परिभाषाएं- इन नियमों में जब तक प्रसंग से अन्यथा अपेक्षित न होः-
(क) सेवा के संबंध में " नियुक्ति प्राधिकारी " से अभिप्रेत है अनुसूची- एक के कॉलम क्रमांक (6 ) में अंकित नियुक्ति प्राधिकारी है ;
(ख) "अध्यापक संवर्ग " से अभिप्रेत है स्थानीय निकाय के नियंत्रणाधीन मध्यप्रदेश पंचायत अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008 तथा मध्यप्रदेश नगरीय निकाय अध्यापक संवर्ग ( नियोजन एवं सेवा की शर्ते) नियम , 2008 के अधीन नियुक्त अध्यापक संवर्ग;
(ग ) "आयुक्त" से अभिप्रेत है आयुक्त, लोक शिक्षण मध्यप्रदेश;
(घ) "विभाग " से अभिप्रेत है मध्यप्रदेश शासन, स्कूल शिक्षा विभाग;
(ड) "विभागीय परीक्षा " से अभिप्रेत है इन नियमों के अधीन पदोन्नति के लिये आयोजित की जाने वाली सीमित विभागीय परीक्षा;
(च ) "विभागीय पदोन्नति समिति " से अभिप्रेत है इस नियम के अर्न्तगत विनिर्दिष्ट विभागीय पदोन्नति समिति;
(छ) "संचालक" से अभिप्रेत है संचालक, लोक शिक्षण मध्यप्रदेश ;
(ज) " परीक्षा अभिकरण " से अभिप्रेत है इन नियमों के अधीन संचालित पात्रता परीक्षा या विभागीय परीक्षा के संचालन के लिये शासन द्वारा निर्धारित अभिकरण;
(झ ) " शासन " से अभिप्रेत है मध्यप्रदेश शासन ;

(ञ) "राज्यपाल" से अभिप्रेत है मध्यप्रदेश के राज्यपाल;
(ट) "अतिथि शिक्षक" से अभिप्रेत है प्रदेश की शासकीय शालाओं में अध्यापन कार्य के उददेश्य से रिक्त पदों के विरूद्ध मानदेय पर अस्थाई रूप से अध्यापन कार्य हेतु रखे गये व्यक्ति;
(ठ) " स्थानीय निकाय " से अभिप्रेत है पंचायत एवं ग्रामीण विकास विभाग के अधीन जिला पंचायत तथा नगरीय प्रशासन एवं विकास विभाग के अधीन नगर पालिक निगम, नगर पालिका और नगर परिषद;
(ड) "अन्य पिछडा वर्ग " से अभिप्रेत है , राज्य शासन द्वारा समय - समय पर यथा संधोधित अधिसूचना क्रमांक एफ-8-5- XXV-4-84 दिनांक 26 दिसम्बर, 1984 द्वारा यथा विनिर्दिष्ट नागरिकों के अन्य पिछडा वर्ग;
(ढ) " अनुसूची" से अभिप्रेत है इन नियमों से संलग्न अनुसूची;
(ण) "अनुसूचित जातियों" से अभिप्रेत हैं, कोई जाति, मूलवंश या जनजाति "अथवा जनजाति, मूलवंश या जनजाति का भाग या उसमें का यूथ , जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के सम्बन्ध में अनुसूचित जातियों के रूप में विर्निदिष्ट किया गया है;
(त) "अनुसूचित जनजाति" से अभिप्रेत है, कोई जनजाति या जनजाति समुदाय अथवा ऐसी जनजाति या जनजाति समुदाय का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के सम्बन्ध में अनुसूचित जनजातियों के रूप में विर्निदिष्ट किया गया है;
(थ) " चयन समिति " से अभिप्रेत है इस नियम के अर्न्तगत विनिर्दिष्ट चयन समितिः
(द) " राज्य" से अभिप्रेत है मध्यप्रदेश राज्य;
(ध) "शिक्षक पात्रता परीक्षा" से अभिप्रेत है शैक्षणिक संवर्ग के सीधी भर्ती के पदों के लिये आयोजित की जाने वाली शिक्षक पात्रता परीक्षा ।
3. विस्तार तथा लागू होना- मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम, 1961 में दिये गये उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना ये नियम सेवा के प्रत्येक सदस्य पर लागू होंगे ।
4. सेवा का गठन- यह सेवा निम्नलिखित व्यक्तियों से गठित होगी , अर्थात्ः-
(1) " मध्यप्रदेश पंचायत अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008" तथा " मध्यप्रदेश नगरीय निकाय अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008 " के अधीन 224 सामुदायिक विकासखण्डों में विभागीय 852(2)

शैक्षणिक संस्थाओं में नियुक्त एवं वर्तमान में कार्यरत व्यक्ति जो नियम -5 के उप-नियम (1 ) के अनुसार नियुक्त किया गया हो ।
(2) वे व्यक्ति जो इन नियमों के उपबंधों के अनुसार सीधी भर्ती से नियुक्त किये जावेंगे, अथवा पदोन्नति प्राप्त करते हैं ।
5. भर्ती का तरीका:-
(1) इन नियमों के प्रवृत होने के पश्चात "मध्यप्रदेश पंचायत अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम , 2008 " तथा "मध्यप्रदेश नगरीय निकाय अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008" के अधीन 224 सामुदायिक विकासखण्डों में विभागीय शैक्षणिक संस्थाओं में नियुक्त और अन्य विहित अर्हताओं की पूर्ति करने वाले वर्तमान में कार्यरत व्यक्ति विभाग में सेवा के प्रारम्भिक गठन के समय नियुक्त किये जाएगें । इन व्यक्तियों के नियुक्ति आदेश अनुसूची- एक के कॉलम (6) में उल्लेखित नियुक्ति प्राधिकारी द्वारा शासन द्वारा विर्निदिष्ट प्रक्रिया के अनुसार जारी किये जाएंगेः
परन्तु नियम-2 की खण्ड (ख) में उल्लेखित व्यक्ति के अतिरिक्त अन्य व्यक्ति को इस उप नियम के अंतर्गत नियुक्त नही किया जाएगा । (2) मध्यप्रदेश पंचायत अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008 और मध्यप्रदेश नगरीय निकाय अध्यापक संवर्ग (नियोजन एवं सेवा की शर्ते) नियम, 2008 के उपधीन नियुक्त सहायक अध्यापक, अध्यापक एवं वरिष्ठ अध्यापक को क्रमशः प्राथमिक शिक्षक, माध्यमिक शिक्षक एवं उच्च माध्यमिक शिक्षक के पद पर नियुक्त किया जाएगा ।
(3) सहायक अध्यापक (प्रयोगशाला) , सहायक अध्यापक (व्यायाम शिक्षक) एवं सहायक अध्यापक (गायन/ वादन) को क्रमशः प्रयोगशाला शिक्षक, खेलकूद शिक्षक श्रेणी-अ तथा गायन / वादन शिक्षक श्रेणी-अ के पद पर नियुक्त किया जाएगा ।
(4) उप नियम (1 ) , (2 ) एवं (3) के अनुसार नियुक्ति के पश्चात् इस सेवा में आगामी भर्ती निम्नलिखित तरीके से की जाएगी, अर्थात्:-
(क) सीधी भर्ती के अंतर्गत पात्रता परीक्षा द्वारा चयन ।
(ख) पदोन्नति द्वारा ।
6. वर्गीकरण, वेतनमान आदि पदों का वर्गीकरण , वेतनमान, उससे संलग्न पे - बैण्ड तथा सम्मिलित पदों की संख्या अनुसूची- एक में अंतर्विष्ट उपबंधों के अनुसार होगी । 852(3)

