क्र. एफ- 16-6-2018- बाईस-पी- 2.- मध्यप्रदेश पंचायत ( स्थावर सम्पत्ति का अंतरण ) नियम , 1994 में संशोधन का निम्नलिखित प्रारूप जिसे राज्य सरकार , मध्यप्रदेश पंचायत एवं ग्राम स्वराज अधिनियम , 1993 ( क्रमांक 1 सन् 1994 ) की धारा 95 की उपधारा (1 ) के साथ पठित धारा 65 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 95 की उपधारा ( 3 ) द्वारा यथा अपेक्षित किये गये अनुसार उन समस्त व्यक्तियों की , जिनके कि उससे प्रभावित होने की संभावना है , जानकारी के लिये एतद्वारा , प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है, कि इस सूचना के " मध्यप्रदेश राजपत्र" में प्रकाशन की तारीख से 30 दिन का अवसान होने पर उक्त प्रारूप पर विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव पर , जो उक्त प्रारूप के संबंध में किसी व्यक्ति से , ऊपर विनिर्दिष्ट कालावधि के अवसान होने के पूर्व प्रमुख सचिव , मध्यप्रदेश शासन, पंचायत एवं ग्रामीण विकास विभाग , मंत्रालय, वल्लभ भवन, भोपाल को प्राप्त हो , राज्य सरकार द्वारा विचार किया जाएगा.
प्रारूप संशोधन
उक्त नियमों में, -
1. नियम 5 में, उप - नियम ( 2 ) के पश्चात्, निम्नलिखित परन्तुक जोड़ा जाए, अर्थात्: -
" परन्तु यह कि इस उपनियम के उपबंध ऐसे व्यक्तियों पर जो उस विशिष्ट स्थान पर दैनिक शुल्क या पट्टे पर अनुज्ञप्ति के साथ या अन्यथा तीन वर्ष से अधिक समय से व्यवसाय कर रहे हों, लागू नहीं होंगे एवं ऐसे व्यक्तियों को पुनर्वासन योजना के अतंर्गत दुकान आवंटन, नीलामी किए बिना किया जा सकेगा, किन्तु ऐसी दुकानों का प्रीमियम नियत मूल्य से कम नही होगा तथा भू- भाटक ( किराया ) नियत प्रीमियम का दो प्रतिशत से अनधिक होगा. " .

No. F - 16-6-2018 -XXII - P - 2.- The following draft of amendment in the Madhya Pradesh Panchayat (Transfer of Immovable Property) Rules , 1994, which the State Government proposes to make in exercise of the powers conferred by sub - section ( 1 ) of Section 95 read with sub - section (2) of Section 65 of the Madhya Pradesh Panchayat Raj Avam Gram Swaraj Adhiniyam , 1993 ( No. 1 of 1994), is hereby published as required by sub - section (3 ) of Section 95 of the said Act for information of all persons likely to be affected thereby and notice is , hereby, given that the said draft shall be taken into consideration on the expiry of thirty days from the date of publication of this Notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received at the Principal Secretary , Panchayat and Rural Development Department , Vallabh Bhawan , Bhopal from any person with respected to the said draft before the expiry of the period specified above shall be considered by the State Government .
DRAFT OF AMENDMENT
In the said rules ,-
1. In rule 5 , after sub - rule (2), the following proviso shall be added , namely : -
"Provided that the provisions of this sub- rule shall not be applicable to such persons who has occupied the specific place on daily fees or on lease with licence or who is doing profession for more than three years and such persons shall be allotted shops under rehabilitation scheme without auciton but premimum shall not be less than the value of fixed price and the rent of the land shall not exceed two percent of the premimum fixed. " .