परंतु शासन , पदों की संख्या में समय- समय पर स्थायी या अस्थायी आधार पर कमी या वृद्धि कर सकेगा ।
7. पदों पर नियुक्ति-इन नियमों के प्रारंभ होने के पश्चात किसी भी संवर्ग में उदभूत रिक्तियों पर सभी नियुक्तियां नियुक्ति प्राधिकारी द्वारा की जायेंगी और ऐसी कोई भी नियुक्ति नियम-5 में विर्निदिष्ट भर्ती के किसी एक तरीके द्वारा चयन करने के सिवाय नहीं की जायेगी ।
8. सीधी भर्ती के लिये पात्रता की शर्तेः- शिक्षक पात्रता परीक्षा में भाग लेने हेतु पात्र होने के लिये अभ्यर्थी को निम्नलिखित शर्तें पूरी करनी होगी, अर्थातः-
(1) आयुः-
(क) अभ्यर्थी ने चयन प्रक्रिया के प्रांरभ की तारीख के पश्चात आने वाली एक जनवरी को अनुसूची- तीन के कॉलम (3) में यथा विर्निदिष्ट आयु पूर्ण कर ली हो किन्तु उक्त अनुसूची के कॉलम (4) यथा विर्निदिष्ट आयु पूरी न की हो;
(ख) यदि अभ्यर्थी मध्यप्रदेश का मूल निवासी है तथा अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछडा वर्ग , महिला एवं दिव्यांग वर्ग का हो तो विहित अधिकतम आयु सीमा में छूट मध्यप्रदेश शासन के प्रचलित प्रावधान अनुसार प्राप्त होगी;
(ग) उन अभ्यर्थियों के संबंध में जो मध्यप्रदेश शासन , निगम मण्डल के कर्मचारी है , या रह चुके है अधिकतम आयु सीमा में छूट मध्यप्रदेश शासन के प्रचलित प्रावधान अनुसार होगी;
(घ) ऐसे उम्मीदवार को, जो भूतपूर्व सैनिक हो, को अपनी आयु में से उसके द्वारा पूर्व में की गई समस्त प्रतिरक्षा सेवा की अवधि को कम करने की अनुमति दी जाएगीः
परन्तु उसके परिणाम स्वरूप निकलने वाली आयु अधिकतम आयु सीमा से पांच वर्ष से अधिक न हो ।
स्पष्टीकरण :- शब्द " भूतपूर्व सैनिक " से अभिप्रेत ऐसे व्यक्ति से है , जो निम्नलिखित प्रवर्गो में से किसी एक प्रवर्ग में रहा हो तथा जो भारत शासन के अधीन कम से कम छः माह तक निरंतर सेवा में रहा हो तथा किसी भी रोजगार कार्यालय में अपना पंजीयन कराने अथवा शासकीय सेवा में नियुक्ति के लिये अन्यथा आवेदन पत्र देने की तारीख से अधिक से अधिक तीन वर्ष पूर्व मितव्ययिता इकाई (यूनिट) की सिफारिश के परिणाम स्वरूप कर्मचारियों की संख्या में सामान्य रूप से कटौती किये जाने के कारण जिसकी छटनी की गई हो अथवा जिसे अतिरिक्त घोषित किया गया हो- मध्यप्रदेश राजपत्र , दिनांक 30 जुलाई 2018

(1 ) ऐसे भूतपूर्व सैनिक, जिन्हें कि समय से पूर्व निवृत्ति रियायतो (मस्टरिंग आउट कन्सेशन) के अधीन निर्मुक्त कर दिया गया हो ।
(2) ऐसे भूतपूर्व सैनिक जिन्हें दूसरी बार नामांकित किया गया हो और जिन्हें-
(क) अल्पकालीन वचनबंध की अवधि पूर्ण हो जाने पर;
(ख) नामांकन संबंधी शर्ते पूरी हो जाने पर सेवामुक्त कर दिया गया हो ।
(3) मद्रास सिविल इकाई (यूनिट) के भूतपूर्व कार्मिक;
(4) ऐसे अधिकारी (सैनिक तथा असैनिक) जिसमें अल्पअवधि सेवा में नियमित कमीशन प्राप्त अधिकारी भी सम्मिलित है जिन्हें उनकी संविदा के पूरी होने पर सेवामुक्त किया गया हो;
(
5) ऐसे अधिकारी जिन्हें अवकाश रिक्तियों पर छह माह से अधिक समय तक निरंतर कार्य करने के पश्चात सेवा मुक्त कर दिया गया हो;
(6) असमर्थ होने के कारण सेवा से अलग किये गए भूतपूर्व सैनिक;
(7) ऐसे भूतपूर्व सैनिक जिन्हें इस आधार पर सेवामुक्त किया गया हो कि अब वे दक्ष सैनिक बनने के योग्य नहीं है;
(8) ऐसे भूतपूर्व सैनिक, जिनको गोली लग जाने, घाव आदि हो जाने के कारण चिकित्सीय आधार पर सेवा से अलग कर दिया हो;
(ङ) अनुसूचित जाति के अंतरजातीय विवाह प्रोत्साहन योजना अंतर्गत पुरूस्कार प्राप्त सवर्ण पति / पत्नि के मामले में अधिकतम आयु सीमा में छूट सामान्य प्रशासन विभाग के प्रचलित निर्देशानुसार होगी ।
(च) विक्रम पुरूस्कार प्राप्त अभ्यर्थी को अधिकतम आयु सीमा में छूट सामान्य प्रशासन विभाग के प्रचलित निर्देशानुसार होगी ।
(छ) मध्यप्रदेश शासन के शासकीय शालाओं में कार्य कर चुके अतिथि शिक्षक जिनके द्वारा न्यूनतम तीन शैक्षणिक सत्रों में एवं न्यूनतम 200 दिवस का कार्य अनुभव प्राप्त हो को अधिकतम आयु सीमा में 9 वर्ष की छूट प्राप्त होगी ।
(ज) उक्त के अतिरिक्त मध्यप्रदेश सामान्य प्रशासन विभाग द्वारा समय- समय पर जारी आयु संबंधी प्रावधान लागू होंगे । 852(5)

(2) शैक्षणिक अर्हताएं:-
शैक्षणिक अर्हताएं अनुसूची- तीन के कॉलम क्रमांक-(5) अनुसार होना चाहिये । परंतु-
(क) निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 के अधीन शिक्षकों के पदों के लिये निर्धारित शैक्षणिक एवं शिक्षण- प्रशिक्षण योग्यता को छोड़कर आपवादिक मामलों में शासन ऐसे अभ्यर्थी को अर्ह मान सकेगा जो यद्यपि इन नियमों में विहित कोई अर्हता न रखता हो, किन्तु जिसने अन्य संस्थाओं द्वारा संचालित परीक्षाएं ऐसे स्तर से उत्तीर्ण की हो, जिसके कारण शासन अभ्यर्थी को चयन के योग्य समझती हो ।
(ख) उन अभ्यर्थियों के चयन के लिये भी शासन अपने विवेकानुसार विचार कर सकेगा, जो अन्यथा अर्ह हों, किन्तु जिन्होनें ऐसे विदेशी विश्वविद्यालयों से उपाधि प्राप्त की हो, जो शासन द्वारा विर्निदिष्ट रूप से मान्यता प्राप्त विश्वविद्यालय न हो ।
(3) शिक्षक पात्रता परीक्षा- शिक्षकों के सीधी भर्ती के पदो के लिए शिक्षक पात्रता परीक्षा, नियम -11 के उप नियम (5) के अनुसार निर्धारित प्रतिशत के साथ उत्तीर्ण करना अनिवार्य होगा ।
(4) फीसः- उम्मीदवार को शासन द्वारा निर्धारित फीस का भुगतान करना होगा । 9. निरर्हताएं:-
(1) किसी अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिये किसी भी साधन से समर्थन अभिप्राप्त करने के किसी भी प्रयास को , शासन द्वारा परीक्षा / चयन में उसके उपस्थित होने के लिये निरर्हता माना जा सकेगा;
(2) कोई भी अभ्यर्थी, जिसने विवाह के लिये नियत की गई न्यूनतम आयु से पूर्व विवाह कर लिया हो, किसी सेवा या पद पर नियुक्ति के लिये पात्र नही होगा;
(3) कोई भी अभ्यर्थी, जो किसी ऐसे अपराध के लिये दोष सिद्ध ठहराया गया हो जिसमें नैतिक अधमता अंर्तग्रस्त हो, किसी सेवा या पद पर नियुक्ति के लिये पात्र नही होगाः मध्यप्रदेश राजपत्र, दिनांक 30 जुलाई 2018

परन्तु जहां उम्मीदवार के विरूद्ध ऐसे मामले लंबित हो तो वहां ऐसे अभ्यर्थी की नियुक्ति आपराधिक मामले का अंतिम विनिश्चय होने तक लंबित रखी जाएगी ।
(4) मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम, 1961 में दिये गये प्रावधान एंव समय- समय पर शासन द्वारा जारी किये गये निर्देशों के अनुसार निरर्हताए अभ्यर्थियों के लिये लागू होंगे ।
(5) कोई भी अभ्यर्थी जिसकी दो से अधिक जीवित संतान हो यदि जिनमें से एक का जन्म दिनांक 26.01.2001 को या उसके पश्चात् हुआ हो किसी सेवा या पद पर नियुक्ति के लिये पात्र नही होगा;
परन्तु कोई भी अभ्यर्थी जिसकी पहले से एक जीवित संतान है तथा आगामी प्रसव दिनांक 26.01.2001 को या उसके पश्चात् हुआ हो , जिसमें दो या दो से अधिक संतान का जन्म होता है, किसी सेवा या पद पर नियुक्ति के लिये अयोग्य नहीं होगा ।
अभ्यर्थी की पात्रता के संबंध में शासन का विनिश्चय अंतिम होगा-

अभ्यर्थी की पात्रता या अन्यथा के संबंध में शासन का चयन/ परीक्षा में प्रवेश के लिये उनका विनिश्चय अंतिम होगा और किसी भी ऐसे अभ्यर्थी को जिसे शासन द्वारा प्रवेश का प्रमाण पत्र जारी नहीं किया गया है, परीक्षा में उपस्थित होने के लिये अनुज्ञात नहीं किया जायेगा ।
11. सीधी भर्ती में चयन तथा नियुक्ति की पद्धति
(1) इन नियमों के प्रवृत्त होने के पश्चात, प्राथमिक शिक्षक, माध्यमिक शिक्षक तथा उच्च माध्यमिक शिक्षक, खेलकूद शिक्षक श्रेणी- ब, गायन वादन शिक्षक श्रेणी- ब एवं प्रयोगशाला शिक्षक के सीधी भर्ती के पदों पर नियुक्ति, इन नियमों के उपबन्धों के अनुसार की जाएगी ।
(2) "शिक्षक पात्रता परीक्षा " जो इसमें इसके पश्चात् "पात्रता परीक्षा " के नाम से निर्दिष्ट है , शिक्षकों की नियुक्ति के लिए विहित किए गए अनुसार संचालित की जाएगी । यह पात्रता परीक्षा शासन द्वारा विहित अभिकरण द्वारा संचालित की जाएगी । पात्रता परीक्षा की वैधता परिणाम की घोषणा होने के पश्चात् दो वर्ष के लिए या अगली पात्रता परीक्षा आयोजित होने तक, इनमें से जो भी पूर्वतर हो, होगी ।
(3) शिक्षकों की नियुक्ति के लिए पात्रता परीक्षा आयोजित करने के लिये प्राधिकृत अभिकरण यथा विहित परीक्षा लेने के लिए आवेदन करने की प्रक्रिया तथा परीक्षा की स्कीम को समाचार पत्रों में विज्ञापित करेगा । 852(7)

(4) पात्रता परीक्षा में सम्मिलित होने के लिए शैक्षणिक अर्हता, अनुसूची- तीन में विनिर्दिष्ट किये गये अनुसार होगी ।
(5) शिक्षक पात्रता परीक्षा में अर्ह होने के लिए प्रवर्गवार न्यूनतम अंकों का प्रतिशत निम्नलिखित अनुसार होगा:-

(6) मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछडे वर्गों के लिये आरक्षण ) अधिनियम, 1994 (क्रमांक 21 सन् 1994) के उपबंध, इन पदों पर नियुक्ति के लिये लागू होगें ।
(7) (क) मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछडे वर्गो के लिये आरक्षण) अधिनियम, 1994 (क्रमांक 21 सन् 1994) के उपबंधों, सामान्य प्रशासन विभाग द्वारा उसकी अधिसूचना क्रमांक - एफ-6-1 / 2002 / आ० प्र० / एक , दिनांक 19 सितम्बर, 2002 द्वारा जारी किए गए अनुदेशों के अनुसार, मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जन जातियों और अन्य पिछडे वर्गों के लिए आरक्षण ) नियम, 1998 और राज्य शासन द्वारा, समय - समय पर जारी किए गए आदेश के अनुसरण में, अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य पिछडे वर्गों के अभ्यर्थियों के लिये पद आरक्षित किए जाएंगे ।
(ख) रिक्त पदों के प्रत्येक प्रवर्ग के लिये निम्नानुसार आरक्षण रहेगा :-
(एक) महिला अभ्यर्थियों के लिए 50 % पद आरक्षित रखे जाएंगे;
(दो) दिव्यांगजन अधिकार अधिनियम, 2016 और मध्यप्रदेश दिव्यांगजन अधिकार नियम, 2017 के अनुसार 6 प्रतिशत पदों का आरक्षण प्रत्येक श्रेणी के लिये 1.5 प्रतिशत की सीमा में निम्नानुसार रहेगाः-
(1) दृष्टिबाधित और कमदृष्टि।

(4) बहुविकलांगता उपरोक्तानुसार (1) , (2) एवं (3) को सम्मिलित करते हुये ।
(तीन) भूतपूर्व सैनिकों के लिये 10 % ;
(चार) शैक्षणिक संवर्ग अंतर्गत सीधी भर्ती के शिक्षकों के पदों के उपलब्ध रिक्तियों की 25 प्रतिशत रिक्तियां अतिथि शिक्षक वर्ग के लिये आरक्षित की जायेगी, जिनके द्वारा न्यूनतम तीन शैक्षणिक सत्रों में एवं न्यूनतम 200 दिवस शासकीय विद्यालयों में अतिथि शिक्षक के रूप में अध्यापन कार्य किया गया है :
परन्तु अतिथि शिक्षक के लिये आरक्षित पदों की पूर्ति नहीं हो पाने की स्थिति में रिक्त रहे पदों को अन्य पात्रताधारी अभ्यर्थियों से भरा जायेगा । (पांच) अन्य किसी ऐसे प्रवर्ग के लिये जो शासन द्वारा समय- समय पर अधिसूचित किया जाए.
(8) नियुक्ति के लिए विज्ञापन एवं प्रक्रिया राज्य शासन के कार्यपालिक आदेश द्वारा विनिर्दिष्ट की जाएगी ।
(9) चयन का मापदण्ड:-
नियुक्ति की प्रक्रिया तथा समस्त वर्गो के अभ्यर्थियों की योग्यता सूची तैयार की जाने की प्रक्रिया शासन के कार्यपालिका आदेश द्वारा विनिर्दिष्ट की जाएगी ।
(10) यदि अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछडे वर्गों के संबंध रखने वाले अभ्यर्थी उनके लिए आरक्षित समस्त रिक्तियों को भरने के लिए पर्याप्त संख्या में उपलब्ध न हो सकें, तो शेष रिक्तियां बिना राज्य शासन की पूर्व अनुमति से किसी अन्य प्रवर्ग से नहीं भरी जाएंगी और उन रिक्तियों को अगले चयन में अनुसूचित जातियों, अनुसूचित जनजातियों तथा अन्य पिछड़े वर्गों के लिए रिक्त रखा जाएगा ।
12. नियुक्ति की प्रक्रिया एवं चयन सूची तैयार करना :-
(1) इन नियमों के अधीन सीधी भर्ती के पदों के नियुक्ति एवं चयन सूची तैयार करने की प्रक्रिया शासन द्वारा विर्निदिष्ट की जाएगी ।
(2) इन नियमों में मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम, 1961 के उपबन्धों के अध्यधीन रहते हुये उपलब्ध रिक्त स्थानों पर नियुक्ति के लिये अभ्यर्थियों के बारे में उसी क्रम में विचार किया जाएगा, जिस क्रम में उनके नाम सूची में आये हों । 852(9)

(3) सूची में किसी अभ्यर्थी का नाम सम्मिलित किए जाने संबंधी तथ्य से ही उसे नियुक्ति के लिये तब तक कोई अधिकार प्रदान नहीं करता, जब तक कि नियुक्ति प्राधिकारी का ऐसी जांच के पश्चात् जैसी कि आवश्यक समझी जाए, यह समाधान न हो जाए , कि उम्मीदवार सेवा में नियुक्ति के लिये सभी प्रकार से उपयुक्त है ।
(4) चयन सूची जारी किये जाने की तारीख से एक वर्ष की कालावधि के लिए विधिमान्य रहेगी , किन्तु शासन की अनुमति से यह अवधि छह माह तक बढ़ाई जा सकेगी।
13. परिवीक्षा-
सीधी भर्ती के अधीन नियुक्त किये गये प्रत्येक व्यक्ति को दो वर्ष की कालावधि के लिये परिवीक्षा पर नियुक्त किया जाएगा। परिवीक्षा अवधि में संबंधित लोक सेवक को उस पद के लिये निर्धारित वेतनमान का न्यूनतम वेतन प्राप्त होगा। परिवीक्षा अवधि सफलतापूर्वक पूर्ण करने के उपरांत वेतन वृद्धि नियमानुसार प्रदाय की जाएगी । परिवीक्षा अवधि में असफल होने पर नियुक्तिकर्ता प्राधिकारी द्वारा सुनवाई का अवसर देने के पश्चात् परिवीक्षा अवधि 1 वर्ष के लिये बढ़ाई जा सकेगी । इसके उपरांत भी परिवीक्षा अवधि सफलतापूर्वक पूर्ण नहीं करने पर परिवीक्षा अवधि पर नियुक्त लोक सेवक की सेवायें समाप्त कर दी जायेगी ।
14. पदोन्नति द्वारा नियुक्ति-
(1 ) समिति उन सभी लोक सेवकों के मामलों पर विचार करेगी , जो पदोन्नत पद के लिए निर्धारित योग्यता धारित करते हों तथा जिन्होंने उस वर्ष की एक जनवरी को उन पदों पर, जिससे पदोन्नति की जानी है , कम से कम उतने वर्षों की अर्हकारी सेवा, जो अनुसूची चार के कॉलम (4 ) में विहित अनुसार पूर्ण कर ली हो तथा जो शासन द्वारा विर्निदिष्ट संनियमों एवं प्रक्रिया के अनुसार पात्र पाये गये हो ।
(2) अनुसूची- एक में अनुक्रमांक-1 के सामने उल्लिखित प्राचार्य हाईस्कूल की पदोन्नति के लिये विभागीय परीक्षा में न्यूनतम अर्हता प्राप्त करना अनिवार्य होगा, जैसा कि शासन द्वारा विर्निदिष्ट किया जाए । तत्पश्चात् इन लोक सेवकों की पदोन्नति वरिष्ठता सह- उपयुक्तता के आधार पर की जाएगी । (3) इन नियमों के प्रभावशील होने के उपरांत नियम-5 के उपनियम (4 ) के खण्ड (क) के अधीन सीधी भर्ती के अंतर्गत नवीन नियुक्त किये गये शिक्षकों में से वे ही शिक्षक पदोन्नति हेतु पात्र होगें जिन्होनें ग्रामीण क्षेत्र में न्यूनतम 3 वर्ष की सेवा पूर्ण कर ली हो । मध्यप्रदेश राजपत्र, दिनांक 30 जुलाई 2018

4) इस सेवा के सदस्यों के पदोन्नति हेतु प्रारंभिक चयन करने के लिये अनुसूची- चार के कॉलम (5) में यथावर्णित समिति गठित की जाएगी । समिति की बैठक एक वर्ष में कम से कम दो बार होगी ।
(5) ऐसे पदों पर, जिन पर अनुसूची- दो में यथाविर्निदिष्ट सेवा के सदस्यों की पदोन्नति के द्वारा नियुक्ति की जाना है , नियम-14 के उपनियम (1 ) एवं (2) के प्रावधानों के अतिरिक्त शेष प्रक्रिया सामान्य प्रशासन विभाग द्वारा समय- समय पर जारी नियम / अनुदेश के अनुसार होगी ।
:(6) पदोन्नति के लिए गोपनीय चरित्रावली को भी संज्ञान में लिया जाएगा एवं गोपनीय चरित्रावली में प्रतिकूल टिप्पणी होने पर पदोन्नति पर विचार नहीं किया जाएगा ।
(7) पदोन्नति/ क्रमोन्नति के प्रकरणों पर विचार करते समय सेवा अवधि की गणना शासन द्वारा जारी निर्देशों के अनुसार की जाएगी ।
15. पदोन्नति हेतु उपयुक्त अभ्यर्थियों की सूची तैयार करना:-
(1 ) विभागीय पदोन्नति समिति ऐसे योग्य व्यक्तियों की एक सूची तैयार करेगी जो उपर्युक्त नियम -14 में निर्धारित शर्तों को पूरा करते हों तथा जो समिति द्वारा सेवा में पदोन्नति के लिये सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी नियम / अनुदेश के अनुसार, सेवा में पदोन्नति के लिये उपयुक्त पाये गए हों । यह चयन सूची, तैयार किए जाने की तारीख से एक वर्ष के दौरान सेवानिवृत्ति/ पदोन्नति के कारण उदभूत् हुयी प्रत्याशित रिक्तियों को भरने के लिये पर्याप्त होगी । उक्त सूची के साथ दो लोक सेवकों अथवा रिक्तियों के 25 प्रतिशत , जो भी अधिक हो , से मिलकर बनने वाली एक आरक्षित सूची भी तैयार की जायेगी ।
(2) चयन सूची तैयार करने के मापदण्ड पदोन्नति के संबंध में सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी नियम / अनुदेश तथा समय समय पर शासन द्वारा जारी निर्देशों के अनुसार होंगे ।
(3) चयन सूची में सम्मिलित किये गये व्यक्तियों के नाम अनुसूची- चार के कालम (2) में विनिर्दिष्ट सेवा/ पदों में उनकी वरिष्ठता अथवा उस क्रम में रखे जायेंगे जैसा कि शासन द्वारा इस संबंध में विर्निदिष्ट किया जाएगा । स्पष्टीकरण:- ऐसे व्यक्ति, जिनका नाम चयन सूची में सम्मिलित किया गया हो, किन्तु जो सूची की विधिमान्यता के दौरान पदोन्नत न किया गया हो, केवल उसके पूर्वोत्तर चयन के तथ्य के आधार पर ही उसका उन लोगो 852(11)

के उपर जिन पर पश्चात्वर्ती चयन में विचार किया गया है वरिष्ठता का दावा नही रखेगा ।
(4) इस प्रकार तैयार की गई सूची का प्रतिवर्ष पुनर्विलोकन तथा पुनरीक्षण किया जाएगा ।
(5) यदि चयन पुनर्विलोकन या पुनरीक्षण की प्रक्रिया में राज्य/ अधीनस्थ सिविल सेवा में किसी सदस्य का अधिक्रमण प्रस्तावित किया जाये तो समिति प्रस्तावित अधिक्रमण के लिये उसके कारण अभिलिखित करेगी ।
16. पदोन्नति समिति में प्रतिनिधित्वः-
यदि पदोन्नति / चयन द्वारा भरे जाने वाले पदो के संबंध में पदोन्नति समिति की अध्यक्षता करने वाले सदस्य को छोडकर नाम निर्दिष्ट सदस्य, अनुसूचित जाति या अनुसूचित जनजाति के प्रवर्ग का प्रतिनिधित्व नहीं करते हैं, तब उसी प्रवर्ग के अनुसूचित जाति या अनुसूचित जनजाति प्रवर्ग का एक सदस्य जो उसी स्तर का या उसके उच्चतर स्तर का होगा , पदोन्नति समिति में सम्मिलित किया जाएगा और पदोन्नति समिति के सदस्यों की संख्या उस सीमा तक बढाई जाएगी ।
17. वरिष्ठता का निर्धारणः-
(1) प्राथमिक शिक्षक का जिला स्तरीय संवर्ग होगा । इस संवर्ग में नियम -5 के उपनियम (1 ), (2) एवं (3) के अधीन नियुक्त सदस्यों की वरिष्ठता का निर्धारण जिला स्तर पर अध्यापक संवर्ग में उनकी नियुक्ति आदेश दिनांक एवं चयन सूची के क्रम अनुसार, जिला स्तर पर संदर्भ सूची तैयार कर किया जाएगा । एक ही वरिष्ठता क्रम पर एक से अधिक व्यक्ति आते है तो, जिसकी आयु अधिक होगी उसे वरिष्ठ माना जायेगा एवं कम आयु वाले को उसके नीचे रखा जाएगा । नियुक्ति आदेश दिनांक, चयन सूची का क्रमांक एवं जन्मतिथि समान होने की स्थिति में अध्यापक के नाम के अंग्रेजी वर्णमाला क्रम के अनुसार वरिष्ठता का निर्धारण किया जाकर नियुक्तिकर्तावार संदर्भ सूची तैयार कर वरिष्ठता का निर्धारण किया जाएगा ।
(2) प्रत्येक संवर्ग की अंतरिम वरिष्ठता सूची का प्रकाशन उनके नियुक्ति प्राधिकारी द्वारा किया जाएगा । जारी अंतरिम वरिष्ठता सूची में 15 दिवस की समय सीमा में संबंधितों से दावे / आपत्तियां प्राप्त कर नियमानुसार वरिष्ठता सूची का अंतिम रूप से प्रकाशन किया जाएगा ।
(3) अध्यापक संवर्ग में एक निकाय से अन्य निकाय में संविलियन किए गए अध्यापकों की संबंधित नवीन निकाय में पदभार ग्रहण करने की दिनांक से वरिष्ठता का निर्धारण किया जाएगा । मध्यप्रदेश राजपत्र, दिनांक 30 जुलाई 2018

(4) प्रत्येक संवर्ग की वरिष्ठता सूची का प्रकाशन प्रथम बार इस नियम के प्रवर्त होने के तीन माह के भीतर और इसके बाद प्रतिवर्ष 01 अप्रैल की स्थिति में किया जाएगा ।
(5) माध्यमिक शिक्षक का संवर्ग संभाग स्तरीय होगा । इनकी वरिष्ठता का निर्धारण संभाग स्तर पर उपरोक्त उपनियम ( 1 ) के अनुसार किया जाएगा ।
(6) उच्च माध्यमिक शिक्षक का संवर्ग राज्य स्तरीय होगा । इनकी वरिष्ठता का निर्धारण संचालनालय स्तर पर उपरोक्त उपनियम (1 ) अनुसार किया जाएगा ।
(7) वरिष्ठता निर्धारण संबंधी उदभूत स्थिति का निराकरण हेतु शासन द्वारा गठित समिति द्वारा किया जायेगा ।
18. सेवा की अन्य शर्तेः-
(1) स्थानीय निकाय के अध्यापक संवर्ग के व्यक्तियों को शासन द्वारा विहित किये गये अनुसार इस सेवा में नियुक्ति के लिये परिशिष्ट- एक अनुसार विकल्प देना अनिवार्य होगा । विकल्प नहीं देने पर नियम -5 के उपनियम (1), (2) एवं (3) अनुसार नियुक्ति की पात्रता प्राप्त नहीं होगी ।
(2) इस सेवा में नियम-5 के उपनियम (1) , (2) एवं (3 ) के तहत नियुक्त किये गये अध्यापक संवर्ग के व्यक्ति इस नियम के प्रभावशील होने के पूर्व की अवधि के वेतनमान, भत्तों एवं योजना आदि को इस सेवा के संदर्भ में प्राप्त करने के हकदार नही होगें ।
(3) शासन द्वारा शालाओं में उपस्थिति दर्ज कराने तथा ड्रेस कोड के संबंध में जो भी अनुदेश समय - समय पर जारी किये जाएं, वे इन नियमों के अधीन नियुक्त और पदोन्नत किये गये व्यक्ति पर बाध्यकारी होंगे ।
(4) इन नियमों के अधीन नियुक्त किये गये व्यक्ति, निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम , 2009 (2009 का सं. 35) की धारा 24 में यथा विहित कर्तव्यों का पालन करेंगे, अर्थात्:-
(एक) विद्यालय में उपस्थित होने में नियमितता और समय पालन;
(दो) पाठ्यक्रम संचालित करना और उसे पूरा करना ;
(तीन) विर्निदिष्ट समय के भीतर संपूर्ण पाठ्यक्रम पूरा करना;
(चार) प्रत्येक बालक की शिक्षा ग्रहण करने के सामर्थ्य का निर्धारण करना और तद्नुसार यथा अपेक्षित अतिरिक्त शिक्षण, यदि कोई हो, जोड़ना;
(पांच) माता-पिता और संरक्षकों के साथ नियमित बैठकें करना और बालक के बारे में उपस्थिति में नियमितता, शिक्षा ग्रहण करने 852(13)

का सामर्थ्य , शिक्षण में की गई प्रगति और किसी अन्य सुसंगत जानकारी के बारे में उन्हें अवगत कराना; और
(छह) ऐसे अन्य कर्तव्यों का पालन करना, जो विहित किए जाए । (5) इन नियमों के अधीन नियुक्त किये गये व्यक्ति के कार्य निष्पादन का वार्षिक मूल्यांकन इस निमित्त शासन द्वारा अधिसूचित किए गए निर्देश अनुसार किया जाएगा ।
निर्वचनः-
19.
यदि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उद्भूत हो तो वह शासन को निर्दिष्ट किया जायेगा और उस पर उसका विनिश्चय अंतिम होगा ।
शिथिलीकरण-
20.
इन नियमों में किसी बात का यह अर्थ नहीं लगाया जायेगा कि वह ऐसे किसी व्यक्ति के मामले में , जिसको ये नियम लागू होते है, राज्यपाल की ऐसी रीति में, जो उसे न्यायसंगत तथा उचित प्रतीत होती हो, कार्यवाही करने की शक्ति को सीमित या कम करती है:
परंतु कोई मामला, ऐसी रीति में नही निपटाया जायेगा, जो कि इन नियमों में उपबंधित रीति की अपेक्षा उस व्यक्ति के लिये, कम अनुकूल हो ।
21. व्यावृत्ति- इन नियमों में कोई भी बात अनुसूचित जातियों, अनुसूचित जनजातियों एवं अन्य पिछडा वर्गों के लिये राज्य शासन द्वारा समय - समय पर इस संबंध में जारी किये गये आदेशों के अनुसार उपबन्ध किये जाने हेतु अपेक्षित आरक्षण, शिथीलीकरण तथा अन्य शर्तों को प्रभावित नहीं करेगी ।
22. निरसन तथा व्यावृत्तिः-इन नियमों के तत्स्थानी और इनके प्रारंभ होने के ठीक पहले लागू समस्त नियम, इसके द्वारा इन नियमों के अन्तर्गत आने वाले विषयों के संबंध में एतद्वारा निरसित किये जाते हैः
परन्तु इस प्रकार निरस्त नियमों के अधीन दिया गया कोई भी आदेश या की गई कोई भी कार्रवाई के संबंध में यह समझा जाएगा कि वह इन नियमों के तत्स्थानी उपबंधों के अधीन किया गया है या की गई है ।

50 प्रतिशत अंकों के साथ स्नातक तथा शिक्षा स्नातक (बी.एड.) जिसने राष्ट्रीय अध्यापक शिक्षा परिषद द्वारा मान्यता प्राप्त संस्थान से शिक्षा स्नातक की उपाधि प्राप्त की है , उस पर कक्षा 1 से 5 तक पढाने के लिये अध्यापक के रूप में नियुक्तिहेतु विचार किया जाएगा । किन्तु इस प्रकार अध्यापक के रूप में नियुक्त व्यक्तिको प्राथमिक शिक्षक के रूप में नियुक्त होने के दो वर्ष के भीतर राष्ट्रीय अध्यापक शिक्षा परिषद द्वारा मान्यता प्राप्त प्राथमिक शिक्षा में 6 महीने का एक सेतु पाठ्यक्रम (ब्रिज कोर्स) आवश्यक रूप से पूरा करना होगा ।

कम से कम 45 प्रतिशत अंकों के साथ हायर सेकेण्डरी अथवा इसके समकक्ष तथा राष्ट्रीय अध्यापक शिक्षा 852(19)

टीप :-
(1) ऐसे माध्यमिक शिक्षक एवं प्राथमिक शिक्षक जिसे शिक्षकों के राष्ट्रीय / राज्य योजना पुरस्कार के अर्न्तगत राष्ट्रपति/ राज्यपाल पुरस्कार प्राप्त हो जाने पर उसे वरिष्ठ वेतनमान/क्रमोन्नत वेतनमान अथवा तदस्थानीय उच्चतर वेतनमान प्राप्त होने के उपरांत एवं पदोन्नति के योग्य पाये जाने पर इन नियमों के अधीन पारी बाहर पदोन्नति देय होगी ।
(2) कॉलम-1 के अनुक्रमांक-1 पर अंकित प्राचार्य हाईस्कूल के पद पर पदोन्नति प्राप्त करने वाले लोक सेवक की पदस्थापना अनिवार्य रूप से तीन वर्ष के लिए ग्रामीण क्षेत्र में की जाएगी । इस अवधि में पदोन्नत लोक सेवक को शैक्षणिक प्रबंधन में पत्रोपाधि (डिप्लोमा) प्रमाण पत्र देने वाली किसी मान्यता प्राप्त संस्था से एक माह का प्रशिक्षण प्राप्त करना होगा । इसके अतिरिक्त सीमेट या भारतीय प्रबंधन संस्थान, इंदौर अथवा अन्य प्रतिष्ठित प्रबंधन संस्थाओं से एक माह का नेतृत्व प्रशिक्षण प्राप्त करना होगा । सीमेट द्वारा यह प्रशिक्षण किये जाने पर परियोजना क्रियान्वयन मॉड्यूल भारतीय प्रबंधन संस्थान, इंदौर अथवा अन्य किसी प्रतिष्ठित प्रबंधन संस्थान से बनवाया जाएगा । इस प्रशिक्षण को सफलतापूर्वक पूर्ण नहीं करने पर संबंधित पदोन्नत लोक सेवक को एक वर्ष का अतिरिक्त अवसर दिया जाएगा । इसके बावजूद भी प्रशिक्षण सफलतापूर्वक पूर्ण नहीं करने पर संबंधित लोक सेवक को उसके पदोन्नति के पूर्व पद पर प्रत्यावर्तित कर दिया जाएगा । मध्यप्रदेश राजपत्र, दिनांक 30 जुलाई 2018

No. F 1-59/2018 /20-1 :: In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India , the Governor of Madhya Pradesh hereby makes the following rules relating to the service conditions and recruitment to the Madhya Pradesh School Education Service (Teaching Cadre ), namely: -
1. Short title and commencement . -
(1 ) These rules may be called the " Madhya Pradesh School Education Service (Teaching Cadre) , Service Conditions and Recruitment Rules , 2018. "
(2) These rules shall come into force from 1st July , 2018.
2. Definitions.- In these rules , unless the context otherwise requires, -
(a) " Appointing Authority " in respect of the service means the authority as shown in Column No.6 of Schedule 1;
(b) " Adhyapak Samvarg " means the persons appointed by and under control of local bodies under the " Madhya Pradesh Panchyat Adhyapak Samvarg (Employment and Conditions of Service ) Rules , 2008 and "Madhya Pradesh Nagriya Nikaya Adhyapak Samvarg ( Employment and Conditions ofService ) Rules , 2008 ; "
(c) " Commissioner " means the Commissioner of Public Instructions , Madhya Pradesh;
(d) "Department " means the School Education Department , Government of Madhya Pradesh;
(e) "Departmental Examination " means the limited departmental examination so conducted under these rules for the purpose of promotion;
(f) "Departmental Promotion Committee " means the committee specified under these rules for promoting the members of the service;

(g) "Director" means the Director of Public Instructions , Madhya Pradesh ;
(h) ."Examination Agency " means an agency authorized by the State Government to conduct the eligibility examination or the departmental examination;
(i) "Government" means the Government of Madhya Pradesh ;
(j) "Governor" means the Governor of Madhya Pradesh ;
(k) "Guest Teacher" means a person engaged for the purpose of teaching in Government schools against vacant posts on a temporary basis on a honorarium;
(1 ) "Local Bodies " means District Panchayat under the Panchayat and Rural Development Department and Municipal Corporation , Municipality, Municipal Council under the Urban Administration and Development Department;
(m) " Other Backward Classes " means the Other Backward Classes of Citizens as specified by the State Government vide notification No.F- 8-5 - XXV-4-84 dated the 26th December , 1984 as amended from time to time;
(n) "Schedule " means a Schedule appended to these rules ;
(o) "Scheduled Castes " means the castes , races or tribes or part of or group within castes , races or tribes which shall for the purposes of this deemed to be Scheduled Castes as are assigned to them by Article 341 of the Constitution and are notified as such by the Government in relation to the Madhya Pradesh;
(p) "Scheduled Tribes " means the tribes , races or tribal communities or part of the group within tribes or tribal communities , which shall for the purposes ofthis deemed to be Scheduled Tribes as are assigned to them by Article 342 of the Constitution and are notified as such by the Government in relation to the Madhya Pradesh;
(q) "Selection Committee " means the selection committee specified under these rules;

(r) "State" means the State of Madhya Pradesh;
(s) "Teacher Eligibility Test" means the eligibility examination to be conducted for the posts of direct recruitment of the teaching cadre ;
3. Scope and application.- Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Service ( General Condition of Service) Rules, 1961 , these rules shall apply to every member of the service.
4. Constitution of Service . The Service shall consist of the following persons , namely:-
(1) Persons appointed under the " Madhya Pradesh Panchayat Adhyapak Samvarg ( Employment and Conditions of Service) Rules , 2008 " and "Madhya Pradesh Nagriya Nikaya Adhyapak Samvarg ( Employment and Conditions of Service ) Rules , 2008 " , and serving in educational institutions ofSchool Education Department in 224 Community Development Blocks who are appointed under the provisions of Sub Rule - 1of Rule 5 .
(2) Such persons who shall be appointed through direct recruitment or shall be promoted as per the provisions of these rules.
5. Method of recruitment.-
(1) After the commencement of these rules , the persons who have been appointed under " Madhya Pradesh Panchyat Adhyapak Samvarg (Employment and Conditions of Service) Rules , 2008 and Madhya Pradesh Nagriya Nikaya . Adhyapak Samvarg ( Employment and Conditions of Service) Rules , 2008 ; " and are presently working in the educational institutions of School Education Department in 224 Community Development Blocks and possess other specified qualifications shall be appointed into the Department at the time of the initial constitution of the service. The appointment orders of such persons shall be issued by the Appointing Authority mentioned in column (6 ) of Schedule-l after following theprocedure as specified by the Government:

Provided that no person other than those referred to in clause ( b ) of rule 2 shall be appointed under these rules.
(2) The Sahayak Adhyapak , Adhyapak and Varistha Adhyapak appointed under the provision of the " Madhya Pradesh Panchayat Adhyapak Samvarg ( Employment and Conditions of Service) Rules , 2008 " and the "Madhya Pradesh Nagariya Nikaya Adhyapak Samvarg ( Employment and Conditions of Service ) Rules , 2008 " shall be appointed on the post of Prathmik Shikshak , Madhyamik Shikshak and Ucch Madhyamik Shikshak respectively.
(3) Sahayak Adhyapak (Prayogshala ) , Sahayak Adhyapak ( PTI ) , and Sahayak Adhyapak ( Vocal /Instrumental ) shall be appointed on the post of Prayogshala Shikshak , Khelkood Shikshak Category A, and GayanVadan Shikshak Category A respectively.
(4) After making the recruitment under sub - rule (1 ) , (2 ) and ( 3 ) the subsequent recruitment to the service shall be made by following methods , namely: - (a) by selection through Eligibility Examination under direct recruitment .
(b) by promotion
6. Classification , Pay- Bandetc.- The classification of the service and the pay- band attached thereto and the number of posts included in the service shall be in accordance with the provisions contained in Schedule I :
Provided that the Government may, from timeto time, add or reduce the number of posts included in the service either on a permanent or a temporary basis.
7. Appointment to posts. After the commencement of these rules , vacancies in any of the cadres shall be filled by the Appointing Authority and no appointment 852(29)

shall be made through methods of recruitment other than those mentioned in rule- 5.
8. Conditions of eligibility for direct recruitment.- In order to be eligible for participating in the Teacher Eligibility Examination , a candidate must fulfill the following conditions , namely : -
(1) Age -
(a) The candidate must have attained the age as specified in column (3). ofSchedule III , but must not have attained the age as specified in column (4) of the said Schedule, on the first day of January that comes after the date of commencement of the selection process .
(b) If the applicant is domicile of Madhya Pradesh and belongs to the category of Scheduled Castes , Scheduled Tribes , Other Backward Classes , Persons with disabilities and Women he shall be entitled for relaxation in upper age limit as per the prevailing provisions of the Government of Madhya Pradesh .
(c) Those applicants who are or who have been employees of Madhya. Pradesh Government , Corporation , Board shall be entitled for relaxation in upper age limit as per the prevailing provisions of the Government of Madhya Pradesh .
(d) A candidate who is an ex - serviceman shall be allowed to deduct from his age the period of entire defense service previously rendered by him:
Provided that the resultant age does not exceed the upper age limit by more than five years .
Explanation.- The term " ex - serviceman " denotes a person who belongs to any of the following categories and who was employed 852(30)

under the Government of India for a continuous period of not less than six months and who was retrenched or declared surplus as a result of the recommendation of the economy unit or due to normal reduction in establishment not more than three years before the date of his registration at any employment exchange or on application made otherwise for employment in Government service , namely:-
(1) Ex-serviceman released under mustering out concessions .
(2) Ex-serviceman enrolled for the second time and discharged on,-
(a) completion of short term engagement;
fulfilling the conditions of enrolment; (b)
Ex-personnel of Madras Civil Unit.
(3)
(4) Officers (Military and Civil ) , discharged on completion of their contract, (including Short Service Regular Commissioned Officers).
(5) Officers discharged after working for more than six months continuously against leave vacancies .
Ex-service man invalidated out of service .
(6)
( 7) Ex-servicemen discharged on the ground that they are unlikely to become efficient soldiers .
( 8) Ex- servicemen who are medically boarded out on account of gunshot, wounds etc.
( e) The upper age limit shall be subject to relaxation as per norms of the General Administration. Department in respect of an awarded upper caste partner of a couple under the Inter Caste Marriage Incentive Programme of theScheduled Castes Welfare Department .
(f) Theupper age limit shall be relax able in case of a " Vikram Awardee " as per the norms of the General Administration Department .

(g) The candidates who have worked as Guest Teacher in Government schools for minimum two hundred days and minimum three educational sessions shall be entitled up to nine years relaxation in maximum age limit.
(h) In addition to the above , the provisions issued by the General Administration Department , from time to time , in regard to age shall be applicable.
(2) Educational qualifications : Educational qualifications shall be as per column 5 of Schedule III .
Provided that, -
(a) Barring the provisions for educational qualifications under The Right Of Children to Free and Compulsory Education Act , 2009, the Government, in exceptional cases may treat a candidate as qualified who , though not possessing the qualifications prescribed in these rules , has passed examinations conducted by other institutions by a standard which, in the opinion of Government , justifies the consideration of the candidate for selection.
(b) The Government on its own discretion , may consider the cases of those candidates who are otherwise qualified but have received degree from a foreign University which is not designated as a University recognized by the Government.
(3) Teacher Eligibility Examination.- For direct recruitment on the post of teachers , it shall be mandatory to pass the Teachers Eligibility Examination with the percentage as prescribed in sub - rule (5) of Rule-11 .
(4) Fees The candidate shall pay the fees as prescribed by the Government.

Disqualifications -
9.
(
1) Any attempt on the part of a candidate to obtain support for his. candidature by any means may be held as disqualification for appearing in the examination /selection by the Government .
(2) Any candidate who has married before the minimum age fixed for marriage shall not be eligible for appointment to a post.
(3) Any candidate who has been convicted for an offence involving moral turpitude shall not be eligible for appointment to any post:
Provided that where cases as mentioned above are pending against a candidate, appointment shall be kept in abeyance till the final decision of the case.
(4) The provisions of Madhya Pradesh Civil Services (General Conditions of Service ) Rules , 1961 and all other disqualifications notified by the Government, from time to time shall be applicable to a candidate .

5) No candidate shall be eligible for the appointment to any service or post who has more than two living children , one of whom is born on or after the 26th day of January, 2001 :
Provided that no candidate shall be disqualified or ineligible for appointment to a service or post who has already one living child and in the next delivery which takes place on or after 26th day of January, 2001 two or more than two children are born .
Government's decision as to the eligibility of a candidate shall be final : - 10.
Thedecision of the Government as to the eligibility or otherwise of a candidate for selection /examination shall be final and a candidate to whom a certificate of admission has not been issued by the Government shall not be permitted to appear in the examination .

11. Procedure of Selection and Appointment through Direct Recruitment.- (1) After the commencement of these rules , appointment to the post of direct recruitment of Prathmik Shikshak, Madhyamik Shikshak , Ucch Madhyamik Shikshak, Khelkood Shikshak category B , Gayan /Vadan category B and Prayogshala Shikshak shall be made in accordance with these rules .
(2) " Teacher Eligibility Examination ", hereinafter referred to as "eligibility. examination " shall be conducted for the recruitment of teachers in the prescribed manner . The eligibility examination shall be conducted by the agency designated by the Government . The validity of the eligibility examination shall be for a period of two years after the declaration of result or the conduct of the next eligibility examination , whichever is earlier.
(3) The agency authorized to hold eligibility examination for appointment of teachers shall advertise the procedure for application and the scheme of examination in the news papers.
(4) The educational qualifications for appearing in the eligibility examination shall be as specified in Schedule -III .
(5) The category wise minimum percentage of marks to qualify in the Teacher Eligibility Examination shall be as under, namely: -

(6) The provisions contained in the Madhya Pradesh Lok Seva (Anusuchit Jatiyon , Anusuchit Janjatiyon Evam Anya Pichhade Vergon Ke Liye Arakshan) Adhiniyam , 1994 ( No.21 of 1994) shall be applicable for the recruitment to these posts .
(7) (a) Posts shall be reserved for candidates belonging to Scheduled Castes , Scheduled Tribes and Other Backward Classes in accordance with the provisions of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon , Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan ) Adhiniyam , 1994 (No.21 of 1994 ) , instructions issued by the General Administration Department vide its Notification No.F -6-1-2002 / Reservation Cell/1 / dated 19-9-2002, The Madhya Pradesh Lok Seva (Anusuchit Jatiyon , Anusuchit Janjatiyon Aur Anya Pichhade Vargon ke Liye Arakshan ) Rules , 1998 and orders issued by the State Government , from time to time in this behalf.
(b) For each category of vacant posts , the reservation shall be as under - (i ) 50 percent posts shall be kept reserved for women candidates.
(ii ).As per the provisions of the Right of Persons with Disabilities Act, 2016 (49 of 2016) and Madhya Pradesh Right of Persons with Disabilities Rules , 2017 six percent posts shall be reserved for disabled persons , subject to the ceiling of 1.5% for each. category, namely: -
(a)Blindness and low vision .
(b) Deaf and hard of hearing.

(iii) 10% for ex- army personnel ;
(iv) 25 percent vacancies of the total available vacancies shall be reserved for Athithi Shikshak category who have worked in Government School for minimum three educational sessions and not less than two hundred days:
Provided that if the vacancies reserved for Atithi Shikshak remain vacant they shall be filled from other eligible candidates.
(v) Any other category which may be notified by the Government from time to time .
(8) The advertisement and procedure for appointment shall be specified by an executive order of the State Government .
(9) Criteria for selection - The procedure for appointment and preparation of merit list ofcandidates of all categories shall be prescribed by an executive order of the Government.
(10) If candidates belongingto Scheduled Castes , Scheduled Tribes and Other Backward Classes are not available in sufficient number to fill all the vacancies reserved for them , the remaining vacancies shall not be filled up from any other category without prior permission of the State Government and those vacancies shall be carried forward to the next selection for the Scheduled Castes , Scheduled Tribes and Other Backward Classes .
12. Process of Recruitment and preparation of Selection List : -

(2) Subject to the provisions of Madhya Pradesh Civil Services (General Terms ofService) Rules , 1961 , the candidates , under these rules , shall be considered in the same order for appointment on available vacancies , as they appear in the list.
(3)The fact that the name of the candidate is included in the selection list does not give him or her any right to appointment, unless the Appointing Authority, after such enquiry as deemed fit, is satisfied that the candidate is fit for appointment in all respects .
(4) The selection list shall be valid for a period of one year from the date of publication , but with the approval of the Government , this period may be increased for six months .
13. Probation-
Persons selected through direct recruitment shall be appointed on probation for a period of two years . The concerned public servant shall receive the minimum pay of the pay-scale for that post during the probation period. On successful completion of probation period the annual increment shall be given as per rules . If probation period is not completed successfully , the same may be extended up to one year by the Appointing Authority after giving an opportunity of hearing to the concerned member of service . The services of the public servant appointed on probation shall be terminated if the probation period is not completed successfully even after the extended period .
14. Appointment by Promotion.-
(1)The committee shall consider the cases of all those public servants , who hold the prescribed qualification for the promotional post and who have completed the qualifying period on 1st January of the year as mentioned in column (4) of Schedule- IV and who have been otherwise found fit as per the norms and procedure notified by the Government .

(2) For promotion to the post of Principal , High School mentioned in serial no . 1 ofSchedule - l , it shall be compulsory to pass the departmental examination with the minimum qualifying marks as specified by the Government. Thereafter promotion of these public servants shall be done on the basis of seniority cum merit.
(3)After the commencement of these rules , only those teachers appointed through direct recruitment as per clause (a ) of sub-rule (4) of Rule 5, shall be eligible for promotion who have completed a minimum service of three years in rural areas .
(4)A committee with members as decided in column 5 of Schedule- IV shallbe constituted for the preliminary selection for promotion of the members of this service. The committee shall meet at least twice in a year.
(5) For posts as specified in Schedule - II , on which appointments are to be made by the promotion of the members of service , in addition to the provisions made in sub - rule ( 1 ) and (2) of rule 14 , the rest of the procedure shall be as per the rules /circulars issued by the General Administration Department from time to time.
(6)At the time of promotion Annual Confidential Report shall be taken into consideration and in case of adverse entries promotion shall not be considered.
(7) For the purpose of promotion/Krammonnti , the service period shall be calculated as per the instructions issued by the Government , from time to time.
15. Preparation of list of suitable candidates for promotion.-
(1) The Departmental Promotion Committee shall prepare a list of such eligible members of service who fulfill the conditions prescribed in rule 14 supra and are मध्यप्रदेश राजपत्र , दिनांक 30 जुलाई 2018

found suitable for promotion to the service according to the rules/ instructions of the General Administration Department issued from time to time . This list shall cover the anticipated vacancies on account of retirement/ promotion during the course of one year from the date of preparation of the select list . A reserve list consisting of two public servants or 25 percent of the number of vacancies, whichever is more , shall also be prepared.
(2) The criteria for preparation of select list shall be as per rules /instructions of General Administration Department and the Government , issued from time to time.
(3) The names of members of services included in the select list shall be arranged in the order of seniority in the service or posts as specified in column (2) ofSchedule IV or as specified by the Government in this regard.
Explanation.- A person whose name is included in the select list but who is not promoted during the validity of the list shall have no claim to seniority over those considered in a subsequent selection merely on the basis of the fact of his earlier selection.
(4)Alist so prepared shall be reviewed and revised every year .
(5) If in the process of selection , review or revision , the supersession of any member of the teaching cadre is proposed, the Committee shall record its reasons for such proposed supersession.
16. Representation in Selection Committee.- If the nominated members other than the member presiding the Promotion Committee in respect of the posts to be filled up by promotion do not represent the category of Scheduled Castes or Scheduled Tribes , then one member belonging to Scheduled Castes or Scheduled Tribes category of the same or higher status shall be included in the Promotion Committee and the number of members of the Promotion Committee shall be increased to that limit.

17. Determination of Seniority.-
(1 ) The cadre of Prathmik Shikshak shall be at District level . The fixation of seniority of the members appointed in this cadre under sub - rule ( 1 ) , (2) and (3 ) of rule- 5 shall be done at the district level on the basis of a reference list prepared according to their date of appointment and seniority in selection list. If there are more than one person at the same seniority level then whosoever is older in age shall be considered senior and the persons junior in age shall be kept below him. In case the date of recruitment , serial number in the selection list and date of birth are the same , the seniority shall be determined , after preparing a reference list , in accordance with the order of their names written in the English alphabet for each appointing authority.
(2) The provisional seniority list of each cadre shall be published by their respective Appointing Authority . Claims and objections shall be invited within a period of fifteen days and then the seniority list shall be published in its final form as per rules.
(3) The seniority of teachers of a local body who have been absorbed in another local body shall be fixed from the date of their joining in the concerned new local body.
(4) The seniority list of each cadre shall be published for the first time within a period of three months after the commencement of these rules and thereafter on 1st April every year .
(5) The cadre of Madhyamik Shikshak shall be at Divisional Level . Their seniority shall be fixed at divisional level according to sub- rule ( 1 ) of rule 17.
(6) The cadre of Ucch. Madhyamik Shikshak shall be at State level . and their seniority shall be fixed at Directorate level according to sub - rule ( 1 ) of these rules.

(7) A committee constituted by the Government shall resolve the issues relating to the fixation of seniority.
18. Other Conditions of Services:
(1) ; It shall be mandatory for members of the Adhyapak Cadre of the local bodies to give option as per Appendix- 1 for the appointment into this service . In case of non submission of option , they shall not beconsidered eligible for appointment under sub-rule ( 1 ) , (2) and (3) ofrule-5 .
(2) Themembers of the Adhyapak Cadre appointed into this service as persub - rule ( 1 ) , (2) and (3 ) of Rule 5 shall not be entitled to get pay scales , allowances and schemes with respect to this service before the commencement of these rules .
(3) All the instructions that are issued from time to time in respect of registering attendance in the schools and of dress code , shall be binding upon the members of service , appointed or promoted under these rules .
(4) The person appointed under these rules shall comply with the duties prescribed in section 24 of the Right of Children to Free and Compulsory Education Act, 2009 (No.235 of 2009 ), namely: - (a) maintain regularity and punctuality in attending school ;
(b) conduct and complete the curriculum;
(c) complete entire curriculum within the specified time ;
(d) assess the learning ability of each child and accordingly supplement additional instructions , if any, as required ;
(e) hold regular meetings with parents and guardians and apprise them about the regularity in attendance , ability to 852(41)

learn , progress made in learning and any other relevant information about the child ; and
(f) perform such other duties as may be prescribed.
(5) The annual appraisal of the work performance of a person who is appointed under these rules shall be done as per instructions notified by the State Government in this regard.
19. Interpretation .-If any question arises as to the interpretation of these rules , it shall be referred to the Government and its decision thereon shall be final .
20. Relaxation.- Nothing in these rules shall be construed to limit or abridge the power of the Governor to deal with the case of any person , to whom these rules shall apply in such a manner as may appear to him to be just and equitable:
Provided that no case shall be dealt in any manner less favorable to the person thanthat provided in these rules .
21. Saving . Nothing in these rules shall affect reservation , relaxation and other conditions required to be provided for the Scheduled Castes , Scheduled Tribes and OtherBackward Classes in accordance with the rules and orders issued by the State Government, from time to time in this regard.
22- Repeal and Saving - All rules corresponding to these rules and in force immediately before the commencement of these rules , on subjects covered by these rules, are hereby repealed:
Provided that the orders made or the action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules .

Note:
( 1 ) . The Madhyamik Shikshak and Primary Shikshak who has received the President's/Governor's Award under the Scheme of National Award/State Award to teachers shall be given out of turn promotion:
Provided that he has obtained the Senior Pay Scale /Time Pay Scale or any other corresponding Higher Pay Scale and is otherwise eligible for promotion.
(2) The Public servant promoted to the post of Principal , High School mentioned in Serial Number 1 of Column ( 1 ) shall compulsorily be posted in rural area for three years . The promoted public servant shall have to undergo training for a month by an institution recognized for awarding diploma certificate in educational management . In addition , leadership training of one month from SIEMAT or Indian Institute of Management , Indore will be required to be undergone . In case of leadership training by SIEMAT, the project implementation module shall be required to be prepared by Indian Institute of Management, Indore or by any other reputed Institute of Management . An additional time of one year shall be given to those promoted public servant who are not able to complete the training successfully . The public servant not completing training successfully despite this opportunity shall be reverted back to the previous post.
